420 with CNW — Largest Employee Union Wants End to Testing Federal Employees for THC

For decades, federal employers have had the right to test their employees for cannabis used because of federal regulations that outlawed the cultivation, distribution and sale of marijuana. But as states have begun to legalize recreational and medical cannabis use, reform activists argued that these drug tests penalize consumers for indulging in behaviors that are considered legal in their home states.

The largest federal employee union in the country is now calling on the government to put an end to policies that punish federal workers for using cannabis during their free time. The American Federation of Government Employees (AFGE) also adopted a resolution in support of federal cannabis legalization during its 42nd national convention last month. AFGE currently represents more than 700,000 federal workers in America.

Although the union hasn’t released the final text of the measure, which is titled “Resolution to Support Deleting Responsible Off-Duty Marijuana Usage from Sustainability Criteria,” it posted the resolution on its website. According to a draft version of the measure that was obtained by Marijuana Moment, it also supports the Marijuana Opportunity, Reinvestment and Expungement (MORE) Act.

If it becomes law, the MORE Act would remove cannabis from the list of controlled substances, eliminate penalties for federal cannabis offenses and expunge prior federal cannabis convictions from people’s records.  It has advanced past the House of Representatives twice so far.

The resolution noted that cannabis use has been increasingly accepted by the American public, especially regarding cannabis use for medical purposes by veterans and civilians. This is clear by the number of states that have chosen to legalize cannabis for medical use in recent years. However, cannabis remains a controlled substance at the federal level, and the resolution says this attaches unreasonable security to cannabis usage.

As such, members of AFGE voted in favor of the measure to partner with other unions and support federal cannabis legalization as well as compel the U.S. Office of Personnel Management (OPM) to get rid of federal policies that require testing cannabis in employees who work in nonnational and nonsafety sensitive positions. AFGE requested that the OPM remove responsible off-duty cannabis use from its sustainability criteria 5 CFR § 731.202 at the state level in Washington, D.C., and other jurisdictions with medical marijuana programs.

The draft measure also urged the OPM to remove marijuana-related questions from the SF86, e-QIP, SF85 and SF8SP. These are some of the forms that people applying for certain federal government positions have to fill out. The measure came shortly after the leaders of the House Appropriations Committee urged the White House to review guidelines and policies on the firing and hiring of individuals who use cannabis privately in states with legal markets.

420 with CNW — New Research Finds Legalization Hasn’t Increased Number of Teens Trying Cannabis

Concerns around how the legalization of marijuana for adult use may prompt an increase in the number of young users have been floated by both parents and health researchers since talks on legalization began a decade ago. Critics against the policy change have even gone as far as to issue warnings with no evidence to back the claims. However, new research has found that the legalization of marijuana does not cause more young individuals to try using the substance.

The study, which was conducted by researchers at Michigan State University, found that legalized marijuana retail sales did not increase the number of underage individuals who consumed cannabis. The researchers cited existing studies on the use of alcohol among the youth to highlight the importance between prevalence and incidence. Research from 2016 and 2018 shows that a big proportion of youth in the United States did not drink alcohol until they could legally. The researchers theorized that the same trend could be true with marijuana.

For their study, the researchers used public data of individuals aged between 12 and 20, then those aged 21 and above, obtained from the National Survey on Drug Use and Health. They analyzed the data using the event study model in an attempt to evaluate the causal effect legalization had on marijuana use. This is in addition to projecting levels of cannabis use if legalization hadn’t been enacted.

They discovered that legalizing adult-use marijuana did increase first-time marijuana consumption — but only among individuals who could use the drug legally once the policy change was enacted. In their report, the researchers noted that they observed no evidence of an increase in use among underage individuals.

The lead author of the study, Barrett Wallace Montgomery, stated that by contrast, the number of individuals aged 21 and above who were trying marijuana for the first time after adult-use legalization could double or triple.

NORML, a marijuana advocacy group, stated in a recent blog post that the study’s findings were consistent with previous research, which had shown that adult-use legalization wasn’t linked to increased access or use among young individuals.

The study was partly funded by the National Institutes of Health and its findings were published in the “PLOS One” journal. The study claims to be the first one designed to assess incidence of use as a result of the legalization of adult-use cannabis. Prior studies have centered on prevalence, trying to measure the effect legalization has had on how much marijuana individuals use or how often they use it.

The government is making moves once again to remove cannabis from the list of banned controlled substances, with the U.S. House of Representatives passage of the Marijuana Opportunity Reinvestment and Expungement (“MORE”) Act (https://cnw.fm/9gXLk). The U.S. House of Representatives has passed the MORE Act before, a “Forbes” article reported, a bill that would end the federal prohibition on cannabis by removing it from the list of banned controlled substances. The article noted that the MORE Act was introduced by House Judiciary Chairman Jerrold Nadler, a Democrat from New York, and passed the House with 220 “yea” votes to 204 “nay” votes.

“Cannabis is legal for adult use in 19 states and for medical use in 36 states,” the article reports. “This bill would end the federal ban but leave legalization up to the states. The legal industry generated $25 billion in sales last year, a 43% increase over 2020, and is expected to hit $65 billion in 2030.

“During his opening statement, Nadler said that the bill, if made into law, would reverse decades of injustices waged on Americans, and especially those from communities of color,” the article continued. “‘Whatever one’s views are on the use of marijuana for recreational or medicinal use, the policy of arrest, prosecution and incarceration at the federal level has proven both unwise and unjust,’ Nadler said. ‘For far too long, we have treated marijuana as a criminal justice problem, instead of as a matter of personal choice and public health.’”

During debate on the bill, Troy Carter, a Democrat from Louisiana, stated that 91% of Americans want some form of cannabis to be legal and that there are more important priorities cops should be focused on. Carter noted that “law enforcement cannot afford to chase small pot offenders when violent crime is on the rise nationwide. . . . The war on marijuana is a costly relic of the past.”

420 with CNW — Studies Question Usefulness of THC Testing to Establish Impairment

For decades, law enforcement has used standardized equipment called breathalyzers to determine the blood-alcohol content of drivers and police-impaired driving. These tests take mere seconds to administer and can give police a decent estimation of how impaired a driver is. As cannabis reform has swept across the country and more states have legalized recreational cannabis, law enforcement and cannabis legalization opponents have argued that legalizing cannabis will inevitably lead to higher levels of impaired driving and road incidents.

We still don’t have a standard test to quickly measure delta-9 THC blood levels. Furthermore, there is relatively little evidence that the level of THC in the breath or blood from recent marijuana use is even associated with impaired driving. With at least a dozen states now allowing recreational cannabis use among adults aged 21 and older, the need to understand the correlation between recent cannabis use and impaired driving as well as develop ways to effectively measure impairment has become even more urgent.

recent study published in “Scientific Reports” did just that, peering into the cannabis plant to study how cannabinoids impact impairment. Two researchers from California ran a one-year clinical study with 74 users who reported using cannabis daily for approximately nine years. The participants had an average age of 25 years, and most of them reported that smoking or vaping were their most preferred methods of consuming cannabis.

One group of study participants had a baseline THC blood level that surpassed THC limits in five U.S. states, even when they were completely sober. This means that in these five states, the study participants were not legally allowed to get behind a wheel even if they had not used any cannabis. Previous studies from Michael DeGregorio, one of the researchers behind the recent study, and other researchers had found that marijuana use could result in short-term functional impairment.

The extent of this impairment depends on factors such as frequency of use and age. Building on previous research, this study found that 16 cannabis users had more than 5ng/ml of delta-9 THC in their blood even though they had abstained from cannabis and were not impaired. Breath and blood samples indicated high THC levels despite no recent cannabis use and no impairment.

Participants who had used cannabis for longer periods had higher baseline THC concentration levels, which in many cases exceeded state limits. However, their duration of impairment was decreased, meaning they were impaired for shorter periods of time even though their baseline THC levels remained elevated. The researchers concluded that THC levels in exhaled breath and blood were not reliable indicators of THC impairment.

420 with CNW — Health Canada Panel Gives CBD the Nod for Mainstream Retail

Cannabis extract cannabidiol (CBD) has become extremely popular over the past decade due to claims of its medical efficacy. CBD is said to be effective against a wide variety of medical issues, and it has even been approved as a major ingredient in a drug used to treat seizures in pediatric epilepsy.

Additionally, the cannabinoid is so versatile in its applications that it can be infused in a range of foods and beverages and still be effective. However, there have been questions about whether approving CBD for mainstream retail would have adverse medical outcomes, especially considering the fact that it is an active ingredient in an approved drug.

CBD retailers and users in Canada will now be happy to know that the country’s top regulator has deemed CBD use by healthy adults without a prescription as “safe and tolerable.” A nine-member Health Canada panel, the Science Advisory Committee on Health Products Containing Cannabis, ruled that short-term CBD use (30 days maximum) at a dose of 20 to 200 mg. per day is safe and tolerable.

This decision comes three years after Canada’s top health regulator formed a team of experts to review whether or not CBD-infused products should be approved for mainstream retail sale without the need for a doctor’s prescription or in a recreational cannabis store.

Health Canada may not have any legal obligation to act on the panel’s recommendation, but it could prove to be a boon for Canada’s nonexistent legal CBD market. As it stands, the country considers CBD a controlled substance and regulates it like delta-9 THC, the main psychoactive component in cannabis. The result is that most of the CBD sellers in Canada operate in the illicit market. This has led to an influx of untested and unregulated CBD products that could be putting consumers at risk.

According to Paul Pedersen, CEO of Nextleaf, Vancouver-based cannabis extraction company, Canada’s black market for CBD products is pulling in an estimated $4 billion per year. If Health Canada decides to act on the panel’s recommendation and approves mainstream retail sales of CBD, Pedersen envisions CBD products will be sold next to other dietary supplements in drug and grocery stores. Speaking to MJBizDaily, he said that he is looking forward to moving CBD sales to any location that sells vitamins.

As per the panel, there are plenty of Canadians who would like to access cannabis-infused products without the need for a physician’s oversight. Still, the panel encouraged CBD manufacturers to put warning labels on their products.

The panel also noted that, unlike THC, cannabidiol was not psychoactive and won’t get most adults high. Furthermore, the panel did not distinguish between hemp or marijuana-derived CBD and did not conclude that CBD was therapeutically effective.

Given that Canada has blazed a trail that other developed countries have followed, it isn’t far-fetched to expect that the recommendations made on selling CBD in mainstream retail outlets will be taken up so that companies such as American Cannabis Partners can have the leeway to market these products as dietary supplements or any other form they choose.

The exclusive rights between Premier and Lexaria are subject to two previously issued licenses for using DehydraTECH technology in Japan for non-pharmaceutical cannabinoid products. As of July 28, 2022, Lexaria has been granted 26 patents worldwide.

Under the terms of the license agreement with Lexaria, Premier purchased rights to the company’s DehydraTECH technology for use in the non-pharmaceutical market for CBD and hemp ingredients in oral liquid and non-liquid product forms, including topical, hair-care, lip-care, and cosmetics. To retain ongoing exclusivity, the minimum quarterly payments from Premier to Lexaria will begin September 1, 2022, and will total US$4,527,500 during the first five years of the agreement. Additional payment beyond five years will be required to keep the license in good standing.

The “Ko” brand is focused on the endocannabinoid system and circadian rhythm, supporting the health and wellness of all consumers, specifically highlighting the concept of wellness for all, and will contain CBD and other botanical extracts. Ko-branded products containing DehydraTECH delivery technology are expected to be introduced during Q2 2023, following a rigorous product development process and formula optimization. 

Premier will create its own e-commerce infrastructure with digital marketing campaigns in collaboration with the licensee’s parent company, Premier Anti-Aging Co, Ltd., listed on the Tokyo Stock Exchange under the ticker symbol ‘4934:JP.’ Wholesale of the “Ko” brand will be done with a third-party Japanese-based distributor, also listed on the Tokyo Stock Exchange, to expand sales reach. The distributor and logistics supplier has shipped more than 3.5 billion products during the fiscal year and comprises more than 50,000 products and over 50,000 retail locations across the cosmetics, OTC pharmaceuticals, and nutraceutical wholesale industries.

In addition to the licensee payments, Lexaria will receive royalties from DehydraTECH-enabled product sales, which are anticipated to be greater than the negotiated minimum payments for the license use if Premier reaches revenue targets. Even with the worst-case projected revenue, Lexaria could expect royalties of US$5 million annually by the fifth year of the contract.

Lexaria’s DehydraTECH technology speeds up delivery, increases bioavailability, increases brain absorption, improves drug potency, reduces drug administration costs, and masks unwanted tastes. Animal studies have demonstrated the propensity of the technology to elevate the quantity of the drug delivered across the blood-brain barrier by as much as 1,900 percent.
