The governor of New Jersey believes the state would get a major economic boost from legalizing marijuana. On top of that, he adds it will promote racial justice, especially as countrywide protests against the aggressive policing of black and Hispanic communities continues.

New Jersey Governor Phil Murphy was recently interviewed on the Jim Kerr Anytime radio show, and the state’s ailing economy was discussed. He recognized that the state will have to be innovative to generate more revenue as the coronavirus crisis rages on, and he concurred with a co-host’s assessment that cannabis could be part of the solution. “As you probably know, I’ve been on that from day one. The legislature hasn’t been able to get there yet, but absolutely,” he said.

“That’s, to me, an incredibly smart thing to do. We’re not inventing marijuana, it exists. It’s got a huge social justice piece for me. The overwhelming percentage of persons nailed in our criminal justice system are persons of color. It’s a no brainer in that respect. It’s a job creator, it’s a tax revenue raiser, and it checks a lot of boxes. I hope we’ll get there sooner than later.”

New Jersey allows medical marijuana, and the state recently announced that cannabis dispensaries would now be able to deliver products to their customers. Although the legislature has so far been unable to pass a recreational marijuana legalization bill, they approved legislation to put a referendum on the issue in the November ballot. Additionally, the state Assembly passed a cannabis decriminalization bill last month that would make possession of up to two ounces of cannabis a civil penalty without the threat of jail time.

420 with CNW – Congress Asks Federal Agencies to Reconsider Firing Employees Who Use Marijuana

Although several states have legalized either medical or recreational marijuana, it remains illegal at the federal level. This duality in legislation means that sometimes, individuals who work with or consume state-legal cannabis face federal repercussions. However, a series of reports for spending bills released by a key House committee contain a wide range of marijuana-related provisions seeking to change this.

The directives from the House Appropriations Committee were attached to spending bills containing legislative reform provisions including previously tabled proposals that would protect state marijuana laws from federal interference as well as protect banks who work with cannabis businesses from federal retaliation. The reports direct federal agencies to reconsider firing federal workers for consuming state-legal marijuana, to promote research into cannabis and fund CBD regulations.

“The Committee encourages OPM to review its policies and guidelines regarding hiring and firing of individuals who use marijuana in states where that individual’s private use of marijuana is not prohibited under the law of the State. These policies should reflect changes to the law on marijuana usage and clearly state the impact of marijuana usage on federal employment,” states a Financial Services and General Government spending bill report.

Another report attached to the Labor, Health and Human Services, Education and Related Agencies funding bill contained a number of marijuana research provisions too. One provision called on the National Institutes of Health (“NIH”) to develop a “multipronged strategy wherein basic and clinical scientists and public health specialists work together to address the opportunities and challenges of cannabis in a comprehensive manner.”

“NIH currently supports a diverse portfolio of research on cannabinoids and the endocannabinoid system, yet this research support typically relies on narrowly tailored program announcements and grants rather than a multipronged strategy wherein basic and clinical scientists and public health specialists work together to address the opportunities and challenges of cannabis in a comprehensive manner. The Committee encourages NIDA to continue supporting a full range of research on the health effects of marijuana and its components, including research to understand how marijuana policies affect public health, to help inform marijuana policy-making in States.”

Members of the committee also noted that there is significant public interest in cannabis research. They made a recommendation to provide protections for universities that would be licensed to carry out these studies.

“Through scientific research, institutions of higher education advance our understanding and knowledge of various aspects of our world. Moreover, when in the public interest, such institutions should be able to conduct such research without fear of reprisal or loss of federal funding.”

420 with CNW – Kansas City Council Decriminalizes Marijuana Possession

For the past three or so decades, the federal government has punished individuals charged with marijuana possession quite harshly. Ever since the ‘War on Drugs’ began, certain communities have been unfairly stereotyped, targeted and punished for marijuana offenses. Although people of all races are likely to purchase and consume cannabis, people of color are much more likely to be arrested and prosecuted compared to other races. Proponents for marijuana legalization have argued that decriminalizing marijuana will go a long way in righting these wrongs.

Last week, the Kansas City Council in Missouri passed an ordinance ending all penalties for marijuana possession under local laws. The cannabis measure was filed by Mayor Quinton Lucas and four local lawmakers last month and the vote to approve it was 9-4. The measure repealed a provision of the Code of Ordinances which stipulates that possession of 35 grams or less of marijuana carries a $25 fine and more than 35 grams carries a $500 fine.

Mayor Lucas who had previously said he was planning on pursuing other efforts to remove other ‘minor drug offenses from our code’, announced on social media that the City Council had passed Ordinance #200455 to remove marijuana from the City Code of Ordinances. “The city doesn’t need to be in the marijuana policing business, and we remain focused on helping open doors to new opportunities and empowering people to make a decent living,” he said in celebration of the development.

Although the text of the ordinance does not change Missouri state law that criminalizes cannabis for non-medical use, it describes the racial disparity in marijuana possession arrests and states that the Council “believes future resources should be focused on the prevention, investigation, and prosecution of violent crime in Kansas City.” This comes a few months after Mayor Lucas announced that he would pardon decades’ worth of municipal marijuana offenses, a move he stated was “fundamentally a question of fairness.”

He argued that society had grown more lenient towards marijuana in recent years, and people with old convictions shouldn’t be held to harsher punishments than are being doled out now. The goal, he said, was to give those with old convictions a second chance. “When you look at the sources of public safety challenges in our community, it’s not those who are using recreational or small amounts of marijuana, and what I want to be able to do for these folks is to say, “You might have made a mistake at some point, but that we’re going to be fair in how we apply, frankly, the law in Kansas City and Missouri.”

420 with CNW – California Plans to Issue Marijuana Organic Certification to Boost Profits

Federal prohibition has been a thorn in cannabis’ side for a long time. And even as tens of states move to legalize recreational and medical marijuana, it remains illegal at the federal level and this has held the industry back in many ways. For instance, state-legal cannabis cannot be considered ‘organic’, a title bestowed by the U.S. Department of Agriculture, even if the growers maintained the purported ‘organic’ standards while growing the crop. However, regulators in California, the largest legal cannabis market in the world, have unveiled proposed regulations for a program that would equal the federally bestowed ‘organic’ status.

Draft regulation for the OCal Program, a statewide certification program, was released in early May, with a public comment period open until July 7. According to the California Department of Food and Agriculture (“CDFA”), the program “will ensure that cannabis products bearing the OCal seal have been certified to consistent, uniform standards comparable to the National Organic Program.” The CDFA is required to have established the certification program for cannabis by January 1, 2021.

Growers who meet a certain set of rules, including proper use of the approved fertilizers and pesticides, will be able to apply the OCal seal to their crop, and brands looking to stand out will be able to charge their health-conscious customers a premium for OCal-certified products. California will join Washington state as the only two state-legal cannabis markets to consider an organic certification for marijuana products, and being the largest legal cannabis market in the nation, it could set a precedent for other states.

According to Kristin Nevedal, Chair and Founder of the International Cannabis Farmers Association, the state-based program will “probably instill more confidence.” Consumers are willing to spend a premium for products deemed ‘organic’, she says. “It’s recognizable, and the branding opportunities are readily apparent.” She adds that some cannabis companies have already been using the consumer appetite for organically grown cannabis and have started labeling their products ‘clean and green.’

Sarah Armstrong, policy chair for the Southern California Coalition, the largest cannabis trade association in the region, hopes the program will be cost-effective enough to be well-received by the industry. “Our hope is that the proposed program will be cost-effective enough that the cannabis industry can fully participate. Right now, testing expenses represent 10% of the cost of product production, resulting in an exceptionally pure product at no small expense. Hopefully, the Organics Program can work with cultivators to develop methods that ensure the program safeguards purity in a cost-effective manner.”

420 with CNW – Congressional Committee Approves Measure Allowing Marijuana Users to Reenlist in the Military

Although plenty of states have now legalized medical and recreational marijuana in various forms, it still carries a lot of stigma. Most employers are uncomfortable with employees consuming cannabis, even during non-work hours, and plenty of sports organizations do not allow their athletes to use marijuana. The military has a harsh stance on marijuana too, and veterans who admit to using marijuana even in a legal state can be barred from reenlisting.

A measure introduced two years in a row by Rep. Ruben Gallego and approved by a Congressional Committee would help resolve the issue. The measure would allow heads of military branches to grant waivers on a case by case basis to service members seeking to reenlist who admit to consuming cannabis or were convicted of a misdemeanor marijuana offense. Text from the measure states that “within 90 days of the enactment of the bill, the Secretary of Defense shall prescribe regulations that permit any Secretary of a military department to grant a reenlistment waiver to a covered person if the secretary determines that the reenlistment of that covered person is vital to the national interest.”

It further states that service members who have “admitted to or been convicted by a court of competent jurisdiction of a single violation of any law of a state or the United States relating to the use or possession of cannabis” would be covered as long as it was a misdemeanor offense and did not occur while they were on active duty. “Smoking pot just once shouldn’t prevent a patriotic American from fighting for our country. We need to finally exercise some common sense when it comes to our marijuana policies, and I’m glad my amendment will lead us in that direction,” says Rep. Gallego.

This is the second year in a row Rep. Gallego has filed a measure to allow service members who admitted to smoking marijuana to reenlist. At the House Armed Services Committee meeting, he stated that it was important to fundamentally rethink the military’s enlistment policies regarding marijuana, “especially given our nation’s recruitment crisis.” “Our nation’s views on marijuana use are changing, and the services have changed their recruitment process accordingly. The services can, where appropriate, grant waivers to former users of marijuana who want to serve their country in uniform,” he said at the time.

This year’s measure was adopted as part of a package with several other amendments to the National Defense Authorization Act by the House Armed Services Committee on Wednesday. As it heads to the House Floor, it will be attached to a large scale defense spending bill for the next fiscal year.

420 with CNW – Survey Shows That Canadians Aren’t Moved by Cannabis Branding

A survey published by Brightfield Group has found that the majority of Canadians are unable to tell pot brands apart despite the resources that these companies have put into marketing.

About 3,000 Canadians were polled during the first quarter of this year. The overwhelming finding of the survey was that brand awareness was woefully low among Canadians, and that they suffered from “decision fatigue” as a result of being faced with so many brands to choose from when they visit a cannabis retail outlet.

Approximately 41% of Canadians said they were aware of Tweed, a brand from Canopy Growth Corp. while a total of 17 pot brands can’t command 20% brand name awareness among users.

These findings confirm that buyers of cannabis products make a choice based on the price of the product or on a recommendation by a friend.

Bethany Gomez, Brightfield Group’s managing director, says that since the cannabis industry is still in its infancy, the companies selling products to consumers have not yet graduated their marketing efforts from teaching the functional issues to a level where they build connections with consumers.

To make matters worse for the legal cannabis industry, sector players have to compete with the black market which doesn’t have to abide by the strict regulations imposed by Health Canada on matters like packaging, online advertising and labeling.

Serruya Private Equity Inc., which owns half a dozen cannabis stores in Toronto, revealed that the staff at their retail outlets say most customers ask about a product with the highest THC (the cannabis compound which induces a high) content rather than paying attention to brand names.

Marijuana companies have realized that they haven’t been using their marketing budgets effectively, so they are now pivoting to start building brand awareness as the market stabilizes. This is especially important now that “cannabis 2.0” products (edibles and vapes, for example) are now on the market.

This second generation of marijuana products is expected to be a big money maker for companies since margins are larger and cannabis consumers buy a lot more of these products when compared to smokable flower, for example.

420 with CNW – Why NJ Medical Cannabis is Slated to Get a Lot Cheaper

On July 1, New Jersey is slated to reduce the sales tax on medical marijuana from 6.625% to 4%. This move is the first in a series of measures that will see state sales taxes removed entirely within a space of three years. On July 1 next year, the tax will reduce to 2% and the following year (July 1, 2022) will see the reduction to a 0% state sales tax.

However, the sales tax reforms which roll out tomorrow don’t mean that buyers of medical marijuana will not pay any taxes on their purchases. Municipalities within New Jersey are still allowed to impose a 2% sales tax within their jurisdictions, but so far, no town has invoked this provision to levy the tax.

The plan to phase out sales taxes on medical marijuana were part of the Jake Honig Compassionate Use Act enacted into law last year. The bill was named after Jake Honig, a 7-year old kid from Howell who had an inoperable tumor in the brain. Only medical marijuana gave him any relief until he passed in 2018.

Activists raised an uproar about the sales taxes imposed by the state on medical marijuana. This outcry was prompted by the fact that prescription medications are exempted from state sales tax. The activists therefore wanted medical marijuana to be regarded in the same way since it is a prescription medicine in New Jersey.

While the bill was being debated in the state legislature, several lawmakers called the sales tax “criminal” since working class and poor families would suffer an added burden while acquiring the medicine they need.

Currently, more than 77,000 people are registered on the state’s medical marijuana program. However, supply chain problems and the resulting prohibitive prices (medical marijuana can cost approximately $500 an ounce) have plagued the progress of the sector.

As the tax cuts kick in, an ounce of medical marijuana will drop to about $469.15. This will bring some relief to patients, and as the supply issues are sorted, prices could drop even further.

At the moment, only nine clinics are open to sell medical pot to patients across the state. Other locations that were pre-approved haven’t opened their doors to customers due to ongoing legal battles.

In November, New Jersey voters are slated to vote on a ballot measure that could see recreational marijuana legalized. If the bill passes, dispensaries will be allowed to sell recreational marijuana to adults who are 21 or older.

The reduction of the state sales tax on medical marijuana is likely to be welcomed by the entire industry, including Green Growth Brands Inc. (CSE: GGB) (OTCQB: GGBXF) since it makes products more affordable for patients.
