420 with CNW — VA Declines Certifying a Veteran’s Hemp Because of Marijuana’s Federal Status

Last week, the Department of Veterans Affairs rejected an application made by a veteran  requesting that his hemp product firm be recognized. In its denial letter, the department stated that the department could not endorse the business because it was involved in products derived from the same genus of the marijuana plant, which would give the impression that a federal agency was endorsing the plant.

This rejection highlights the confusion around hemp’s legal status, which is defined as cannabis sativa L., and its derivatives, which contain less than 0.3% THC under U.S. law. Marijuana products with higher THC concentrations are still classified as Schedule I substances and remain illegal under the Controlled Substances Act.

The company in question, Holistic Serendipity LLC, operates under a native ceuticals licensing agreement. The company, which is owned by Zack Zindler, was seeking certification as a veteran-owned, service-disabled small business. This designation would allow the company to compete for contracts in the federal government.

While some federal agencies allow companies to self-certify service-disabled veteran-owned small businesses, the Department of Veterans Affairs requires that businesses be verified through its Center for Verification and Evaluation. Director John Perkins stated in the letter denying the application that verification would grant the company the ability to use the VA’s veteran-owned business trademark, which would give the appearance that the department was promoting the use of a Schedule I controlled substance.

The letter also made it clear that Native Ceuticals Tampa was a hemp company, noting that, based on online research as well as the documentation submitted, it sold products derived from hemp.

Zindler started his company last year in May. His objective, he said, was to offer alternatives to pharmaceuticals and narcotics for members of the military who were recovering from mental health conditions such as post-traumatic stress disorder or physical injuries. In his statement, the Marine veteran revealed that hemp had helped him regulate and process his emotions as well as helped him manage physical ailments, without side effects or dependency.

Zindler also revealed that he’d applied for a federal contracting program in an attempt to reach more military service members, which required him to seek verification from the Department of Veterans’ Affairs as a service-disabled, veteran-owned small business.

Currently, hemp is legal under federal law and was legalized under the 2018 farm bill. Earlier this year, however, a measure was filed in Congress that would increase hemp’s THC limit to 1%.

Last week, members of the Cannabis Regulators Association (CANNRA) penned a letter to leaders of congress. The letter’s primary signatories were regulators serving in Washington, Oregon, Nevada, Minnesota, Michigan, Hawaii and Georgia.

In the letter, the nonpartisan association outlined primary aspects of worry for the respective cannabis markets in their states. While it didn’t endorse the SAFE Banking Act directly, the letter did highlight that the absence of safe financial and banking services for marijuana industry actors and for the individuals involved in marijuana marketplaces was a public safety matter.

Legislators are currently holding a debate to attach the language of the SAFE Banking Act to the America COMPETES Act.

The letter stated that nearly all territories and member states of the association had been negatively affected by the lack of banking and financial services for marijuana businesses and those who worked with the marijuana industry. The primary issues the association identified concerned public security and safety, the need for small as well as minority-owned companies to have access to financial institutions and the lack of access to depository and banking services.

This banking issue has compelled many cannabis businesses into operating on cash-only terms, which makes them targets of criminal activity and threatens the public safety of communities and neighborhoods across the country.

In the letter, the association cited instances of recent robberies and violent crimes that took place at retail outlets in various states these last few months. The association noted that access to conventional banking services will strengthen efforts to prevent criminal enterprises and diversion and offer regulatory agencies better insight into legitimate operators.

The letter also highlighted that this issue was impacting small plus minority-owned businesses. The letter explained that while big businesses had the capability to identify and then use alternatives for financial transactions, small businesses struggled with this and were often left to operate on cash-only terms with no access to capital, which in turn affected their viability as well as success in the legal cannabis space.

CANNRA noted in the letter that this grew the already unequal playing field, which existed for small as well as minority-owned marijuana businesses.

Additionally, absence of access to safe banking also made it harder for marijuana regulators to promote equity and safeguard public health as well as consumer safety, in addition to promoting regulatory certainty with regard to those involved in the industry. CANNRA then urged Congress to accord prominence to policy approaches that promoted safe banking. This comes as more legislators, including Rep. Earl Blumenauer and Sen. Patty Murray, call for the advancement of the SAFE Baking Act.

420 with CNW — Congressman Calls on DOT to Modify Truck Driver Cannabis Testing Rules

Earlier this week, Rep. Earl Blumenauer sent a letter to the U.S. Department of Transportation urging the federal agency to reform its cannabis testing policies for truckers and other commercial drivers. The congressman explained that these drug tests unnecessarily cost individuals their jobs and also contribute to issues in the supply chain. In the letter, he cited data from the department showing that thousands of drivers lost their jobs due to strict THC drug-screening policies.

Blumenauer explained that while no individual wanted impaired drivers on U.S. roads, there didn’t exist tests that could detect impairment, which meant that these individuals were being punished for using marijuana while they were off duty or even some days or weeks before they got tested. The congressman emphasized that these disqualifications penalized patients and individuals of color who legally used medical marijuana, decreased the workforce despite the increasing demand for drivers, and denied individuals the right to earn a living, which was why this issue needed to be dealt with urgently.

Blumenauer told Pete Buttigieg, the transportation secretary, that the Department of Transportation needed to develop an accurate test to measure impairment and also reform testing requirements for drivers.

Buttigieg, who hasn’t commented on the department’s cannabis testing policies before, has in the past called for the legalization of marijuana and the decriminalization of other drugs that are still classified as illegal substances.

Currently, the Department of Transportation has made it compulsory that drivers undergo a urine test, which experts and advocates say is problematic. This is because metabolites of THC can stay in an individual’s system for weeks after cannabis has been consumed.

A proposed change in policy would enable the use of saliva-based tests. THC can usually be detected in saliva anywhere from 1 to 24 hours after the use of marijuana. The new proposal also establishes a cut-off point for testing for THC, which will stand at four nanograms per ml. This cutoff will enable the detection of cannabis while eliminating the possibility of getting a positive test from passive exposure.

During a recent press briefing, Blumenauer also stated that the federal government needed to allocate resources to find alternative methods that could be used to determine impairment. Blumenauer, who is the Congressional Cannabis Caucus’ cochair, added that blanket disqualifications caused widespread social and economic damage, and were also unfair and wild. In addition, he explained that the policies around drug testing and cannabis had a different impact on individuals, as individuals of color were more likely to be targeted. This is despite reliable data showing that there were similar rates of marijuana use across races.

420 with CNW — NIH to Fund Studies Exploring Marijuana’s Role in Cancer Treatment

The National Institutes of Health (NIH) has published a notice calling on interested researchers to apply for funding to facilitate studies related to the role cannabis can play in various aspects of cancer treatment. In that notice, the federal agency revealed that one out of every four patients with cancer report using marijuana products in order to manage the symptoms they experience. These symptoms include pain, nausea and anorexia. However, NIH points out that despite these reasons for using marijuana, there is scant research about its efficacy and any potential risks that the cancer patients may be exposing themselves to.

The funding is therefore intended to promote studies geared at understanding the different mechanisms through which cannabinoids and cannabis in general influence cancer biology, interception and treatment as well as cancer resistance. Studies looking into oncology symptom management also qualify for the federal funding.

The notice also delves into an overview of existing studies exploring marijuana’s relationship with cancer. According to the NIH, the present epidemiological studies on cancer and marijuana haven’t yielded consistent or definitive findings. For instance, some studies suggest that smoking marijuana exposes an individual to harmful compounds, but no study has so far been able to demonstrate a link between smoking marijuana and increased cases of lung cancer.

The National Institutes of Health also provides eight areas of interest that qualify for funding by the federal agency. These include how ethnicity or sex disparities manifest when cannabinoids and marijuana are being used to treat cancer or manage the symptoms triggered by cancer treatment; developing relevant study models through which a better understanding of the role of marijuana in cancer treatment can be attained; and defining the exact effects that marijuana/cannabinoids have on the treatment of cancer, among other study areas.

420 with CWN — Report Shows High Taxes, Marijuana Deserts Stoking California Black Market

According to a recent report by Reason Foundation, the high taxes levied on state-approved marijuana products as well as the “marijuana deserts,” or localities and municipalities that have banned cannabis sales, have helped the black market to thrive within the state.

Geoffrey Lawrence, the managing director of Reason Foundation, says approximately 80% of the localities in California have enforced bans or some form of restriction on marijuana cultivation and sale. He also says that retail outlets are few and far between for the more rural regions of the state. This makes it hard for residents in these areas to access marijuana from licensed sources. Consequently, illicit suppliers have taken advantage of this situation to meet the demand that cannot be satisfied by regulated companies.

To show how significant this shortage of retail outlets is, Lawrence points out that nearby Oregon has a cannabis retail facility for every 6.1 residents while the more populous California has a licensed outlet for every 29.2 residents. This per capita distribution of marijuana retail outlets creates opportunities for black market operators to fill the gaps left by state-regulated cannabis suppliers.

Law enforcement agencies say that many illegal cannabis grows exist in northern California as well as in southern Oregon. A number of these illicit grows are run by Mexican drug cartels, and there are concerns that these gangs could be using illegal immigrants to work in those cultivation sites.

Reason Foundation is calling on the state government in California to reduce the taxes imposed on marijuana products so that the cost can come down and squeeze black market operators out of the sector. To support this argument, Lawrence says that Oregon imposes 17% as state tax and allows localities to levy an extra 3% or less.

As a result, Oregon doesn’t have as much of a black-market problem as California does, where the state levies a 15% excise tax, 8.5% as sales tax, and several local taxes on cultivation and manufacturing as well as retail and distribution taxes. These numerous taxes make legal cannabis at least 40% more expensive when compared to what is available on the black market.

Once these taxes are reduced, sector players will have a better chance of running profitable enterprises as more people will abandon black market cannabis in favor of legally sourced products.

The report released by Reason Foundation also calls on authorities to look for ways through which local authorities can be encouraged to permit cannabis business activities in order to make marijuana more accessible to those interested in it.
