The pharmacokinetic (“PK”) randomized, double-blinded, cross-over study will comprise 36 human subjects who are current cigarette smokers. Each subject will visit the laboratory, where they will be dosed three times over a period of weeks. Only one of three nicotine pouch brands – DehydraTECH(TM)-nicotine, On! brand manufactured by Altria, or Zyn brand manufactured by Swedish Match – will be administered during each visit. Subjective and objective evaluations will then follow.

Through predetermined questionnaires, which will be used for each nicotine pouch, aiding in subjective evaluation, Lexaria will seek data related to throat burn, user experience, gastrointestinal experience, and more. Additionally, blood samples taken a total of eight times per visit will help in objective evaluations associated with the quantity of nicotine in the blood at various time points. At the same time, vital signs such as respiratory rate, heart rate, blood pressure, and temperature will also be collected.

Drug, racial and social-justice activists will be happy to know that House lawmakers will be discussing marijuana reform once the midterm elections draw to a close. Although the Biden administration was quick to act on its green-energy and electrification promises, there were plenty of valid complaints regarding the administration’s lack of action regarding cannabis reform.

President Joseph Biden recently made waves across the country when he announced that his administration was taking steps to begin pardoning all Americans who had simple cannabis possession offenses on their records.

With the midterm elections drawing to a close as final seat winners are announced, the House Oversight Civil Rights and Civil Liberties Subcommittee has indicated that it will hold a hearing this week to discuss state and federal bipartisan cannabis reform. The subcommittee posted a notice announcing the upcoming hearing las week, calling the Nov. 15, 2022, hearing “Developments in State Cannabis Laws and Bipartisan Cannabis Reforms at the Federal Level.”

With voters across the country deciding whether or not to approve marijuana legalization measures, this announcement shows that lawmakers are cognizant of the changes to cannabis policies and are willing to discuss the possibility of passing cannabis legislation.

The announcement may not have specified which cannabis policies the lawmakers will be discussing, but ranking GOP member Rep. Nancy Mace has said in the past that leadership had “promised” to consider her states reform act. The bill, which has been touted as a reasonable compromise between what the left and right want, would eliminate federal cannabis prohibition while ensuring that existing cannabis businesses aren’t significantly affected by the evolving federal cannabis rules.

Another legislation that could be under consideration in the hearing is the Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act. The bill was introduced by Judiciary Committee Chairman Jerrod Nadler. House members voted to pass the MORE Act for the second time this April, with House Majority Leader Steny Hoyer calling it an important piece of legislation. Oversight subcommittee chair Rep. Jamie Raskin also filed an amendment to the MORE Act that would make it so that cannabis consumption cannot be used as a reason to deny or revoke security clearance, but the amendment failed to pass.

The MORE Act would put an end to federal cannabis prohibition and take steps to promote social equity in the nascent marijuana industry.

Given that two (Missouri and Maryland) of the five states that had marijuana on the ballot passed those measures in the midterm election, the subcommittee discussions may be more animated riding on those poll results. 420 with CNW — Colorado’s Amendment 64 a Decade Later

It has been 10 years since Amendment 64, which legalized adult-use marijuana in Colorado, was passed and implemented. The proposed constitutional amendment had a number of arguments in support of legalizing marijuana, and we shine the spotlight on some of those arguments to see to what extent they have been vindicated.

One major argument was that by legalizing recreational marijuana, adults who wish to use the substance would purchase it from regulated sources that are licensed and have quality standards to adhere to, unlike marijuana sourced from underground sources that aren’t subject to any regulation. Teen use would also be curbed, proponents stated.

To some extent, results have shown that adults prefer to source their marijuana from licensed outlets since they find these products to be of a better quality than those from black market suppliers. The recent spate of lung injuries (EVALI) have since been linked to contaminate black market vape products, and most cases were reported in states that prohibit marijuana. This seems to suggest that legal markets such as Colorado have shielded users from potentially dangerous or tainted products by availing outlets where licensed producers sell products that meet set quality standards.

According to the data collected during the Healthy Kids Colorado Survey undertaken every two years, it does seem that the rates of marijuana use among teens are declining. For example, 2015 survey data indicates 21.2% of high school students admitted to using cannabis a minimum of one time within the past month, but the 2021 survey shows that the number has dropped to 13.3% of high school students.

These reductions can be attributed to the age restrictions that marijuana retail facilities enforce when selling their products, such as ID verification. In this way, teen access has been curbed and is continuing to go down, if current trends are to continue. In fact, the regulator of the marijuana industry regularly carries out enforcement checks, and their bulletin released in August this year indicates that compliance rates stand at 98% with regard to enforcing age restrictions.

However, the black market still persists, and a number of reasons could explain this. First, illicit suppliers can undercut the prices of marijuana products sold in licensed outlets, and price-sensitive buyers may still opt for those unregulated black-market products. Secondly, since Colorado has neighboring states that haven’t legalized cannabis, illicit operators may use the regulated market as cover for their illegal activities targeting the export market in the neighboring states.

All in all, while legalization has brought mixed results based on the arguments for and against as captured in Amendment 64 put before voters a decade ago, many sceptics such as Senator John Hickenlooper have since had a change of heart and admit it was a good move to end prohibition. This isn’t surprising given that statistics show that nearly 400,000 people are employed in the legal marijuana industry across the country by numerous entities, including American Cannabis Partners, that have set up shop in jurisdictions which allow marijuana to be sold, purchased and consumed by adults.

Governor Tony Evers (D), who has just been reelected as the governor of Wisconsin, has promised to include marijuana policy reform in his budget proposals due early in 2023. This pledge comes after Wisconsin voters in a number of counties and cities approved nonbinding questions in the midterm polls supporting the establishment of a legal marijuana market in the state.

Speaking during a press conference after his reelection, Evers said his 2023–25 budget plan will contain provisions on marijuana legalization and that it was something that lawmakers needed to discuss and find a way forward. He added that sooner or later, the will of the people of Wisconsin would prevail and legalization will happen. He expressed his frustration that despite a vast majority of voters in the state wanting marijuana legalization, nothing is happening in that regard because the legislature keeps stalling.

His frustrations stem from the fact that he has included decriminalization and legalization proposals in his budget estimates since 2019, but the legislature keeps blocking any advancement of those measures.

To push any meaningful change, the Democrats in Wisconsin needed to get a majority in both the state assembly as well as the senate. However, the Republicans have retained control of both chambers of the legislature, albeit with a slimmer majority, which cannot allow them to sidestep a veto. A super-majority is needed to force the hand of the governor on any issue.

Prior to the midterms, Governor Evers met with and urged students to turn out to vote in large numbers because their support was needed to pass progressive policy changes in the state, including on marijuana legalization. That support was direly needed because the governor wanted more Democrats elected so that some pending policy matters, such as a measure amending the constitution so that voters can put various ballot measures on the state ballot, could be passed. Republican lawmakers aren’t likely to support such an amendment.

Meanwhile, voters have in one way or the other been voicing their preferences. For example, during the midterms, voters in five municipalities and three counties voted in the affirmative on nonbinding questions asking whether they wanted marijuana to be legalized. These questions act as a sounding board to inform legislators about the views of voters on different policy issues. A poll whose findings were released in August also confirmed that 69% of the voters in the state favored marijuana legalization.

Clearly, the demand for change is growing, and that is how momentum built in jurisdictions where enterprises such as Prime Harvest Inc. now legally operate in regulated cannabis markets. It seems more a matter of when, rather than if, Wisconsin will legalize medical and/or recreational marijuana.

President Joseph Biden made plenty of promises while on the campaign trail, including his pledge to offer marijuana pardons. One of his more progressive statements, the promise was met with praise from drug reform activists across the country.

Last month, President Biden announced that he was taking steps to pardon everyone who had been federally convicted of simple marijuana possession offenses. The announcement was met with surprise as the Biden administration has been largely silent on cannabis reform despite Biden’s campaign promises.

Biden also instructed governors to issue similar pardons at the state level and stated that he would initiate an administrative review of marijuana’s scheduling at the federal level. This is the system of classification that classifies cannabis at the same level as dangerous drugs like heroin and cocaine. Biden noted that it made no sense that marijuana, which has been found to have a variety of medical applications, is considered to be more dangerous than fentanyl at the federal level.

A group of more than 130 organizations comprised of immigration and civil rights groups is now calling on the president to extend the cannabis possession pardon to every U.S. resident regardless of their immigration status. The group sent a letter to the White House urging the president to do more for people who live in America but aren’t lawful permanent residents or citizens. These individuals were specifically excluded from the pardon and will not have their simple cannabis possession offenses pardoned.

The group, led by the National Immigrant Justice Center and the National Immigration Project, wrote that Biden’s move to offer mass cannabis pardons was a “much-needed” step toward alleviating the harms caused by the decades-long war on drugs. However, they observed that that they were “grimly disappointed” by the president’s exclusion of immigrants as well as the lack of affirmative measures to ensure immigrants are protected from any immigration consequences that could arrive from receiving a cannabis conviction.

The group of more than 130 organizations focus on immigrant rights, human rights and racial justice issues. They stated that excluding immigrants from these cannabis reforms based on where they were born casts a shadow of doubt on the White House’s efforts to address criminal policies that have disproportionately affected Black and Brown communities.

The organizations asked the president to extend the cannabis possession pardons to all immigrants regardless of their immigration status and to ensure that these immigrants are protected from negative immigration outcomes following cannabis convictions.

Marijuana crime pardons are just one of the reforms that activists want to see implemented. 420 with CNW — Federal Judge Dismisses Suit Challenging Ban on Gun Rights for Medical Cannabis Patients

There are an estimated 3.6 million registered medical cannabis patients in the United States with slightly more than 700,000 residing in the state of Florida. But, despite the fact that dozens of states have legalized medical marijuana and launched legal markets, the drug is still illegal at the federal level.

This often leads to situations where businesses and customers abiding by state law are penalized by the federal government, which still considers cannabis to be illegal. One major example is the fact that cannabis businesses cannot access banking and financial services despite paying billions of dollars in taxes.

On the other end of the spectrum, recreational and medical cannabis customers have also found themselves running afoul of federal law despite consuming cannabis as per state law. For starters, the federal government has banned medical cannabis patients from purchasing and possessing firearms, a move that has been called unconstitutional because it is in direct violation of the second and fifth amendments.

Last week, a federal Florida judge dismissed a lawsuit from state agriculture commissioner Nikki Fried that challenged the federal government’s decision to prevent medical cannabis patients from legally accessing firearms.

Fried filed the lawsuit in April on the basis that the ban was unconstitutional and was optimistic about last week’s hearing, stating that her legal team had done a “compelling job” arguing the merits of the lawsuit before a federal judge. She filed the lawsuit alongside Florida medical marijuana patients who had been barred from purchasing firearms by the “unconstitutional and discriminatory” federal policy.

However, her lawsuit was dismissed by a U.S. District Court for the Northern District of Florida judge in a 22-page ruling. Judge Allen Windsor ruled that while medical cannabis patients were allowed to consume cannabis by state law, doing so was considered criminal at the federal level. As such, the judge ruled that there was a precedent for denying these individuals their right to bear arms.

He stated that a congressional rider meant to prevent the Department of Justice from using tax dollars to interfere with medical cannabis programs at the state level simply prevented prosecution. It did not, however, “bless the plaintiffs’ actions” forever, he said, arguing that purchasing and consuming medical cannabis was still a crime at the federal level whether or not the user was prosecuted.

With Fried’s lawsuit being thrown out, medical cannabis patients who are honest about their cannabis use when they fill out a background check form from the Bureau of Alcohol, Tobacco, Firearms, and Explosives will be prevented from purchasing firearms.

These inconsistencies between federal marijuana policy and state-level laws don’t just affect consumers. Even companies such as Flora Growth Corp. 420 with CNW — Marijuana Consumers Opt for Concentrates as Product Prices Drop

Marijuana industry watchers as well as retail buyers indicate that cannabis concentrates are registering more sales across the industry, particularly in mature markets. Frequent marijuana users are also taking a greater liking to concentrates.

Brightfield Group, a Chicago-based cannabis analytics firm, says approximately 29% of all marijuana consumers admit that they have used cannabis concentrates at least once during the past half year. Two years prior, that figure stood at 22%. Bethany Gomez, the managing director of Brightfield Group, says such a jump is significant in a space of only two years.

Mature cannabis markets also registered an even bigger increase of people who say they’ve used cannabis concentrates at least once during the recent six months. In Massachusetts, for example, the percentage rose from 13% to 20%, while in Michigan, users increased to 26% from 20% two years earlier.

Gomez explains that as more people use marijuana daily, their level of tolerance for the substance also increases, and that partially explains why there is growth in the use of concentrates. At the moment, data collected by Brightfield indicates that daily users of cannabis stand at 64% of all marijuana users. This is a significant driver of the concentrates market, because a lot more people are willing to try more potent products as tolerance levels rise.

Another surprising factor driving up the sale of concentrates is the current level of inflation. Gomez explains that as the purchasing power of people is weakened with rising inflation, heavy marijuana users see concentrates as offering value for money since their effects are stronger than the effects of other products, such as cannabis flower.

The positive strides made in packaging and branding of the concentrates has also played a role in making more of these products attractive to consumers.

Several markets have also seen concentrate prices decrease due to the reduction in the wholesale prices of cannabis flower as production grows at a higher rate than the rate at which demand is growing. For example, wholesale prices of dry cannabis flower have declined to less than $1,000 a pound in Michigan. Such a drop means that the raw material for concentrates is priced lower, and therefore the finished product will also be priced more affordably. These price changes are luring more people to try these products.

Innovations in the equipment required to consume concentrates have also helped. In the past, a dab rig was mandatory for one to consume concentrates. However, these products can now be consumed in vape pens and other such simple equipment, thereby rendering concentrates more appealing to consumers who aren’t sophisticated enough to use complicated equipment such as dab rigs. All these innovations mean that companies such as American Cannabis Partners can sell their marijuana products to significantly more people without sacrificing profitability.
