420 with CNW – Group Campaigns for Congressional Action on Pesticide-Free Marijuana

Last Tuesday, Beyond Pesticides, a nonprofit organization said that a lack of federal regulations on pesticides used on marijuana plants is putting marijuana consumers at risk.

Beyond Pesticides are advising their supporters to send letters to lawmakers urging them to hold hearings and investigations on the illicit use of unapproved pesticides in the legal markets to prevent toxic pesticide contamination. They are urging the state to advise the farmers to adopt an organic system of planting the cannabis crop.

The Environmental Protection Agency (EPA) has to approve and register each crop before farmers can apply the pesticide. And since cannabis is not a legal agricultural crop, EPA will not be able to register any pesticides for the crop as it will require first to carry out studies showing their environmental and human impact. Moreover, there are no established tolerances for pesticide use in marijuana plants; therefore, EPA cannot approve labeling of the product’s safety requirements.

However, in August, EPA announced that they are reviewing ten pesticides that can be used on hemp crops.

Some states that have implemented their own regulations regarding pesticide application in cannabis crops have reported several cases of contamination. These states include California, Colorado, and Oregon. This situation requires congressional interference, argues Beyond Pesticides, because the use of federally registered pesticides is prohibited in other states.

The letter says that states do not have the permission to allow the use of pesticides in marijuana production or processing because of the absence of federal testing on the possible effect of pesticides on marijuana users, producers, and the environment as a whole. However, it can provide guidelines for sustainable production practices meant to protect the health of the consumers and the environment.

The nonprofit organization argues that the only option for marijuana farmers is to embrace input exempt from federal registration and adopt organic soil management practices. However, the downside to embracing the organic soil management approach is the continued registration of pesticides for marijuana in some states, which violates federal law.

The group further argues that it would be prudent, precautionary, and a positive trajectory for the farmers to follow the dictates of the national organic soils management practices when growing marijuana.

Beyond Pesticides says that it is essential to limit consumer exposure to pesticide. This is because pesticides introduce toxic chemicals to medical marijuana products. And, the ability of the body to detoxify these pesticide chemicals can be hindered by using medical marijuana because cannabinoids essentially inhibit enzymes that assist in detoxifying chemicals.

Beyond Pesticides made two recommendations to be addressed by Congress. The first issue is for Congress to hold hearings documenting states that are using federally registered pesticides, thus violating federal law. The second issue is for Congress to request the Office of the Inspector General and Government Accountability Office to conduct an investigation that clarifies the responsibility of the EPA and state enforcers in ensuring pesticide product labeling compliance.

It is strongly believed that cannabis industry actors like Neutra Corp. (OTCQB: NTRR) and Organigram Holdings Inc. (TSX: OGI) (NASDAQ: OGI) are also concerned about pesticide use but a definitive direction can only be provided by the authorities.

Drivers who have smoked marijuana in the past three hours will be easily identified using roadside breath tests, which may be available in 2019. It has been reported that the two companies manufacturing roadside marijuana breathalyzers such as Oakland-based Hound Labs and Sann Tex are hoping that by the second quarter of 2020, their breathalyzers will be ready for use.

Mike Lynn, who is the co-founder of Hound Labs, said that his company’s Breathalyzer would be able to identify someone who has used marijuana in the past three hours since that is when the drug is in full effect, and as a driver you are impaired.

The AAA Foundation for Safety published the results of a survey they conducted earlier this year, which showed that close to 15 million Americans had driven a vehicle after smoking weed in the past one hour or used marijuana in the past 30 days.

Both companies are developing devices designed to check the presence of THC in the body. THC is the compound that gives the high effect.

Compared to alcohol, THC detection in the body is very hard because the amount of psychoactive compounds in the body is minute. That is, it is a million times lower than the quantity of alcohol in a drunk person’s body.

The Breathalyzers will help fill a gap in the marijuana market since medical and recreational marijuana are increasingly being legalized across the country, said the developers.

For the police force to determine if a person is under the influence of cannabis, they have to go through an expensive and time-consuming process where Drug Recognition Officers (DROs) are used to identify people who have consumed marijuana in the past 1-3 hours. DROs are specially trained to identify people who are under the influence of any drug.

When a DRO suspects a driver of being under the influence, the said driver is driven to the hospital for blood tests, which identifies the type of drug in their system. The DRO then has to provide testimony in court, which is time-consuming.

The new devices will make the work of the police ten times easier since they can directly identify and convict people under the influence of marijuana; thus, reducing the cost and time spent by the police. It also reduces the work of the defense attorneys when proving their client’s innocence if they were wrongly accused of being high while driving.

Companies using heavy pieces of machinery or engaging in dangerous tasks could also use the testers to check if their employees are under the influence to minimize the occurrence of accidents. This would be beneficial to both the employer and employee.

The Madera Police Chief, Dino Lawson, in an interview with Sacramento Bee, said that the new technology is exciting, and although the police force is happy about it, they hope more improvements will be made to perfect the device.

Analysts believe that marijuana industry players like Hemptown USA and Sugarmade Inc. (OTCQB: SGMD) may be having reservations about these devices since determining marijuana intoxification isn’t as easy as identifying alcohol intoxication.

420 with CNW – California Governor Signs Law Allowing Medical Marijuana on K-12 Campuses

In some California school districts, parents can now bring medical marijuana to their children in K-12 campuses; this is according to a new bill signed into law by Governor Gavin Newson. Last year, Governor Jerry Brown had barred the same bill.

The bill which was signed late Wednesday states that, if the school board permits access, parents can administer medical marijuana that is not in the form of vaping or smoking products to the students on the campus premises.

Governor Newson who was among the first proposers of the 2016 recreational cannabis legalization, overruled the opposition by law enforcement groups and signed the bill.

In his rejection message, Governor Brown had previously said that allowing the use of medical marijuana in schools would expose the youth to the drug and the probability of them using medical cannabis for all ailments was high.

Senator Jerry Hill (D-San Mateo) supported the bill saying that medical marijuana is vital as it can help hundreds of students with certain illnesses such as epilepsy. Besides the use of cannabis oil, creams and pills would be effective ways of treatment since vaping and smoking weed in schools is prohibited.

However, before parents administer medical marijuana to their children, they must obtain a doctor’s recommendation to administer weed on campus.

A member of the Americans Against Legalizing Marijuana, Scott Chipman said that the bill is a stunt since the Food and Drug Administration has already approved medical marijuana for epileptic disorders taken morning and evening. Therefore, there is no valid reason for taking medical marijuana at school since it is more convenient before and after school, accoding to Chipman.

Jackie Goldberg, a member of the Los Angeles unified school district, voiced her support for the bill and said that she would talk to the health officials in the region to recommend a policy on the same. She further added that the medicine should be available when the need arises and if the student’s family gets a medical marijuana prescription.

The new law will help students like JoJo attend school. According to his mother, Karina Garcia, JoJo takes medical cannabis tinctures to manage debilitating seizures that have prevented him from attending school. The new law is nicknamed JoJo’s Act by Hill.

On Thursday, Hill said Governor Newsom lifted all barriers for students who can only use medical pot to treat or manage their medical disabilities when he signed JoJo’s Act.

The bill was opposed by the majority of Republican lawmakers who said that it would promote drug abuse. The California Police Chief was also in opposition, saying that the top priority should be to prevent young adults under the age of 21 from accessing any marijuana products.

The new law goes against the rule that states that possession or consumption of medical marijuana should not be within 1,000 feet of any school premises, which required the parent to administer the medicine out of the school premises.

If a school district permits the use of medical marijuana, the guardian should first check-in after arriving and take strict precaution not to expose other children to the products.

California is among the eight states allowing the use of medical marijuana on K-12 campuses, a move that experts believe is regarded by cannabis companies like Earth Science Tech Inc. (OTCQB: ETST) and Geyser Brands Inc. (TSX.V: GYSR) as a progressive step that all states where medical marijuana is legal should emulate.
