Americans in five states have had the chance to vote on cannabis legalization during the Midterm elections. In Missouri, voters approved a cannabis legalization initiative dubbed Amendment 3, which would allow adults age 21 and older to purchase and possess up to three ounces of marijuana. Adults would also be able to grow up to six immature plants, six clones and six flowering plants at home once they secure a registration card.

The initiative was pushed by Legal Missouri 2022, a campaign that worked for months to convince Missourians to vote in favor of the measure. Missouri lawmakers have acted quickly in the wake of the legislation’s passage. Only two days after Missourians approved Amendment 3 at the ballot, the Missouri Department of Human and Health Services (DHHS) unveiled draft cannabis legislation for the state’s recreational cannabis market and launched a public comment period.

The Department of Human and Health Services, which will be in charge of Missouri’s adult-use market, began working on potential cannabis rules in August after the state confirmed that cannabis legalization would be on the November ballot.  The agency announced at the time that it had begun planning for potential changes to Missouri’s medical cannabis program because it would require some adjustments if voters approved recreational cannabis legalization.

State officials are now encouraging Missourians to go over the proposed draft rules and submit comments before the public comment period ends in two weeks. This feedback will help regulators finalize the cannabis rules in preparation for the state’s recreational cannabis market.

The DHHS will also be in charge of issuing adult-use licenses and will soon begin receiving applications from already-existing medical marijuana dispensaries that would like to serve recreational cannabis. The agency will accept license applications from dispensaries, and officials will have a maximum of 60 days to choose from the pool of applicants. Recreational cannabis sales are expected to begin by February 2023 at the earliest once the agency chooses the first recreational cannabis retailers in the state.

Given that Amendment 3 was subject to intense criticism from advocates who felt that it did not prevent regulators from passing licensing caps, the proposed rules will most likely receive plenty of public comments.

A spokesperson for Rep. Cori Bush said in early November that the congresswoman did not believe the Missouri legalization measure met the standards of equity and restorative justice that are at the heart of drug reform.

420 with CNW — Congressional Subcommittee to Hold Marijuana Hearing Soon After Midterms

Drug, racial and social-justice activists will be happy to know that House lawmakers will be discussing marijuana reform once the midterm elections draw to a close. Although the Biden administration was quick to act on its green-energy and electrification promises, there were plenty of valid complaints regarding the administration’s lack of action regarding cannabis reform.

President Joseph Biden recently made waves across the country when he announced that his administration was taking steps to begin pardoning all Americans who had simple cannabis possession offenses on their records.

With the midterm elections drawing to a close as final seat winners are announced, the House Oversight Civil Rights and Civil Liberties Subcommittee has indicated that it will hold a hearing this week to discuss state and federal bipartisan cannabis reform. The subcommittee posted a notice announcing the upcoming hearing las week, calling the Nov. 15, 2022, hearing “Developments in State Cannabis Laws and Bipartisan Cannabis Reforms at the Federal Level.”

With voters across the country deciding whether or not to approve marijuana legalization measures, this announcement shows that lawmakers are cognizant of the changes to cannabis policies and are willing to discuss the possibility of passing cannabis legislation.

The announcement may not have specified which cannabis policies the lawmakers will be discussing, but ranking GOP member Rep. Nancy Mace has said in the past that leadership had “promised” to consider her states reform act. The bill, which has been touted as a reasonable compromise between what the left and right want, would eliminate federal cannabis prohibition while ensuring that existing cannabis businesses aren’t significantly affected by the evolving federal cannabis rules.

Another legislation that could be under consideration in the hearing is the Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act. The bill was introduced by Judiciary Committee Chairman Jerrod Nadler. House members voted to pass the MORE Act for the second time this April, with House Majority Leader Steny Hoyer calling it an important piece of legislation. Oversight subcommittee chair Rep. Jamie Raskin also filed an amendment to the MORE Act that would make it so that cannabis consumption cannot be used as a reason to deny or revoke security clearance, but the amendment failed to pass.

The MORE Act would put an end to federal cannabis prohibition and take steps to promote social equity in the nascent marijuana industry.

Given that two (Missouri and Maryland) of the five states that had marijuana on the ballot passed those measures in the midterm election, the subcommittee discussions may be more animated riding on those poll results. As more states legalize cannabis, residents of senior living communities are using the substance more and more, and this is putting the operators of those facilities in the spotlight regarding how they respond to this reality.

At the moment, marijuana is categorized as a schedule 1 substance, the same category as heroin, MDMA, LSD and cocaine. While President Joseph Biden instructed the attorney general and the health and human services department to review this categorization, the law is the law, and marijuana users are still regarded as criminals. Public opinion has changed sharply on this matter, and pressure is mounting to allow cannabis to be used medically and recreationally.

For senior living facilities, the legalization of marijuana in 37 states has created some leeway for the management at those facilities to come up with policies guiding the use of the substance. Some facilities have opted to do nothing and ask no questions about the use of marijuana by the residents in their communities. This group is taking a big risk because legal and other issues can arise when the facility doesn’t have any guidelines in place. For example, what would happen if a resident sued a neighbor in the community for using marijuana on the premises?

Other facilities, such as Silvarado, which operates senior living locations across several U.S. states from one coast to the other, have opted to allow their residents to use marijuana in states where the substance is legal. They say that anecdotal reports indicate that medical marijuana is of some help to patients with memory loss issues, such as Alzheimer’s.

Surveys also show that baby boomers are increasingly turning to cannabis for relief from various symptoms, including insomnia, chronic pain and anxiety. This means that senior living facilities will sooner or later have to consider what position to take with regard to marijuana use within their communities since more and more of their residents will be using or consider using marijuana, whether for recreational or medical purposes.

The executive order mandating the review of marijuana’s status in the Controlled Substances Act is one of the many steps and processes that may need to be performed before any changes can be made. The United States Drug Enforcement Administration (DEA) is likely to have a big say in any recommendations made at the conclusion of the review and how those recommendations are to be implemented. In a recent video, Gov. Gavin Newsom of California stated that he’d like to see cannabis legalized federally, so marijuana farmers in the state could legally supply the plant to the rest of the country. Under current federal prohibition, commercial exports of cannabis leaving California’s borders are deemed to be illegally trafficked goods.

The video was played at the Oakland International Film Festival, which was held in September 2022. During the festival, activists previewed a documentary on the cannabis reform movement’s local history, which featured the California governor.

Gov. Newsom thanked the advocates for helping the state legalize marijuana in 2016 as well as their leadership. He noted that while the state’s law needed to be improved upon, he looked forward to federal reform that would put an end to federal prohibition. The governor also stated that broader reforms needed to be accompanied by efforts to repair damage done to individuals, families and communities as a result of the war on drugs.

Interstate cannabis commerce will be profitable for the state of California, which has an ideal climate for outdoor growing and will help meet the demand for cannabis in other states.

The state’s governor recently signed a bill that would allow California to enter into agreements with other legal states, in anticipation of interstate commerce in the future. This ability will be set off under the measure once federal guidance or law allows it or if the state’s attorney general guarantees that interstate marijuana trade won’t bring about legal risk to California.

Many hope that permitting interstate commerce will help stamp out the illicit market by decreasing the demand for unregulated products and enabling cultivators to make a living legally.

Meanwhile, Newsom’s administration is praising the efforts of an illegal marijuana enforcement task force that the governor recently established. Thus far, the task force has seized and eradicated $15 million worth of illegal processed flower and cannabis plants, as per the latest state data.

Newsom also talked about marijuana equity, explaining that this would help maintain a diverse industry and level the playing field. For this purpose, officials in the state of California announced in October that the state would be awarding $20 million in grants funded by cannabis taxes to universities conducting studies on marijuana policy and science. This was publicized a few days after officials in the state announced that they’d be accepting applications for grants to support local efforts promoting equity in the cannabis industry.

420 with CNW — German Plan to Legalize Cannabis Won’t Permit Imports

The government of Germany recently published a proposal detailing its plans to legalize and regulate the recreational use of marijuana. The 12-page plan excludes cannabis imports, which means that the plant will be cultivated in the country. This will be a blow to some global producers who had plans to import their products into Germany, which is said to be the biggest economy in Europe.

In a news conference last week, the country’s Health Minister, Karl Lauterbach, stated that plans were underway to ensure complete cultivation in Germany.

The proposal, which was endorsed by the German cabinet, suggests that the program may be launched in 2024. However, before it is brought before legislators, a blueprint will have to be forwarded to the European Commission for approval. This will help ensure that the law is compatible with EU and international drug laws.

Lauterbach added that Germany would argue that the plan was aligned with global treaties, noting that the legislative process would only proceed after the plan was approved by the European Union. This suggests that these proposals may undergo amendments before they’re presented in a draft law.

The plan proposes the regulation of adult-use marijuana to protect the youth and disintegrate the country’s illicit market, in an approach similar to that of Canada. The proposal also suggests that marijuana will be sold in pharmacies as well as in approved stores, to individuals aged 18 and above. Marijuana purchases will be limited to 20-30g. Germans will also be allowed to grow no more than 3 plants at home.

The proposal states that cultivation will be permitted in greenhouse and indoor facilities to ensure quality control. However, it doesn’t touch on any possible production quotas, which currently govern Germany’s medical marijuana cultivators.

The proposal explained that the entire trade and supply chain will be subject to a controlled system which will include documentation for every step in the chain. Activities like cultivation, processing and distribution as well as retail and wholesale sales will only be carried out by licensed parties.

In addition to this, the proposal states that individuals applying for licenses will be required to demonstrate proof of sufficient financial resources and creditworthiness and proof of entry into the European Union’s beneficial ownership registry as well as expertise.

If the proposal is approved by the EU, it could be used as a blueprint for broader marijuana reform in nations across the EU who’d like to jump on the bandwagon.

That provision allowing home cultivation could very well create a potential market for indoor cultivation equipment commercialized by various entities, such as Advanced Container Technologies Inc. (OTC: ACTX).

420 with CNW — Federal Commission Considers Amending Sentencing Guidelines on Past Cannabis Use

Before states began legalizing cannabis in the late nineties and early 2000s, the plant had been prohibited across the country for decades. Over the years, tens of thousands of Americans were convicted and imprisoned over cannabis-related charges, with a majority of them being people of color.

Even though dozens of states now allow medical and recreational cannabis use, plenty of people are still held back from fully participating in life by cannabis offenses on their records. Hundreds of thousands of people have been arrested for cannabis-related offenses in the past couple of years and cannabis arrests overall make up more than half of all drug arrests across the country.

Amidst the landscape of patchwork state cannabis policies and federal prohibition, the U.S. Sentencing Commission (USSC) has revealed that it is considering making amendments to sentencing guidelines on past cannabis use.

The federal commission recently passed 14 policy priorities for the amendment cycle ending in May 2023. Although the cannabis sentencing item wasn’t included in a previous version of a priority list that was released for public feedback, the item was added and adopted following a mass cannabis pardon announcement by President Biden.

Even though guidelines from the USSC may not be binding on judges, they still have to take the guidelines into account when they make their decisions.

The federal commission is now declaring that it is a priority to consider making amendments to guidelines for the review of defendants’ criminal histories when it comes to cannabis-related offenses. One component of the amendments would make it so that prior cannabis possession offenses are not considered at current court hearings. If the amendment is passed, the effect it could have on America’s criminal justice system could be massive.

Sterling said that the move was most likely a response to President Biden’s pardon of simple cannabis possession offenses in September.

Soon after the President’s pardon was announced, the USSC released a separate report outlining the demographics of the people who were pardoned. The USSC has also revealed a steady reduction in cannabis cases as more states have passed cannabis policies. This is in its routine reports.

In the near future, prior convictions for simple cannabis charges may be of no concern from a sentencing perspective regardless of whether the commission develops and passes any amendments to cannabis sentencing guidelines.

420 with CNW — AOC Calls Out Biden for Excluding Undocumented Immigrants from Cannabis Pardons

Last week, Rep. Alexandria Ocasio-Cortez stated that President Joseph Biden’s cannabis pardon proclamation was limited because it exempted noncitizens, who made up most of the federal possession cases.

During the interview with Pod Save America, the congresswoman emphasized the importance of having a Democratic party that stood up for the immigrant population through the enactment of policies that were more inclusive. She argued that while the presidential pardon should be applauded, it wasn’t inclusive because the proclamation exempted convicted individuals who were undocumented. This is despite the fact that about 90% of individuals who would have benefited from the pardon had status complications.

A 2016 U.S. Sentencing Commission report shows that more than 90% of cannabis possession cases at the federal level in fiscal year 2013 took place at the Southern border. The report states that 94% of the individuals arrested were not U.S. citizens. While these stats have changed as the years have gone by, they still speak to a trend in law enforcement.

Ocasio-Cortez also discussed how individuals with citizenship issues weren’t included in Biden’s pardon, highlighting that it was discriminating against people based on their citizen statuses. The mass pardon issued by Biden only impacted about 6,000 individuals who had committed cannabis possession offenses at the federal level, as well as those who had broken the law in the District of Columbia.

The congresswoman’s sentiments are shared by activists who have also argued that the relief should be extended to individuals with sales convictions as well as immigrants. Activists with DCMJ, Last Prisoner Project and Sensible Drug Policy protested against this last week and demanded that individuals currently in federal prison for cannabis convictions that weren’t limited to simple possession also be released.

This comes after the president himself boasted that his mass pardon had changed the lives of thousands. In an interview conducted after the mass pardon’s issuance, Biden stated that he was keeping his promise to ensure that no individual was in jail for being in possession of or using cannabis. Biden also noted that once released, the records of these individuals needed to be expunged completely because not doing so would make it hard for them to be employed.

In addition to pardoning individuals, Biden also directed that the Department of Health and Human Services and the Department of Justice carry out a scheduling review to determine whether marijuana’s current classification under the Controlled Substances Act was necessary.
