420 with CNW — Study Finds That States with Legal Marijuana Markets Register Fewer Impaired Drivers

According to the findings of a new study, states that have legalized marijuana either for medical and/or recreational adult use, register fewer motorists driving under the influence of marijuana when compared to those states where prohibition of marijuana is enforced.

The analysis was conducted by RTI International, a nonprofit organization. RTI relied on self-reported data provided by drivers in several states. The statistics show that people living in states without legal marijuana markets are more likely to get behind the wheel within three hours of consuming marijuana. This is in contrast to people living in states that have enacted enabling marijuana laws; these individuals are less likely to drive within three hours of using cannabis.

One possible reason for this, researchers posit, is that in jurisdictions with legal access to marijuana, people are more likely to receive information from their healthcare providers, who issue recommendations for medical marijuana cards, about the dangers of getting behind the wheel while under the influence of marijuana.

Another likely explanation is that the labeling requirements in state-legal markets compel manufacturers to place warnings about driving while under the influence of marijuana. Such warnings cannot be mandated in states that haven’t legalized marijuana, and so the residents in nonlegal states may have a higher likelihood of driving while under the influence.

The study and its findings dispel yet another claim by prohibitionists that once cannabis is legalized, cases of driving under the influence of cannabis will surge. Furthermore, the current federal administration led by President Joseph Biden passed an infrastructure bill with a provision urging states with legal marijuana markets to undertake public education campaigns about the risks of driving while intoxicated by marijuana. This research shows that on the contrary, such public education campaigns are urgently needed in states that haven’t legalized the recreational or medical use of cannabis.

Paul Armentano, deputy director of NORML, commented that these research findings serve to dismiss the fears of people who think that cannabis legalization triggers an uptick in driving while intoxicated due to relaxed attitudes about the substance. In fact, the reverse is true: states maintaining prohibition laws tend to have more drivers who are under the influence of marijuana unlike drivers in states with laws legalizing marijuana.

It should be noted that this study relied on self-reported cannabis use by motorists. That limitation notwithstanding, the findings challenge the long-held claim that legalization can result in more cases of impaired drivers.

The subject of ascertaining impairment is also still under debate, with some studies indicating that there is no correlation between having the legal limit or more THC in your blood and the likelihood of being involved in a crash. So if you take the necessary precaution of waiting for at least three hours postcannabis use before you drive, there is no reason to feel guilty about buying and using marijuana products made by duly licensed companies such as Flora Growth Corp. 420 with CNW — Researchers Draw Attention to Widening State-Federal Cannabis Policy Differences

In a new report released shortly after the U.S. House of Representatives passed a bill legalizing cannabis at the federal level, congressional researchers revealed that the gap between the marijuana policies at state level and those at the federal level was wide — and it was getting wider with each passing year.

The analysis by the Congressional Research Service (“CSR”) was 101 pages long and covered several aspects connected to the marijuana industry in the country. For example, the document points out how the policy schism has affected cannabis banking. The researchers say that because of the federal classification of marijuana as a Schedule 1 controlled substance, banks are hesitant to accept cannabis businesses, so many of those companies are compelled to accept only cash and use that cash in all their activities and operations. Because of this, marijuana companies face security risks that businesses in other sectors don’t face; it is also hard for tax collection agencies to track all the finances of marijuana firms.

The researchers also say that the contradiction between state and federal marijuana policies has created challenges for some people to find or retain certain jobs, federal housing or even education support.

Cannabis research is also discussed in the report. The CRS says that the federal classification of marijuana continues to make marijuana research burdensome, and as a result, it isn’t easy to obtain reliable scientific data on the risks or benefits of the marijuana products that members of the public are consuming.

However, the analysis recognizes that some measures are being taken to address the challenges of conducting cannabis research. For instance, the report points out the ending of Mississippi University’s monopoly of producing research-grade marijuana and the draft laws being considered to allow researchers to use cannabis sourced from dispensaries in states where marijuana is legal.

The report goes on to mention the four options available to Congress with regard to the widening gap between marijuana laws at the state and federal level: Congress can choose to be inactive, authorize the strict implementation of federal marijuana laws, enact modest adjustments allowing states to have robust marijuana markets or pass a policy ending federal marijuana prohibition.

The CRS says additional options exist, such as changing the classification of marijuana to a less strict category, which would avail banking services to the industry and free law enforcement of the oversight role; the report notes that these options should be considered.

To cannabis advocates, the most obvious option would be to end prohibition federally so that the policies at the federal level are in alignment with the wishes of the public as shown by the rate at which different states are opening marijuana markets either through legislative means or through voter initiatives.

Once federal laws are reformed to legalize marijuana, we could see existing state-level players such as Flora Growth Corp. (NASDAQ: FLGC) establishing a national footprint while also expanding internationally.

The state of New Jersey recently launched its adult-use recreational marijuana market. While adult residents and visitors were thrilled to finally be able to buy cannabis legally, a memo written by the attorney general of the state regarding off-duty police officers’ use of marijuana sparked controversy.

In the memo, Mathew Platkin clarified that according to the existing marijuana laws in New Jersey, police officers shouldn’t be penalized in any way if they use cannabis during their off-duty hours. There was immediate pushback from different quarters once this memo went public. For example, the Democratic speaker of the state assembly, Craig Couglin, immediately said that a bill should be filed in his office in order to address off-duty cannabis use by police officers.

Similarly, the chair of the budget committee in the state senate indicated he would like to amend the state law so that it is in line with the laws in other states with regard to marijuana use by police officers while they aren’t on duty. The state governor, who has been a strong advocate of cannabis legalization, has also weighed in on this matter. Phil Murphy indicated that he was in favor of a possible change in marijuana policy so that law enforcement officers aren’t allowed to use marijuana during their private time away from work.

Several Republican state senators have also written a letter to the attorney general of the state saying that allowing police officers to consume marijuana during their time off the clock would be in violation of federal law.

Despite all this pushback, the acting attorney general of the state has stuck to his guns. He insists that he is bound to respect the existing laws and if there were provisions that different sections of society weren’t comfortable with, then the legislature should make the necessary changes to that law. He also warned that cities and police departments that were taking unilateral action to ban off-duty marijuana use by law enforcement were contravening state law and could open themselves to all manner of lawsuits with regard to employment rights.

The top prosecutor’s comments come after Jersey City, in defiance of state law, issued a directive banning off-duty marijuana use by law enforcement. The majors of Weehawken and Kearny also revealed that they would be taking steps to place bans on off-duty cannabis use by law enforcement.

It remains to be seen how the issue of off-duty cannabis use will eventually be resolved after the launch of recreational marijuana sales. Plenty of interest from the entire cannabis industry, including companies operating in the space, such as Flora Growth Corp. 420 with CNW — Bipartisan State AGs Send Letter to Senate Leaders Demanding Cannabis Banking Law

A bipartisan pair of attorneys general from Ohio and Colorado recently penned a letter to the leaders of the U.S. Senate urging the chamber to quickly pass a bill protecting financial institutions that accept marijuana businesses as clients in states that have regulated marijuana markets.

This letter from Ohio AG Dave Yost and Colorado AG Philip Weiser is the latest in a series of communications imploring legislators to expeditiously pass the SAFE Banking Act, which seems to be caught in a vicious cycle of being passed by the House of Representatives and then stalling in the Senate.

The two attorneys general, who also double as cochairs of an influential committee of the association bringing together all attorneys general across the country, revealed in their recent letter that all states with marijuana markets share a strong interest with the federal government to protect public safety in addition to bringing financial activities in legal grey areas into the formal banking system. They therefore implore the Senate to enact cannabis banking legislation so that the common interests of the federal government and states can be attained.

The bill at the center of this pressure is the SAFE Banking Act authored by Rep. Ed Perlmutter, a Democrat from Colorado. The bill seeks to shield any bank working with state-legal marijuana firms from federal sanctions given that marijuana is still illegal at the federal level.

This letter comes at the time when officials in Washington State are faced with an upsurge of robberies and other criminal activities targeting marijuana businesses in the state. These officials are demanding federal action on cannabis banking, and they also plan to explore their own options of protecting banks while the federal administration remains silent on this matter.

It is baffling how Democrats who control the House of Representatives, the Senate and White House, can fail to approve this banking reform measure. One possible explanation is the opposition of Chuck Schumer, the Senate Majority Leader, to any cannabis policy reforms that don’t address reforms to the criminal justice system, address social equity matters, and decriminalize or legalize marijuana. He thinks that passing the banking reform bill is giving big businesses what they want without addressing the concerns of the general population.

Schumer is working on tabling a long-awaited cannabis legalization bill that was initially scheduled to be filed by the end of this month, but the Senate Majority Leader announced that he would delay the filling of this bill while more consultations take place to garner consensus and increase the odds of a successful outcome.

Due to restrictions placed on the cannabis market by federal prohibition, players in the nascent industry cannot market or sell their products through regular chains. Furthermore, patchwork cannabis regulations make it extremely tricky for cannabis businesses to expand to other states.

As a result, many cannabis businesses across the country are tapping into a resource that has essentially revolutionalized commerce: the internet. By building navigable and user-friendly websites, cannabis businesses can open up their market base without having to spend millions of dollars opening stores out of state.

Marijuana businesses are now investing in user-experience (UX) design to ensure their customers have a stress-free and enjoyable experience when shopping for products on their website. Before the coronavirus pandemic struck, most cannabis consumers purchased their cannabis in physical brick-and-mortar shops. But as states across the country began to issue lockdown orders, cannabis businesses began offering online ordering, curbside pickup and home deliveries.

Home deliveries were especially crucial as a significant percentage of medical marijuana patients are immunocompromised and were much more likely to experience severe symptoms if they contracted COVID. By 2020, 22.7% of older adults used medical cannabis. According to the World Health Organization, age-related physiological changes coupled with possible underlying health conditions mean older people have a significant risk of becoming severely ill if they are infected with the virus.

Now that states are steadily lifting their lockdown orders, plenty of cannabis businesses plan on retaining their online presence. To lure customers away from brick-and-mortar stores, businesses that rely on online sales will have to make the experience even better than going into a store.

A good user-experience design will ensure that customers can navigate products as well as place and cancel orders easily. On average, a user will spend less than a minute on a webpage. If your UX design isn’t good enough to capture their attention in the first 10 seconds, they will most likely exit your website.

Cannabis clients and consumers tend to be more tech savvy compared to those in other industries, says Sam Harris, CEO of Springbing, a cannabis marketing and loyalty software company. As a result, they are more likely to know the difference between bad and good UX and will be critical of bad UX.

Andreas Neumann, the chief creative director of Florida-based Jushi Holdings, calls UX the “new branding.” He was hired because of his experience in design, and his main duty at Jushi is to ensure processes are as frictionless as possible for both customers and employees.

He notes that good UX doesn’t just make it easier for customers to navigate and make purchases, it also makes online communication for staff a lot easier and eliminates a lot of potential friction.
