420 with CNW — Iowa Legislators Pass Bill Slashing Fees Paid by Medical Cannabis Patients

Thanks to a new bill advancing in the Iowa Senate, Iowans may soon be paying only $10 every year in medical cannabis license fees instead of the $100 a year they currently pay. The bill will also allow the licensing of more medical cannabis dispensaries beyond the five currently allowed by law as well as the creation of mobile dispensaries to cater to the state’s medical marijuana patients. Additionally, Senate Bill 1177 will allow medical cannabis dispensaries to recommend physicians who can prescribe medical cannabis to patients, something current law prohibits.

However, a subcommittee of the Senate noted that lawmakers will have to make changes to the fees and other sections of this bill to ensure the medical cannabis program receives enough revenue to cover state administration as well as testing. The Department of Public Health together with the University of Iowa, which runs the State Hygienic Laboratory, have said via representatives that without any changes, cutting medical cannabis card fees from $100 a year down to $10 every two years will leave them with insufficient revenue to run the program.

On top of drastically reducing medical cannabis card fees, the bill will also cut the fees incurred by medical cannabis manufacturers down to $2,000 annually. It will instead create income tax deductions for business-related expenses linked to manufacturing medical cannabis. According to Dane Schumann, from the medical cannabis manufacturer and dispenser MedPharm Iowa, state manufacturers have so far paid in excess of half a million dollars’ worth of fees to Iowa’s Department of Public Health ever since the program was launched, with dispensaries paying a similar sum.

Generally, manufacturers as well as dispensaries pay hefty fees to the state health department, Schumann says, even though state operators such as MedPharm need to keep overhead costs manageable to make sure that the program keeps running. Last year, medical cannabis sales totaled around $5 million, which is an increase from the $2.2 million recorded the year before. At current sales levels, a 6% tax would produce $210,000 annually.

Senator Joe Bolkcom, who supports the bill, notes that lawmakers initially intended for the program to be self-sustaining when they created it. At the moment, the state Department of Health receives between $600,000 and $700,000 each year to run the medical cannabis program, and lawmakers wouldn’t wish to eat into other segments of its operations to meet the cost of the program, he says. So while the $100 a year fee for medical cannabis cards was too high, he believes the proposed $10 paid after every two years is too low to afford the program’s running costs.

Meanwhile, many companies have realized that a significant number of consumers are interested in cannabis products containing THC, the psychoactive compound responsible for the “high” users experience. For example, Grapefruit USA Inc. (OTCQB: GPFT) is planning to nationally distribute its patented Hourglass Topical Cream made from hemp.

420 with CNW — Utah Introduces New Bills to Improve Medical Marijuana Program

Two bills in Utah’s state legislature may bring change to the state’s medical marijuana program. Since the state’s voters passed a bill approving medical marijuana in 2018, the medical program has slowly started progressing. However, it has faced various challenges, which legislators have tried addressing through legislations.

One of the legislations follows 2019 research conducted by FOX 13, which discovered that patients who qualify to use medical cannabis find it hard to find doctors who will prescribe it. This has caused many individuals frustration and also allowed the development of specialized medical marijuana clinics, which charge unreasonably high prices because they are permitted to issue cards.

Senate Minority Whip Luz Escamilla, who’s sponsoring the SB 170 bill, stated that there’s a limited number of dispensaries in the state, adding that some physicians in those dispensaries had been charging $600 for an appointment, which became a concern because it would limit the number of people who could access this service.

Rep. Ray Ward and Escamilla have introduced a legislation that would permit more health-care providers to recommend marijuana for up to 15 qualifying patients. After this, the providers would have to go through licensing and specialized training through the state. Ward had recently told the Senate Health and Human Services Committee that the bill had been formulated to get physicians to be more comfortable with recommending marijuana.

Utah Patients Coalition’s executive director Desiree Hennessy stated that she had spoken to primary care physicians who admitted to not wanting to recommend marijuana because they only had a small number of patients who were interested in medical marijuana. The coalition is a medical marijuana advocacy group.

At the start of the year, the state’s law on medical marijuana changed, which eliminated the use of affirmative defense letters that allowed patients to avoid a cannabis possession charge while they waited to be issued with a state medical marijuana card. The new law states that all patients must go through the state’s Department of Health in order to be issued with a card. This, together with the issue of doctors not wanting to go through training to recommend marijuana, led to the creation of a new issue.

Many hope that the SB 170 bill will fix this issue.

At the moment, the state of Utah has permitted 14 dispensaries to operate but only seven are up and running. Senate Majority Leader Evan Vickers stated that these dispensaries, including the ones in Cedar City and St. George, had been given a June 1, 2021, ultimatum that would require them to be running by that time.

In other news, The Alkaline Water Company Inc. (NASDAQ: WTER) (CSE: WTER) has been causing a stir with its line of A88CBD(TM) products, which makes it easy for consumers to add high-quality CBD products into their wellness routines.

CannAssist International Corp. (CNSC) Focused on Leveraging Position in Growing Cannabis Industry through Strategic Marketing Plan

  • Vast opportunities exist in growing cannabis space
  • CannAssist is committed to establishing aggressive marketing presence in promising market
  • CannAssist brings impressive advancements, achievements to the table, including its propriety CiBiDinol technology

Carefully developing and executing a strategic go-to-market plan has never been more important for companies operating in the cannabis industry, according to a recent “Rolling Stone” article (https://cnw.fm/uMoi5). The article urges cannabis companies to consider the industry from both a competitive perspective as well as an opportunity angle, which is exactly what CannAssist International (OTCQB: CNSC) has done as it looks toward 2021 and a projected $5.8 million share of the market.

“The 2020 election was another exciting turning point: Four new states joined the 12 existing markets with legal recreational cannabis, bringing adult use to 15 regions in just eight short years,” the “Rolling Stone” article reported. “Nearly one in three Americans now live in a state where those aged 21 and older can purchase and possess cannabis freely. This will likely expand significantly with the addition of more East Coast markets poised to legalize in the near future through legislation in New York, Pennsylvania and Connecticut.

“It gets even better,” the article continued. “With a new federal administration comes the likelihood of a mandate to decriminalize cannabis and a path to legalization through bills in Congress such as the passing of the MORE Act by the House of Representatives, with its lead sponsor Vice President Kamala Harris. Consumer sentiment favoring legalization is expanding. According to findings from Pew Research from 2019, two-thirds of Americans approve of adult-use in what has become one of those rare bipartisan issues with differences of opinion occurring predominantly along generational lines.”

CannAssist recognizes the wave of opportunity flooding the cannabis market and is committed to establishing an aggressive marketing presence using tactics across the entire marketing funnel plan as part of its go-to-market strategy (https://cnw.fm/cDw0H). In part, the company will focus on retail partnership, brand collaborations and influencer programming. In addition, CannAssist is eyeing large-scale video and content capture and will also evaluate avenues for digital advertising, email marketing, and both paid and organic social media engagement.

These efforts are designed to support the company’s efforts to reach its goals in five key product areas: Xceptol Capsules M($1 million), Xceptol Drops ($532,000), Xceptol Pain Cream ($1.27 million), Xceptol Pet product ($130,000), and raw material from its Xceptor Labs ($1.48 million). CannAssist owns Xceptor Labs, which produces and markets the Xceptol brand product line and also produces superior quality raw materials for third-party company use.

A biotechnological pharmaceutical and wellness company, CannAssist brings impressive advancements and achievements to the table—none more notable than its development of CiBiDinol, which simply put is cannabidiol made water compatible (https://cnw.fm/JGyB1). CiBiDinol addresses critical issues regarding CBD molecules, including delivery, bioavailability and short shelf life, by offering predictable potency, reduced dosage requirements and a wider variety of product forms.

Established in May 2017, CannAssist is headquartered in San Diego County, California, and markets its consumer line of cannabidiol (“CBD”) products under the Xceptol brand. CNSC is currently targeting North America, Central America, South America, South Africa, the EU, the UK and the Philippines as viable product markets. The company has established strategic partnerships in sourcing, manufacturing, processing, laboratory, distribution, public relations and legal representation.

420 with CNW — Senate Leaders Have First Meeting to Discuss Cannabis Legalization Plan

The past few years have seen several states legalize recreational or medical cannabis. By 2020, more than 30 states allowed cannabis in various forms, and there was hope that eventually the wave of cannabis reform would reach the federal level. Toward the end of the year, the U.S. House of Representatives passed a cannabis decriminalization bill that would definitely have stalled in the then Republican-controlled Senate. However, the Democrats clinched both the House and Senate majority, renewing the hope that one day, cannabis would be legal at the federal level.

In late January, Senate Majority leader Chuck Schumer hosted a meeting with marijuana stakeholders, beginning the long journey toward finally legalizing cannabis at the federal level. The Democrat was joined by Senate Finance Committee Chair Ron Wyden and Senator Cory Booker, as well as representatives from advocacy groups and the fledgling cannabis industry. The guests included staffers from Drug Policy Alliance (“DPA”) and Students for Sensible Drug Policy as well as other organizations with ties to the Marijuana Justice Coalition, according to sources who attended the hour-long meeting.

In a joint statement released before the meeting took place, the trio of senators, who are at the forefront of cannabis reform, said they would release draft legislation in the coming weeks to help paint a picture of what federal legalization would look like. They stated that the war on drugs and marijuana policing, in particular, had failed, and they called for a change in federal policy that would focus on repairing the harms of the decades’ long war on drugs.

Topics that were discussed during the meeting include the regulatory structure for cannabis, tax policy and social equity. Attendees say one issue the senators were especially committed to was a Senate bill that at minimum would deschedule cannabis and replace current anti-cannabis legislation with a justice and equity-focused policy. Although the senators didn’t go into much detail about what the cannabis bill would eventually look like, they signaled that they would incorporate the feedback they received during the meeting and from other sources.

Amber Littlejohn, executive director at the Minority Cannabis Association (“MCBA”), says the meeting between the senators, advocates and industry stakeholders was historic, especially since Schumer, Booker and Wyden want to make equity and justice the foundation of the legislation. Queen Adesuyi, policy manager of national affairs for the Drug Policy Alliance, also praised the senators’ efforts, saying that seeing “such a dynamic trifecta of leadership” working on delivering justice to communities that were most affected by the war on drugs is exciting.

Booker is expected to be the legislation’s lead sponsor once proposed legislation is filed, after which the bill would likely be referred to Wyden’s committee.

Next door in Canada, cannabis was legalized years back, opening up plenty opportunities for companies to seize. An example of that is the way Pac Roots Cannabis Corp. (CSE: PACR) (OTCQB: PACRF) opted to leverage high-end cannabis genetics as well as the best-in-class cultivars in order to produce cannabis products of premium quality.

420 with CNW — Legislators in South Dakota Remain Hopeful about Cannabis Legalization

A circuit judge’s decision to hinder a voter-approved initiative that legalized adult-use cannabis from progressing in South Dakota isn’t discouraging legislators from advancing with a series of marijuana related measures. While many doubt that cannabis prohibition will end soon in South Dakota after Judge Christina Klinger overturned Constitutional Amendment A, some lawmakers are working on legalizing cannabis through the statutes of the state.

Before heading into a strategy meeting with other legislators and lobbyists, Senator Brock Greenfield told reporters that legalizing was still a real possibility and that planning ahead for any situation was the best option.

Defendants legally challenging the judge’s decision to strike down Constitutional Amendment A are expected to appeal the decision to the state’s Supreme Court. Greenfield asserted that if the judge’s decision wasn’t revoked after the appeal, he would expect that South Dakotans for Better Marijuana Laws, which was responsible for placing the initiative on the voters’ ballot, would try to legalize cannabis again.

However, several legislators argue that trying to legalize cannabis again through the legislative way may give rise to better results. Senator Arthur Rusch stated that among the many flaws of the initiative was that it gave all its rule-making powers to the state’s Department of Revenue, which many lawmakers were not on board with.

Rusch said that if the Supreme Court decided to uphold the circuit judge’s ruling, then the state’s best option for legalizing cannabis would be to assemble all stakeholders and try to negotiate and draft a policy that would encompass the voters will but refrain from conflicting with other regulations in the state’s constitution. Rausch, who is  a former attorney and judge, stated that Amendment A contained some flaws, noting that advocates would be better off if they collaborated with advocacy groups that were working on cannabis, partnering together to draft a measure that was satisfactory to everyone.

The deadline for filing new measures for the legislative session in the state has already passed. However, Greenfield has come up with a vehicle bill that can be used to carry any cannabis-related bills that are yet to be recorded by the Legislative Research Council by the now expired deadline. The vehicle bill could, for instance, allow Constitutional Amendment A’s language to be added into Greenfield’s bill collectively before being proposed formally to his colleagues for consideration.

The good news is that Measure 26, which legalized medical cannabis in the state, has not been affected by the ruling and is set to go into effect on July 1, 2021.

Meanwhile, lots of benefits are accruing from the legalization of cannabis in other states around the country. For example, Green Hygienics Holdings Inc. (OTCQB: GRYN) has taken major strides towards distinguishing itself as a leader with regard to its capabilities within the highly competitive supply chain of cannabinoids.

Closing Soon: Fast Flower Farms SPV Investment Opportunity

Fast Flower Farms & The Artisanal Cannabis Connoisseur

While cannabis companies have recently raised hundreds of millions in an attempt to bring ‘craft cannabis’ to scale, many consumers prefer cannabis that is cultivated by craft growers rather than large corporations. Enter artisanal cannabis products.

Artisanal Products

Artisanal products create value via limited production, emphasis on quality, and creation by industry connoisseurs. Artisan flower is grown in small batches and is manicured by hand, unlike commercial flower which is done with machines. Artisanal production combined with superior genetics that have limited market availability increases consumer demand and builds brand loyalty.

Solventless ‘Live’ Extracts

Solventless extraction is a process of extraction that uses cold water and agitation to separate the medicinal part of the plant, trichomes, from the leafy green material. This methodology keeps cannabinoids and terpenes intact and has emerged as the preferred extraction trend for high-end consumers, over the use harsh solvents. Another step up the quality ladder is using the solventless extraction process is to create a ‘live’ extract. This involves freezing freshly harvested flowers, eliminating terpene, cannabinoid and trichome degradation caused by the oxidation process of drying. The extracts from this process are considered the ‘holy grail’ of extracts.

Michigan

Michigan has quickly emerged as a powerhouse for cannabis companies, ranking #2 in the nation for medical cannabis patients – behind only California. Its average basket size is a whopping 30% greater than California’s at $84.58 vs. $64.13, a number even more striking when one looks at average annual household income – $56,697 in Michigan, compared to $101,493 in California.

Fast Flower Farms

Fast Flower Farms, a company based in Bay City, MI, boasts years of cannabis experience and a deep genetic library.  Specializing in artisanal flower and ‘live’ solventless extracts, Fast Flower Farms is poised to appeal to the high margin artisanal cannabis connoisseur.

Investors can now participate in Fast Flower Farm’s journey, starting at $5,000, via MAZAKALI’s SPV in the company.  This SPV has already been funded and will close in one week, on February 23rd, 2021.

420 with CNW — South Dakota Circuit Judge Nullifies Cannabis Legalization Measure

A South Dakota circuit judge has rejected an amendment that was approved by voters in the state during the November polls, ruling it as unconstitutional. The judge, who had been appointed by South Dakota Gov. Kristi L. Noem, stated that the change, which would end cannabis prohibition in the state, should not proceed.

Judge Christina Klinger supported her ruling by stating that Constitutional Amendment A violated the state’s constitution as it conflicted with the constitution’s language, in addition to defying single subject rule.

Pennington County Sheriff Kein Thom and the South Dakota Highway Patrol Superintendent Rick Miller, as well as attorneys for the case’s plaintiffs, argued in January that Constitutional Amendment A ought to be viewed as a revision instead of an amendment because it did not modify an existing clause in the state’s constitution but added a completely new section to the constitution of the state.

Klinger, however, stated that a failure to present Constitutional Amendment A through the proper process as cited in the constitution not only had no effect but also nullified the amendment.

Amendment A, which was approved by voters in the November 2020 election, would have legalized all forms of cannabis in addition to legalizing the growing, sale and licensing of cannabis in the state. The measure was approved with a margin of 8% and was to go into effect on July 1 this year.

Noem, who opposed the ballot initiative, ordered that the legal fees for the role Miller played in challenging the measure be paid for by the state.

Many expect that the decision will be appealed to the South Dakota Supreme Court.

The Attorney General’s office chief of staff Tim Bormann stated that the office, which was charged constitutionally with defending any ballot initiatives that were approved by voters in court, was currently reviewing the judge’s decision but declined to give any further commentary, adding that the office was treating this as an ongoing case.

The group that had placed the initiative on the voters’ ballot, Representing South Dakotans for Better Marijuana Laws, also gave its opinion on the judge’s decision. Brendan Johnson, who represents the group, stated that it disagreed with the judge’s ruling and would be appealing to the state’s Supreme Court.

Noem applauded the court’s ruling, stating that she expected an appeal on the judge’s ruling to have similar results. In a statement sent to a news outlet, she noted that the decision made by the judge protected and safeguarded the South Dakota state constitution, adding that she was confident that the state’s Supreme Court would came to a similar conclusion.

While South Dakota is still working to legalize cannabis, plenty of companies are thriving in jurisdictions with legal marijuana markets. For instance, Pure Extracts Technologies Corp. (CSE: PULL) (OTC: PRXTF) based in Canada has a vertical engaged in white labelling because its reputation commands customer interest, especially for edibles and oils.
