420 with CNW — Vermont Legislators Introduce Bill to Decriminalize Drugs

Legislators in Vermont have introduced legislation that would put an end to criminal penalties on small amounts of illegal drugs. The bill, which was introduced last week, states that the dispensation and possession of small drug amounts would be subject to a referral to a substance-use health and screening service or a fine of up to $50 dollars. The legislation, dubbed H. 422, is sponsored by Reps. Logan Nicoll, Selene Colburn and 12 other legislators. Supporters state that the measure offers a public health approach to overdose deaths and drug use disorders.

In an email to a news outlet, Nicoll stated that the state had led in various ways with the approach to substance misuse prevention and substance use disorder treatment. However, Nicoll continued, too many residents of the state were lost annually to substances, adding that instead of treating drug abusers as patients, the state still treated them as criminals

Last month, another legislation H.309, whose focus is to eliminate criminal penalties imposed on fungi and plant-based substances such as DMT, ibogaine, mescaline and psilocybin, was introduced by Rep. Brian Cina. The measure was referred to the House Judiciary Committee, which has yet to schedule a hearing for the proposal.

In addition to the aforementioned changes, H. 422 would also set up a Drug Use Standards Advisory Board in the Health Department of the state. The board would be charged with setting personal-use supply and personal-use dosage amounts for regulated drugs. Individuals caught in possession of less than the personal use supply would have to pay a civil penalty of $50. Personal use supply is stipulated in the legislation as the amount possessed for consumption by an individual for any recreational, medicinal or therapeutic use.

During the 2020 November elections, the state of Oregon became the first state to eliminate criminal penalties on all drugs after Oregonians approved Measure 110, which had completion of a health assessment on paying a $100 fine for simple possession replace criminal penalties in the state.

While state legislators from other states have considered reforms similar to Oregon’s, to date no legislature has embraced the change in policy. Apart from lawmakers in Vermont, lawmakers in the states of VirginiaWashington State,  MissouriKansasHawaii and Connecticut are also considering various drug and psychedelics policy reform legislation for this year’s session. Additionally, legislators in New York are currently considering a bill to decriminalize psilocin and psilocybin and a separate measure to decriminalize drugs in the state, which were both filed last week.

As lawmakers in Vermont are discussing how to decriminalize cannabis, several other states are reaping the fruits of full marijuana legalization. For example, the success of Gage Growth Corp. (d.b.a. 420 with CNW — Could Cannabis Legalization in Mexico Force a Federal Policy Change in Washington?

Mexico may soon become the biggest legal cannabis market in the world after the country’s Chamber of Deputies approved a legislation last week that would legalize recreational sales of cannabis. The Senate is expected to support the legislation in the days to come.

Mexico president Andrés Manuel López Obrador from the MORENA party strongly supports the bill. The president is expected to sign the legislation in the coming days.

Many speculate that this move may pressure President Joe Biden to federally legalize the plant in the United States as well since the country will be sandwiched between the two largest legal cannabis markets globally: Mexico and Canada.

To put it into context, Mexico has a population of roughly 130 million people. Legalizing marijuana at the national level would make it the biggest country to do so as the other two nations that have done so, Uruguay and Canada, have a 3.4 million and 37.6 million people respectively. Even when combined, however, their populations don’t make up even a third of Mexico’s population.

Director of the Mexico Institute at the Wilson Center Andrew Rudman mentioned that, with many of the U.S. House members representing states with legal marijuana markets, the federal government of the United States may be pressured to legalize or decriminalize the plant or at least, loosen restrictions on it. Earlier in December, the U.S. House approved bills that would do away with past cannabis convictions and end federal penalties for cannabis possession. With Democrats being the majority in the Senate under the Biden administration, the likelihood for cannabis restrictions being loosened has increased. However, some marijuana policy watchers are doubtful that there will be a huge change made with regard to federal policy any time soon.

The president’s stance on the matter doesn’t seem too positive on the federal legalization front either. President Biden has stated that he wants to broaden medical research on cannabis and end criminal penalties but does not support full legalization of cannabis. On the other hand, Vice President Kamala Harris was a sponsor of the Senate version of the legislation that the House approved in the last session.

Despite his stance on full cannabis legalization, President Biden nominated Xavier Becerra, who up until recently was the California Attorney General, to be the Health and Human Services secretary. Becerra is a strong backer of cannabis legalization, and many are hopeful that under his leadership, Health and Human Services could revise its 2015 outlook that stated that cannabis had no medicinal benefits.

420 with CNW — US Firms Gear Up to Enter Legal Mexican Marijuana Market

The wave of cannabis reform sweeping across the world has finally reached Mexico, and some American cannabis operators are already seeing gold. Canada, several states in the United States and some European countries have already legalized cannabis in various forms, and for most legal cannabis markets, cannabis has proven to be an insanely lucrative product. Not only are stakeholders reaping big rewards, but local governments are also receiving millions of dollars in tax revenue from the industry.

Last week, the Chamber of Deputies allowed the sale of cannabis products as well as the possession of small amounts of cannabis. Additionally, individuals would be able to consume cannabis in their homes as long as no minors are present. The legislation, which already has the Senate’s stamp of approval, will head back to the Senate where it will more than likely pass and be published, says Raul Elizalde, CEO of HempMeds.

With the legislation in play, now would be a great time for American, Canadian and international companies to invest in Mexico, he says. The Senate initially passed the law with little changes, he says, and it will essentially legalize the cultivation, harvest, processing, transportation, and sale of cannabis and cannabis products. However, it will take some time before retailers can start selling cannabis to the masses, thanks to an April 30 Supreme Court-imposed deadline.

According to Elizalde, the earliest Mexico will see the legislation’s final guidelines will be March 2022. He concedes that it isn’t a perfect law and it could run into plenty of challenges, especially from companies that don’t agree with the legislation and want it changed to suit their agenda. For instance, end-to-end licenses, which were introduced via an amendment in the lower house, may see pushback from some stakeholders. These licenses would allow companies to handle harvesting, processing, distribution and sales, similar to vertically integrated companies in the United States.

The state-legal cannabis industry in the U.S. is still bogged down by plenty of issues despite its relative success, chief among them being the patchwork of cannabis legislation in different states and municipalities. Fortunately for future cannabis companies in Mexico, only one legislation, rather than several different ones, will govern the country’s cannabis industry.

Elizalde’s confidence in the bill is warranted given the support it has received from President Andres Manuel Lopez Obrador’s party. His company, which is a subsidiary of Medical Marijuana Inc., was the first American company \allowed to import hemp supplements into the country. As the legislature works out the details of the cannabis legislation, the company hopes to gain a foothold in Mexico’s cannabis industry as well.

As Mexico works its way through the cannabis legalization process, companies in mature markets in North America are raising the stakes. For instance, XPhyto Therapeutics Corp. 420 with CNW — Mexico’s Chamber of Deputies Approves Marijuana Legalization Bill

Last week, the majority of the legislators in Mexico voted to legalize cannabis for recreational purposes, despite some of the legislators rejecting the legislation as they had health concerns. The Mexican Chamber of Deputies passed the bill with 23 abstentions, 129 votes of opposition and 316 votes in favor of the bill. This approval is a step forward by legislators to decriminalize cannabis, with senators having approved another version of the legislation in November last year. There were some changes that were made to the bill that senators voted on in this recent session.

Earlier in January, health authorities in Mexico had issued rules to secure pharmaceutical production and medical use of cannabis derivatives.

In last week’s move, lawmakers voted to publish the federal law for the regulation of marijuana, in addition to approving changes to the federal Penal Code and the General Health Law.

The legislation will decriminalize the possession of up to 28 grams of cannabis, with users being required to get a special permit to allow them to grow cannabis plants on their premises as well as a special permit to import, export, transform and research on cannabis. Presently, it is illegal to be in possession of more than five grams of cannabis.

Conadic, which is the National Commission Against Addictions, makes up part of the ministry of health. It will be in charge of the promotion and regulation of cannabis, which isn’t what the Senate had agreed on. Instead, the Senate had agreed to create a Mexican institute for the control and regulation of marijuana.

Additionally, the chamber of Deputies also voted to permit ownership of six plants in each household and eight if there were two consumers. This differs from what the senators had approved in November, which was four plants. The bill will be advanced to the Senate, where the changes will be reviewed before the final law is voted upon. The MORENA Party, which is  the ruling party, is confident that the bill will be approved, arguing that the legislation could help address drug cartels in the country.

For the longest time, the country has waged a war on powerful drug cartels, with thousands of lives being lost each year due to violence. If the new legislation is approved, it will make Mexico one of the biggest regulated markets for marijuana in the world. Additionally, Mexico would become the third country globally to legalize recreational use of marijuana nationwide after Canada and Uruguay.

However, some critics have concerns that the legislation would make cannabis more accessible to children.

There needn’t be a lot of alarm about Mexico’s planned legalization of cannabis as not all companies in jurisdictions with legal marijuana markets make products that make users “high.” For example, California-based Green Hygienics Holdings Inc. 420 with CNW — Colorado May Soon Make Sweeping Changes to Its Marijuana Legalization Laws

Despite being relatively young, the state-legal cannabis industry in the United States has made plenty of strides in just a couple of years. The industry is incredibly lucrative, earning millions in tax revenue at a time when state coffers are running dry, and creating thousands of employment opportunities. These days, the cannabis market has become flooded with high-potency products, with cannabis retailers in the U.S. selling $797 million worth of concentrates in 2020. According to some lawmakers in Colorado, this trend is worrying, especially for the nation’s children.

Back in 2014, Colorado made only 14% of the medical and recreational cannabis in the state, with cannabis flower making up most of the sales. By 2019, however, cannabis flower made up less than 50% of the market while concentrates made up one-third. With high THC concentrates becoming more popular and even more accessible, some lawmakers and political groups are worried about teenagers who have no idea about the long-term impact of frequently indulging in concentrates.

Consequently, lawmakers are currently working on legislation to regulate the state’s cannabis industry more tightly. The legislation, which would be the largest cannabis bill since Colorado allowed recreational cannabis back in 2012, contains several proposals that would put the state’s cannabis industry under a tighter leash. That legislation includes a requirement that people only obtain medical marijuana cards in person to ensure doctors and patients have a relationship, better data collection so the state enforces purchasing limits more strictly and a possible cap on THC potency.

Although supporters say the proposal is meant to protect the state’s children, stakeholders and cannabis advocates say it would regress the industry to a level of “soft prohibition” and increase racial inequality within the cannabis industry. The proposal’s public face, Rep. Yadira Caraveo, is a Democrat who was a pediatrician before entering public service. Over the last few years, she has seen an increased number of teenagers who use cannabis concentrates frequently, she says.

Wanda James, owner of Denver-based Simply Pure Dispensaries, sees it differently. Teenagers using cannabis concentrates more frequently isn’t a business issue but a parenting issue, James says. She is one of the state’s few dozen Black cannabis business operators compared to the nearly 2,000 white operators in the state. 420 with CNW — How CBD Oil Differs from CBD E-Juice

Legalized after decades of prohibition by the 2018 Farm Bill, CBD quickly became one of the most popular products on the market. The hemp extract has potent medicinal properties, making it effective against a wide range of medical conditions. Since CBD does not intoxicate users, plenty of people have been using it to help address a variety of issues, with CBD oil and CBD e-juice (vape juices) being among the most popular means of consumption.

CBD oil was the original method of consumption when CBD became legal, but industry growth coupled with advances in technology led to the popularity of CBD e-liquid. So what is CBD oil and vape juice, and how do the two differ?

CBD oil is the cannabidiol extract that is derived from the hemp plant. Although users can consume CBD in its oil form, usually sublingually or orally, it can also be formulated into tinctures, edibles, and capsules. CBD oil products can be taken orally but cannot be smoked or vaped. CBD oil is usually extracted with food-grade oils such as olive or coconut oil that the body can easily digest and absorb. However, these additives make CBD oil too viscous to be smoked or vaped.

CBD e-juice and vape liquids, on the other hand, are designed for vaping. Unlike CBD oil, which is viscous and does not vaporize easily due to the food-grade oils used during extraction, CBD vape juice comprises CBD oil extract coupled with a thinning agent. Common thinning agents include medium-chain triglyceride (“MCT”) oil, vegetable glycerin (“VG”) and propylene glycol (“PG”), and these agents reduce the CBD oil’s viscosity, allowing the vape juice to heat and vaporize easily. Users have to use specialized vape pens that heat the CBD e-juice until it vaporizes and can be inhaled.

Any form of CBD oil that is taken orally will take a while to kick in as the oil first has to be digested before the body metabolizes the CBD, usually in 30 to 60 minutes. The caveat is that the effects will last anywhere up to 12 hours. CBD e-juices take much less time to kick in because they are inhaled, and consumers can start feeling the effects in as little as 30 seconds. However, the effects only last a maximum of five hours, much less than CBD oil.

Both methods have their pros and cons, but at the end of the day, they both deliver cannabidiol to the system. CBD oil may take longer to kick in, but its effects last much longer. And while CBD vape juice doesn’t stay in the system for as long, it offers quick relief. Individuals thinking about consuming CBD should consult their health-care professional.

420 with CNW — Cannabis Stores Benefit from Consumer Loyalty Programs

Ever heard of loyalty programs? This marketing strategy allows brands to offer special offers, discounts and points to their consumers as a reward for brand loyalty. The strategy is being used by regulated marijuana retailers in Canada as well as in the United States.

Providing these perks to loyal customers comes at a price, but operators of loyalty program assert that the benefits easily outweigh the costs.

Recent data provided by Headset, a cannabis analytics company based in Seattle, demonstrates how loyalty programs influence shopping habits. According to Cooper Ashley, a data analyst from Headset, nearly 50% of marijuana stores in the state of Washington use a loyalty program. Over a three-month period, the average basket spend among retailers who had loyalty schemes was 13% higher than the average spend by customers who did not have loyalty programs. This ends up being almost $38 in additional spending.

Additionally, loyalty program baskets were found to have more commodities per basket with moderately higher commodity prices. Ashley stated that this was a notable advantage to having a loyalty scheme, as consumers tend to have bigger transactions. Ashley also explained that majority of the time, if a store was gathering consumer data, it would be connected with a loyalty program.

Understanding how loyalty programs influence consumer behavior could be used to aim promotions to the most valuable consumers of a store.

Planet 13, a marijuana dispensary which operates in Las Vegas, provides a loyalty member program that is accessible by out-of-state shoppers and also serves residents of the state, offering in-state shoppers extra benefits. All who take part in the loyalty program receive text-message notifications about deals and can accumulate reward points with purchases made.

Planet 13’s VP of sales and marketing noted that residents from Nevada were given a 20% discount off items that are regularly priced while loyalty members were allowed access to the store promotions such as daily deals.

In Canada, a major marijuana retail chain that owns various store brands including Canna Cabana and High Tide operates a loyalty scheme known as Cabana Club. Andy Palalas, the company’s chief revenue officer, stated that the country’s restrictions on using incentives to sell marijuana prevent the company from providing certain loyalty benefits. Despite this, however, other perks, such as giving a 5% discount on items that are regularly priced, are allowed. Palalas asserted that simple discounts helped increase loyalty program sign ups.

Another factor that is likely to impact client behavior is the rapid advances being made within the medical cannabis segment. For instance, RYAH Group Inc. has brought to market devices that leverage technology so that it is possible to precisely control the dosage of medicinal cannabis products such as dry herb, which is inhaled. Such devices are likely to make more patients comfortable taking cannabis medicines, and this will impact product sales.
