420 with CNW — AMA Poll Finds 67% Support Congressional Action on Cannabis Banking

A new opinion poll commissioned by the American Bankers Association has found that two out of every three Americans would like Congress to approve a law allowing state-legal cannabis companies to have access to traditional banking services, including access to loans and checking accounts.

This survey was focused on two questions. First, the poll wanted to know whether Americans felt cannabis businesses licensed in states with legal cannabis markets should be in position to get access to basic banking services. The second question sought the opinion of respondents regarding whether or not Congress needs to act on cannabis banking reform.

For both questions, respondents exhibited support. Nearly seven in ten Americans said they supported proposals to grant cannabis companies access to mainstream financial services. Of this number, 37% were “strongly” in favor of granting such access. Only a paltry 16% of the respondents were of the view that there is no need for Congress to enact cannabis banking reform policies.

Rob Nichols, AMA president and CEO, wrote in a press release that U.S. residents strongly believed that the time had come for the current contradictions between federal and state-level policies on marijuana to be fixed once and for all. He called on Congress to expeditiously approve the SAFE Banking Act before this year ends so that public safety can be improved in more than three dozen states where marijuana has been legalized in one way or the other.

The House of Representatives has approved some form of the Safe Banking Act more than half a dozen times, but the law has always hit a wall when it gets to the upper chamber of Congress regardless of whether the Democrats or Republicans have a majority in that chamber. The good news is that banking reform has been included in a package containing cannabis policy reforms that leaders in the Senate are finalizing.

Earl Blumanauer, who tabled the banking law before the House of Representatives, says that the continued denial of banking services to the cannabis industry not only hurts businesses owned by minorities but is also deadly due to the attacks such businesses are exposed to. Because of these security concerns, Rep. Ed Perlmutter has threatened to go the “nuclear way” of blocking other legislation in order to force cannabis banking to be addressed by Congress.

Several groups, including the National Conference of State Legislatures (NCSL) and National Association of State Treasurers (NAST) have all come out to push for cannabis banking reform. It remains to be seen whether Congress will heed these calls and give ancillary actors such as Advanced Container Technologies Inc. 420 with CNW — Young Adults, Women Are Driving Marijuana Use Increase

New federal data shows that users of marijuana may soon be a majority among young adults in cannabis-friendly states across the country. In states such as Oregon and Colorado, cannabis patrons are nearing majorities, given that these particular states have had legal markets for years now.

Data from Vermont also shows that young marijuana users outnumber nonusers. The state fully legalized the recreational use of cannabis earlier this month.

Federal data also shows that more than two-fifths of young women and men across the country now use marijuana at least occasionally. This is significantly different from the trend observed 10 years ago and can mainly be attributed to the wave of legalization observed in the country this past decade.

An increase in the number of young women using cannabis has also helped close a gender gap in the plant’s use, which further influenced this trend.

However, the use of cannabis hasn’t yet reached its ‘70s peak of 36%. Currently, the drug’s use among young people stands at 29%. In the adult population, however, the use of cannabis may be at an all-time high. This may be difficult to interpret accurately because federal marijuana research has largely focused on young people in the past.

Results from a recent Gallup poll show that in 2021 the proportion of adults who revealed that they had tried cannabis in their lifetimes hit 49%. This is the highest figure measured in more than five decades. Gallup’s director of U.S. social research, Lydia Saad, stated that this figure would exceed 50% in the near future.

When Gallup first asked this question in 1969, only 4% of grownups admitted to having used marijuana before.

This news comes after President Joseph Biden earlier this month pardoned all individuals convicted of simple cannabis possession under federal law.

At the moment, 19 states have legalized the recreational use of marijuana while 37 states and the District of Columbia have legalized its medical use. It is expected that five more states will join the recreational cannabis movement after the midterms.

Legalizing the recreational use of cannabis may transform the marijuana culture in Arkansas, South Dakota and North Dakota, where only 10% or so of adults use the drug currently.

The marijuana legalization movement has almost completely erased decades of stigma against the use of the drug. If all five proposals are approved, legalization will be the law for about 49% of the American population. 420 with CNW — New Data Shows That Less Than 10% of Canadian Marijuana Licensees Exited Growing Industry

New data from the Canadian government shows that less than 10% of federal marijuana license holders have left the market since the plant was legalized in 2018. This data suggests that industry forecasts of a decrease in marijuana producers in the market has not occurred, as new entries into the hypercompetitive market surpass those exiting by a wide margin.

The new data was released as part of the Canadian government’s engagement paper for the Cannabis Act review. The public engagement paper also asks questions relevant to the industry to help gather feedback; that feedback will be used by the government to inform the legislative review of the law.

Since October 2018, about 95 marijuana license holders left the burgeoning industry. Of this number, 67 held standard licenses, which face no canopy limits; 13 held licenses for sale for medical purposes only; and the remaining were micro-license holders.

The data doesn’t delve into why the licensees left the market. However, industry experts believe that marijuana businesses suffer from overtaxation, which makes it hard to operate in the increasingly competitive market. In this environment, businesses often have to restructure or find new investors to help them compete, which is easier said than done. At the moment, Canada has only 920 active federal marijuana licenses.

An analysis of the data also shows that the most profitable marijuana businesses in the country are government owned while profits generated from the private sector are uncommon. In addition, the data showed that cultivators in the country produced roughly 618 tons of dried marijuana last fall, which brought the total amount stored by licensed retailers, wholesalers and producers to 1.4 billion grams.

It also showed that about 43% of dried marijuana production in the country in the period between October 2019 and December 2021 was generated by 10 standard license holders. In comparison, less than 1% of all marijuana production in the country was generated from 178 holders of micro-licenses.

These numbers come as the country’s legal market grows and displaces the illegal market. The recently released data also demonstrated that by the fourth quarter of 2021, legal marijuana sales were two times higher than sales in the illicit market.

In figures, combined recreational and medical marijuana sales in legal channels hit C$1.3 billion during the fourth quarter of 2021 while sales in the illegal market declined to C$660 million during the same period. The Canadian government remains committed to combating the illicit market by providing consumers with the ability to purchase marijuana from regulated and legal sources.

It would interesting to see a similar attrition analysis done for the different marijuana markets within the United States, including jurisdictions where established actors such as Advanced Container Technologies Inc. (OTC: ACTX) operate alongside mainstream marijuana companies.

420 with CNW — New York Legislator Calls for Research on Determining Marijuana Impairment

As New York State works feverishly to ensure that recreational sales of marijuana are launched on schedule, a leading lawmaker, Crystal Peoples-Stokes, is concerned that at the moment, there is no surefire way to ascertain that someone has consumed marijuana and is impaired.

Peoples-Stokes is the majority leader in the state assembly, and she was pivotal in getting the legalization law passed. She revealed that concerns about finding ways to determine impairment was part of the reason why the bill (now law) had provisions stipulating that 20–25% of the tax revenue generated from recreational marijuana sales should go toward conducting cannabis studies, including on matters such as assessing motorists to confirm whether they are impaired behind the wheel.

She wants leading academic institutions in the state, such as the University of Buffalo, to become actively involved in conducting marijuana research not just on testing for impairment but also on other vital matters such as other beneficial effects that the compounds in this plant can have.

The need for such studies has been impressed upon politicians, advocates and members of the academia by recent reports of an uptick in fatal crashes in some states that have recently legalized adult-use recreational cannabis. Such fatalities are being attributed by some people to people driving while impaired by marijuana, and there is no way to definitively confirm or rule out such claims.

In New York State in 2019, a man in Tonawanda was convicted for committing vehicular manslaughter. This was after the man drove while intoxicated with marijuana and rammed into a retirement home, causing the death of a woman who was inside her apartment in that community.

Are such reports due to isolated incidents or a growing pattern as marijuana use becomes more widespread? Only a scientifically validated test can determine whether those incidents can be directly linked to marijuana legalization in different jurisdictions or whether their prevalence isn’t so high that consumer education on responsible cannabis use cannot tame the possible irresponsible behavior of some marijuana users on the road.

In California, teams of researchers are focused on developing breathalyzers designed identify motorists who may be under the influence of marijuana. However, there is no consensus that there is a link between the amount of THC detectable in someone’s blood, saliva or breath and whether such a person can be described as impaired. Some police authorities have opted to train their personnel to look out for actual signs of impairment in drivers, such as red eyes and delayed reaction time.

Now that New York has also legalized marijuana home grows for patients with a medical marijuana card, an additional client base is likely to open up for companies such as Advanced Container Technologies Inc. 420 with CNW — Companies Scramble to Adapt as Marijuana Legalization Spreads

As more states across the United States establish legal marijuana markets, employers are scrambling to adjust to this new reality. This is because the traditional no-tolerance policies are becoming harder to enforce in the face of the changes brought by legalization.

For instance, there is a current shortage of workers, particularly for lower-paying job opportunities. Pre-employment testing for marijuana is increasingly being seen as a barrier to getting even the few applicants interested in joining the workforce. Many companies are therefore suspending such pre-employment tests especially for jobs which aren’t safety sensitive, such as operating machinery or driving trucks.

The shift away from pre-employment cannabis testing doesn’t however mean that companies are doing away with marijuana testing. For example, Dave Clark, while still CEO of Amazon, wrote in a blog post that the company would no longer reject applicants on the basis of failing a cannabis test. However, the firm would still conduct drug tests after every safety incident or accident that occurs in order to establish whether the party involved was impaired.

Some employers are also expressing concerns about the possible effect on insurance premiums when they stop testing for marijuana before hiring employees and conducting routine tests for the substance on existing employees.

However, Mark Pew, a Georgia-based insurance expert focusing on workers’ compensation, says that it is unlikely that insurers will slap companies with bigger premiums just because those entities are no longer conducting marijuana tests. Rather, premiums could creep up if insurance firms notice that claims are increasing among companies with less stringent drug testing policies in comparison to those that conduct rigorous testing.

The tests themselves have faced some criticism since most test for the presence of THC metabolites in the sample (blood, urine, saliva or hair follicle) tested. A positive test therefore isn’t irrefutable proof that someone was impaired on the job. Rather, the test just confirms that the person used marijuana at some point in the past, and they may or may not have been impaired at the time of the safety incident. Better tests are needed to establish cannabis impairment in a way that can stand court scrutiny.

That notwithstanding, a broader trend of safer workplaces may make it harder to establish whether looser testing policies result in more work-related accidents. Statistics show that there are fewer accidents at work today compared to the frequency of such incidents in the years gone by.

420 with CNW — DEA Admits It Was Founded Based on Ethnic, Class and Racial Prejudice

These days, most pundits agree that the war on drugs is a failure. After decades of prohibition, the drug war has barely dented the illicit drug trade but contributed to the incarceration of thousands of Black people. Under prohibitionist policies, law enforcement waged a war on Black and Brown communities for decades in what some called the new Jim Crow.

Black people were and still are four times more likely to be arrested for cannabis consumption despite similar use rates as White people, and they are subject to harsher sentences. Analysis of the cannabis-related arrests that occurred in the five boroughs of New York City in 2020 revealed that Black people made up 94% of those arrested. Overall, data collected from all over the country shows that Black people are much more likely to be arrested for cannabis offenses.

The Drug Enforcement Administration (DEA) recently acknowledged that its formation was partly based on racially discriminatory drug policies. DEA Museum officials talked about the history of drug prohibition in America during the agency’s “Stories from the Collection” video series when they made the admission. They said that the DEA had been formed in alignment with punitive drug policies from the early-20th century.

The DEA Museum historian stated that public views on addiction evolved as the government began regulating drugs such as opium that originally had medical uses. Class, ethnic and racial prejudice coupled with increasing recreational drug use steadily changed public opinions, the officials said, resulting in the enactment of laws meant to curb the use of cocaine, heroin and marijuana.

The U.S. government, under the Treasury Department, formed the Federal Bureau of Narcotics (FBN) to enforce these new drug laws. FBN, which was the precursor of the DEA, enforced mostly politically and racially motivated laws in its time. For instance, law enforcement used stigmatizing and racist media depictions of cannabis to strengthen prohibition efforts. Research has also shown that communities of color were disproportionately affected by drug criminalization.

The DEA itself has now admitted that it was formed based on punitive racially motivated policies. Even while dozens of states have legalized cannabis, the DEA continues to enforce federal prohibitionist policies. Although the agency has taken steps to expand research into drugs such as psilocybin and cannabis as well as increase the number of approved cannabis growers, advocates and scientists believe the DEA remains a barrier to cannabis access.

The agency has spent the past few years fielding lawsuits over administrative policy and drug-scheduling issues, including one from a doctor who believed the DEA was breaking state and federal right-to-try laws by preventing terminally ill patients from accessing psilocybin therapy.

The prohibitionist and biased leaning of the DEA doesn’t just affect companies that are directly manufacturing and dealing in marijuana products. It also impacts ancillary companies such as Advanced Container Technologies Inc.
