420 with CNW — U.S. Border Patrol Agents Cautioned Against Using CBD Products

The U.S. Customs and Border Protection agency is warning its workers and their family members to say no to CBD. CBD (cannabidiol) is one of the two primary compounds found in marijuana. However, unlike THC, which induces a high when ingested, CBD does not.

In a recently published advisory, the agency highlighted some issues associated with this compound, highlighting that CBD products were still unregulated and could contain THC that can be detectable using a drug test.

It should be noted that the agency isn’t forbidding its workers from using CBD products derived from hemp, because the substance was legalized federally following the 2018 Farm Bill’s approval. However, the agency does strongly urge its agents to abstain from their use as a form of precaution.

In its advisory, the agency stated that its drug-free workplace plan mandated drug testing, which applied to all federal civilian employees. A positive drug test may result in disciplinary action and in extreme cases, removal from service. The advisory also observed that while some states had legalized the use of cannabis, THC and marijuana were still prohibited substances federally.

Currently, marijuana is classified as a Schedule I substances under the Controlled Substances Act. This is despite the fact that the recreational use of marijuana is legal in 22 states and Washington, D.C., while the medical use of the drug is legal in 38 states and the nation’s capital.

The federal agency elaborated on the warning, giving examples of research showing CBD products were sometimes mislabeled.

Given that the FDA is yet to establish regulations for these products, it is expected that the issue will persist. Earlier this year, the FDA announced that congressional action was needed to allow CBD be marketed as a dietary supplement or in food.

The recent advisory  by Customs and Border Protection comes after the human resources division at the U.S. Forest Service posted a notice in 2022 that also warned its employees about the risks of consuming CBD products that were federally unregulated.

Meanwhile, other federal agencies are reviewing their drug testing and employment policies, both for applicants and workers, amid the state-level legalization movement. Recently, the Secret Service relaxed restrictions on previous use of cannabis by prospective agents. The Bureau of Alcohol, Tobacco, Firearms and Explosives also recently updated its employment policy to not automatically disqualify applicants who had cultivated, manufactured or sold cannabis in compliance with state laws.

The warning by the border patrol agency clearly indicates that personnel should refrain from using cannabis-derived substances that aren’t federally regulated. This means that the products which companies such as IGC Pharma Inc. Almost a year after the decriminalization of marijuana amid hopes of a boom in the economy, Thai cannabis cultivators and sellers allege that illegal imports from the United States that sell for a much lower price than the country’s buds are affecting their businesses. Thailand delisted marijuana from its list of prohibited substances in June of last year. This came about as a result of a significant effort by Anutin Charnvirakul, the health minister, to position the nation as a global powerhouse for medical marijuana.

However, the long-awaited marijuana bill has not yet been approved by Thailand’s parliament, which has left the industry’s regulatory structure in a state of uncertainty. Local companies claim that foreign capital is filling the funding void, with many shops around the nation promoting cheap cannabis that has been illegally imported from the United States.

Local marijuana operators argue that foreign brokers are approaching neighborhood dispensaries to market inexpensive, untaxed marijuana that is brought in at a discount and then sold for almost six times the original price.

Recreational marijuana use is still technically not allowed under Thailand’s law. But marijuana booths and shops can be spotted on most streets in major cities and towns due to the spotty regulation. Thai sellers and farmers are concerned that local companies are losing out on the increasing demand as visitors pour into Thailand to enjoy the country’s liberal attitude toward recreational marijuana use.

The Bhumjaithai political party, known for supporting decriminalization, attributes the influx of illegal imports to corrupt officials and political rivalry, which is creating unfavorable press coverage of marijuana reform in advance of upcoming general elections.

Supachai Jaisamutr, a proponent of marijuana legalization for the party, stated that despite the existence of legislation to deal with illegal imports, the officers from the agriculture and customs ministries who are in charge of implementing it do not do so. Supachai mentioned that according to estimates from the nation’s commerce chamber, the marijuana industry contributed roughly $1.2 billion to the economy in 2017. However, the financial advantages are difficult to see for many local stakeholders who are up against foreign capital.

One seasoned marijuana dealer who transitioned into a legal businessman claimed he spent a lot of money making his own fertilizer and soil only to discover that his marijuana was too pricey for a market flooded with low-cost imports.

Recent federal data reveals that rates of marijuana usage among high school students have decreased even as more states legalize the drug. The Youth Risk Behavior Survey (YRBS) from the Centers for Disease Control and Prevention (CDC), which was released last week, indicated that teen usage of all substances tracked, including alcohol, prescription drugs and marijuana, has fallen linearly over the past 10 years.

The federal analysis reveals that marijuana use among high school kids was high between 2009 and 2013 — before legal cannabis outlets began to open — but it has since been generally declining. Voters passed the first state laws allowing for recreational use in 2012, and regulated retail sales started in 2014.

According to the most recent statistics from the biennial survey, 15.8% of high school students reported consuming marijuana at least once in the previous 30 days in 2021. This is a considerable decrease from 23.4% in 2013.

Health officials are encouraged by the trend, although they have noted that social isolation policies brought on by the coronavirus epidemic probably played a factor in how much juvenile substance abuse fell in the most recent two-year measurement period. Nevertheless, the general trend runs counter to one of the most popular prohibitionist justifications for opposing cannabis legalization. Despite their assertions, research and surveys, including federally funded ones, have repeatedly demonstrated that legalizing marijuana for adults will not increase teen use.

In fact, the YRBS survey found that marijuana use in high schools peaked in the years before any recreational cannabis dispensary was opened. And since then, as more and more marketplaces have opened up online, fewer young people now report consuming cannabis. Additionally, fewer teenagers claim to have ever used marijuana. In 2021, 27.8% of teenagers reported having used marijuana at least once in their lives, a decrease of more than 10% from the figure in 2019, which was 36.8%.

While COVID likely also played a role in the sudden fall in cannabis use observed in 2021, cannabis patterns have remained constant throughout the reform. For instance, research financed by NIDA and released in the “American Preventive Medicine Journal” last year revealed no correlation between the legalization of cannabis at the state level and a rise in juvenile use. According to the study, teenagers who used cannabis more frequently during adolescence had no increased or decreased likelihood of doing so at the age of 15 compared to those who used it less frequently or never.

(NYSE American: IGC) register success in developing FDA-approved medicines from marijuana, it is possible that people will look at marijuana as a medicine, and juvenile use could decrease even further as access to these medicines is regulated through the healthcare system while recreational use is subject to age-verification in the states which permit adult-use marijuana.

420 with CNW — New Bipartisan Bill to Seal Federal Cannabis Records Automatically

Bipartisan congressional legislators have reintroduced a measure mandating the automatic sealing of records for nonviolent federal cannabis convictions. The bill would also offer relief to individuals who’d been arrested for other offenses that didn’t end in conviction.

Representatives Nancy Mace and Lisa Blunt Rochester filed the Clean Slate Act last week. The previous version of the bill was advanced through the House Judiciary Committee in 2022 but was never voted on.

In a press release, Blunt Rochester stated that the Clean Slate Act was one of her top priorities, highlighting the importance of giving those who had paid their debt to society and served their time a second chance and a clean slate. Blunt Rochester added that she looked forward to working with her colleagues across the aisle and Congress to approve the bill and advance it to the president’s desk.

The measure would also set up a new process for individuals to petition the courts to seal records for nonviolent offenses that weren’t eligible for automatic sealing. If their initial request was denied, individuals could still petition for relief once a two-year wait period was over. Additionally, district courts will be allowed to nominate a public defender to help petitioners process their record sealing requests.

Mace stated that this measure was an important step in the right direction because it focused on rehabilitation and second chances.

Last year, President Joseph Biden issued a mass pardon for individuals who had committed federal marijuana possession offenses. However, this proclamation is limited, as presidential pardons don’t help seal conviction records.

The Mace measure is supported by various institutions, including R Street, the American Conservative Union, LinkedIn, Brennan Center for Justice, Justice Action Network (JAN), Center for American Progress, JPMorgan Chase, Code for America and Clean Slate Initiative.

Nan Gibson, the executive director of the JPMorgan Chase Policy Center, stated that the bill would establish a process for clearing nonviolent federal records and streamline it via automation, helping individuals pursue stable career opportunities. Gibson then noted that this bill would allow companies such as JPMorgan Chase to continue connecting people to meaningful career pathways, strengthening the economy and uplifting communities.

The Clean Slate Initiative CEO Sheena Meade stated that Congress had the power to unlock opportunities for millions of individuals in the country by approving the Clean Slate Act.

This bill is the latest in a string of cannabis reform measures that have been introduced in Congress.

While many reforms have been put before Congress over the past years, not many have made their way through the legislative chambers and reached the president’s desk for enactment. Washington State’s governor has signed legislation allowing interstate marijuana trade in anticipation of a change in federal law. Governor Jay Inslee recently signed the bill introduced by Senator Ann Rivers into law after it passed the legislature last month.

Once a federal law is changed or a federal Justice Department decision authorizing cannabis trading across state lines is passed, the legislation will permit the state to engage in interstate cannabis trade.

Now that this bill has been approved, all three states on the western coastline are ready to allow cannabis export and import. Oregon passed its bill in 2019 while California followed suit last year.

The Washington legislation stipulates that if one of the two federal conditions is satisfied, state authorities must provide written notice of the policy change and any state-level statutory amendments necessary to allow the delivery, sale and reception of marijuana from businesses out of the state. However, under California law, implementation could also begin without taking into account any conditions at the federal level.

Regulators in Washington will also be required to develop rules that will guide marijuana exports and imports. However, the governor will have sole authority to sign agreements with other states. Goods imported from out-of-state businesses would have to abide by Washington regulations, including labeling and packaging guidelines.

Meanwhile, a legislator from Maine has introduced a bill to permit marijuana exports and imports between states where it is legal. A comparable interstate plan was submitted by New Jersey’s senate president last year, but it hasn’t yet been approved.

Additionally, last year, a federal court ruled that the U.S. Constitution’s Commerce Clause made Maine’s law prohibiting nonresidents from running medicinal cannabis businesses in the state unlawful. Some commentators contend that the same logic used to support the residency restrictions also applies to state-level restrictions on marijuana import and export, rendering them invalid. There is also a belief that prohibiting medicinal cannabis imports and exports in states that have legalized it would be seen as both unconstitutional and protectionist.

If cannabis interstate commerce becomes a reality around the country, states with favorable cultivation conditions could have a competitive edge and perhaps opt to use equipment such the microgardens sold by Advanced Container Technologies Inc.
