420 with CNW — Recreational Cannabis Bill Passes First Test in Connecticut

With more than 16 states already allowing the sale and consumption of recreational cannabis within their borders, Connecticut has now taken the first tentative steps towards establishing a legal recreational cannabis market. Last week, the state’s Judiciary Committee approved a bill that would legalize recreational cannabis with a 22 to 16 vote. Backed by Governor Ned Lamont, the legislation would legalize the sale and consumption of adult-use marijuana to individuals aged 21 and over.

In his opening remarks, Judiciary Committee Chairman Steven Stafstrom mentioned that Connecticut has already legalized and regulated drugs such as alcohol and tobacco. He stated that it is time for the state to do the same with cannabis which is “less addictive” and “less harmful” than many of the drugs the state of Connecticut allows. This comes just a month after the Labor and Public Employees Committee approved another cannabis reform proposal introduced by Rep. Robyn Porter.

Individuals aged 21 and older will be able to possess up to five ounces of cannabis at home and one and a half ounces in person, and medical cannabis patients will be allowed to grow their own cannabis at home. The bill has gone through a variety of amendments that added a series of social justice provisions since it was first introduced. According to committee chair Stafstrom, giving communities that were adversely impacted by the failed war on drugs first crack at the recreational cannabis sector has been a top priority for lawmakers working on the bill.

Consequently, 40% of the types of licenses for cannabis businesses will be set aside for businesses that qualify as social equity applicants, individuals whose lives were negatively affected by restrictive cannabis policies. To qualify, these businesses must be 51% owned by a person with a prior cannabis-related conviction, someone who is immediately related to someone with such a conviction, or an individual who lived in a community that was disproportionately affected by cannabis policing within the past 10 years.

People living on tribal land and businesses whose day-to-day management is under someone who meets any of the aforementioned criteria will also qualify for social equity. The bill would task the Department of Consumer Protection with the responsibility of regulating Connecticut’s recreational cannabis market. A state Cannabis Control Commission will develop more guidelines for issuing licenses while a Social Equity Council consisting of 12 members will formulate criteria for social equity, tax revenue allocations and licensing policy.

If the legislation passes, the department could start accepting social equity applications as well as applications from medical cannabis businesses looking to branch into the adult-use market as early as July 1.

As Connecticut makes its first moves toward establishing a legal cannabis marketplace, other states are seeing how beneficial it can be to allow licensed companies such as Gage Growth Corp. (d.b.a. Gage Cannabis) to operate within their borders in a regulated marijuana market. The benefits include job opportunities, taxes and more medical marijuana options.

420 with CNW — Colorado to Raise Money for Disability Fund Through Auction of Cannabis-Themed License Plates

The state of Colorado seems to be embracing its reputation as a cannabis state, with officials of the state working on an auction that will sell marijuana-themed license plates in an attempt to raise money for a disability fund. Between April 1—20, residents in the state will have the chance to place their bids on vanity plates that have terms such as ISIT420, HEMP, GOTWAX, GANJA and BONG engraved on them.

Bids on some of these plates will begin at $420, which most will agree is particularly fitting.

The auctions’ proceeds will go to the Colorado Disability Funding Committee, which provides grants to various organizations that have innovative and new ideas that benefit the disability community.

The plates are bound to be a hit, given the popularity of the state’s cannabis market, which raked in more than $2 billion in sales alone in 2020. In addition to this, data acquired from the Department of Revenue in the state shows that more than $10 billion of cannabis has been sold since the state launched its adult-use program in 2014.

The auction will also be open to individuals who do not reside in the state. If an individual who does not live in Colorado does win, they will receive a novelty plate that will not contain the security features that come on a normal plate. The page setup for every license plate that is up for auction includes a disclaimer to use marijuana responsibly and to not drive while impaired.

The marijuana program in the state is constantly evolving, despite Colorado being among the first states to legalize adult-use marijuana.

For instance, earlier in March, the House approved a legislation that would increase the lawful possession limit for cannabis while the Gov. Jared Polis signed a bill to establish a social equity fund for the cannabis industry.

Polis also visited a cannabis dispensary in Denver where he signed the measure that would create a program in the state’s Office of Economic Development and International Trade whose purpose would be to support marijuana businesses owned by individuals who had qualified as social equity licensees and were mainly individuals who had been the most affected by the war on drugs. The program will receive a $4 million injection from the state’s cannabis tax fund, which is roughly $1 million less than what the governor had requested earlier in January of this year.

Additionally, in 2020, the governor signed a separate legislation that would establish a statewide definition of marijuana social equity licensees. These businesses are the primary beneficiaries of the new bill.

The high level of innovation exhibited by entities such as RYAH Group Inc. has allowed cannabis users, especially medicinal cannabis users, to access a huge array of products, and this has in turn boosted the tax earnings of the states where marijuana is legal.

420 with CNW — How New Cannabis Law in New York Could Impact Medical Marijuana

As March drew to a close, New York Governor Andrew Cuomo signed a bill to legalize recreational marijuana in New York, making it the 15th state alongside the District of Columbia to allow adult-use cannabis. The legislation will allow adults over age 21 to possess up to 24 grams of cannabis concentrate and 3 ounces of cannabis flower; adults will also be allowed to grow up to six cannabis plants at home. Additionally, the bill will automatically expunge prior cannabis offenses that are now considered legal.

Medical cannabis patients in New York will be happy to know that the adult-use bill will also have positive implications for the medical marijuana sector. For starters, it will allow doctors to prescribe cannabis for a lot more medical conditions than current legislation allows. At the moment, state law allows doctors to only prescribe medical cannabis to patients with certain qualifying conditions. According to the state department of health, the new law will allow doctors to prescribe medical cannabis for any medical condition that they feel warrants that kind of treatment.

Additionally, the new bill will also allow medical cannabis patients to grow their own marijuana at home, giving rural patients who have to travel miles to get their medical cannabis a reprieve. Penelope Hamilton Crescibene, for instance, has an autoimmune disease called Sjögren’s syndrome that causes her chronic pain. A rural customer living in Genesee County, she would be forced to travel all the way to Buffalo or Rochester to pick up her medical cannabis prescription, traveling for around two hours every time.

With the new recreational cannabis legislation in place, she can now grow her own cannabis at home. She will now have much more control over the medical cannabis she consumes, including the specific genetics that would benefit her the most and whether or not the cannabis will be grown organically. Allaying fears that increased access to cannabis would lead to overuse, Steuben County Health Commissioner Darlene Smith says that patients who are dealing with chronic pain and disability are more likely to use their cannabis as per their doctor’s instructions to ensure it lasts until their next prescription.

On top of increasing patient access to medical cannabis, the new recreational cannabis bill allows designated caregivers to pick up medical cannabis for patients under age 21, and it abolishes the $50 fee patients were required to pay to obtain a medical cannabis card. Patients will also be able to pick up enough medical cannabis for 60 days at once, up from only 30 days’ worth of cannabis that is presently allowed.

The reforms being made to the cannabis policies at state level in various jurisdictions appear to ease the environment within which companies such as Golden Leaf Holdings Ltd. (CSE: GLH) (OTCQB: GLDFF) attempt to serve the different needs of the populations within those jurisdictions.

420 with CNW — New Poll Finds That 75% of Americans Support Legalization of Marijuana

survey conducted recently by The Hill and HarrisX found that three in four voters in America support either letting individual states decide on policies governing cannabis or legalizing cannabis nationally. The survey interviewed 1,882 voters between March 24 and 26, and shows just how much public opinion has shifted; the majority of Americans now support the end of federal prohibition.

The survey asked the respondents their views on marijuana policy and provided three options to choose from:

  • Marijuana should be illegal everywhere.
  • States should decide on marijuana legalization.
  • The federal government should legalize marijuana.

An estimated 38% of the respondents stated that the federal government should approve the change in marijuana policy while 37% felt that the choice should be left up to the states. The remaining 25% revealed that they would prefer extensively enforcing marijuana prohibition across the country.

The poll demonstrates a roughly even split between federal legalization and letting states enact changes in policy despite the fact that there’s no serious movement to get the federal government to compel states to approve policy changes.

Thus far, legislations that have been introduced in Congress to federally legalize cannabis may not force individual states to legalize cannabis; rather, proposed legislation would remove marijuana from the Controlled Substances Act, which would empower individual states to make their own choices, without interference, while also legitimizing the industries that already exist.

The survey also highlights how voters from different parties view this issue from an ideological perspective, with the results showing that members of the Democratic party are more likely to be in favor of federal legalization while GOP party members prefer state-level decision making. No geographic, racial, age, political or other demographic in the survey demonstrated majority support for keeping marijuana illegal across the board.

Despite this, legislators are pursuing both options of reform this year.

A new wave of enacting new marijuana policies seems to be hitting every state, with the state of New York, under Gov. Andrew Cuomo, having recently signed a bill to legalize marijuana while the legislature in New Mexico advanced a proposal to legalize marijuana in the state to its governor’s desk.

Over in Congress, Senate Majority Leader Chuck Schumer revealed that a bill that would put an end to federal prohibition, which he has drawn up with the help of his colleagues, would be introduced soon.

Another recent survey discovered that two-thirds of voters in Louisiana support cannabis legalization while a separate poll released in March found that New Yorkers support legalization policy that also allowed for deliveries and home cultivation.

Amid the current federal prohibition of cannabis, many companies have found success in states where enabling laws exist. One such company is Grapefruit USA Inc. (OTCQB: GPFT), which operates in California, the largest legal market for marijuana in the United States.

CBDNewsBreaks – Plus Products Inc. (CSE: PLUS) (OTCQX: PLPRF) Releases Q4, FY 2020 Audited Financial Report

Plus Products (CSE: PLUS) (OTCQX: PLPRF), a cannabis and hemp-branded products company in the United States, has released audited financial and operational results for fourth-quarter and fiscal year periods ending Dec. 31, 2020. Financial highlights from the report include an increase in gross profits of 104% in 2020, totaling $5.6 million in 2020 compared to $2.8 million in 2019; cash balance of $11.6 million; an increase in net revenues of 15% from 2019, with 2020 totals reaching $15.9 million; and a 67% improvement in operating costs. The company also noted several key new product launches throughout the year, including the launch of its PLUS CBDReliefbrand; the unveiling of its HI-CUBES brand, which is the highest concentrated cannabis gummy in California;  the launch of its new PLUS SLEEP gummies brand designed to assist consumers to fall asleep; and release of its PLUS Strains gummy product line, featuring three regular options and one holiday option: Lemon Jack (Sativa)Pineapple Express (hybrid) , Granddaddy Purple (Indica) , andSugar Plum (Sativa). The company also noted a significant restructuring designed to improve costs, its launch into the United Kingdom, and its partnership with CannRx Biosciences, a leading Israeli cannabis firm. “Looking forward to the first quarter of 2021, the company does expect net revenues will be negatively impacted by a significant one-time accounting shift in which PLUS will move to recognizing revenue at the time its products are sold to licensed retailers for all sales occurring through the company’s new self-service distributor,” the company reported in the press release. “Previously, the company recognized revenue at the point in which inventory was transferred (sold) to its full-service distribution partners. The shift will result in an effective delay in the time at which all sales of products through the company’s new distributor are recognized relative to sales that occurred to its previous distribution partners.”

420 with CNW — Mexico Cannabis Legalization Bill Passed by Key Senate Committee, Floor Vote Expected This Month

The Justice Committee of the Senate in Mexico has voted to approve the amended cannabis legalization bill as referred to the upper House by the Chamber of Deputies. This approval means that the bill now has to be cleared by two more Senate committees before it is sent to the floor for a final vote. That final floor vote is expected to happen this month.

On Monday, the Justice Committee passed the bill with a 6 to 5 vote; the panel didn’t make any changes to the bill that was sent back to Senate after the lower legislative chamber made changes to the version passed by Senate in December. It is generally expected that the remaining two Senate panels will not make any changes to this current form of the bill either, regardless of the voices of advocates calling for some sections to be revised.

For example, advocates had wanted the proposed law to have a provision ring-fencing a certain percentage of licenses for communities that had been worst hit during the futile drug war. This wasn’t included in the bill sent to Senate. Advocates are also unhappy that people who would like to grow cannabis at home will have to register with the government.

However, the Chamber of Deputies did make some amendments to the bill before passing it. The lower legislative chamber opted to place control of the cannabis industry in the hands of an existing government agency instead of creating a new agency.

The Deputies also passed a change stipulating that land currently occupied by forests would not be allocated for the cultivation of marijuana. Of concern to advocates is the change increasing the penalties for marijuana-related crimes. Campaigners feel that those stringent penalties could undo the social justice benefits of legalizing cannabis.

While there are still some disagreements regarding the contents of the cannabis legalization bill, most lawmakers, such as Senator Eduardo R. Aguilar, who is a member of the party in power, remarked that it was crucial that marijuana is legalized now and any needed changes can be made later once a law is in place.

Aguilar’s position can be looked at from the context of the looming Supreme Court-imposed deadline giving the lawmakers up to the end of this month to pass legislation enabling the recreational use of marijuana. Earlier in 2018, the highest court in the country had declared the prohibition of recreational cannabis use as unconstitutional. Consequently, it tasked the legislators with making the needed policy changes; however, lawmakers kept asking for deadline extensions, and the current extension runs out at the end of this month.

As the legalization wave sweeps through different jurisdictions, cannabis sector players will have to identify a winning formula that will keep them afloat when the competition magnifies. For instance, Pac Roots Cannabis Corp. (CSE: PACR) (OTCQB: PACRF) (FSE: 4XM) thinks its strength lies in leveraging top-notch genetics, and the Canadian company is pursuing that approach.

420 with CNW — Schumer Says Senate Will Loosen Marijuana Policies Regardless of Biden’s Attitude

Although more than 30 states have legalized cannabis in various forms over the past decade, federal law still classifies cannabis as a controlled substance. With the House, Senate and White House in the Democratic Party’s hands, however, federal cannabis legislation has never had a greater chance of becoming law as it does right now. Unfortunately, President Joe Biden is staunchly against allowing adult-use cannabis, although he does support modest cannabis reform, including medical cannabis and expunging records of prior cannabis related offenses.

But according to Senate Majority Leader Chuck Schumer, Biden’s views on the matter won’t hold him back, and consequently, the Senate will move forward with federal marijuana legislation whether or not the president is on board. For a while now, Schumer has been an outspoken advocate of cannabis reform, first introducing a bill to legalize cannabis back in April 2018. Schumer, whose home state New York recently legalized recreational marijuana, has said he supports federal legalization and that he will soon introduce a federal cannabis reform bill with Senators Ron Wyden and Cory Booker.

Even though the White House isn’t behind broad cannabis legalization, Schumer says the Senate will still take aggressive action to loosen the currently restrictive federal laws on cannabis. Although most cannabis reform opponents said legalizing cannabis would lead to all kinds of social ills, including increased drug use and higher crime rates, Schumer says the fears are unfounded. Most states that legalized cannabis in the past decade have seen more positives than negatives from their legal cannabis markets, including increased job opportunities, social justice, and millions of dollars in tax revenue.

State-legal cannabis markets also proved that the American people wanted to legalize cannabis, says Schumer, adding that if a relatively conservative state such as South Dakota votes in favor of legalizing cannabis, then the tides are definitely changing in favor of legalization. With Democrats now in control of the Senate, he can now put a cannabis reform bill on the floor, something that was basically impossible while Senator Mitch McConnell was in charge.

The only holdout is Biden, who has said that although he supports medical cannabis and record expungement, he isn’t behind legalizing adult-use cannabis. According to Schumer, Biden has said he would like to see more information, and the Senate Majority Leader would be happy to make his arguments and try to evolve his stance on cannabis. If the president doesn’t budge, the Senate will still move forward with cannabis reform without his support.

The entire cannabis sector is holding its breath and doing what it can to operate within the existing legal landscape as the journey of reforming those laws plays out. The Alkaline Water Company Inc. (NASDAQ: WTER) (CSE: WTER) is one of the companies that has found success manufacturing CBD-infused products and premium bottled drinking water.

420 with CNW — NYPD Memo Says No Arrests for Adults Smoking Cannabis on Sidewalks

Last week, the New York City police department (“NYPD”) sent out an internal memo clarifying a number of issues after Gov. Andrew Cuomo signed a bill legalizing adult-use marijuana.

Among other things, the memo indicated that individuals who are at least 21 years old will no longer be liable for an arrest once they smoke marijuana in any place where people are allowed to smoke tobacco. Those places include sidewalks as well as other public spaces.

The police department also informed its officers that under the new marijuana law, adults were at liberty to gift cannabis to other adults as long as no payment or other form of compensation are given in return. The NYPD noted that, at the moment, it is still illegal to grow cannabis at home, but once enabling rules are published, no police officer will be at liberty to take any enforcement action unless someone is growing marijuana in ways that flout the home-grow rules, such as exceeding the number of plants permitted by law.

NYPD was unequivocal in its assertion that absolutely no one would be permitted to drive while under the influence of marijuana. However, police officers wouldn’t be allowed to cite the smell of burnt or unburnt marijuana as probable cause for enforcement action, such as searching a vehicle, arresting the driver or issuing a summons.

The NYPD memo goes on to spell out the exception to that rule. The department says enforcement action can justifiably be taken once a driver seems to be impaired and an officer suspects that the marijuana triggering the impairment is within the vehicle. Also, law enforcement officers can act when they observe a driver consuming (smoking) marijuana as they drive a vehicle.

It is also noteworthy that the memo makes reference to the possession of cannabis by minors. The agency clarifies that at the moment, there isn’t a mechanism that the police department can base upon to take action as long as the minor is found with less than the three ounces permitted for adults. In due course, a mechanism will be established to guide how marijuana possession by minors will be treated by the law enforcement community.

Individuals on parole are also mentioned in the internal memo. Officers were advised to desist from approaching or even detaining parolees who are in possession of legally permitted amounts of cannabis unless their parole conditions stipulate otherwise. Even then, the police officers are only required to inform the parole officers about the suspected infraction.

With this internal communication by the police, it looks like changes are coming thick and fast after the enactment of the recreational cannabis law in New York State.

While New Yorkers can now legally use cannabis recreationally, it has been permitted for medical use for several years now. As a matter of fact, many companies, both within and outside the United States, have taken steps to develop drug formulations from this plant. An example is British Columbia-based XPhyto Therapeutics Corp. (CSE: XPHY) (OTCQB: XPHYF) (FSE: 4XT), which is conducting pilot studies to establish the medical efficacy of three drug candidates made from combinations of cannabinoids such as CBD and THC.
