A federal court of appeal in the U.S. has shot down a request by the Drug Enforcement Administration (“DEA”) challenging a lawsuit against the existing marijuana classification in the federal law. The federal agency was sued by veterans and scientists over their decision to declare cannabis as belonging to schedule 1 of the Controlled Substances Act.

The decision sparked mixed reactions among various players in the marijuana sector who termed the move unconstitutional.

The petitioners in the case argued that the DEA’s scheduling standards misinterpreted the federal law. DEA’s contentious claim dismissing marijuana’s approval for use in medication has set the center stage for protracted legal battles among various actors.

Typically, the government’s stand dismissing the medicinal value of marijuana has disgruntled various marijuana industry players.

The DEA led the government to believe that marijuana hasn’t been proved to be safe for use in the medical sector. In the case, the petitioners argue that a proposal by DEA calling for strict control in the use of marijuana is unconstitutional. A number of times, the DEA has been taken to court by Scottsdale Research institute SRI over dubious marijuana policies. The policies are said to hurt the cannabis industry. SRI has been instrumental in pushing for changes in policies governing the marijuana industry, and it is one of the applicants for licenses to manufacture marijuana for research purposes.

Most petitioners in the case have raised concerns about the DEA’s scheduling standards based on government perception that marijuana has no proven medicinal value. In this case, the push and shove in proper policies to guide the cannabis industry has brought a back and forth kind of approach that has delayed the release of appropriate laws and regulations to govern the marijuana sector.

Shane Pennington, one of the legal counsels representing Scottsdale Research Institute SRI indicated that a 9th circuit panel is anticipated to review the arguments of the case and give a decision based on merit.

Recently, the Centers for Disease Control and Prevention (“CDC”) published a notice in the Federal Register asking stakeholders like patients, their families or caregivers as well as health workers to request to participate in conversations about the alternatives to the use of opioids in chronic pain management. These meetings will help to educate the federal government about how marijuana and other alternative treatments can be helpful in managing or treating pain.

In response to the notice, Americans for Safe Access, through its staffer Heather Despres, has written to the CDC requesting to get an individual session during one of those meetings which are expected to last between 45 and 60 minutes.

Americans for Safe Access is a nonprofit which has been advocating for access to medical marijuana since 2002. Despres wants to be selected for one of the 100 planned sessions so that she can talk about pain management from a personal as well as from a professional perspective.

On a personal level, she says she developed chronic pain as a result of pregnancy-related complications as well as from a broken leg she suffered. She reveals that she has been using medical marijuana to deal with this pain on days when it isn’t so intense, then she uses prescription opioids on those days when the pain is severe. Medical marijuana has therefore helped her to use fewer prescription opioids while maintaining a better quality of life.

Professionally, Despres says she interacts with patients on a daily basis and these patients share how marijuana has been instrumental in helping them to manage the pain they suffer from. In some cases, medical marijuana was the only option that could bring any relief.

Heather Despres therefore looks forward to being given an opportunity to share these experiences with the federal officials in the conversations to be hosted. She also calls upon patients, caregivers and other stakeholders to write expressing their interest in sharing their stories with the CDC so that the federal agency can have extensive stakeholder input while formulating policies on how chronic pain can be managed without making the current opioid crisis worse than it already is. Interested parties have until Friday to submit their request for participation in the planned meetings.

This isn’t the first time that the federal agency is seeking public input on pain management. The CDC’s injury prevention and control center previously asked for stakeholder input on their preferred method of pain management and they received more than a thousand comments on marijuana and kratom.

420 with CNW – How Marijuana Dispensaries Differ from Liquor Stores

Are you considering visiting a local marijuana dispensary for the first time? You may think that they don’t differ much from liquor stores, they are both retail establishments that sell a drug after all. Heck, cannabis advocates looking to legalize recreational marijuana said that once legalized, it would be taxed and regulated “in a manner similar to alcohol.” Adults 21 and over would ideally be able to stroll into a cannabis dispensary, grab whatever they need, and leave shortly, as they would in a liquor store. However, cannabis is a unique industry that’s unlike any other, and it differs from alcohol in several ways.

For starters, marijuana dispensaries are a lot more serious about the age limit. While you have to be 21 years old to buy alcohol from a retail establishment, liquor stores can be a little lax with their security. It’s not uncommon to see a young fella rifling through their pockets at the liquor store counter for a moment before sheepishly declaring that they left their ID at home but that they are definitely old enough. Dispensaries, on the other hand, require IDs even before you can walk in and many establishments have security personnel posted at the entrance to make sure customers are old enough.

Additionally, liquor stores are known for their fairly quick service. You can walk in, grab whatever you need, pay, and leave in a couple of minutes. You know what you want, you probably know exactly where in the store it is and you don’t need anyone’s help or guidance on how to use your beverage of choice. In a marijuana dispensary, on the other hand, you will most likely have to talk to a ‘budtender’ before you can make a purchase. A budtender is an in-store expert on everything cannabis, and a cannabis dispensary will probably have a few of them on the floor answering customer questions and offering product recommendations.

A trip to a cannabis dispensary will without a doubt take longer. Liquor stores usually have high customer turnovers, with customers completing their transactions within a matter of minutes. At a marijuana dispensary, there’ll probably be a long line of customers, high demand, and all. After showing your ID, you will have to wait for a budtender to guide you accordingly, especially if it is your first visit. Many budtenders are known to spend as much as 10-20 minutes with new customers just to make sure everything is going alright.

While the dispensary experience may be different, most of the measures are there to protect both the dispensary and the customers. They ensure the dispensaries follow state regulations and that customers have access to all the information they need to make informed decisions when they buy and consume cannabis.
