420 with CNW — USDA Kick-Starts Hemp Farmer Survey for Better Policy Making

Last week, the National Agricultural Statistics Service revealed that forms for a survey on hemp farmers to be filled out online or via email were being finalized. This comes after the U.S. Department of Agriculture requested permission in July to carry out a survey of hemp farmers.

Hemp has been legal in the United States since it was legalized federally under the 2018 Farm Bill. The large-scale survey will help the USDA to better understand the hemp market, which will allow for better policy making.

The survey will include questions about the secondary and primary uses for hemp, the prices producers can charge, acreage used for operations and plans for the outdoor production of hemp. This is in addition to examining how farmers acquire the clones and seeds they use, the yields they have harvested, whether they plan to extract terpenes or cannabinoids from hemp and if they hand trim the crop they produce. The department is also interested in learning more about seeds, fiber, grain for human consumption, extracts such as CBD and preparations such as smokeable hemp.

In an explanatory document, the USDA stated that the survey’s purpose was to develop state and national estimates of the hemp grown and produced last year, adding that the survey would be carried out every year. The department also revealed that the questionnaires used in the survey would gather data for hemp produced under cover, namely in hoop houses, high or low tunnels, greenhouses and the like, as well as in the open.

The document then explained that crop produced under cover would gather data in four categories, including seed, transplants or clones, flower and other, while crop produced in the open would gather data in five categories, including seed, fiber, grain, flower and other.

The USDA will use the results of the survey to set a benchmark for hemp production and acreage to assist processors, state governments, producers and regulatory agencies, among other central industry entities.

The agency will begin sending reminders and notices to industry operators, including hemp businesses, on Oct. 1, 2021, to encourage them to take part in the survey. The Department of Agriculture estimates that the cumulative time taken to complete the surveys will be roughly 7,530 hours.

Another national survey by the USDA, which is being conducted in partnership with the University of Kentucky and the National Association of State Departments of Agriculture, is also gathering data from hemp businesses in the country. This data will be used to formulate better approaches for the industry’s regulation.

The road to cannabis reform has been long, tedious and fraught with hurdles. After decades of prohibition, anti-marijuana propaganda and harsh policing, reforming cannabis laws and changing the public’s perception towards cannabis was bound to be a challenge.

While reform advocates argued that legalizing cannabis would offer a much-needed reprieve to the minority communities that had suffered the most from the failed war on drugs in addition to creating new jobs and filling state coffers with tax revenue, opponents said that it would inevitably lead to increased drug use, especially among the youth, and promote criminal activity.

However, studies have revealed that there has been minimal or no increase in teen cannabis use in states with legal markets. Furthermore, a top federal officer who previously believed that marijuana use among adolescents would increase after the passage of cannabis legalization bills has conceded that things have played out differently. Speaking at the Psychoactive Podcast hosted by Drug Policy Alliance Founder Ethan Nadelmann, the National Institute on Drug Abuse (“NIDA”) director Nora Volkov discussed a wide variety of drug policy issues. She said that the country’s booming state-legal cannabis industry has not led to a rise in marijuana use among the youth.

Volkov also talked about how the country needs to stop looking at drug abuse and addiction as criminal activity deserving of punitive action and instead approach it as a public health matter, an issue she has covered extensively before. Additionally, she and Nadelmann discussed the medical potential of a variety of psychedelics that federal law has long classified as dangerous.

The effects of cannabis legislation have varied greatly on a state-by-state basis, she says, with some states having better outcomes and others seeing the adverse effects of cannabis use. As such, she noted, it is crucial for federal officials and policymakers to understand which cannabis policies promote the best outcomes while protecting the populace from the negative effects.

Despite more than 30 states passing at least one form of cannabis legislation, federal law, which classifies cannabis as a Schedule 1 controlled substance with no medical application, has held the nascent cannabis sector back. Federal law has created major research barriers, forcing scientists interested in studying cannabis to go through “extremely cumbersome” processes to obtain cannabis, she says. Additionally, scientists are only allowed to use the low-quality cannabis grown at a facility at the University of Mississippi, but Volkov says she has been heartened by moves to increase the number of sanctioned cannabis providers by the Drug Enforcement Administration (“DEA”).

Cannabis use among athletes is a controversial topic. Some sporting leagues have adhered to federal law, which classifies cannabis as a Schedule 1 controlled substance, and banned their athletes from consuming marijuana.

In the past, professional sporting leagues such as the NBA and the NL tested for cannabis and often imposed punitive measures on athletes who failed these tests. However, the conversation regarding professional sports and cannabis peaked when American sprinter Sha’Carri Richardson was suspended from participating in the Olympics after testing positive for THC, the main psychoactive agent in cannabis.

Richardson had consumed cannabis in Oregon where both recreational and medical marijuana is legal, and her suspension was met with furor. Drug reform activists as well federal candidates and several members of Congress condemned her suspension, with Reps. Alexandria Ocasio-Cortez and Jamie Raskin calling the ban on cannabis a “significant and unnecessary burden” on athletes’ civil liberties in a letter to the United States Anti-Doping Agency (“USADA”) and the World Anti-Doping Agency.

Hip Hop legend and well-known cannabis connoisseur Snoop Dogg recently weighed in on the debate at a talk show where he voiced his support for cannabis use among athletes, especially as an alternative to opioids. When guest host Stephen A. Smith asked for his opinion on the matter on Jimmy Kimmel Live, Snoop Dogg said that sports leagues ought to stop testing their players for cannabis and update their policies to allow athletes to use cannabis rather than prescription opioids.

Currently a sports commentator for ESPN, Smith asked Snoop whether athletes should stay away from cannabis to avoid penalties that may cost them money. Snoop said that while entertainers such as himself who did not have to adhere to such policies could consume cannabis, athletes who have rules to follow and are subject to tests should indeed avoid using cannabis as it could jeopardize their income.

However, Snoop Dogg still isn’t at all sold on the idea that athletes should be penalized for using cannabis. A lot of athletes are prescribed opioids to help alleviate the aches and pains that come with being a professional athlete, he says, and they eventually get addicted to the medications, even though the medications don’t actually provide the relief the users are looking for.

Thanks to cannabis, however, athletes have been able to alleviate pain and anxiety without experiencing the side effects pharmaceuticals are known for. The fact that different sports leagues hold players to different standards regarding drug testing doesn’t make sense, he says, and sports leagues should reform and standardize their cannabis policies.

Thanks to Richardson’s controversial suspension, the case for cannabis reform in sports is gaining even more steam. The NBA put random drug testing on hold during the early days of the pandemic, and according to the league’s top official, this policy change may be permanent. The MLB already removed cannabis from its list of banned substances in 2019, and the NFL changed its policies to protect athletes who receive positive results for any drug test, including cannabis, from being suspended.

420 with CNW — California Sets Fiscal Year Record for Marijuana Tax Revenue

The nonpartisan Legislative Analyst’s Office in the state of California estimates that during the 2020–21 fiscal year, the state collected roughly $817 million in recreational cannabis tax revenue. This amount is 50% more than the marijuana earnings for the state coffers that were generated in the previous fiscal year. The officials state that combined cultivation and excise tax revenue for the fourth quarter, which ended in June, equates to $211 million.

It should be noted that these figures do not include local revenues to municipalities where the transactions occur, nor do they take into account additional regular sales taxes generated from marijuana.

It is surprising that this trend of increased tax and sales revenue has been continuing amid the COVD-19 pandemic, which significantly contributed to an increase in unemployment and forced many businesses to shut down. The cannabis marketplace also grew considerably during this time, despite the fact that marijuana businesses are ineligible for the federal aid that was provided to other industries.

An analysis of new data by the state’s Department of Tax and Fee Administration also found that since 2018, total adult-use cannabis revenue to date for the state of California is $2.8 billion. This amount is inclusive of $1 billion in sales tax, about $348 million in cultivation tax and $1.4 billion in excise tax.

California isn’t the only state recording strong marijuana sales. A scientific analysis of sales data that was recently conducted in Washington State as well as in the states of Oregon, Colorado and Alaska has found that cannabis purchases have grown significantly during the coronavirus pandemic than in the past two years.

In the month of July, more than three states in the country hit new sales records for adult-use marijuana. The state of Missouri also saw record-breaking sales for its medical cannabis program.  In the same month, the state of Illinois saw almost $130 million in recreational marijuana purchases, which is more than double its sales for July 2020. This makes July the fifth month that sales in the state have exceeded $100 million. Illinois may rake in over $1 billion in recreational cannabis sales by the end of the year if the trend continues.

In Maine, July’s recreational cannabis sales were more than $9 million, which is a 45% increase from its June sales record. Data from a regulatory body in the state of Michigan also shows that the state broke its cannabis sales record in July, with more than $170 million in marijuana transactions.
