420 with CNW – Mexican Senate to Start Debating Cannabis Legalization This Week

The Senate in Mexico is set to start debating the legalization of marijuana this week, according to information from the leader of the Morena Party.

Different Senate committees will consider the different proposals before them before a bill is put together, possibly by the end of October.

Jesusa Rodriguez Martinez, a Senator belonging to the Morena Party, revealed that there are thirteen legalization proposals before the upper chamber of the Mexico legislature. These proposals will all be discussed during open committee sessions.

During those sessions, members of the public and other stakeholders will be invited to share their views on those proposals.

Early this year, the Supreme Court of Mexico made a landmark ruling that it was unconstitutional for the government to prohibit the recreational use of marijuana by adults. That latest ruling was the fifth such ruling, and under Mexican law, once the Supreme Court makes five similar rulings on a matter, then all other courts are obliged to rule in the same way if a similar matter is brought before them.

It should be remembered that the Supreme Court also gave the government a deadline within which the appropriate law should be drafted and passed. The clock is ticking on that deadline so the lawmakers have to act fast to avoid missing the court-imposed deadline.

During a summit held at the Senate to kick start discussions on marijuana legalization, a former U.S. narcotics official, Gil Kerlikowske, addressed the summit. He urged the lawmakers to pass what he called “robust regulation” to keep minors from accessing recreational cannabis.

He referred to research that suggests that marijuana can be harmful to the developing brains of young people. Strict regulation is required to prevent such harm, he argued.

He also added that there should be strict rules governing the production, packaging and marketing of recreational marijuana once it becomes legal. Kerlikowske also recommended that the country taxes recreational marijuana and the tax revenue should be directed towards marijuana law enforcement efforts, drug prevention and rehabilitation of those suffering from drug use disorders.

In an indirect criticism of the U.S. states that have legalized recreational marijuana, Kerlikowske said that they had all failed to stamp out the black market and yet eliminating the black market is vital to controlling recreational marijuana in any jurisdiction.

It remains to be seen what form the Mexican legalization law will take. Analysts think industry actors like Therma Bright Inc. (TSX.V: THRM) (OTC: THRBF) and TransCanna Holdings Inc. (CSE: TCAN) (FRA: TH8) are confident that the Mexicans have done their research and will pass a law that is good for all stakeholders, such as law enforcement and consumers.

420 with CNW – Congress to Vote on Marijuana Banking Bill This Month

A bipartisan bill that was drafted to protect the banks that accept marijuana businesses as clients will be put before the whole House for a vote this month, according to the office of the Majority Leader.

This decision was announced during a closed-door meeting of the Democratic Party lawmakers held on Thursday. The exact date hasn’t been agreed upon, but it will be this month.

Some lawmakers who attended that closed-door meeting revealed that there was a suggestion that the bill be voted upon after suspending the rules of procedure. If this were to happen, at least two-thirds of the lawmakers have to vote in favor of the bill if it is to pass.

The SAFE Banking Act currently has 206 cosponsors, which means that the advocates of this bill still have some work to convince more members to come on board so that the option of voting under suspended rules can result in success.

The suspension process also doesn’t allow lawmakers to make any changes to the law being considered, and this could be a potential flashpoint since it is possible that some legislators want to include other provisions, such as protecting banks that do business with hemp companies, before the bill is passed.

It isn’t entirely far-fetched to consider the possibility that a completely new bill may be tabled for a vote. This option is likely in case the lawmakers talked to those who are opposed to the SAFE Banking Act and new terms were agreed upon and included in the new version. This could explain why the idea of voting under suspended rules arises.

The SAFE Banking Act had been expected to receive a floor vote before the House went on recess in August, but this didn’t happen.

Meanwhile, the Senate Banking Committee is also getting set to vote on a marijuana banking bill. No date has been set, but committee chair Mike Crapo (R-ID) said on Thursday that a panel is getting the bill ready.

This announcement may have forced the hand of the Democrats in Congress since they have been unwilling to let the Republicans in Senate advance the marijuana law before the Democrats do anything along the same lines.

The Democrats have positioned themselves as the champions of marijuana law reform, so it is crucial, at least for perception purposes, for the bill in Congress to be voted upon before the Republican-dominated Senate considers a similar bill.

Regardless of the motives behind the timing of the House vote, analysts believe different members of the marijuana industry, such as The Green Organic Dutchman Holdings Ltd. (TSX: TGOD) (OTCQX: TGODF) and The Supreme Cannabis Company Inc. (TSX.V: FIRE) (OTCQX: SPRWF), will welcome this crucial legislation since it will make it easier for the industry to thrive.

420 with CNW – Medical Marijuana Prices in Michigan Rise as Recreational Sales Near

The cost of cannabis flower in Michigan has risen by about 50 percent from the time medical marijuana became available in the state nearly ten months ago.

In August, the wholesale price of an ounce reached $249, the highest it has ever been from the time the regulated market was opened.

This increase in the price of marijuana flower comes as the supply is declining. This decline started in April and the numbers have been dropping to the lowest point in August.

The price hike comes despite the fact that while marijuana from caregivers is still dominating the market, the licensed cultivators have been getting a bigger share of the market. For example, the licensed growers only contributed 3 percent of the cannabis flower sold on the medical marijuana market in February. However, this proportion grew to 36 percent in August.

The regulatory agency released a statement in August showing that it was tracking the sales data in order to see how the licensed growers are progressing in addressing the supply needs of the market.

Some of the licensed growers say that they aren’t to blame for the price increases because the state government has continued to license provisioning centers at a pace that isn’t in tandem with the rate at which new growers are licensed. Consequently, there are many provisioning centers competing for the same supply of marijuana flower.

While there are 96 licensed medical marijuana cultivators to meet the demand of the 127 provisioning centers, it takes at least six months for a cultivator to grow their first crop and bring it onto the market.

State regulators made the decision not to prosecute licensed growers who buy medical marijuana products, such as cannabis flower, from the registered caregivers. Products from caregivers have been part of the regulated medical marijuana market from the very beginning, and many are of the view that this arrangement should continue.

Marijuana advocacy organizations, such as NORML, say that the licensed cultivators are still unable to meet the demand for products for both the medical and the recreational markets. These advocates therefore suggest that caregivers should continue supplying the market beyond 2020 as the regulators monitor the supply situation.

The regulators say that they are holding off making a decision on whether caregivers can be permitted to supply the recreational market with marijuana products. This decision will be made in November.

However, the data from other markets suggests that there is likely to be a decline in the number of patients using medical marijuana once the recreational market opens. Industry experts wonder what suggestions experienced industry players like Sproutly Canada Inc. (CSE: SPR) (OTCQB: SRUTF) (FRA: 38G) and Sugarmade Inc. The ballot initiative that AG Ashley Moody has turned her guns on is sponsored by a group called Sensible Florida. That initiative seeks to legalize recreational cannabis for adults who are at least 21 years old.

Michael Minardi, the chairperson of Sensible Florida, says that the bulk of this constitutional amendment seeks to establish a framework through which the recreational marijuana industry would be regulated.

According to Minardi, the initiative is for Floridians, Florida businesses and for giving power over the cannabis plant back to the people of Florida.

AG Moody doesn’t seem to see things in the same way, and she argues that the 75-word summary of the initiative cannot allow Florida voters to understand fully what the campaigners are proposing.

To drive her point home, Moody took a picture of the amendment as it was dangling from the ceiling to the floor, and she put a caption to the effect that the amendment was longer than the first article of the state constitution. This picture was posted on Twitter by the AG.

To put this amendment in context, the other two initiatives are shorter than the one by Sensible Florida. In fact, one amendment is just a paragraph long while the second one covers two pages. This makes the Sensible Florida amendment tower above these two since it is ten pages long.

That notwithstanding, Minardi says that the strength of their amendment lies in its length. He says that the document clearly spells out all the details of what voters will be called upon to approve, and this removes the possibility that the state lawmakers will implement anything else other than what the voters will have supported.

This argument by Minardi seems to hold water, as the drama surrounding Brexit in the UK shows the folly of approving a general plan without the necessary accompanying details. Successive prime ministers have struggled to build consensus on how the UK should leave the EU, and the millions across the nation are beginning to question whether what the politicians are feuding over is really what they voted for.

Sensible Florida has vowed to take the AG on once the Supreme Court starts considering the language of their proposed amendment. It would be interesting to hear what cannabis companies like Plus Products Inc. (CSE: PLUS) (OTCQB: PLPRF) and SinglePoint Inc. (OTCQB: SING) have to say about this unexpected point of contention between the attorney general and Sensible Florida’s proposed amendment.
