420 with CNW — 10 Senators Urge Feds to Grant Cannabis Firms Access to SBA Loans

America’s state legal cannabis industry has been dubbed one of the fastest-growing industries in the country, but its federal classification has been a constant hindrance. While more than 30 states allow either medical or recreational cannabis, the federal government still classifies marijuana as a Schedule I controlled substance. Consequently, banks and financial institutions do not transact with businesses in the cannabis space, and, in many cases, they won’t even work with businesses that are indirectly connected to cannabis.

In the wake of the coronavirus pandemic and the resultant financial crisis, a group of senators has urged the federal government to grant cannabis firms access to financial aid. In a letter sent to the Appropriations Committee leaders, 10 senators have asked that language allowing cannabis firms to access financial aid via the federal Small Business Administration (SBA) be added to a soon-to-be unveiled spending bill document. This would see businesses in the cannabis space finally access SBA loans as well as disaster assistance as the country and world at large recovers from the worst financial downturn in a century.

Federal relief would help alleviate the impacts of the coronavirus pandemic, the senators wrote. Led by Sen. Jacky Rosen, the group was comprised of Senators Bernie Sanders, Cory Booker, Jeff Merkley, Maria Cantwell, Ed Markey, Ron Wyden, Bob Menendez, Alex Padilla and Raphael Warnock. The group sent the letter to the heads of the Appropriations Financial Services and General Government (“FSGG”) and the Senate Appropriations Committee asking that the federal aid language to be appended within the FSGG spending bill document for the fiscal year 2022.

The letter also requested that state legal cannabis businesses be allowed access to the Loan Guarantee, Microloan, Disaster Assistance and the 504/Certified Development Company Loan Programs. The SBA currently excludes businesses that are directly or indirectly involved with the cultivation, production and sale of cannabis products, the letter says, and this places undue and unfair pressures on small enterprises operating in states with legal cannabis markets.

Additionally, the letter mentions that banks do not transact with cannabis businesses because they fear repercussions from the federal government. As such, these cannabis operations mostly operate on a cash-only basis, which puts them at a high risk of robberies and burglaries. Additionally, the coronavirus can survive for quite a while on paper money, putting workers in the cannabis space as well as their clientele at risk of infection.

It would be good for the entire marijuana industry, including sector players such as Chalice Brands Inc. Such a gesture would mean that the state-legal marijuana industry was being accorded equal treatment with other industries.

With at least 40 states allowing the cultivation and sale of either medical or recreational cannabis, the sector is larger than ever. Growing legal cannabis is now accessible to many, but it comes with plenty of of environmental considerations.

Cannabis can be a pretty resource intensive plant, and illegal grows are known to demand a ton of water and electricity, so it is important for growers to ensure their operations are green and produce minimal waste. While this won’t come cheap, especially if you’re growing on a larger scale, ecological production, methods will result in a higher quality yield while conserving the land and water systems you rely on.

Power is a crucial resource when you’re growing cannabis because plants rely on light and dark cycles to flower and produce cannabinoids and terpenes. However, giving them all the light they need for months can consume plenty of energy. LEC (aka ceramic metal halide) lighting will provide a spectrum of light that’s as close to the sun as possible without placing a major strain on the grid.

Additionally, you will require a cooling system to control the temperatures. The best option would be water-chilled climate systems, which can manage the temperature and reuse waste energy, feeding back up to 10% additional energy. On top of that, a water-chilled system will switch to outside air when temperatures dip below 45 degrees, saving 60–70% in energy costs.

Water is another important component for anyone wanting to grow cannabis. Managing waste effectively will also be essential. Such a system will keep out chlorine, sediment and other toxic wastes from the water supply and ensure that the wastewater only contains organic matter and can be reused.

Ever heard of aeroponics? Well, if you haven’t, it is the process of growing plants in a mist or air environment without using soil. Instead of using soil, the roots dangle in the air and are sprayed with solutions laden with nutrients needed for growth, using specially designed devices. Aeroponic systems utilize soilless growing mediums, liquid nutrients and water to efficiently and quickly grow nutritious produce.

To grow plants using this system, seeds are placed in pieces of foam, which are placed into tiny pots. The pots are then exposed to mist that’s filled with nutrients on one end and light on the other. The system uses foam as it holds the roots and stem in place as the plant grows.

Research has found that not using a growing medium, such as soil, is actually good for plants, as their roots are exposed to extra oxygen, which prompts even faster growth. Aeroponic systems have also been found to be extremely water-efficient because they use roughly 90% less water than plants that are irrigated in soil.

This is in addition to being an eco-friendly way to grow large quantities of food in tiny spaces, through the use of towers and other vertical approaches.

So, what can you grow using aeroponic systems?

Similar to hydroponic systems, these systems are mainly used to grow cucumbers, tomatoes, strawberries, cannabis, culinary herbs and leafy greens. You can also grow root crops using aeroponic systems, which isn’t possible in a hydroponic system, as the roots won’t have a lot of room to grow and will be harder to access when harvesting.

However, the systems do have some disadvantages. These include:

  • Relying on electricity to pump water through the devices used for misting. This can, however, be remedied through the use of solar power and other alternative sources of energy in order to reduce the energy consumption of the cultivation process.
  • Skill required for effective operation. Ensuring that your crops receive the right amount of nutrients may be a bit of a challenge, as even a slight deviation from the parameters stipulated may lead to their loss. Skill is therefore required to use this method.
  • Quality professional systems that are equipped with a backup power supply and automated nutrient monitoring go for four figures or more. It should be noted that DIY models can be built for as little as $100 or even less.

420 with CNW — Federal Economic Committee Recommends Marijuana Reclassification as Industry Continues to Grow

Last week, the White House Office of Management and Budget published a proposal in the federal register in which it provided policy recommendations for next year’s North American Industry Classification System (“NAICS”), which is utilized in the compilation of data on markets across Canada, Mexico and the United States, as well as in the classification of businesses.

In a series of recommendations, the federal economic committee stated that the cannabis industry would keep growing, noting that steps needed to be taken to make certain that the growth was tracked under a system that would allow analysts to publish statistical data and follow the markets. The recommendations include a suggestion to categorize marijuana retailers under a new category where they would be grouped with smoking, e-cigarette and tobacco shops. The committee also suggested that marijuana wholesalers and CBD agriculture and hemp firms be classified into different categories as well.

These moves show that the federal economic panel is recognizing the cannabis sector’s growing legitimacy and is working to make it easier for economists to conduct research on the space, similar to other business categories.

The U.S. Economic Classification Policy Committee, which is made up of the Bureau of Labor Statistics, the Bureau of Economic Analysis, the Census Bureau and the Office of Management and Budget, considered prior public comments that had called for the committee to restructure the North American Industry Classification System, with reference to marijuana retailers. Among the comments was one that proposed that vape shops and cannabis retailers be split in terms of their classification.

In response to this comment, the committee stated that there was sufficient evidence proposing that the retail market for recreational and medical cannabis, e-liquids, e-cigarettes and related accessories would continue its growth, even with increasing regulations at both the state and federal levels. The committee further explained that as both cannabis and vape shops mainly engaged in the retail of smokers’ supplies, the committee would establish a new industry that would combine Industry 453991 with cannabis stores and e-cigarette shops, which are currently categorized under Industry 453998 by NAICS.

Apart from this, the Economic Classification Policy Committee also recommended that the wholesaling and agricultural categories under NAIC be updated to include hemp and marijuana as matching index entries.  The committee then advised that CBD index entries be added to the following categories under NAICS: 459999, 424690 and 325998. The panel is also planning to alter the North American Product Classification System to take CBD into account.

The observations of the committee regarding the growth of the CBD and marijuana industries are  solid, given the rate at which innovations, such as the medicinal cannabinoid formulations undergoing trials by companies such as XPhyto Therapeutics Corp. 420 with CNW — White House Asks for Comments on How Underserved Communities Face Barriers Due to Drug Policies

Despite starting with relatively noble intentions, the drug war is considered an unmitigated failure by many. Not only did it fail to sufficiently curb drug use or suppress the criminal enterprises behind the drug trade, but it also ensured that certain communities were intensely policed and harshly sentenced for decades. Now that America’s state-legal cannabis sector is steadily growing, some policies from the drug war era that have endured may be creating “systemic barriers” for these communities.

As such, the White House, via its drug policy arm, has opened a 30-day comment period in a bid to see whether existing drug policies have barred underserved communities from accessing opportunities and whether policymakers can create programs to help ensure equity. Additionally, the Office of National Drug Control Policy (“ONDCP”) is also seeking counsel from drug users to see how it could better involve them when creating policies that ultimately impact them. The ONDCP published the notice in the Federal Register, and the notice is bound to attract plenty of attention from drug reform advocates.

The ONDCP was founded in the 1980s, with help from President Joe Biden who was a senator at the time. Over the years, the agency has been quite resistant to drug reform such as cannabis legislation, and advocates have often questioned whether the office is even necessary. The notice for feedback on how drug policies may affect equity wasn’t issued independently by the agency;  rather, it is part of a governmentwide executive order signed by President Biden in January.

Specifically, the executive order requires agencies to determine whether their programs and policies provide systemic barriers for underserved communities and people of color and bars these individuals from accessing opportunities and benefits, the ONDCP says. Via a series of prompts, the agency states that it is looking for more perspectives from people of wide-ranging backgrounds, especially those who were disproportionately impacted by America’s drug policies to help guide its efforts in the future. The White House’s drug policy arm is currently in charge of the High-Intensity Drug Trafficking Areas Program, which enables the war on drugs, and sufficient feedback could help the office tailor its policies and reduce the intense policing and harsh sentencing that communities of color face.

The agency is also interested in receiving feedback from “people who use drugs,” especially those who are usually left out of household surveys, to aid in the process of developing national drug control policy. Individuals who would like to provide feedback to the ONDCP can do so at OGC@ondcp.eop.gov until Aug. 6, 2021.

As more states across the country legalize and decriminalize marijuana for medical and recreational use, the burgeoning industry continues to grow. Cannabis oils have low THC amounts and can be used to relieve nausea and anxiety, as well as alleviate pain, without inducing any psychoactive reactions.
