420 with CNW — Cannabis Banking Bill Sponsor Talking with Senate Leadership About Equity Amendments

Rep. Ed Perlmutter, who sponsored the Secure and Fair Enforcement (“SAFE”) Banking Act, revealed last week that he’d been having discussions with Senate leadership about altering his bill to place more focus on equity issues.

Perlmutter said this shortly before the House passed the SAFE Banking Act for the sixth time. The act was attached to the America COMPETES Act, a large-scale manufacturing and innovation legislation. During the press briefing, the congressman stated that he’d initiated discussions with Sen. Cory Booker’s and Sen. Chuck Schumer’s offices, in addition to having discussions with House Speaker Nancy Pelosi.

Perlmutter explained that the time had come to pass a bill that rationalized banking, noting that any research elements, tax reforms or criminal justice reforms were all bonuses which needed to be viewed in a positive light. In addition to this, he mentioned that the discussions had begun before the House passed the banking measure when it was attached to the National Defense Authorization Act, noting that the conversations didn’t produce results in time as the banking language was excluded after bicameral negotiations.

The Senate already approved its related version of this new innovation legislation, which doesn’t contain the marijuana banking language but focuses on competing with the People’s Republic of China on trade.

Schumer, who is the Senate Majority Leader, recently stated that he was open to advancing the banking legislation if some amendments that further promoted equity were added. Perlmutter revealed that while he was open to making amendments, adding too many new equity provisions would alter the bipartisan measure too much, which could prompt Republican members such as Patrick McHenry, the House Financial Services Committee Ranking Member, to oppose the bill’s passage. This, he said, would reduce support for the bill from that side of the aisle.

When asked about whether he’d spoken to the House Speaker about advocating to keep the banking language attached to the America COMPETES Act in bicameral conference, Perlmutter stated that he had and was confident that she would do so.

Rep. Dave Joyce stated that there was agreement in passing bipartisan marijuana reforms such as the SAFE Banking Act, as well as a separate initiative he was sponsoring with Rep. Alexandria Ocasio-Cortez, which would incentivize states to expunge cannabis records.

Many legislators, in particular Republicans, are puzzled at why Democrats haven’t succeeded in passing this modest banking legislation, despite having control of the White House and being the majority in both chambers. Last week, Senate Majority Leader Chuck Schumer discussed social equity issues during a meeting with a number of cannabis advocacy and reform groups. Schumer is preparing to introduce the Cannabis Administration and Opportunity Act later this year.

In an interview, activists who were part of the Zoom meeting stated that the Senate Majority Leader wasn’t clear on when he would be filing his marijuana legalization measure, only noting that he would do it soon. The implementation of the adult-use cannabis program in New York, immigration issues associated with marijuana and cannabis banking were also discussed during the meeting.

Representatives of VOCAL-NY, Women Grow, Immigrant Defense Project, Cannabis Regulators of Color Coalition, the Drug Policy Alliance and the Rochester NORML chapter took part in the discussion.

Schumer also revealed during the meeting that he’d received criticism from advocates about how long it had taken to file his legalization measure. He noted that both he and his colleagues at the Senate felt that it was important to make sure that equity was effectively integrated into the measure before the committee processes begun.

Last year, the Senate Majority Leader observed that he wanted to keep major players in the tobacco and alcohol industries out of the cannabis industry, in favor of creating opportunities for smaller businesses when the plant was federally legalized. His soon-to-be filed legislation is designed to ensure that these big companies don’t overtake the industry.

The director of National Affairs for the Drug Policy Alliance stated in an interview that Schumer made it clear in the meeting that he understood that social equity needed to be a crucial and intentional part of any cannabis measure that was advanced in Congress. She also pointed out that her organization looked forward to working with Schumer’s office on a comprehensive cannabis initiative that would offer restitution to communities and individuals who were severely impacted by cannabis prohibition.

Cannabis Regulators of Color Coalition vice chair Shaleen Title stated that the Senator had consistently stood with minority-owned businesses as well as small businesses, adding that they were glad to share lessons for how Congress could help ensure that communities which had been affected by the war on drugs could thrive.

During the meeting, Schumer also recognized that until federal prohibition on marijuana was lifted, the system wouldn’t be thoroughly equitable in states such as New York where regulators were working to implement an adult-use cannabis market.

420 with CNW — Congressman Wants to Add Cannabis Banking Language to America COMPETES Act

The sponsor of the SAFE Banking Act, Rep. Ed Perlmutter, recently stated that he’s planning to attach an amendment to the proposal for a broader measure that deals with innovation and research in the manufacturing and technology sectors. The congressman is looking for another vehicle to pursue his initiative after it was removed from a separate defense legislation in 2021.

The measure’s language had been successfully attached to the National Defense Authorization Act on the House side but was removed later, during bicameral negotiations. At the time, the congressman said that senate leadership was to blame for the decision to remove the banking amendment from the legislation.

Perlmutter’s measure has stalled in the senate, despite clearing the house in five forms. The house sponsor’s most recent attempt to get the measure enacted is filing an amendment that contains language from the Secure and Fair Enforcement Banking (“SAFE”) Act to the America COMPETES Act, which doesn’t deal with issues concerning marijuana.

In a press release, Perlmutter stated that small and big marijuana-related businesses and their employees needed access to capital as well as the banking system in order to operate in a safe and efficient manner and compete in the burgeoning global marijuana marketplace. He added that the SAFE Act was a good opportunity to enact federal marijuana reform this year and would ensure that marijuana businesses were treated the same as other legitimate and legal businesses.

The congressman is committed to getting his measure approved and signed into law, despite having plans to retire from congress after this session. It is uncertain whether the America COMPETES Act will be an effective vehicle for the marijuana banking bill.

To be formally considered on the house floor when the organization initiates proceedings for the research and innovation act, the new cannabis banking act amendment will need to go through the House Rules Committee. The deadline for filing amendments was last Friday. The panel is scheduled to take amendments up this week.

This failure to approve the modest banking initiative has some GOP party members puzzled, as Democrats have control of the White House and are also the majority in both chambers. For instance, Republicans such as Rep. Rand Paul have criticized their Democrat counterparts over this issue.

In an interview, Rodney Hood, a federal financial regulator and former chair of the federal National Credit Union Administration, offered advice on how to steer through the state-federal conflict, which had made financial institutions reluctant to work with marijuana businesses, noting that cannabis legalization was a question of when and not if.

When cannabis is finally legalized at the federal level, industry companies such as Flora Growth Corp. (NASDAQ: FLGC) will have a bigger marketplace within which to operate with having to work through a complex mix of laws.

420 with CNW — Study Finds That Marijuana Legalization in Europe Doesn’t Increase Underage Usage

Marijuana is the most used illicit substance globally, with roughly 90 million individuals in Europe alone having used the drug once in their lifetime. Recently, scientists from the Karolinska Institute in Stockholm conducted a study to determine whether changes in marijuana laws led to an increase in the recreational use of the herb by young adults and adolescents.

They found no evidence to support the claim that the legalization of marijuana causes an increase in the use of marijuana in individuals aged 15 to 34. Critics of marijuana legalization often argue that allowing the legal and free access of the drug will make it more attractive to young adults and teenagers, which they believe will automatically result in increased usage.

The researchers’ objective was to address concerns around social harm that stem from marijuana legalization changes, especially since changes in cannabis legislation in Europe have been initiated in countries such as Czech Republic, Estonia, the United Kingdom, Italy, Malta, Spain, Netherlands, Germany and Belgium. Prior studies conducted on the impact of changes in marijuana laws on the prevalence of use have yielded inconclusive results.

The researchers, all from the Department of Global Public Health, conducted an analysis of data collected by the EMCDDA from 11 countries in Europe. The data contained rates of self-reported marijuana use in 15- to 34-year-olds in the period between 1994 and 2017, as well as information on the marijuana policy changes implemented by the countries included in the study. These changes were classified as less lenient or more lenient.

The researchers used a time-series linear model to evaluate the changes in nation-specific trends over the particular period, in relation to policy changes. They discovered that the use of marijuana was, on average, stable or rising weakly in countries that hadn’t changed their legislations. This increase was also observed in countries where laws were changed to the extremes.

By contrast, the average use of cannabis declined after changes in laws, regardless of whether the change was classified as more lenient or less lenient. It should be noted that the researchers took into account inconsistencies in drug legislations that different European nations enforced as well as the challenges in collecting the data.

In their report, the researchers explained that their discoveries aligned with prior research that didn’t find any clear link between marijuana policy and the use of the herb. In their conclusion, the team of researchers noted that their findings did not support any substantial impact of marijuana legislation on the prevalence of recreational marijuana use among young adults and youth in Europe.

As more studies clear the air about the unfounded fears that cannabis legalization will lead to an explosion of teen marijuana use, more jurisdictions around the world are likely to open up to this herb and companies such as Flora Growth Corp.
