For starters, those arguing against college degrees in the cannabis industry or anywhere else say that those degrees create a widening divide that locks out a huge majority of people from the lucrative job opportunities available. Statistics show that a little more than one-half of all Americans don’t have college degrees, so demanding a college degree as a job requirement worsens the inequalities in the society. Additionally, marijuana industry veterans assert that the industry was built by innovative, risk-taking people who didn’t have any college degrees, so they see no reason why the college degrees are making their appearance now that the industry is firmly on a trajectory of growth.

Removing or not considering college degrees when hiring also widens the options since more people will express interest in an available position. This is particularly necessary at this time when there is a general labor shortage in most industries.

However, the side in support of college degrees has its own strong arguments. For example, they say that there are specific roles within the industry that require personnel with college degrees. For example, the industry needs attorneys who have specialized in cannabis law Additionally, many in the industry see college degrees and other such qualifications as a way to increase access to jobs in this growing sector. This is because the degree provides the credentials that one needs to get a job on merit rather than relying on the “old-boy” network and other such relationships while looking for a job.

Esai Miera, founder of Colorado Cannabis Education, belongs to this school of thought that sees marijuana education as a ticket to a job even if you don’t personally have a connection to someone within the industry. He adds that cannabis education is needed to move the industry forward since it has reached a point where specialized skills are now needed if any company is to stand out and beat the stiff competition.

As things stand, it isn’t easy to tip the degree-or-no-degree debate in one direction or other. There are so many nuances to this that each company, such as American Cannabis Partners, may have to handle this matter on a case-by-case basis.

420 with CNW — NJ Legislators File Bills Seeking to Prevent Off-Duty Cannabis Use by Police

We reported about the controversy that had arisen when the New Jersey attorney general penned a memo clarifying that, under existing law, police officers aren’t barred from consuming cannabis while off duty. As a result of that memo, several bills have been filed in order to empower employers, including law enforcement agencies, to ban the use of marijuana by people occupying safety-sensitive jobs, including those in law enforcement.

One of the three measures that have been filed aims at giving law enforcement agencies the authority to act against the police for consuming marijuana even while off duty. This particular measure was filed by Rep. Louis Greenwald, a Democrat. His bill will also give law enforcement agencies leeway to undertake random testing for drugs and also turn down any applicants who have a history of using cannabis in compliance with the laws of the state.

At the moment, people serving in law enforcement agencies cannot be penalized for consuming marijuana as long as they don’t show up for work while impaired. This situation is concerning to the governor and other influential lawmakers who feel that police officers and other law enforcement personnel shouldn’t be allowed to consume cannabis.

While the bill introduced by Greenwald is looking at imposing cannabis consumption restrictions on the police, two other bills have a wider scope and seek to bring amendments that curtail cannabis consumption rules that started being implemented last month. For example, one of those other bills wants to bar first responders from consuming recreational marijuana even if the substance is legally available within the state.

The third bill, whose full text isn’t readily available yet, is intended to grant employers permission to restrict certain employees from consuming marijuana products. Without the full text of this draft law, it isn’t easy to decipher which particular categories of employers the proposed law is targeting with this permission to restrict the lawful use of marijuana.

If you think that these bills are unpopular given that recreational marijuana sales have just been launched, think again. There is widespread concern that people who bear arms to protect and serve the community wouldn’t be in contravention of any laws if they consumed cannabis products outside their work hours. As a result of this concern, several local authorities, including members of the city council of Newark, have taken steps to unilaterally ban cannabis use by the police. Other mayors and councils are also vowing to issue their own orders restricting off-duty use by police officers in their jurisdictions.

This is because there is no agreement about how much THC, the cannabis compound responsible for making users high, is sufficient to cause a driver to be impaired. Additionally, impaired drivers exhibit the same signs, such as swerving while driving, delayed reactions while at traffic intersections, driving too slowly or too fast, and so on.

As a result, law enforcement agencies in different jurisdictions are having to tweak their protocols and procedures in order to take action against those suspected to be driving under the influence of cannabis (DUIC). Captain Rick Bancroft, who works in the sheriff’s department in Monroe County, New York, defines drugged drivers as drivers who are impaired by a substance that isn’t alcohol. Such a person drives in a way that is unsafe to themselves and other road users, which is why impaired driving is of concern to law enforcement.

Since there is no acceptable test to rule out or confirm cannabis impairment, Bancroft says that officers now have to rely on the normal sobriety tests that they have been conducting and then add the special measures drug-recognition professionals recommend when deciding whether someone is driving under the influence of marijuana or not.

Some police departments, such as the Rochester PD, have a 12-step process to help in identifying people who are suspected to be impaired by cannabis.  For example, an officer may use a breathalyzer to find out whether a driver exhibiting the signs of impaired driving has a blood alcohol level exceeding the legal limit.

Once alcohol impairment is ruled out, the officer may look at the taste buds at the back of the mouth to see if they look dark and are swollen. This is often a sign that someone has consumed cannabis a short while before. The pupils will also be dilated while the eyes will be bloodshot.

For people who show signs of cannabis impairment, an ultraviolet light is shone on the tongue and if red patches show on the tongue, THC consumption is strongly suspected. The screening process continues until as many of the 12 steps as possible have been exhausted. An arrest is then made, and the struggle to prove cannabis impairment in court begins.

As the consumption of marijuana becomes more mainstream, opportunities may arise for companies such as Advanced Container Technologies Inc.
