America’s state-legal cannabis industry has achieved quite a lot in a little over a decade. Generating billions of dollars in revenue, it has created hundreds of thousands of new job opportunities and provided states with millions in tax revenue. The industry is projected to grow even larger as it matures and more states join; one group of people who are poised to benefit from the cannabis legalization boom are military veterans.

Cannabis’ federal classification as a Schedule I regulated substance has prevented banks and credit card processors from working with businesses in the cannabis space. This has forced these companies to require cash-only payments, meaning they usually have large amounts of money on hand. Additionally, cannabis itself is a valuable commodity with near-constant demand, and offloading it in the black market is fairly easy for those who know their way around. As such, cannabis retailers and dispensaries have become prime targets for burglars and robbers.

Armed guards are quickly becoming a necessity for any cannabis business with reasonable turnover, and veterans with firearms training are taking up the mantle. Paul Ballenger, a Marine veteran and an Army reservist, is the chief executive officer of Invicta Solutions, which has approximately 400 armed guards stationed in five states. His company provides guards for shopping malls, religious institutions and cannabis companies, among others. With the wave of cannabis reform steadily sweeping across the country, Ballenger’s goal is to have guards stationed in New York, New Jersey and Florida by the end of the year as these key states launch their markets.

In Fresno, California, Operational Security Solutions (“OSS”) hires about 100 armed guards, a lot of them veterans, for cannabis-related businesses. Ryan Hale, the company’s chief sales officer, says OSS has a strict no-drugs policy, stating that marijuana and guns should not mix. Since cannabis businesses are such prime targets, often with lots of cash on site and plenty of cannabis with high resale value on the black market, the guards need to be vigilant and “100% cognizant.”

Veterans often have a hard time finding work after coming back home, with more than half of them finding it difficult to utilize their military skills in a civilian setting. With the cannabis industry poised to see major growth, especially after weathering the coronavirus pandemic like a champ, plenty of vets may finally be able to land employment. Even if lawmakers finally pass cannabis banking legislation allowing financial institutions to work with cannabis businesses, the precious product they sell will need protection.

420 with CNW — State Cannabis Regulators Discuss Effects of Legalization with Members of Congress

Last week, a group of state cannabis regulators met with members of Congress and federal officials to discuss the possible effects that national legalization of the plant and other changes in marijuana policy could have on the programs they manage.

The meeting was organized by the Cannabis Regulators Association. The coalition is made up of members whose states have put an end to marijuana prohibition and would be impacted by any federal cannabis actions.

In attendance were the co-chairs of the Congressional Cannabis Caucus Reps. Dave Joyce and Earl Blumenauer, who spoke with staffers from various congressional offices as well as the state regulators. Representatives from the Alcohol and Tobacco Tax and Trade Bureau, the Food and Drug Administration and the National Institute on Drug Abuse were also in attendance.

In an interview, the Michigan Marijuana Regulatory Agency’s executive director Andrew Brisbo stated that federal officials were open-minded during the discussion, adding that their main objective for the meeting was to highlight how important it was that state regulators have a position to share their perspectives.

Brisbo also observed that promoting economic and social equity, product testing and labeling were among the issues that they discussed during the meeting. In addition, they also talked about laws to protect banks that cater to state-legal cannabis businesses from incurring penalties from federal regulators. Regulators from the states of Utah, Oregon, Nevada, Minnesota, Massachusetts, Illinois, Hawaii, Colorado and California among others also took part in the discussion.

In addition to this, Brisbo stated that they also wanted to make sure that there was consideration for already existing frameworks when federal policies were enacted. He also explained that while some initiatives honored the people’s will and established structures that functioned on the state level, it was important to make sure that the progress made by different states wasn’t overrun by federal policies.

Earlier in the year, the regulators association had penned a letter to congressional leaders who had provided assistance and outlined marijuana policy priorities as legislators consider various reform initiatives that may be advanced during this session.

The priorities included supporting public health initiatives, making certain that there was economic and social equity in legal markets, advancing research on cannabis, offering banking access to state-legal marijuana businesses, and offering protection to states that have legalized cannabis in some form.

At present, the sponsors of a Senate legislation to offer marijuana banking protections are calling for the chairman to put the measure to a vote in Congress.

If such meetings are anything to go by, the entire cannabis industry, including Chalice Brands Ltd. (CSE: CHAL) (OTCQB: CHALF), could soon be looking at enabling laws at the federal level that address many of the existing regulatory contradictions.

420 with CNW — Oregon Marijuana Tax Collection Shatters Annual Record with Two Months to Spare

Marijuana tax collections in the state of Oregon have hit a new fiscal year record, having collected $15 million in April this year, which brings the total to about $146 million. Last year, the state of Oregon collected a total of roughly $133 million in taxes.

At the start of the pandemic, marijuana sales in Oregon increased by 52% in the April to June period, in comparison with the April to June 2019 sales. In the two quarters that followed, increases of roughly 38% were also observed.

Economists in the state acknowledged that at the start of this year, sales rose once more, totaling more than $100 million. This amount, which was made up of $8.7 million in medical use and $91.5 million in adult-use marijuana, accounts for a 46% increase, in comparison with figures from January 2020.

As can be seen above, marijuana sales increased at the onset of the pandemic, slowed down towards the end of last year before steadily rising once more at the start of 2021. This move surprised economists in the state, who had expected marijuana sales to decrease as more people began to go back to work, the economy gradually reopened and other spending opportunities were presented.

The most recent forecast released by the state’s Office of Economic Analysts noted that predictions showed that short-term sales would improve as a result of strong household finances, an economy without fully reopened entertainment options and the ongoing coronavirus pandemic. In addition to this, economists stated that they expected marijuana sales to diminish in the fall as the aforementioned issues faded, noting that in the long term, the state’s marijuana industry would flourish once more.

In their updated forecast, the economists assert that the growth rates projected in the long run align with the office’s personal income outlook, which took into consideration wage gains and the increasing population, arguing that they were the primary drivers of recreational cannabis sales in the future. This, in dollar terms, equates to an extra $21 million prediction for the 2021–2023 period. These figures are in comparison to last year’s forecast, which cited $298 million as the forecast for the 2021–2023 biennium.

Additionally, the economists’ forecast from three months ago for the same period stood at $354 million.

Presently, the state of Oregon taxes retail marijuana sales at 17%, with local governments being allowed to add their own tax, which should not exceed 3%.

Before the state of Michigan legalized marijuana, various areas in the Southwest were filled with empty storefronts and warehouses. However, the plant’s legalization brought with it marijuana-industry investors into the state who were looking for locations to process and grow plants, as well as establish dispensaries.

City leaders in southwest Michigan state that the marijuana industry has brought more than 10 years’ worth of redevelopment to the area, adding that even more projects are scheduled to begin in the next year or so. In the last two years alone, the sum investment in equipment and buildings in Buchanan and Niles has surpassed $50 million, with the cities noting that more than 250 new employment opportunities have been created in each city. Additionally, taxes collected by the state from cannabis businesses in the area have been allocated to different communities.

Thus far, there are nearly a dozen provisioning/dispensing centers in Edwardsburg, Buchanan and Niles, with plans to launch more, including micro-businesses. In addition to this, there are more than 10 growing operations in the Galien, Eau Claire, Benton Harbour, Buchanan and Niles Townships, with more planned.

Apart from the willingness of local officials to consider cannabis businesses, investors are also interested in the area because of the many available empty buildings that can be turned into facilities to cultivate, process and pack marijuana or establish dispensaries. Other investors have also been attracted to the abandoned storefronts in Buchanan and Niles, planning to turn them into adult-use and medical dispensaries, providing convenience for consumers from Indiana as well as other locations.

Officials are hopeful that the investments and employment opportunities will continue to increase in the near future as the marijuana market develops further in Buchanan, Niles and other areas. The development of the marijuana market throughout the state is also facilitating the entrance of new businesses such as Biggby Coffee and Culver’s, as foot traffic increases.

Earlier in March, the state’s Department of Treasury announced that it would be dispensing $10 million to more than a hundred counties and municipalities as part of the taxes gathered on recreational cannabis sold in the state. Department officials added that roughly $24 million would be divided evenly between the Michigan transportation fund and K-12 education.

Most of the buildings that have been occupied by marijuana retailers and cultivators might have otherwise been torn down. For instance, the Simplicity plant, which covers roughly 750,000 square feet and is currently being restored for use by marijuana processors and cultivators, was due to be torn down.

420 with CNW — Projections Show Oregon’s Cannabis Market May Grow Stronger

Despite the effect of the coronavirus pandemic on various industries, the cannabis industry in Oregon has persisted, with forecasts showing that cannabis sales will continue to increase. An economic forecast report released by analysts with the Office of Economic Analysis in the state’s Department of Administrative Service stated that while cannabis sales in the winter aligned with forecasts, sales in the recent months had grown.

The report notes that it isn’t clear whether the cannabis sales data shows increased spending power from stimulus checks that were sent out in March or a growth in demand for marijuana products. It does highlight, however, that other states where the plant is legal, such as Illinois, have recorded similar trends in their marijuana sales during this pandemic period.

In the report, the economic analysts stated they were focused on how much the demand for recreational cannabis would increase in the near future. They explained that they were using federal data collected on the proportion of the adult population who use marijuana, noting that in the state, the rate has been about 20%, which may indicate slow sales in the future. However, the analysts added that the information could be biased given that this was a federal survey and cannabis is still illegal at the federal level.

Generally, the analysts noted that they expected cannabis sales in the short term to remain on the higher side because of an economy with options of entertainment that aren’t fully reopened, strong household finances and the ongoing pandemic. They add that as factors related to the pandemic are resolved into the fall, sales will slowly decline.

However, cannabis sales in the long term are expected to grow. The analysts speculate that this may be brought about by an increase in wages as well as a growth in the state’s population, which will boost demand. Prior projections showed relatively minimal growth in the future as the recreational cannabis segment matured. The analysts assert that while this assumption fundamentally remains unchanged, growth may still increase, prompted by underlying gains in the economy.

Recent projections for marijuana tax revenue in the state show that more than $300 million will be generated in the 2019–21 biennium. The analysts note that this figure will continue increasing each biennium, surpassing $450 million in the 2027–29 period. Currently, some of the tax generated is being used to finance the expansion of the state’s substance misuse treatment.

Last year, voters in the state passed a drug decriminalization measure that called for some cannabis tax revenue to support these services.

420 with CNW — Wyoming Supreme Court Admonishes Prosecutor for Allowing False Testimony to Be Presented in Court

The Supreme Court in the state of Wyoming has admonished an attorney in Cheyenne for permitting a DCI agent to make a false testimony in a case against hemp growers.

Last year during a hearing of the case, Special Agent Jon Briggs of the Division of Criminal Investigation gave a false testimony about an exchange he had with one of the defendants when officers conducted a raid on the operation. The defendant, a contract farmer by the name of Brock Dyke, presented to the agent test results that showed that the hemp crop was legal during the raid, which took place in 2019. However, during preliminary hearings, Briggs asserted that the tests possibly showed that the hemp was above the legal limit of THC, which was false. The case sought to prosecute hemp growers as cannabis traffickers.

Hemp has been legal in Wyoming since 2017. However, under the state’s law, hemp plants shouldn’t have a concentration of more than 0.3% THC.

David Singleton, the senior assistant district attorney in Laramie County, was the presiding prosecutor in the case.

After the hearing, Tom Jubin, who was the defendant’s attorney, asked Singleton and Briggs to correct the record. However, the two tried to reinforce the false testimony once more in a court hearing a few months later.

The order of public censure released by the Supreme Court shows that during this hearing, which was held in August, Briggs not only reiterated his false testimony but also stated that he was not aware of the request by the defendant’s attorney. For his part, Singleton acknowledged that he violated the state’s judiciary rules of professional conduct and agreed to pay administrative fees to the Wyoming State Bar.

Brock Dyke revealed in an interview that during the raid, which occurred in November 2019, the DCI seized more than 600 pounds of hemp, noting that law enforcement officers armed with rifles and in tactical gear carried out the operation.

Singleton was trying to charge the hemp farmers whose operations were raided with drug trafficking charges. However, the attempt was thwarted after Antoinette Williams, the circuit court judge in Laramie County, dismissed the charges during the hearing in August.

It is yet to be confirmed whether Briggs will be charged for giving a false testimony. Additionally, Forrest Williams, director of the DCI, hasn’t responded to a request for a comment.

This Wyoming case highlights some of the challenges that cannabis sector players face as they conduct lawful activities and shows how much additional reforms are needed before cannabis entities such as Chalice Brands Ltd.
