The number of Democratic and Republican senators showing their support for including marijuana banking in the COMPETES Act is growing, and this suggests that not all is lost in regards to enacting a marijuana policy reform this year.

It should be noted that the marijuana banking bill was left out of the Senate version of the Innovation & Competitiveness Bill approved by the Senate, but it was included in the version passed by the House of Representatives. A bicameral conference has been established to work on the language of the final text, which will be forwarded to the desk of the president for enactment. Support is growing to include marijuana banking in that final text.

Senator Patty Murray, the third-most ranking Democrat in the upper legislative chamber, has taken the lead in urging fellow legislators in the Senate to support the inclusion of cannabis banking in the manufacturing law, which will be sent to President Joseph Biden. Murray says that she is using every way available to fight for the inclusion of marijuana banking. She notes that at the moment, the marijuana industry has been forced to operate on cash-only terms, and this puts employees and patrons of marijuana businesses in danger. She adds that this danger can be alleviated, and the bicameral conference discussions offer an opportunity to do just that.

Sen. Steve Daines, a Republican from Montana, agrees with Murray and adds that he thinks that other Republican senators can support the banking legislation. He points out that the bill already has the support of nine GOP senators, and he believes that many more would cast their vote in support of the cannabis banking measure should it ever be put up for a vote, even as a standalone piece of legislation.

The legislators selected to serve as conferees have until August to work out the final text of the innovativeness and manufacturing bill so that as attention shifts to the upcoming midterms, this crucial piece of legislation will have been completed. Legislative work has been known to grind to a crawling pace as attention shifts to the elections.

It is noteworthy that Senate Majority Leader Chuck Schumer has been opposed to passing cannabis banking legislation without addressing social equity issues and expunging nonviolent marijuana convictions. Since no new provisions can be added to the SAFE Banking Act during conference sittings, it is highly likely that Schumer could try and block the banking provisions from inclusion in the text sent to the president.

It remains to be seen whether the spate of violent robberies targeting cannabis shops will impress upon the conferees the urgent need to allow marijuana firms to have access to banking services. Once that banking is permitted, it will create a trickle-down effect that extends to entities that don’t touch the plant directly but are enablers of the industry in one way or the other, such as Advanced Container Technologies Inc. When the current wave of marijuana legalization hadn’t fully taken root around the country, concerns about impaired driving mainly focused on alcohol. Today, impaired driving can be due to alcohol, cannabis and, in some few cases, medications.

For a police officer looking for impaired drivers, there is a growing challenge to distinguish cannabis impairment from impairment caused by alcohol consumption. This is because there is no agreement about how much THC, the cannabis compound responsible for making users high, is sufficient to cause a driver to be impaired. Additionally, impaired drivers exhibit the same signs, such as swerving while driving, delayed reactions while at traffic intersections, driving too slowly or too fast, and so on.

As a result, law enforcement agencies in different jurisdictions are having to tweak their protocols and procedures in order to take action against those suspected to be driving under the influence of cannabis (DUIC). Captain Rick Bancroft, who works in the sheriff’s department in Monroe County, New York, defines drugged drivers as drivers who are impaired by a substance that isn’t alcohol. Such a person drives in a way that is unsafe to themselves and other road users, which is why impaired driving is of concern to law enforcement.

Since there is no acceptable test to rule out or confirm cannabis impairment, Bancroft says that officers now have to rely on the normal sobriety tests that they have been conducting and then add the special measures drug-recognition professionals recommend when deciding whether someone is driving under the influence of marijuana or not.

Some police departments, such as the Rochester PD, have a 12-step process to help in identifying people who are suspected to be impaired by cannabis.  For example, an officer may use a breathalyzer to find out whether a driver exhibiting the signs of impaired driving has a blood alcohol level exceeding the legal limit.

Once alcohol impairment is ruled out, the officer may look at the taste buds at the back of the mouth to see if they look dark and are swollen. This is often a sign that someone has consumed cannabis a short while before. The pupils will also be dilated while the eyes will be bloodshot.

For people who show signs of cannabis impairment, an ultraviolet light is shone on the tongue and if red patches show on the tongue, THC consumption is strongly suspected. The screening process continues until as many of the 12 steps as possible have been exhausted. An arrest is then made, and the struggle to prove cannabis impairment in court begins.

420 with CNW — New Poll Suggests Parents Are Willing to Give Kids CBD

Cannabidiol (CBD) is a chemical compound produced by plants in the cannabis family. Since most of the CBD on the American market is extracted from hemp, a nonpsychoactive form of cannabis, cannabidiol will not intoxicate you. For the past couple of years, people have been turning to this hemp extract as an alternative medicine for a variety of health problems. Studies have shown that it can be effective at alleviating the symptoms of medical conditions such as chronic pain, anxiety depression and insomnia.

Furthermore, the FDA has approved a CBD-based drug called Epidiolex to treat two rare forms of pediatric epilepsy: Dravet syndrome and Lennox-Gastaut syndrome.

Experts have cautioned the public against seeing CBD as a miracle cure that can treat any condition, stating the hype around CBD treatments seems to have eclipsed the science. There is limited research on cannabidiol, and we still don’t know much about its potential benefits and risks, especially over the long term.

This problem becomes even more serious when you consider the fact that there are companies making CBD products for children with barely any regulation from the federal government. And according to a new report from the University of Michigan’s C.S. Mott Children’s Hospital, some parents are willing to give their children CBD.

Researchers surveyed 2,020 parents with at least one child aged one to eighteen years old. They discovered that three in four parents were receptive to the idea of giving their children CBD if other medications were not effective. Sarah Clark, the poll’s codirector, says the results point to parents being more open-minded about CBD treatments.

However, the report noted that most parents do not have access to crucial information about CBD. One-third of the respondents didn’t know that CBD was nonpsychoactive and believed that using the cannabinoid is no different from using marijuana. Such parents would be more likely to prevent their children from using CBD even when they could benefit

Clark believes that parents who don’t understand the difference between CBD and THC (the main psychoactive agent in cannabis) can be properly educated via continued exposure and explanation. On the other hand, she is optimistic that the respondents who expressed that they would give their children CBD if other medications did not work at least have a basic understanding of the cannabinoid. Those parents realize that there is no miracle medicine that can cure every childhood ailment, she says.

The poll also revealed that 83% of parents believed the FDA should regulate CBD products meant for children, and 74% feel that you should have a doctor’s prescription before you can give CBD to your children.

420 with CNW — Congressional Bill Wants Parity Between Cannabis, Alcohol-Linked Punishments in the Military

Ever since states started legalizing cannabis, the sector has existed in a precarious position, allowed by state law but prohibited by federal law. More than once, consumers have found themselves penalized for doing activities that are allowed by state law, such as consuming cannabis, by organizations that abide by federal law.

For starters, military service members who are found in possession of up to 30 grams of marijuana are eligible for a maximum punishment of dishonorable discharge, two-year confinement, and forfeiture of all their pay and allowances.

Given that some studies have found that cannabis can help alleviate the PTSD many active and retired service members suffer from, these penalties are quite harsh. Possession of more than 30 grams of cannabis can result in up to five years of confinement. Consequently, Rep. Anthony Brown has introduced a new bill to Congress that would do away with most of these harsh penalties.

The Restoring Equity for Offenses Related to Marijuana (REFORM) Act would make it so that the penalties for using marijuana wrongfully do not exceed the penalties for being found while on duty. Furthermore, the text of the legislation states that the punishment for wrongful cannabis possession shouldn’t exceed the penalties for incapacitation for work due being drunk or having used a drug.

Compared to the penalties military service members are subject to if they are found in wrongful possession of cannabis, being incapacitated for duty due to alcohol consumption can lead one to forfeit two-thirds of their salary for three months or confinement for three months. Service members who are drunk while on duty face discharge due to bad conduct, total forfeiture of their pay and allowances, and up to nine months of confinement.

Brown’s bill seeks to remove the disparity between the punishments for alcohol and cannabis possession and use. Speaking to Marijuana Moment, he noted that cannabis prosecutions tend to disproportionately affect service members of color. Black service members are even more likely to be investigated and prosecuted for offenses connected to drugs, he notes. Calling the current zero-tolerance marijuana policy outdated, he says that it is “disconnected from the present reality,” especially when considering the fact that many service members enlist from states with legal cannabis markets.

On top of equalizing the penalties for cannabis and alcohol use, the REFORM Act would also require that military branches send annual reports about drug evaluation and testing programs to congressional defense committees.

Denver, Colorado, has always been a major attraction as a travel destination, and tourist numbers have put pressure on the hotel industry to ramp up.
