Agriculture Secretary Tom Vilsack noted that the program “will help get local and regional agricultural products into schools, food banks and other nutritional assistance programs, and organizations that reach underserved communities. It also advances our efforts to ensure that historically underserved populations gain equal access to USDA resources through a combination of grants, loans, pilot programs, technical assistance, cooperative agreements, and more.”

420 with CNW — Bankers’ Groups from All 50 States Urge Senate to Enact Cannabis Banking Reform

Last week, a group of banking associations from all 50 United States wrote a letter to the U.S. Senate urging the legislative body to include cannabis banking language in the final text of a manufacturing bill for which a bicameral conference is being organized.

The American Bankers’ Association (ABA) as well as associations from every state in the United States says that the SAFE Banking Act is needed urgently and has wide support from both sides of the legislative aisle. The group added that this law is needed to handle the financial transactions that so many entities, such as real estate companies, law firms, members of the skilled trades and so many others rely on in their day-to-day transactions with marijuana companies.

The groups representing banks said that cannabis firms are forced to operate mostly on a cash basis and this was creating concerns about public safety as well as making the work of regulators, tax collection agencies and security agencies harder due to the lack of a verifiable trail of the finances flowing through the marijuana industry. The letter mentions that currently, 37 states allow marijuana in some form and many other states are in the process of reforming their policies and legalizing marijuana. It is therefore vital that banking reform is included in the COMPETES Act so that the existing challenges of public safety and regulation are addressed.

Advocates are hopeful that the legislators selected as conferees will push for the cannabis banking language to be included in the manufacturing bill. These hopes are buoyed by the inclusion of conferees who support the marijuana banking bill. They include Rep. Earl Blumenauer from Oregon, Senator Patty Murray from Washington State and Maxine Waters from California.

The spike in burglaries and robberies in different states, including Washington, has made the voices for cannabis banking reform even louder. Officials in Washington State organized an online roundtable to discuss the security threats facing cannabis businesses, and they even explored different measures that they can take to promote cannabis banking as they wait for Congress to act on this urgent matter.

It is noteworthy that reports coming from FinCEN, a federal agency fighting financial crimes, indicate that the end of 2021 saw an increase in the number of financial institutions working with marijuana businesses. It isn’t clear whether that uptick was due to the anticipation that Congress would pass a law enabling cannabis banking federally or the fact that banks are now less fearful about possible penalties from federal regulators.

One thing is clear — there will be a collective sigh of relief from the entire cannabis sector, including entities such as American Cannabis Partners, once a bill is signed into law allowing federally chartered banks to work with marijuana companies in states with legal cannabis markets.

420 with CNW — Researchers Draw Attention to Widening State-Federal Cannabis Policy Differences

In a new report released shortly after the U.S. House of Representatives passed a bill legalizing cannabis at the federal level, congressional researchers revealed that the gap between the marijuana policies at state level and those at the federal level was wide — and it was getting wider with each passing year.

The analysis by the Congressional Research Service (“CSR”) was 101 pages long and covered several aspects connected to the marijuana industry in the country. For example, the document points out how the policy schism has affected cannabis banking. The researchers say that because of the federal classification of marijuana as a Schedule 1 controlled substance, banks are hesitant to accept cannabis businesses, so many of those companies are compelled to accept only cash and use that cash in all their activities and operations. Because of this, marijuana companies face security risks that businesses in other sectors don’t face; it is also hard for tax collection agencies to track all the finances of marijuana firms.

The researchers also say that the contradiction between state and federal marijuana policies has created challenges for some people to find or retain certain jobs, federal housing or even education support.

Cannabis research is also discussed in the report. The CRS says that the federal classification of marijuana continues to make marijuana research burdensome, and as a result, it isn’t easy to obtain reliable scientific data on the risks or benefits of the marijuana products that members of the public are consuming.

However, the analysis recognizes that some measures are being taken to address the challenges of conducting cannabis research. For instance, the report points out the ending of Mississippi University’s monopoly of producing research-grade marijuana and the draft laws being considered to allow researchers to use cannabis sourced from dispensaries in states where marijuana is legal.

The report goes on to mention the four options available to Congress with regard to the widening gap between marijuana laws at the state and federal level: Congress can choose to be inactive, authorize the strict implementation of federal marijuana laws, enact modest adjustments allowing states to have robust marijuana markets or pass a policy ending federal marijuana prohibition.

The CRS says additional options exist, such as changing the classification of marijuana to a less strict category, which would avail banking services to the industry and free law enforcement of the oversight role; the report notes that these options should be considered.

To cannabis advocates, the most obvious option would be to end prohibition federally so that the policies at the federal level are in alignment with the wishes of the public as shown by the rate at which different states are opening marijuana markets either through legislative means or through voter initiatives.

Once federal laws are reformed to legalize marijuana, we could see existing state-level players such as Flora Growth Corp. (NASDAQ: FLGC) establishing a national footprint while also expanding internationally.
