Recently, Eric Holder spoke on a drug policy panel stating that the United States was on the path to decriminalizing cannabis federally as more states advance reform measures. Holder, the former U.S. attorney general who served under the President Barak Obama administration, stated that he was encouraged that the country was moving toward more tolerant laws on drugs that saw addiction as a public health issue.

Holder explained that the drug war had cost lots of taxpayer dollars and shattered livelihoods, noting that the society had begun to move in a different direction. Holder added that he was conflicted by efforts to decriminalize other illicit substances, including cocaine and heroin. The former attorney general revealed that he had a difficult time thinking about the decriminalization of these substances, which one could see had had a negative effect on individuals as well as the society at large. He also argued that the penalties for drug-related offenses could be lower, noting that judges should exercise more discretion when dealing with drug cases on a case-by-case basis, adding that mandatory minimum sentences for these offenses should be abolished.

The former attorney general has received credit from advocates for calling for deprioritizing the enforcement of cannabis federally. In 2013, the Justice Department issued the Cole memo, whichi discouraged federal prosecutors from going after individuals who were in compliance with state-legal marijuana laws.

However, activists also call attention to the fact that while Holder suggested that cannabis be federally rescheduled after he left office, he didn’t begin the process to enact the change in policy while he was still in office.

The panel, which was hosted by the Moritz College of Law at the Ohio State University, also centered on racial inequities in drug enforcement. The conversation was moderated by Douglas Berman from the institution. Other members of the panel included U.S. District Chief Judge Algenon Marbley, Ohio Supreme Court Chief Justice Maureen O’Connor and activist Piper Kerman. All the members of the panel agreed that the disparities illuminated the need for reform.

Marbley also stated that the federal government needed to align themselves with the states in regard to cannabis laws. He explained that most states in the country permitted the use of medical cannabis and those that were yet to allow for recreational cannabis use were headed in that direction, which meant that it was time for the federal government to get on board.

Three years ago, the Supreme Court in Mexico ruled that the country’s ban on cannabis consumption was unconstitutional, ending decades of cannabis prohibition and requiring that lawmakers reform cannabis laws. Mexico’s Congress was granted a deadline to repeal prohibitionist cannabis policies, now considered unconstitutional, but policymakers failed to do so within the allotted time. Both chambers of Congress spent months discussing and working on a legalization bill, repeatedly asking the court to extend the deadline.

Last year, the Senate passed a bill and sent it to the Chamber of Deputies, which made revisions and sent it back. However, after a few Senate committees took up and cleared the amended measure, some leaders stated that the amendments made the legislation unworkable. This June, three years after the Supreme Court first declared that cannabis prohibition in the country was illegal, the Senate voted to put an end to prohibition on its own after lawmakers failed to act in time. However, since all the top court did was decriminalize cannabis, the country still did not have regulations for legally sanctioned sales.

Now a top Mexican senator has indicated that lawmakers may finally pass a cannabis legalization bill during the new session. During a press conference, Senate Majority Leader Ricardo Monreal Avila said that lawmakers plan on filling this gap, which is the lack of regulations, during this session. They have a chance to deliberate upon and approve the “long-overdue law,” he says, ending a century of cannabis prohibition and criminalization. The legislation would in turn open the country to a nationwide and international multimillion dollar market and help to reactivate Mexico’s economy.

The cannabis legislation passed by the Senate may need further revisions before it is ready for passing during this session, Avila noted, including modifications to tax collection frameworks. Both chambers need to strive to create a bill that guarantees the freedoms and rights of all people involved, eradicate discriminatory treatment, in addition to “solve possible ambiguities,” says Monreal. Back in April, he urged lawmakers not to allow commercial interests, especially the tobacco and pharmaceutical industries, to pressure them to prematurely pass a bill, stating that it was important they take their time to formulate an equitable and socially conscious bill.

But Senator Eduardo Ramirez Aguilar from Morena said at the time that lawmakers should pass the bill as it was presented to them and work on fine-tuning it later through additional revisions. As it is, the cannabis legalization proposal allows adults who are at least 18 years old to purchase as well as possess a maximum of 28 grams of cannabis as well as grow up to six plants for their personal use.

420 with CNW — Study Finds Cannabis Abuse Hasn’t Increased in States with Legalized Recreational Cannabis Use

A study published earlier this week found that cannabis abuse hasn’t risen in states that have enacted laws to legalize recreational cannabis. The study assessed the impact of recreational cannabis laws on the use of cannabis across ethnic and racial groups, tracking trends in usage between 2008 and 2020. For the study, the researchers analyzed data collected from more than 80,000 individuals.

Researchers discovered that less than 2% of individuals living in states that have enacted enabling laws for the recreational use of cannabis have been given a cannabis use disorder diagnosis. This is in contrast to the number of people living in states that are yet to legalize the plant that have a cannabis use disorder diagnosis.

The researchers also found that legalization laws did have an effect on cannabis use among people from different ethnic and racial groups, with their findings showing that Hispanics were 30-plus% more likely to indicate past-year use of cannabis following legalization. Likewise, Caucasians living in states that have legalized the recreational use of cannabis were roughly 20% more likely to report past-year use. This is in comparison with their likelihood of doing so when the use of cannabis hadn’t been legalized. However, the researchers saw little to no change in the behaviors of Blacks after laws allowing for recreational cannabis use were enacted.

The study also found that the daily use of cannabis across all age, ethnic and racial groups didn’t significantly increase even after cannabis was legalized for recreational use. This proposes that there wasn’t an increase in cannabis use disorder in these states.

The director of the Substance Use Epidemiology Unit at the Mailman School of Public Health, Columbia University, Silvia S. Martins stated that the use of marijuana only rose in specific demographic subgroups in the initial few years after adult-use marijuana was legalized for recreational use. Martins, who is the co-author of the study, explained that the group observed no increase in marijuana use disorder and in the frequency of marijuana use. In addition to this, the researchers observed no increases in the use of cannabis among teens aged between 12 and 20.

Thus far, 18 states have legalized marijuana for recreational use. The states of Washington and Colorado were the first to legalize the recreational use of cannabis in 2012.

Before marijuana was legalized in various states in the country, people of color were four times as likely to face criminal charges for use and possession of cannabis, in comparison with white people.
