The use of marijuana, whether for medicinal or recreational purposes, has grown rapidly within the United States during the past few years. This growth is said to be due to the wave of legalizations that has swept through several states as well as the changing public attitudes towards this controversial plant. The growing use of marijuana has presented a huge challenge to both law enforcement agencies and employers as they work to detect and prevent cannabis impairment on the roads and at workplaces.

Many have looked to breathalyzers to provide a way to quickly identify someone who is acting under the influence of cannabis. Breathalyzers are familiar technology, and they are easy to use in the field. However, there is currently no verifiable way to link the presence of THC metabolites in the body to a degree of impairment.

This challenge stems from two key factors. First, THC can remain detectable in someone’s body several weeks after they consume marijuana, so a positive test for THC isn’t reliable evidence that a person is impaired. Secondly, different people respond differently when they use marijuana, so having a certain concentration of marijuana in the blood (or whatever sample has been analyzed) isn’t proof beyond reasonable doubt that an individual is impaired.

A new impairment test looks set to settle this debate on how to assess cannabis impairment once and for all. The artificial intelligence (AI)- and VR (virtual reality)-based device is focused on measuring actual impairment rather than on detecting how much THC is present in an individual’s blood, saliva or other biological sample.

The Gaize Cannabis Impairment Test, developed by Gaize AI, seeks to provide video evidence to confirm or rule out marijuana impairment. The person being tested wears a VR headset and performs half a dozen tasks as sensors on the headset monitor the eye movements of the test subject. The logic behind this test is that every substance has a different effect on the eye movements of a person. The tests require approximately five minutes, with an additional two minutes needed to crunch the numbers and provide the results of the impairment test.

Ken Fichtler, founder and CEO of the company, says that his system is up to 90% accurate in detecting impairment, and the machine learning tech it runs on can allow the system to improve its degree of accuracy. He thinks that once the device is widely deployed, the hurdle of getting marijuana federally legalized could be reduced since one of the current challenges in the way of legalization is the difficulty of measuring impairment.

The handy device can also be used to test employees just before their shifts begin, so there is a lot of potential for the usability of this impairment test. These more precise testing methods could enjoy the support of the marijuana industry and its actors such as American Cannabis Partners because the accuracy tests would eliminate the possibility of people being unfairly victimized for using recreational or medical marijuana several days or even months before they were tested.

420 with CNW — NIH to Fund Studies Exploring Marijuana’s Role in Cancer Treatment

The National Institutes of Health (NIH) has published a notice calling on interested researchers to apply for funding to facilitate studies related to the role cannabis can play in various aspects of cancer treatment. In that notice, the federal agency revealed that one out of every four patients with cancer report using marijuana products in order to manage the symptoms they experience. These symptoms include pain, nausea and anorexia. However, NIH points out that despite these reasons for using marijuana, there is scant research about its efficacy and any potential risks that the cancer patients may be exposing themselves to.

The funding is therefore intended to promote studies geared at understanding the different mechanisms through which cannabinoids and cannabis in general influence cancer biology, interception and treatment as well as cancer resistance. Studies looking into oncology symptom management also qualify for the federal funding.

The notice also delves into an overview of existing studies exploring marijuana’s relationship with cancer. According to the NIH, the present epidemiological studies on cancer and marijuana haven’t yielded consistent or definitive findings. For instance, some studies suggest that smoking marijuana exposes an individual to harmful compounds, but no study has so far been able to demonstrate a link between smoking marijuana and increased cases of lung cancer.

The National Institutes of Health also provides eight areas of interest that qualify for funding by the federal agency. These include how ethnicity or sex disparities manifest when cannabinoids and marijuana are being used to treat cancer or manage the symptoms triggered by cancer treatment; developing relevant study models through which a better understanding of the role of marijuana in cancer treatment can be attained; and defining the exact effects that marijuana/cannabinoids have on the treatment of cancer, among other study areas.

There is a rider stipulating that the list of eight items isn’t exhaustive and that scientists looking into any other aspect of marijuana in the treatment of cancer can apply, especially those planning to make use of expertise drawn from diverse disciplines and those making use of highly rated study models that are relevant to humans.

Despite the federal government’s insistence that marijuana remains classified under Schedule 1 of the CSA, many federal agencies are intensifying their efforts in supporting research aimed at documenting the therapeutic effects and possible side effects of marijuana. Such federally funded studies could go a long way toward gathering evidence that can be used to push for a reclassification or even legalization of cannabis, at least for medicinal purposes.

420 with CNW — IRS Official Discusses Cannabis Sector’s Current Financial Challenges

The U.S. IRS Taxpayer Advocate, an agency under the Internal Revenue Service (IRS), has published a blog post in which the agency discusses the tax obligations that marijuana companies have and the efforts which are being taken at the Congressional level to resolve some of those challenges.

The blog post pointed out that, although companies in the cannabis industry are expected to meet their federal tax obligations, the firms aren’t at liberty to deduct many of the expenses that firms in other industries normally deduct when determining their tax obligations. This disparity stems from the fact that under federal law, marijuana is a controlled substance that cannot be bought or sold legally, so businesses engaged in cannabis business can’t claim tax deductions on an illegal activity.

Erin Collins, the National Tax Advocate (NTA) who penned the post, wasn’t committal about any changes to policy that needed to be made. However, she did acknowledge that Congress was making efforts to enact marijuana legalization or at the very least offer protections to banks that opt to do business with marijuana companies at state level.

The reason for posting this article, according to the author, was to highlight some of the increasing frustrations that a notable and growing category of taxpayers, including marijuana growers, processors, distributors as well as retailers, face. Educating these taxpayers was also a focus of the post.

The NTA wrote that tax code 280E is unequivocal in precluding businesses that “traffic marijuana” from taking advantage of many tax deductions enjoyed by other businesses that the federal government regards as legal. Because of this provision, Collins says that businesses in the marijuana industry end up meeting their tax obligations from their gross earnings rather than from their net income as would ordinarily be the case.

Another challenge facing the cannabis industry is the limited number of IRS locations that can receive cash payments. Businesses not only have to arrange to transport such large sums of cash, but they also have to move long distances in order to access the specific IRS sites capable of accepting large cash payments to clear tax obligations.

As a result of the high tax rate and the limitations on what business expenses can be deducted, it is significantly harder for a marijuana business to reach break-even point in its operations, the post says. The article also mentions that since marijuana isn’t federally recognized as a medicine, people can’t deduct medical marijuana costs as they file their annual tax returns.

420 with CNW — Thai Government to Distribute Marijuana Plants for Home Cultivation

The government in Thailand has announced that it plans to distribute one million free marijuana plants in June as it marks the commencement of a new law permitting the cultivation of marijuana at home. This announcement was made by the nation’s health minister.

Anutin Charnvirakul, Thailand’s health minister, took to Facebook to make his announcement on May 8, 2022. He said that the government wants marijuana to be grown like any other household crop.

The rule he referred to is expected to take effect on June 9, 2022. This new legislation paves the ground for individuals to notify the authorities in their locality about their need to start growing cannabis at home. The plants must meet the quality requirements for medicinal marijuana, and the person growing those plants should use them exclusively for therapeutic purposes and not for commerce. Those interested in growing marijuana for sale can apply for additional permits from the authorities.

The soon-to-be implemented law marks another step in Thailand’s journey to promote the cultivation of marijuana like any other cash crop. The World Bank estimates that approximately 33% of the population in the country is employed within the agriculture sector, so adding marijuana to the list of crops farmers can grow would be a boon for the sector.

It should be noted that the broader southeast Asian region is famous for its stringent laws against illicit drugs, such as marijuana. However, Thailand broke ranks and legalized medicinal marijuana back in 2018. The country has also eased its other laws related to cannabis in general.

For example, cannabidiol and hemp in general were legalized for use as food and cosmetics ingredients. As a result there has been a proliferation of companies marketing cosmetics and beverages containing these ingredients.

In another post made two days after his post announcing the free marijuana plants, Anutin also mentioned that locally registered companies that had the appropriate paperwork were free to begin selling marijuana products as long as the THC content didn’t exceed 0.2%. THC is the compound that gets cannabis users “high.”

Anutin added that marijuana commerce will make it possible for the country to earn at least 10bn baht ($288 million) annually from this industry.

Kitty Chopaka, a marijuana entrepreneur based in Bangkok, indicated that in her view, this upcoming legislation is intended to make medical cannabis part of the healthcare system in the country. According to her, one must have a prescription allowing the use of medicinal marijuana in order to be permitted to grow cannabis at home.  She further indicated that while recreational adult-use cannabis isn’t legal, people are bound to smoke the substance and the government won’t be able to prevent that from happening.
