420 with CNW – Oklahoma Could Soon Pioneer Marijuana Breathalyzer Use

In the coming months, Oklahoma may be pioneering a pilot program that will greatly influence how driving laws are enforced in regard to cannabis use. The state is currently working on the implementation of a program to conduct marijuana breathalyzer tests which will allow the police to accurately determine who’s driving while high. Last week, Oklahoma’s legislature passed legislation requiring the Department of Public Safety to dedicate $300,000 to pay for the marijuana breathalyzer test kits. The agency will be tasked with coming up with new rules and regulations for the pilot program.

One issue that has stood in the way of legalization is the fact that there is no accurate test to see how much fresh cannabis is in someone’s system, denying law enforcement the ability to weed out who’s driving while high from those who smoked days ago. At the moment, law enforcement can only test for cannabis by testing urine, blood or hair, but unfortunately, cannabis smoked days before will still be present in your system, making it difficult to determine whether or not you are driving stoned.

According to Rep Scott Fetgatter, Oklahoma has a lot of problems when it comes to medical marijuana, DUI laws and determining impairment. There are hardly any roadside tools designed to determine cannabis impairment and if the state’s pilot program is successful, it will be the first state in the country to use cannabis breathalyzer technology. “Right now, we don’t really have a lot of roadside testing options for drug screening. Most of those things are going to fall into a blood test or drug recognition expert doing an evaluation and giving an opinion,” says Joshua Smith, director of the Board of Tests for Alcohol and Drug Influence.

The breathalyzer will test a person’s breath for THC, the cannabinoid responsible creating marijuana’s high, and it will be able to determine whether the cannabis in your system was introduced just a few hours prior. According to Fetgatter, participation should be voluntary and the test results should not be used in a punitive manner.

“It’s kind of a trial program to make sure the system works,” says Rep. Ross Ford, adding that ideally, the state would be able to collect data from the program and then report the findings back to the Legislature. Sarah Stewart, a spokeswoman for the Department of Public Safety, says it could take up to a year to get the pilot program off the ground as the agency does research and comes up with rules and regulations.

Analysts believe the entire cannabis industry, including Sugarmade Inc. (OTCQB: SGMD), will be following events in Oklahoma to see how the trial goes.

420 with CNW – Argentina Legalized and Gives Away Free Medical Marijuana

Cannabis has been prohibited for decades, but in the past few years, attitudes have started shifting. The U.S. has been one of the pioneer countries, with numerous states allowing either recreational use, medical use or both, and generating billions of dollars in sales. Canada hasn’t done so bad either, with the world’s largest cannabis company, Canopy Growth situated in Smith Falls, Ontario. However, one country that seems to have made quite progressive marijuana reforms while staying relatively under the radar is Argentina.

In 2009, the Supreme Court made a landmark ruling, the Arriola decision, declaring that personal use of small amounts of marijuana was legal. It was based on a case involving five people who were arrested for possessing small amounts of cannabis, and the court determined that as long as it is meant for personal use only, cannot affect or hurt anyone else and does not pose any harm or danger, small amounts of cannabis are not illegal. As the court stated, “each adult is free to make lifestyle decisions without the intervention of the state,” and in the meantime, the time and resources that would have been spent on marijuana possession cases goes to more worthwhile causes.

Trafficking of cannabis is still illegal in the country, however, and can attract a prison sentence of 4-15 years. Commercial growing is also illegal for residents.

Medical marijuana, on the other hand, was legalized by a March 2017 bill. The legislation requires patients who want access to medical marijuana to register with the national program, with approved patients, including children, being guaranteed free access. Personal cultivation is still illegal for medical cannabis and it carries a sentence of up to two years.

A section of the medical marijuana legislation mandated the creation of the National Program for the Study and Research of the Medicinal Use of the Cannabis Plant and its By-Products and Non-Conventional treatments. Basically Argentina’s medical marijuana program is intended to provide access to medical cannabis, and the law states that those who require medicine from cannabis can receive it for free. As long as you qualify as a patient, you will have access to free medical cannabis oil. The program is also set up as a research initiative and the free cannabis oil is given as part of the research program.

At the moment, only the most debilitating illnesses qualify one for medical marijuana, but more illnesses may be included as the program expands. Still, the government has made efforts to ensure patients can get medicine whether they have money or not, and other territories should also aim to establish a medical cannabis program aimed at helping their citizens.

420 with CNW – Long Lines as Recreational Pot Shops Reopen in Massachusetts

When governments issued lockdown and social distancing orders to curb the spread of the coronavirus, most states with legal marijuana programs deemed cannabis an essential service, allowing both recreational pot shops and medical marijuana dispensaries to continue operating. In Massachusetts, however, only medical marijuana shops were deemed essential, forcing residents who wanted to indulge in recreational pot during the lockdown to turn elsewhere. With the state slowly reopening, recreational marijuana retailers have been allowed to reopen since they were forced to shut down in March due to the coronavirus pandemic.

With customers now able to order in advance and pick up their purchases outside, some recreational pot shops in Massachusetts have seen some pretty long lines. During the lockdown, medical marijuana establishments were granted extra permissions like online ordering and curbside pickups to keep the staff and customers safe, and they have finally been extended to recreational marijuana shops. In response, customers have showed up in droves, with shops like Solar Therapeutics and Pure Bliss, the first pot shop to open in Boston, seeing dozens of customers lined up on their sidewalks.

“It’s a sort of tricky situation, because we understand the importance of preserving lives, but we also want to be able to provide our customers with the products that they need,” says Pure Oasis co-owner Kevin Hart. The state government had been under a ton of pressure from advocates and stakeholders to allow recreational pot shops to continue operating during the lockdown, with Governor Baker arguing that doing so would attract out of state customers and help facilitate the spread of the virus. However, tons of people who didn’t have prescriptions for medical pot still needed access to marijuana, and according to Chelsea resident Ben Crocker, “a lot of people were going back to the streets to get their self-medication.”

The state’s reopening plan now allows pot shops to open, albeit with some restrictions to reduce the risk of infection for staff and customers. “Our products are in high demand. People need this,” says Hart, with customers waiting as long as two hours to be served by his staff. According to NETA President Amanda Rositano, the restrictions mean her Brookline store will only be able to serve around 500 customers a day, only 20% of the 2,500 customers it serves.

“It’s been tough to stay on our feet but we have gotten by and this is a good chance to be able to reintroduce adult use, albeit in a reduced way.”

Analysts say this reopening of recreational pot shops in Massachusetts is likely to be seen as a long overdue move by industry actors like Plus Products Inc. (CSE: PLUS) (OTCQX: PLPRF) who saw the problems caused by the closure as avoidable ones.

420 with CNW – Jamaica Allows Online Medical Cannabis Purchases as COVID-19 Fight Intensifies

The coronavirus pandemic has shown just how essential the cannabis industry is, with numerous territories allowing medical and recreational pot shops to continue operating during the lockdown and granting them certain permissions to keep transactions between staff and employees smooth and safe. The Jamaican government, for instance, recently announced that it will be allowing medical marijuana patients to make cannabis purchases online for pickup at ‘herb houses’ to maintain social distancing and help combat the spread of the coronavirus.

The interim rule change was made by the country’s Cannabis Licensing Authority [CLA] in coordination with the Ministry of Industry, Commerce, Agriculture and Fisheries and announced last week. They are designed to keep pot shops, or ‘herb houses’ open for businesses while minimizing the public’s exposure to the coronavirus. Under the new rules, patients who have already registered with a cannabis dispensary will be able to order products from the dispensary online and pick them up.

According to regulators, the move is “meant to minimize the length of time spent in such licensed facilities thereby limiting the exposure of staff and patients alike.” Faith Graham, the Cannabis Licensing Authority director of enforcement and monitoring said in a press conference that the agency is “cognizant of the far-reaching effects of the pandemic and remains vigilant and proactive in taking steps to secure the industry.”

Marijuana dispensaries that want to opt in to online ordering will have to submit documents including government issued photo identification and proof of registration in the medical cannabis program to the CLA. They are also required to “submit reports and inventory to the CLA in accordance with the required standards and within stipulated time lines.” In light of the coronavirus pandemic, the CLA has also crafted new but temporary rules regarding cannabis imports and exports.

The change in policy is a reflection of the global legal cannabis landscape. Most territories that deemed cannabis an essential service also allowed online ordering, curbside pickups and in some cases, home deliveries to reduce congestion in the shops and keep both staff, customers and medical marijuana patients safe. A large percentage of medical marijuana patients are advanced in age and have compromised immunities, putting them in greater danger of succumbing to COVID-19.

The new rules will allow these patients to stay safe as they purchase the medicine they need and it will keep herb houses afloat at a time of great financial upheaval.

Experts say such a proactive approach in dealing with the challenges faced by the cannabis industry at this time gives sector players like Round Meadow Holdings Corp. and Champignon Brands Inc.
