CannabisNewsBreaks – Bern One Down: Sanders Tweets Plan to Legalize Marijuana Nationwide During First 100 Days in Office

“The Five” on Fox News yesterday discussed independent senator and 2020 presidential primary contender Bernie Sanders and his plan to legalize marijuana. Under the plan, announced on Thursday, Sanders will work on legalization by executive order within the first 100 days of his administration should he win the White House. Sanders, whose home state of Vermont in 2018 legalized possession of one ounce of pot and allowed each adult resident to grow two plants for personal use, has long been a supporter of decriminalizing marijuana nationwide. He’s argued that criminalization of the drug has ravaged communities of color and created an unequal incarceration rate. “Too many lives were ruined due to the disastrous criminalization of marijuana,” Sanders wrote in a tweet announcing his plan.

420 with CNW – Michigan Jittery About Availability of Recreational Marijuana

After adult-use recreational marijuana was legalized in Michigan last year, people went to the stores licensed to sell only to realize that they needed medical certification from the state to be able to purchase pot.

One year later and Michigan residents still cannot walk into a store and buy weed.

However, this may soon be possible in the first quarter of 2020. That is if the  Marijuana Regulatory Agency accepts applications from businesses possessing medical marijuana licenses this fall. Since medical marijuana businesses have passed the rigorous licensing process, it will be quicker and easier to issue recreational selling licenses to them.

It may be a long wait before the sale of any adult-use marijuana begins because owners of the medical marijuana dispensaries are complaining about lacking enough quality products to stock their shelves, which begs the question of where the sellers will get enough recreational marijuana supplies whose market is almost ten times that of medical marijuana.

Currently, all the licensed marijuana growers are growing medical cannabis, and this includes the caregivers who are allowed to grow weed for their patients. Before, the caregivers used to sell their excess stock to dispensaries, but the MRA prohibited the act in June. Medical cannabis cannot be sold as a recreational weed.

According to Robin Schneider, the executive director of the Michigan Cannabis Industry Association, the MRA rules allow for surplus medical marijuana to be used for recreational purposes if the department approves it. However, this is not possible if there is a shortage of medical marijuana, as it would entail denying the patients medication.

Currently, there is no surplus, and it is not possible to grow recreational marijuana as licenses are yet to be approved. No one has an accurate answer regarding when residents of Michigan will be able to walk into a store and buy legal cannabis.

According to the CEO of GROW Cannabis Marketing in Royal Oak, Mort Meisner, medical marijuana shortages are still a big challenge, and the MRA, together with the growers, should take action to increase availability.

Since licenses for recreational marijuana are yet to be issued, the market will still be in shortage, and the adult-use consumers will continue procuring their weed from the black market. Meisner says the shortage and lack of licensing are due to poor leadership since the agency was created last spring by Governor Gretchen Whitmer.

One is left wondering what suggestions industry actors like Neutra Corp. (OTCQB: NTRR) and Sugarmade Inc. (OTCQB: SGMD) would have for fixing this needless shortage once and for all.

420 with CNW – Judge Upholds Massachusetts Vaping Product Sales Ban

On Monday, a Massachusetts judge, Douglas Wilkins, refused to reverse the ban on the sale of vaping products, which was adopted after the outbreak of lung illnesses associated with e-cigarettes. However, he instructed the state of Michigan to modify the ban and solicit public comments.

Judge Douglas Wilkins from Suffolk County Superior Court’s ruling was a partial win for Charlie Baker, a Republican Governor who, in response to the outbreak of the lung illnesses, adopted the strictest sales ban. However, Judge Wilkins said that by issuing the ban, Baker overexerted his powers. The judge issued an order that would stop the state from enforcing a ban on the sale of nicotine-vaping products unless defects were detected in the products.

The judge said that by October 28, through an emergency regulation, Baker should reissue the ban and give the vape shops as well as the members of the public a chance to comment.

Products containing THC, which is the psychoactive compound of marijuana, are legal in the state; therefore, they will not be affected by the ban.

Baker’s administration was responsible for ensuring that the order was issued correctly as they prepared for the next steps, said Lizzy Guyton, Baker’s spokeswoman.

The business association was not happy about the ban and said they are working to block it. The group said the ban is a threat to the state’s $331 million nicotine vaping industry, said Tony Abboud, VTAs executive director.

According to the United States Centers for Disease Control and Prevention, the number of e-cigarette lung-related illnesses reported nationally are about 1,479. The Centers for Disease Control and Prevention links most of the diseases to products containing compounds of THC, especially those bought from the illicit market.

Washington-based VTA filed the lawsuit against Baker’s emergency order citing that the mandate was unconstitutional, overreaching, and arbitrary because it was meant to target the youth engaging in vaping activities and the outbreak but ended up banning the sale of vaping products to everyone irrespective of their age.

Other states such as Oregon, Michigan, New York, Rhode Island, and Washington joined in on the ban of e-cigarettes sales, asserting that they are harmful to public health, especially to teenagers.

The ban of e-cigarettes in Michigan, New York, and Oregon has been put on hold by the courts following similar lawsuits.

It is expected that marijuana industry players, such as Green Hygienics Holdings Inc. (OTCQB: GRYN) and Canopy Rivers Inc. (TSX: RIV) (OTC: CNPOF) may be happy with this ruling since it puts a halt to the arbitrary and farreaching bans that would have been imposed elsewhere.

CannabisNewsBreaks – Lexaria Bioscience Corp. (CSE: LXX) (OTCQX: LXRP) Applauds FDA Forward-Looking Decision on Reduced Risk Tobacco Format

Global innovator in drug delivery platforms Lexaria Bioscience (CSE: LXX) (OTCQX: LXRP) today announced that the Food and Drug Administration (“FDA”), for the first time ever, has authorized the marketing of oral nicotine products through the Modified Risk Tobacco Product pathway. According to the update, this pathway includes product categories that could benefit from Lexaria’s technology. The FDA-authorized product format is in the tobacco pouch category, similar to a mini tea-bag that is held in the mouth from which the nicotine within is absorbed. Unlike chewing tobacco, there is no need to spit. Significantly, because there is no combustion, heating or vaporization of the tobacco pouch during use, as well as FDA-accepted scientific evidence that included long-term epidemiological studies in association with this approval, claims of a lower risk of mouth cancer, stroke, lung disease, heart disease, emphysema and chronic bronchitis than cigarettes are permitted by the FDA. “Lexaria applauds this informed and forward-looking decision by the FDA to recognize improvements in delivery formats that are being made by industry,” Lexaria Bioscience Corp. CEO Chris Bunka said in the news release. “Lexaria realized long ago that DehydraTECH(TM) could empower alternative nicotine product formats and as a result our delivery technology which is already patented in the U.S. and patent pending around the world for enhanced oral nicotine delivery.”

420 with CNW – Two Studies Show Marijuana is Helping Patients Avoid Opioids

Two studies show that patients suffering from chronic pain are using marijuana instead of addictive pharmaceuticals to help them manage the pain.

The studies are an addition to the growing body of research on the importance of marijuana in the growing opioid crisis in the United States.

The first study, carried out by researchers from Florida International University, investigated if managing pain was the only reason people substituted opioids with marijuana. The study was published in the International Journal of Drug Policy. The researchers used data from the National Survey on Drug Use and Health when evaluating the likelihood of opioid consumption by people in states where medical marijuana is legal and where medical marijuana was not available.

The researchers used the following to evaluate the data, did the respondents use or abuse any pain relief medication in the past year, the states they resided in, and if medical cannabis was legal. They analyzed the surveyed data for the year 2015 through to 2017, which included 120,764 respondents.

The study authors concluded that an analysis of the data resulted in a multivariate logistics regression equation, which showed that a reduction in opioid usage is associated with the medical cannabis laws.

The study states that marijuana helped patients minimize their dependence on opioids significantly because in relieving pain, marijuana and opiates are on the same level; however, most patients prefer to use weed over opioids. The patient’s perception of the treatment and tolerance of the side effect is the basis of a successful treatment plan.

The second study was carried out by researchers from the San Francisco Veterans Affairs Medical Center, who asked direct questions to people on whether or not patients use medical marijuana instead of the prescribed painkillers. The study, which was published in PloS, surveyed 16,280 adults where the researchers asked participants to share information on their opioid and cannabis usage. They also asked them to note if there were any changes in the amount of opioids they used after using marijuana and why the patients substituted cannabis for opioid prescriptions.

Those who responded to the survey were more than half the number of participants, whereby 5% (486) said to have used marijuana and opioid in the past year, 43% used opioid daily, and 23% reported to have used marijuana in the past one month. The study also found that 41% of the respondents stopped or reduced their opioid consumption because of marijuana, 46% did not alter their opioid usage, and 8% increased their opioid intake.

The researchers also found that most Americans substituted marijuana for opioids, with 36% crediting it to better at pain management, 32% experienced fewer side effects, and 26% associated it to fewer withdrawal symptoms. Thirteen percent said the medicine was cheap, and the remaining thirteen percent said they used it due to social acceptance.

The two studies show the importance of mitigating opioid use and misuse when caring for patients. And, the Department of Health and Human Services (HHS) Pain Management Inter-Agency echoed the same sentiments earlier this year.

Analysts believe these findings are in line with what the cannabis industry, including actors like Youngevity International Inc. (NASDAQ: YGYI) and Therma Bright Inc. (TSX.V: THRM) (OTC: THBRF), has always known as the benefit of medical marijuana in taming the opioid crisis.
