420 with CNW – 4 Things to Expect in the California Marijuana Market in 2020

California is the largest marijuana market in the U.S., so it is worthwhile to look forward and see what is in the works for this state’s cannabis industry in the new year. Here are some of the major things that could pan out in 2020.

  1. Courts Hear Marijuana Delivery Lawsuits

When Prop 64 was approved by California voters, local authorities were given the liberty to decide whether to accept or reject marijuana businesses within their jurisdictions.

That promise was put to the test and a row over how much control municipalities and cities have over the marijuana industry came to a head when state regulators insisted that marijuana businesses could deliver weed anywhere within the state while the local authorities say such deliveries should only happen in places that permitted marijuana businesses to set up shop.

In a twist of irony, the Fresno County Superior Court is set to start hearing a case pitting 24 cities against the California Bureau of Cannabis Control on April 20 (the unofficial marijuana holiday). The outcome of this case could either give weed companies some needed respite or hamper their activities even further.

  1. Legislative Changes

On January 1, Senate Bill 34 took effect and licensed businesses can now donate medical marijuana products to patients that are needy and cannot afford them.

More importantly for marijuana businesses, Assembly Bill 37 seeks to allow companies to deduct their operational costs before their tax liability is computed. This is a major piece of legislation because it effectively sweeps aside federal laws that have denied marijuana businesses the same tax benefits that other businesses enjoy.

A legislative change that is likely to rub weed businesses and consumers the wrong way is Assembly Bill 1810. This bill seeks to ban passengers in taxis, limos and other commercial vehicles from consuming marijuana. This means that the idea of weed party buses has gone up in smoke.

Marijuana businesses insist that California needs to make many more legal reforms if the industry is to survive or even thrive given the challenges that it has faced in the first three years of legal recreational cannabis sales.

  1. Expunging Criminal Records

Prop 64 set out a process through which people with marijuana convictions could apply to have their records expunged or charges amended. However, records show that only a tiny fraction of potential beneficiaries has applied for expungement, partly due to the costs and complications of the process.

Assembly Bill 1793 passed in 2018 gave a July 2020 deadline in which local prosecutors have to track down and process the expungement or retroactive downgrading of cannabis convictions. As this deadline looms, thousands are likely to be eligible for housing, employment and other benefits they were denied as a result of their convictions.

  1. Cleaning Up Weedmaps

Weedmaps was started to provide marijuana consumers with information about the places where they could buy weed legally in California. However, state regulators warned the directory about having listings of unlicensed marijuana sellers and Gov. Newsom enacted a law that imposed fines of up to $30,000 for each day that an unlicensed marijuana seller remains operational.

Weedmaps is likely to make good on its promise to remove illicit sellers from its directory and the outcome of this action could reveal how much damage delisting those unlicensed businesses does to the cannabis black market.

It is widely believed that the entire marijuana industry, including companies like No Borders Inc. (OTC: NBDR) and Sugarmade Inc. (OTCQB: SGMD), could be keeping a close eye on events in California since they can reveal what may happen elsewhere over time.

420 with CNW – Alabama Legislative Panel Recommends the Legalization of Medical Marijuana

When a state Senate bill to legalize medical marijuana in Alabama was met with stiff resistance in the state Assembly, a compromise was reached to create a panel to study the matter further and recommend a way forward for the state. That legislative panel voted last week to proceed with legalization in a move that has been lauded by marijuana advocates.

The Medical Cannabis Study Commission is made up of 18 members and 12 of them voted in favor of medical marijuana legalization. Three abstained and the other three members voted against legalization.

The report of the panel indicates that the members of the Commission presented and debated various issues connected to the use of medical marijuana. While some medical research on the therapeutic use of marijuana was inclusive, the members found strong evidence that the substance was helpful to people suffering from a number of health challenges.

In their draft legalization bill, the panel recommends that the state forms an 11-member Alabama Medical Cannabis Commission to license cannabis businesses and track the industry “from seed to sale.”

The panel also recommends that the state supports research into the medical benefits of cannabis and also puts resources towards finding ways to make the legal medical marijuana industry as inclusive as possible.

Sen. Tim Melson (R), a long-time marijuana advocate who was the chair of the study commission, revealed that the Friday vote shows that the draft bill formulated is a well-thought out document that addresses the crucial issues connected to a regulated medical marijuana industry.

Melson is an anesthesiologist and medical researcher who spearheaded the Senate bill that was passed in May last year. He admitted that at one time, he was strongly opposed to the legalization of marijuana for any purpose. However, when he took a rational look at the available research, he changed his mind and became a strong advocate of medical marijuana.

For that reason, he appealed to other legislators to set their biases aside and evaluate the existing literature before forming an opinion on marijuana.

While advocates are happy with the findings of the commission, they are concerned that the draft bill is too restrictive in its current form. For example, it bans smokable forms of marijuana and gives employers the liberty to fire or refuse to hire an employee based on that employee’s use of medical marijuana.

The list of qualifying conditions is also shorter than what is typical in other states where medical marijuana is legal.

Alabama’s legislature will resume business on April 4 and the bill will come up for discussion. Experts believe that marijuana companies like VPR Brands LP (OTCQB: VPRB) and Plus Products Inc. A wave of marijuana legalization has been sweeping across the U.S., and its genesis can be traced to Colorado and Washington approving marijuana legalization initiatives way back in 2012. Marijuana advocates believe there are currently 26 states where voters might have to vote on marijuana initiatives, either for full-scale recreational legalization, legalization of medical cannabis or decriminalization. In 2020, voters will vote on an initiative dubbed ‘Smart & Safe Arizona’ led by a group of Arizona medical cannabis companies. Individuals with prior marijuana convictions could have their records expunged, and some tax revenue from legal sales will be used to invest in communities disproportionately affected by prohibition.

The fight for legalization in Florida started in 2016 when voters approved a constitutional amendment to legalize medical cannabis. An advocacy group called Make It Legal Florida is seeking to push it further. It is working to place a full-scale marijuana legalization measure for the 2020 ballot that would allow adults 21 and over to possess up to 2.5 ounces of cannabis. It is backed by cannabis companies like MedMen and Parallel.

The Idaho Cannabis Coalition is pushing a proposal that would allow approved patients and their caregivers to possess up to four ounces of marijuana, and it would establish a system of licensed and regulated growers, processors, testers and retail dispensaries. The organizers would have to collect 55,057 valid signatures from voters for the measure to qualify for the ballot.

Mississippi activists have already filed a measure for medical cannabis for 2020’s ballot, along with what they say is more than enough signatures for the measure to qualify. If approved, it will allow patients with any of 22 conditions including chronic pain and PTSD to possess up to 2.5 ounces of cannabis per 14-day period.

Missouri voters already approved a medical cannabis measure back in 2018, and activists are looking to expand upon it with broader marijuana legalization. Several proposed measures to end prohibition have been filed with the secretary of state. Still, they lack significant push, and they need groups with enough funding to get them off the ground.

Oklahoma voters approved a medical cannabis ballot last year during a midterm primary election. Activists are now looking to expand the measure with a broader marijuana legalization initiative this year. The effort is backed by the National New Approach PAC, and it will have to collect 178,000 signatures from registered voters to qualify for the ballot. The measure would allow people 21 and over to possess, cultivate and purchase cannabis from licensed retailers.

These six are just a tip of the U.S. states in which ballot measures aimed at reforming cannabis laws are planned. Experts believe that such grassroots changes give the marijuana industry, including entities like HTC Extraction Systems (TSX.V: HTC) (OTCQB: HTPRF) and VIVO Cannabis Inc. (TSX.V: VIVO) (OTCQX: VVCIF), hope that federal reforms could soon happen once most of the country legalizes cannabis in some form.

420 with CNW – Top Italian Court Rules That Growing a Few Marijuana Plants at Home is Legal

Italians have joined the club of countries that allow their residents to grow and use a limited amount of marijuana at home as long as it’s for personal use. The country’s highest court in Rome made the landmark decision long before Christmas, on December 19, but local media only got wind of the news last Friday.

Legislation dating back to the 1990s barred the farming and sale of marijuana, but there has been great uncertainty about the laws due to contradictory court decisions. After being asked to clarify, the Court of Cassation declared that the crime of growing narcotics should exclude “small amounts grown domestically for the exclusive use of the growers.” In a one page statement, the court said that “at home, small scale cultivation activities are to be considered excluded from the application of the penal code.”

Matteo Mantero, a senator from the 5-Star Movement, the governing coalition party, presented an amendment to the 2020 budget calling for the legalization and regulation of domestic cannabis use. Sadly, it was ruled inadmissible by the Senate speaker form Silvio Berlusconi’s conservative Forza Italia party. He says that the Court has opened up the way for cannabis legalization and that it’s “up to us now.”

Leonardo Fiorentini, a representative of the drug policy advocacy group Forum Droghe, says that it’s a ” very important decision because it will shield from prison those who choose to cultivate marijuana for personal use.”

In 2013, a court in Torre Annunziata, a small town in southern Italy, sentenced a man to a year in prison and a $3,365.85 fine for growing two cannabis plants at home. After a series of appeals, different sections of the court system came to different conclusions on allowable scale of marijuana cultivation. In August, the court turned to its highest authority, the Sezioni Unite, which is like the Supreme Court of the country.

It concluded that the rudimentary techniques and small amounts produced in small scale growing makes it irrelevant to the illegal drug trade that the criminal law is intended to address.

There are 6.2 million cannabis users in Italy, most of them aged between 15 and 34, according to the newspaper Corrier della Sera. More men than women consume cannabis in the country. Although it is currently decriminalized for personal use, medical and industrial use is heavily restricted. The country is dotted with special “weed shops” that cater to people who smoke recreationally, as long as the plants maintain a THC level of below 0.6 percent.
