420 with CNW – Study Finds Overregulation Encourages Illicit Marijuana Market in Legal States

The excessive regulations in the U.S. states where marijuana is legal could be the reason why the marijuana black market continues to thrive, according to a new study.

This conclusion came at the end of an exploratory study that crunched the numbers on data from the first two states to legalize recreational marijuana. This quantitative analysis focused on the news reports about the crime rates in the two states.

The findings of the analysis were mixed. On the one hand, the marijuana crime rates in Colorado remained unchanged while those in Washington State increased significantly once stricter regulations were implemented.

The research that came up with these findings was in a master’s thesis of a graduate student. Sikong Song, at Portland University in the criminology and criminal justice department.

The graduate student reveals that he was interested in finding out why the black market for marijuana persists even when a legal market exists. The assumption has always been that once a regulated market opens, then cultivators, processors and other players can operate above board. But that isn’t happening, and Song wanted to find out.

For example, a study done last year found that 18 percent of adults bought marijuana from the illicit market in California.

To find out if there is any connection between the degree to which state marijuana laws are strict and the level of marijuana-related crimes, Song studied the articles that were published between 2013 and 2019. Those articles featured black market cultivators, sellers, processors and consumers. The reports included the reasons why those people were involved in the illegal marijuana market.

In Washington State, the graduate student considered June 2016 as what he called “the intervention point.” For Colorado, the intervention points were November 2015 as well as January 2017. These dates were selected because of their significance in changing the regulatory landscape in the two states. For example, new packaging rules were released in Colorado in 2017.

The news reports are full of descriptions like “overregulation,” “high taxes,” “cost of compliance,” and other such phrases to describe what the interviewees said were the barriers to their entry into the legal marijuana market.

The author of the study concludes that from his findings, the intensity of the regulations governing the legal marijuana industry could explain why there is a spike in marijuana crimes in some of those states and leveling off of such crimes in other states.

He therefore called on lawmakers to think seriously about some of the unintended consequences of passing strict marijuana regulations, such as making it harder for smaller players to gain entry into the regulated market.

Scientists recently discovered that chocolate inexplicably complicates the process through which the potency of marijuana edibles can be tested. This discovery was revealed during the American Chemical Society conference held on Sunday.

David Dawson, the principal investigator, revealed that the THC potency of marijuana edibles can be affected if those products contain chocolate. These findings could make manufacturers, regulators and consumers to rethink everything they know about marijuana edibles.

To illustrate the ramifications of his findings, David Dawson referred to the law in California which requires any marijuana edible whose THC content is found to be less than what is indicated on the label by 10 percent to be relabeled while those that are tested and are found to exceed the concentration indicated on the label by 10 percent have to be destroyed.

While presenting his findings, Dawson said that he and his team were surprised to find that if they took a sample of a gram of marijuana-infused chocolate and put it in a vial, the potency test results were more precise than when they put 2 grams of the same marijuana-infused chocolate in a vial and tested it.

This discovery goes against the basic assumption that the bigger a sample is, the more that sample accurately represents the whole.

The findings mean that marijuana potency tests can be skewed in either direction by simply changing the size of the sample that a laboratory analyst tests. This abnormality can have serious consequences for consumers (who may overdose or under-dose) and manufacturers (who could be forced to re-label or destroy a batch of products).

The researchers were unable to pinpoint what exactly makes chocolate have this effect during the potency-testing process, but they were of the view that the fat content of chocolate could be responsible.

The team was also unsure whether a similar trend existed when other marijuana-infused products, such as lotions, which didn’t contain chocolate are tested for potency.

Dawson and other researchers now have the task of conducting similar tests on other cannabis compounds, such as cannabidiol (CBD), to establish whether they also exhibit the same trend as what they found in cannabis-infused chocolate. The findings of such an inquiry would be of great interest to entities like the FDA which are in the process of making rules through which CBD can be used as an ingredient in food, cosmetics and dietary supplements.

The findings of this research highlight how much more would have been known about marijuana and its compounds if the federal classification of the drug hadn’t made it so hard for scientists to study it. Last weekend saw festival-goers in Northern California treated to the first ever major festival to sell marijuana on-site. This happened during the Outside Lands music festival which was held between August 9 and 11 in San Francisco at the Golden Gate Park.

The event had a cordoned-off area called Grass Lands where marijuana and music lovers were delighted to learn that they could buy different marijuana products. More than 20 cannabis vendors were in this section of the festival grounds to serve customers.

While consuming marijuana in public is still illegal in California, the Outside Lands music festival provided a rare opportunity for people to buy and consume pre-rolled joints, marijuana-infused chocolates and other products. People who wanted to smoke their weed could do so in a clearly marked smoking area.

The Outside Lands festival was also notable because it had another first for California. State law doesn’t permit the sale of weed and alcohol within the same venue, but festival attendees could enjoy both. The only restriction was that no one was allowed to enter Grass Lands with an alcoholic beverage, but alcohol was abundant in the other sections of the festival venue.

Grass Lands made its first appearance at the Outside Lands festival last year. During its maiden appearance, only educational materials were available for festival-goers to learn about marijuana and its numerous benefits.

This year, the organizers of Grass Lands had to wait until August 7 when the San Francisco Office of Cannabis finally approved the application for on-site sale of marijuana during the festival. This approval came just two days before the Outside Lands festival was due to start.

The people who attended the festival were allowed to buy a maximum of 2grams of marijuana concentrates while those who wanted cannabis flower could only buy up to 7grams of pot.

Many of the vendors at Grass Lands, such as Kiva Confections and NUG, revealed that their objective in taking part during this year’s Outside Lands festival was to help in making conversations about cannabis and its use normal in society.

As the first event at which cannabis has been sold and consumed in the state, this year’s Outside Lands could be a pointer of what is yet to come for the cannabis industry.

The working group created by New Mexico Gov. Michelle Grisham (D) announced on Friday that it would be holding its first public meeting on August 14. During that meeting, several issues connected to plans to legalize recreational marijuana in the state will be discussed.

Individual residents and groups are free to comment either in advance or during the actual meeting on the topics lined up for the day. During that meeting, the Department of Health will address the people present about the medical cannabis program in the state while the Department of Regulation and Licensing will deliver a presentation about the current status of cannabis regulation.

The committee members will then discuss various issues, such as recreational marijuana marketing, the option of creating state-operated marijuana shops, how licensing should be done and whether a marijuana control division should be created by the state.

The website of the working group has a landing page for almost all the items lined up for discussion during this maiden meeting. On those pages, visitors will find the specific goals that the committee has for that area, the questions that the committee plans to answer on that topic, details about how that particular aspect was going to be legalized under the bill which was put before lawmakers, and how other states have legislated on that matter.

At the bottom of each of those pages, online visitors will find a form that they can use to share their opinion on that specific aspect of marijuana legalization.

For example, on the matter of whether the state should directly run a marijuana retail network, the working group posed a question regarding what risks, if any, the state employees will face by participating in what the federal government calls “drug trafficking.” The committee also posed a question on how else a fair distribution of marijuana shops can be ensured if the state isn’t to be involved in retail sales.

Once an item on the list is discussed extensively, the members of the working group will finally take a vote on the matter and move onto the next item on the agenda. The members of the working committee are also free to suggest policy proposals for discussion by the entire group following a method that will be explained during the meeting on August 14.

Another meeting of this committee will be held on August 27 to handle other matters connected to cannabis legalization.

It should be remembered that Gov. Grisham made a campaign promise to legalize recreational marijuana and she formed the working group after a legalization bill failed to pass in the state senate. The findings of the working group will form the basis of a new legalization bill which will be tabled before lawmakers early next year.

420 with CNW – Poll Finds Cannabis Legalization More Popular than $15 Minimum Wage and Free College Education

A new national survey has found that legalizing marijuana is more popular than providing free college education and instituting a $15 minimum wage across the country. The poll, conducted by Marist Poll, was funded by PBS NewsHour and NPR.

In the poll, 1,346 adults from across the country were interviewed over the phone between July 15 and 17 about their views on 20 policy proposals. More specifically, the respondents were asked to state whether those policy proposals were or weren’t a good idea. 63 percent of the people polled said legalizing cannabis was a good idea while 32 percent were opposed to this policy proposal.

Only four policy proposals ranked higher than cannabis legalization during this poll. Those policies are; making it mandatory for a background check to be done before anyone buys a firearm, government passing regulations for the prices of prescription drugs, giving people the liberty to opt in to Medicare, and creating a mechanism through which people who enter the U.S. illegally can acquire citizenship.

On the issue of Medicare, 70 percent of the respondents said that they supported a system that would allow people to choose between being on the national healthcare insurance scheme and enrolling on a private one.

The findings of this poll provide some explanation as to why many see marijuana policy reform as a politically correct view to hold. For example, almost all the 2020 Democratic presidential candidates have voiced their support for cannabis legalization.

That said, previous polls suggest that advocates shouldn’t be excited by this development since marijuana policy reform hasn’t yet become a strong enough issue upon which political offices can be won or lost across the country. Many voters would still elect a candidate even if that candidate wasn’t in favor of marijuana legalization.

The Marist Poll also highlights the ideological and demographic patterns defining whether someone thinks cannabis legalization is a good or bad idea. For example, more Democrats (74 percent) support legalization while less than half of Republicans are in favor. Younger adults are also more likely to welcome legalization when compared to those who are passed 50.

All in all, this particular poll doesn’t differ from the findings of the Gallop poll of June this year which found that 64 percent of American adults want to see marijuana legalized. Industry analysts believe the cannabis industry, including Geyser Brands Inc. (TSX.V: GYSR) and Earth Science Tech Inc. (OTCQB: ETST), must be wondering when all this public support will eventually trigger federal marijuana policy reform.

420 with CNW – Senate Committee Confirms Marijuana Banking Hearing Date

On Monday, we reported that a key senate committee would soon schedule a hearing on marijuana banking. Now the Republican-controlled committee on Banking, Housing and Urban Affairs has revealed that it will hold this hearing on Tuesday next week (July 23).

This announcement comes as yet another indicator that marijuana reform is gaining momentum at the highest levels of decision making in the country. The legislation to be discussed is geared at finding a solution to the challenges that marijuana businesses have been having regarding access to banking services.

A similar law, which was passed by a Congressional committee, now has almost half of the members of Congress as co-sponsors after 206 representatives signed on. The Senate companion bill so far has 32 senators signed on from a total of 100 senators in that chamber.

The senate hearing slated for Tuesday is titled “Challenges for Cannabis and Banking: Outside Perspectives.” Representatives of CUNA (Credit Unions National Association), Smart Approaches to Marijuana (a prohibitionist advocacy group) and Citywide Banks will testify during this hearing.

Jim Nussle, the CEO and president of CUNA remarked that his organization was willing and happy to work with senate leaders to find a solution to marijuana banking which is a public safety issue.

John Lord, the CEO of LivWell Enlightened Health (a marijuana retail chain) is also lined up to testify before the senate committee, as will Cannabis Trade Federation’s Neal Levine (who also testified before a sub-committee of Congress on how prohibition can be ended).

Sen. Cory Gardner (R-CO), the main GOP cosponsor of the Senate cannabis banking bill has also been booked to appear before the committee during this hearing.

Support for marijuana banking has been growing steadily with pressure being mounted for action on this matter by the highest financial sector regulators in 25 states, a huge majority of state attorneys general, 20 state governors from both sides of the political divide, banking associations from 50 states across the country and the National Association of State Treasurers. All these groups want the STATES Banking Act to be passed by Congress.

While Chairman Crapo is personally opposed to marijuana, his scheduling of the senate committee’s hearing on this matter shows that he recognizes that matters of cannabis banking present serious public safety concerns that have to be addressed soon rather than later.

Consensus is also growing on the need to make broader reforms to marijuana policy beyond access to banking services. The clearest example of this was the Congressional subcommittee hearing last week at which all parties agreed on the need for reform although there were some disagreements on how that reform can be realized.

Industry watchers believe that the entire marijuana industry, including Geyser Brands Inc. (TSX.V: GYSR) and Earth Science Tech Inc. (OTCQB: ETST), is now encouraged to believe that federal marijuana reform may happen soon.

420 with CNW – Alzheimer’s Patients Can Now Register for Medical Marijuana in Minnesota

Starting from July 1, patients suffering from Alzheimer’s can start enrolling for medical marijuana in Minnesota. Once these patients are registered, they will be permitted to buy medical marijuana from the two licensed manufacturers in the state.

The Department of Health first announced in December last year that Alzheimer’s would be added to the list of qualifying conditions for medical marijuana.

While a review panel had recommended that seven conditions be added to the list, only Alzheimer’s was approved by Jan Malcom, the Health Commissioner. The others which had been proposed include traumatic brain injury and opioid use disorder.

The addition of Alzheimer’s now brings the number of medical marijuana qualifying conditions to 14. This number has been growing every year since the medical marijuana program started five years ago with just 9 qualifying conditions.

Currently, statistics put the number of patients on the state’s medical marijuana program at 15.687 by March 31. The inclusion of Alzheimer’s among the qualifying conditions has the potential to increase the number of registered patients significantly since the Alzheimer’s Association estimates that there are at least 94,000 people who are living with Alzheimer’s in the state. Even if just one tenth of this number signs up for medical marijuana, the patient numbers on the program will swell by a huge percentage.

It isn’t just the Alzheimer’s patients who will benefit when medical marijuana is available. Approximately 254,000 family members and friends are involved in taking care of these patients. When marijuana brings improvements in the behavioral effects of Alzheimer’s, it get easier for caregivers to look after their loved ones.

The Department of Health in Minnesota will use the month of July to process the applications of Alzheimer’s patients and these people will start accessing medical marijuana on August 1. The details of what patients require in order to be certified on the program have been availed on the department’s website.

While no scientific studies have provided any conclusive proof that marijuana can cure, prevent or slow the progress of Alzheimer’s, some recent studies suggest that this could be possible. A small study recently showed that marijuana inhibits the formation of the protein plaque which has been associated with the onset of dementia, one of the leading symptoms of Alzheimer’s.

Minnesota now joins the ranks of states and territories which have included Alzheimer’s among the conditions for which patients may use medical cannabis. Marijuana industry advocates speculate that while the industry players like Earth Science Tech Inc. (OTCQB: ETST) and Choom Holdings Inc. (CSE: CHOO) (OTCQB: CHOOF) may have been disappointed that only one condition was added, they could be pleased that thousands of patients and their families will benefit from medical marijuana.

420 with CNW – Company Invents CBD Extraction Method Aimed at Bringing Prices Down

While the popularity of cannabidiol (CBD) has been growing, the current price of high-quality CBD oil is so high that it is out of reach for many of the people who need it the most. Draconis Extraction Technology (DET) has come up with a system which will extract crude CBD on an industrial scale and lower the cost of the final product.

The large-scale ethanol extraction process is patented and is set to start being used to avail winterized, full-spectrum de-waxed CBD oil.

Paul Baskis, the person who invented the extraction system says he was driven by a desire to help those who badly need CBD oil but struggle to afford it. He singled out veterans who suffer from different conditions, such as PTSD and anxiety.

Currently, 1,000mg of CBD oil costs $350 on the market and this oil can last approximately 11 days for a person weighing 180 pounds with a recommendation of 5mg for each pound of body weight. How many people can afford such a cost, he wondered.

The technology introduced by DET will make it cheaper for crude CBD oil to be available without sacrificing the quality of the product. Paul Baskis boasts that the crude oil his extraction system will produce is so pure that someone can vape it without seeing any residues in the vape pen.

The other novel thing about this extraction method is that no waste is generated. The oils and waxes removed are also products in their own right. For example, the waxes are sold as raw materials for the cosmetics industry while the pulp is ready to use in the manufacture of bioplastics, paper and fabrics.

The hemp pulp can also be converted into fuel to power the extraction system and the residue from this fuel is a high-quality carbon-based fertilizer.

Max Le Pera, the Vice President of Draconis, explained that the company feels strongly about environmental sustainability and the need for a circular economy in which each section of the company feeds another without causing any adverse effect on the environment.

The example set by DET shows just how far the recently legalized hemp industry can go in terms of offering solutions to the different problems facing the country, such as reviving the economy of rural areas where hemp can be grown.
