420 with CNW – White House Completes Reviewing FDA’s Cannabis Research Guidelines

Back in December 2018, Congress passed a bill legalizing the cultivation and sale of industrial hemp and its derivatives. CBD or cannabidiol is one of the chemicals produced by the cannabis plant, and research has found it to be effective against a wide range of medical conditions. An industry quickly grew to cater to the rising demand for CBD and by the time tons of companies were marketing and selling CBD products, the industry was still barely regulated.

For more than a year, advocates, stakeholders, and lawmakers have urged the U.S. Food and Drug Administration (“FDA”) to create a comprehensive regulatory structure and rein in the rogue elements in the industry. In May, the FDA authored a proposal plan titled Cannabis and Cannabis-derived Compounds: Quality Considerations for Clinical Research and sent it to the Office of Management and Budget. The White House recently completed its review of the proposal, according to a report by InsideHealthPolicy.

Although very few details about the proposal have been made public, an FDA spokesman previously said that it is related to the agency’s ongoing work to develop broader CBD regulations that could eventually allow for the marketing of cannabis products as dietary supplements or food items. “We recognize that there is substantial public interest in marketing and accessing CBD in a variety of products. We are working toward the goal of providing additional progress. There are many questions to explore regarding the science, safety, effectiveness, and quality of products containing CBD, and we need to do our due diligence.”

According to a recent statement from an FDA representative, the agency “cannot provide an update of when or even if this guidance will issue” despite the review being finalized. However, they stated that it would be announced via the Federal Register should it move to publication. This comes only days after the FDA released a spending bill that includes a provision providing “funding to develop a framework for regulating CBD products.” It also includes provisions to protect medical legalization laws from federal interference, provide marijuana businesses access to banking services, to expand cannabis research, and to oversee the country’s nascent hemp and CBD industries.

The FDA has in the past said that it has several specific questions it wants to be answered before deciding whether CBD can be lawfully marketed. This includes questions about the impact of different methods of consumption and drug interaction. The agency has consequently asked for public input on the safety and efficacy of CBD in a comment period that will be open indefinitely.

420 with CNW – Kansas City Council Decriminalizes Marijuana Possession

For the past three or so decades, the federal government has punished individuals charged with marijuana possession quite harshly. Ever since the ‘War on Drugs’ began, certain communities have been unfairly stereotyped, targeted and punished for marijuana offenses. Although people of all races are likely to purchase and consume cannabis, people of color are much more likely to be arrested and prosecuted compared to other races. Proponents for marijuana legalization have argued that decriminalizing marijuana will go a long way in righting these wrongs.

Last week, the Kansas City Council in Missouri passed an ordinance ending all penalties for marijuana possession under local laws. The cannabis measure was filed by Mayor Quinton Lucas and four local lawmakers last month and the vote to approve it was 9-4. The measure repealed a provision of the Code of Ordinances which stipulates that possession of 35 grams or less of marijuana carries a $25 fine and more than 35 grams carries a $500 fine.

Mayor Lucas who had previously said he was planning on pursuing other efforts to remove other ‘minor drug offenses from our code’, announced on social media that the City Council had passed Ordinance #200455 to remove marijuana from the City Code of Ordinances. “The city doesn’t need to be in the marijuana policing business, and we remain focused on helping open doors to new opportunities and empowering people to make a decent living,” he said in celebration of the development.

Although the text of the ordinance does not change Missouri state law that criminalizes cannabis for non-medical use, it describes the racial disparity in marijuana possession arrests and states that the Council “believes future resources should be focused on the prevention, investigation, and prosecution of violent crime in Kansas City.” This comes a few months after Mayor Lucas announced that he would pardon decades’ worth of municipal marijuana offenses, a move he stated was “fundamentally a question of fairness.”

He argued that society had grown more lenient towards marijuana in recent years, and people with old convictions shouldn’t be held to harsher punishments than are being doled out now. The goal, he said, was to give those with old convictions a second chance. “When you look at the sources of public safety challenges in our community, it’s not those who are using recreational or small amounts of marijuana, and what I want to be able to do for these folks is to say, “You might have made a mistake at some point, but that we’re going to be fair in how we apply, frankly, the law in Kansas City and Missouri.”

The coronavirus pandemic has had a devastating effect on the economy. In early March, most states issued lockdown orders to curb the spread of the novel coronavirus, and this involved all but the most essential businesses to shut down. This has led to Great Depression-era levels of unemployment, and most industries, especially the travel and service industries, have a long road of recovery ahead of them. However, one industry that seems to have weathered the storm fairly well for the past few months is cannabis.

Most states that legalized marijuana declared the industry essential and pot dispensaries have been operational during the lockdown. Illinois’ first cannabis stores opened in January and in June, marijuana retailers saw their busiest month ever. According to data released on Tuesday, recreational cannabis sales in June shattered existing records, with retailers selling 994,545 cannabis items and bringing in more than $47.6 million in total sales. In-state residents brought in $35.3 million while out of state visitors brought in $12.4 million.

On the first day of legal cannabis sales, customers bought more than $3.1 million worth of products but the following months, especially March and April, were quite slow. However, things picked up in May, and cannabis retailers in the state enjoyed record sales, followed by record-breaking sales in June. Since Illinois launched its cannabis program in January, it has consistently brought in tens of millions of dollars in tax revenue from cannabis sales. State policy dictates that 35% of that money goes to the state’s general fund, 25% to aid communities disproportionately affected by the war on drugs, 20% to substance use treatment and mental health programs, and 10% towards the state’s bill backlog.

Oregon has also enjoyed record cannabis sales despite the coronavirus pandemic, beginning with a spike in sales during the weeks leading up to lockdown in March. The state then saw record-high sales in April, especially on April 20, the unofficial holiday for cannabis lovers. However, analysts predict the boom in sales will continue but taper off as the economic downturn caused by the coronavirus crisis finally takes hold. “Expectations are that some of these increases are due to temporary factors like the one-time household recovery rebates, expanded unemployment insurance benefits, and the shelter in place style policies,” said Oregon’s office of Economic Analysis in a May report.

“As the impact of these programs fades in the months ahead, and bars and restaurants reopen to a larger degree, marijuana sales are expected to mellow.”

420 with CNW – Study Finds Marijuana Legalization in Colorado Reduced Crime in Neighboring States

For years, law enforcement and opponents of marijuana prohibition have argued that legalizing the controversial plant could lead to a surge in crime in neighborhoods hosting retail marijuana stores and spill over into neighboring states that still prohibit it. There have even been a few studies showing that this is indeed true, but according to researchers going through county-level crime data in municipalities neighboring two states which legalized marijuana, these studies may have been skewed. Ultimately, they found scant evidence that legalizing marijuana increased crime rates.

The research was conducted by Guangzhen Wu of the University of Utah, Francis D. Boateng of the University of Mississippi and Thomas Roney, an economic and statistical consultant based in Texas. The study, published in the Journal of Drug Issues looked at before and after crime data in Washington and Colorado, the first two states to pass adult-use cannabis laws in 2012, seeking to find out how neighboring states were affected after the passage of adult-use cannabis laws. After studying data on crimes such as robbery, aggravated assault, burglary, larceny, and motor vehicle theft, the researchers found that legalizing cannabis may have actually reduced certain major crimes in nearby jurisdictions.

“We did not detect any increases in the rates of multiple types of crimes in border counties of the non-legalized states bordering Colorado and Washington,” wrote the authors of the study. “Moreover, we observed a substantial reduction in certain types of crimes, namely property crime, larceny, and simple assault, in border counties in the Colorado region. This finding challenges the argument made by the opponents of legalization that marijuana legalization would increase crime.”

Existing research proving that legalizing marijuana increases crime rates is skewed and doesn’t account for all variables, the researchers say. Due to federal prohibition, banking institutions avoid working with the cannabis industry, forcing retail marijuana stores to operate on a cash-only basis. “As scholars have reasoned, the criminogenic effect of recreational marijuana dispensaries is largely attributable to the fact that marijuana sale is a cash-and-carry business, which exposes both the business and customers to criminal victimization,” says the study.

The researchers argue that decriminalization reduces crime instead, stating in the study that it shrinks “the underground marijuana market that is believed to be fertile soil for violent crime.” In fact, the data from Colorado suggested a ‘crime reducing effect’ of recreational marijuana legalization in Colorado on neighboring states. They concluded that recreational marijuana legalization in a state may not bring about negative consequences on crime in neighboring states, which challenges the assertions made by public officials in these neighboring states arguing a crime-inducing effect of legalization.

420 with CNW – California Plans to Issue Marijuana Organic Certification to Boost Profits

Federal prohibition has been a thorn in cannabis’ side for a long time. And even as tens of states move to legalize recreational and medical marijuana, it remains illegal at the federal level and this has held the industry back in many ways. For instance, state-legal cannabis cannot be considered ‘organic’, a title bestowed by the U.S. Department of Agriculture, even if the growers maintained the purported ‘organic’ standards while growing the crop. However, regulators in California, the largest legal cannabis market in the world, have unveiled proposed regulations for a program that would equal the federally bestowed ‘organic’ status.

Draft regulation for the OCal Program, a statewide certification program, was released in early May, with a public comment period open until July 7. According to the California Department of Food and Agriculture (“CDFA”), the program “will ensure that cannabis products bearing the OCal seal have been certified to consistent, uniform standards comparable to the National Organic Program.” The CDFA is required to have established the certification program for cannabis by January 1, 2021.

Growers who meet a certain set of rules, including proper use of the approved fertilizers and pesticides, will be able to apply the OCal seal to their crop, and brands looking to stand out will be able to charge their health-conscious customers a premium for OCal-certified products. California will join Washington state as the only two state-legal cannabis markets to consider an organic certification for marijuana products, and being the largest legal cannabis market in the nation, it could set a precedent for other states.

According to Kristin Nevedal, Chair and Founder of the International Cannabis Farmers Association, the state-based program will “probably instill more confidence.” Consumers are willing to spend a premium for products deemed ‘organic’, she says. “It’s recognizable, and the branding opportunities are readily apparent.” She adds that some cannabis companies have already been using the consumer appetite for organically grown cannabis and have started labeling their products ‘clean and green.’

Sarah Armstrong, policy chair for the Southern California Coalition, the largest cannabis trade association in the region, hopes the program will be cost-effective enough to be well-received by the industry. “Our hope is that the proposed program will be cost-effective enough that the cannabis industry can fully participate. Right now, testing expenses represent 10% of the cost of product production, resulting in an exceptionally pure product at no small expense. 420 with CNW – Feds Hire Hazmat Company for Cannabis Eradication Training

The U.S. Forest Service has in the past come under fire for its handling of illegal marijuana cultivation sites. Most of the unregulated growers use dangerous chemicals that pollute nearby waterways and in some cases, they clear entire sections of natural forest to plant their crop. The Forest Service has been accused of not always reclaiming and rehabilitating the grow sites after the marijuana has been eradicated, and for reportedly exposing employees to the harmful chemicals at the sites without proper protection.

In response to these concerns, the agency has announced that it will hire a hazardous materials consulting firm to train employees on how to safely remove marijuana grown on public lands under a newly awarded government contract. According to a document filed in support of the contract and posted last week to the U.S. General Services Administration Website, a large number of Forest Service agents and officers fell ill at public lands, “requiring trips to the emergency room with possible long term health effects.”

Agents with the Forest Service’s South Pacific Southwest Region will now be trained by NES, a leading hazardous materials consultant and training company that has worked extensively with law enforcement, and they will have to pass a hazmat class before they can take part in a cannabis clearing operation. The document states that the NES program “is the only training course in the U.S. available that meets our needs, and has met OSHA standards.” The program will cost taxpayers an estimated $44,732, and there will be no bidding process or consideration of competing firms.

In April 2018, the U.S. Department of Agriculture’s Inspector General stated that the Forest Service doesn’t always reclaim and rehabilitate illicit marijuana grow sites after clearing the crop and as a result, “trash and chemicals such as pesticides and fertilizers are still present in these grow sites, thereby putting the public, wildlife, and environment at risk of contamination.” Marijuana legalization advocates have said for years that legalizing the plant will go a long way in reducing and eventually eliminating the environmental and health threats posed by the chemical contaminants used at illegal marijuana grow sites.

“It’s no surprise that those who elect to clandestinely cultivate cannabis on federal lands engage in practices that provide greater potential risks both to the environment and the end product itself,” says Paul Armentano, Deputy Director advocacy group NORML. “By contrast, a legal market provides regulatory oversight and demands that those engaged in these activities be licensed and utilize best practices. While legalization itself will likely not entirely eliminate the illicit market, just as, for instance, border alcohol legalization has not eliminated moon-shining in its entirety, the reality is that it will continue to severely curtail thee activities and the involvement of criminal entrepreneurs.”

The step taken to train federal agents in the best ways to eliminate illegal marijuana grows is likely to be applauded by the entire cannabis industry, including Pure Extracts Corp.
