More than six years after hemp pilot programs were launched by the 2014 Farm Bill, the nascent sector is still plagued by patchwork state legislations and little if any federal regulation. As more farmers dip their toes into the hemp space and it becomes more lucrative, industry players and  lawmakers alike have consistently urged the U.S. Department of Agriculture (“USDA”) to craft standardized hemp rules. Now, the National Association of State Departments of Agriculture (“NASDA”) is asking the USDA to expand hemp farmers’ access to federal grants by allowing for two different classifications based on its intended use.

This comes a week after members of the NASDA, which represents agriculture departments in all 50 states and four U.S. territories, agreed during an annual meeting to change the organization’s policy regarding USDA’s Specialty Crop Block Program. The organization is now requesting that the USDA allow hemp farmers to designate their crops as either an agronomic commodity or a specialty crop. If the USDA agrees to this request, it would help farmers across the country have expanded access to federal grants, providing them with the valuable resources they need to prosper in the evolving hemp space, stakeholders say.

NASDA’s new policy states that the organization supports dual designation for hemp as a specialty crop based on the way and the purpose for which it is grown as well as expanding eligibility to funding from Specialty Crop Block Grant Program to include farmers who grow hemp for horticultural purposes. According to Jonathan Miller, general counsel for the U.S. Hemp Roundtable, the group is encouraged by NASDA’s commitment to working with the hemp industry and identifying solutions that support hemp farmers. The move also has the potential to open the door to the finding and support that hemp farmers “desperately need,” especially as the country struggles to recover from the coronavirus pandemic.

In a press release, NASDA CEO Barb Glenn said allowing hemp to be designated as both a specialty crop and agronomic commodity acknowledges the plant’s “up and coming nature” and assures new farmers that they will be supported if regardless of which route they choose —  growing hemp for fiber, food or horticultural use. Herrick Fox, the co-chair of the National Industrial Hemp Council’s government relations committee, posits that the only reason hemp wasn’t granted dual designation by the USDA before is because federal agencies are still getting used to the idea of hemp being legal after nearly a century of prohibition.

Fortunately, the USDA is now working to create a regulatory structure for hemp. The agency passed a Final Rule on hemp earlier this year, and the agency is about to run a large-scale survey to gain a deeper understanding of the hemp sector.

If you still haven’t used a cannabidiol (“CBD”) product, I bet you know someone who has. CBD became legal more than two years ago when the 2018 Farm Bill legalized the cultivation and sale of industrial hemp and its derivatives. It is one of more than 100 chemical compounds called cannabinoids that are produced by plants in the cannabis family. But unlike marijuana, hemp has minimal amounts of THC (delta-9 tetrahydrocannabinol), the main chemical agent that makes marijuana intoxicating.

As such, CBD is nonpsychoactive, meaning it will not intoxicate you. However, the hemp extract has become incredibly popular within quite a short period for a reason; it is claimed to be full of potent medical properties. People from all over the country have since been using CBD to treat chronic pain, alleviate anxiety and depression, and treat skin conditions such as acne and psoriasis. Furthermore, the U.S. Food and Drug Administration (“FDA”) has approved the use of a CBD formulation called Epidiolex to treat Dravet Syndrome and Lennox-Gastaut Syndrome, two rare types of pediatric epilepsy that are extremely hard to treat.

But as CBD becomes more accessible to the public and more people turn to the cannabinoid to address several health issues, one question has echoed in the minds of the public and experts alike: is CBD addictive? With a whopping 33% of Americans claiming to have used CBD at least once in the past, how likely are regular CBD users to get addicted?

According to the limited resources available, it looks like CBD may not be addictive partly due to the fact that it does not have intoxicating effects. A small 2016 study found that, unlike THC, CBD does not produce significant physical and psychological effects such as euphoria and rapid heart rate. When the study participants reported about feelings of intoxication, CBD performed similarly to a placebo.

In fact, studies have found that cannabidiol works contrary to addiction, helping individuals with drug addiction to kick their drug habits. Preliminary studies have found that rather than being an addictive substance, such as alcohol or nicotine, CBD may be able to actually reduce the likelihood of developing a methamphetamine or cocaine-use disorder.

2015 systematic review of available preclinical and clinical data covering the effect of cannabidiol on addictive behaviors concluded that there’s a good chance that CBD may be able to help in the treatment of tobacco and alcohol addiction. Although there is limited research on both the benefits and risks of CBD, the cannabinoid does not appear to be addictive. However, further research is needed to be completely sure of its potential for addiction as well as its potential for treating other drug use disorders.

Floods and hurricanes affecting states in the East and drought conditions prevailing across the country, particularly in the Western region, have made this year’s conditions for crop production unpredictable. To protect their investments, cannabis and hemp producers are working to secure insurance for their crops. However, this is not an easy feat, considering hemp has been federally illegal for a longer period of time than it has been legal.

Hemp was legalized under the 2018 Farm Bill, which allowed producers to pay for private insurance policies as well as secure crop insurance through the Department of Agriculture. As more states legalize recreational and medical cannabis, commercial insurance providers have been preparing to expand their coverage. However, there are limits on how far their coverage can reach.

With regard to drought insurance, federal agriculture regulators are allowing emergency practices to help crop producers affected by drought conditions. The Risk Management Agency has also been working with crop insurance companies to make payments more efficient to policyholders in drought areas. Earlier this month, the agency also announced that it would be extending crop insurance deadlines to give producers more time to pay their administrative fees and premiums. In addition, the agency also permitted approved insurance providers to waive interest fees on written payment agreements for another 60 days.

Producers of hemp who hold crop insurance policies should contact their agents if they notice any damage in order to give the insurance companies time to appraise their crop prior to replanting or cutting. It should be noted, however, that most insurance companies don’t provide crop insurance for outdoor growing fields, despite the fact that all insurance is considered to be disaster insurance.

Most insurance agents sell both private and federal insurance policies, which means they possess the tools to help hemp farmers develop custom programs. Elite Risk Insurance Solutions owner Jeff Kleid states that insurance solutions are often based on gathering direct feedback from growers, which is combined with accumulated data.

For lower-level coverage and smaller farmers, creating custom coverage programs is a good option while larger hemp growers may benefit from a hybrid program, which may have high-deductible plans.

Private policies usually include inventory, equipment coverage, product liability and living plant coverage. Farmers are allowed to add different weather events and crop coverages for disasters to their policies as well.

When acquiring insurance, farmers should keep in mind that insurance companies are more willing to cover disaster events such as wildfire for indoor hemp growers operating in warehouses or greenhouses.

420 with CNW — California Sets Fiscal Year Record for Marijuana Tax Revenue

The nonpartisan Legislative Analyst’s Office in the state of California estimates that during the 2020–21 fiscal year, the state collected roughly $817 million in recreational cannabis tax revenue. This amount is 50% more than the marijuana earnings for the state coffers that were generated in the previous fiscal year. The officials state that combined cultivation and excise tax revenue for the fourth quarter, which ended in June, equates to $211 million.

It should be noted that these figures do not include local revenues to municipalities where the transactions occur, nor do they take into account additional regular sales taxes generated from marijuana.

It is surprising that this trend of increased tax and sales revenue has been continuing amid the COVD-19 pandemic, which significantly contributed to an increase in unemployment and forced many businesses to shut down. The cannabis marketplace also grew considerably during this time, despite the fact that marijuana businesses are ineligible for the federal aid that was provided to other industries.

An analysis of new data by the state’s Department of Tax and Fee Administration also found that since 2018, total adult-use cannabis revenue to date for the state of California is $2.8 billion. This amount is inclusive of $1 billion in sales tax, about $348 million in cultivation tax and $1.4 billion in excise tax.

California isn’t the only state recording strong marijuana sales. A scientific analysis of sales data that was recently conducted in Washington State as well as in the states of Oregon, Colorado and Alaska has found that cannabis purchases have grown significantly during the coronavirus pandemic than in the past two years.

In the month of July, more than three states in the country hit new sales records for adult-use marijuana. The state of Missouri also saw record-breaking sales for its medical cannabis program.  In the same month, the state of Illinois saw almost $130 million in recreational marijuana purchases, which is more than double its sales for July 2020. This makes July the fifth month that sales in the state have exceeded $100 million. Illinois may rake in over $1 billion in recreational cannabis sales by the end of the year if the trend continues.

In Maine, July’s recreational cannabis sales were more than $9 million, which is a 45% increase from its June sales record. Data from a regulatory body in the state of Michigan also shows that the state broke its cannabis sales record in July, with more than $170 million in marijuana transactions.
