420 with CNW – Marijuana Banking Bill Changes Suggested to Win Republican Support

On Monday, we reported that Congress was likely to vote on the SAFE Banking Act this month, and the latest indicators strongly point to a floor vote being scheduled for next week. The supporters of the bill would like the vote to be conducted under suspended House rules, and a number of amendments have been suggested to win over more Republicans and ensure that the bill will get the two-thirds majority needed under the suspended rules arrangement.

One of the changes that has been made provides clarification that the protections given to banks that work with state-legal marijuana companies also apply to the banks serving companies in the hemp and CBD industries.

Another change expands the definition of the ancillary businesses that work with marijuana companies. The expanded definition includes insurance companies and federal home loan companies. The bill also states that financial regulators wouldn’t have any undue restrictions placed upon them as they supervise marijuana companies.

An extra section added to the SAFE Banking Act also talks extensively about the hemp industry and why financial regulators must release guidelines explaining how banking institutions can work with the hemp and CBD industries without facing any sanctions from regulators.

There is also a specific section that is aimed at forestalling any plan by the Justice Department to arbitrarily order banks to close the account or accounts of a company or people in the firearms industry as a way of forcing those entities out of business. Any such action must be accompanied by a sound reason.

All these provisions are aimed at putting the concerns of conservative lawmakers at bay, especially those who don’t want to be involved in passing a law that is primarily intended to facilitate the marijuana industry. By including the hemp, CBD and gun industries, the scope of the bill is expanded and more GOP lawmakers may be enticed to support it.

However, not all is well within the Democratic caucus as some members have been vocal that they will not support the bill unless measures to address social equity issues in the marijuana industry are first implemented.

Such members of Congress feel that the SAFE Banking Act largely helps banks and marijuana companies to thrive and yet a more pressing concern are the racial issues surrounding the implementation of marijuana laws across the country.

Supporters of the proposed law say that any measure that chips away at prohibition should be supported and the social equity issues will also be addressed by the other bills before different committees of the House of Representatives.

Analysts believe marijuana sector players like Hemptown USA and HTC Extraction Systems (TSX.V: HTC) will be waiting keenly to hear what comes out of Congress when the bill is voted on.

420 with CNW – Feds Say Researchers Should Access Marijuana from Licensed Dispensaries

In their reply to a letter written by Sen. Brian Schatz (D-HI), the Food and Drug Administration (FDA) and the National Institutes for Health (NIH) wrote that researchers should be allowed to access marijuana from licensed dispensaries in states where marijuana is legal instead of being compelled to rely on the single source licensed by the federal government.

In that same letter, the federal agencies discussed how the prohibition of marijuana at the federal level was limiting marijuana research. These limitations include the quality and diversity of research-grade marijuana.

Studies have revealed that the marijuana grown at the only federally licensed facility at the University of Mississippi is closer to industrial hemp than to the marijuana which is readily available in states which have legalized the substance.

The federal agencies say that this discrepancy creates gaps in the way the government and the scientific community understand marijuana products.

The letter from NIH and the FDA comes in response to a letter that was written by Schatz in March asking the agencies about the research agenda they had, their take on what the federal prohibition of marijuana was having on easing marijuana research, and what they thought should be done to make the validity and quality of marijuana research better.

Schatz’s letter was written when Dr. Scott Gottlieb was still the commissioner of the FDA, but the reply had the signature of Norman Sharpless since Gottlieb was no longer at the agency.

The heads of the two federal health agencies discussed at length what their organizations had done and was continuing to do in support of cannabis research, then they proceeded to state that they agree with Schatz that more research should be done. Some of the ongoing clinical studies that they cited included research into how the marijuana laws of states contribute to or influence the use of opioids within those jurisdictions.

NIH and the FDA then pointed out that the federal restrictions, such as having only one licensed supplier of research-grade cannabis, were making it hard for the necessary cannabis research to be done.

The agencies were of the view that any entity with a Schedule 1 license should be free to access marijuana from the licensed dispensaries and retail outlets in states where marijuana is legal so that the research that they conduct is more reflective of the products that consumers use today.

These statements about allowing researchers to access marijuana from licensed dispensaries made all the more sense given that the head of the Mississippi University farm currently supplying all the marijuana used for research is reported to have said that marijuana with an 8 percent THC potency was strong enough and he didn’t see why people needed anything stronger. It was as though he didn’t know that the marijuana on the market can have as much as 25 percent THC!

Analysts think industry participants like HTC Extraction Systems (TSX.V: HTC) and IONIC Brands Corp. (CSE: IONC) (OTC: IONKF) must be wishing that the NIH and the FDA convert their words into actions so that some of the headaches faced by the marijuana industry can come to an end.

420 with CNW – Utah Decides to Switch to a Private Medical Marijuana Distribution System

The subject of medical marijuana elicited heated debates between lawmakers, the medical community, law enforcement and other powerful groups, such as the Mormon Church in Utah. Eventually, voters approved Prop 2 during the 2018 midterms but this measure was quickly replaced by a law drafted behind closed doors. In the law, medical marijuana would be distributed through the state’s health system. In another change to the proposed system, the state has decided to ditch this distribution system and instead opt for a private network to do this work.

The state legislature will hold a special session in which an amendment to effect the change will be adopted.

If that change is approved, the “central till” envisaged in the medical marijuana law will be abandoned and in its place, a network of 12 privately owned and operated dispensaries will sell marijuana throughout the state.

The original plan in the medical marijuana law raised controversy when it proposed that all the medical marijuana should be sold through the state-level and local health departments. Many people felt that the plan would force state employees to become what the federal government describes as “drug traffickers” since the federal government doesn’t regard marijuana as a substance with any therapeutic use and has therefore maintained it on Schedule I of the Controlled Substances Act.

When the state government insisted on the central till model, the Attorney for Davis County and the one for Salt Lake City strongly advised their respective health departments to desist from distributing medical cannabis because their employees would be exposed to the risk of federal prosecution on drug-related charges.

Such strong opposition compelled the state to revisit its earlier position, and the result is the amendment to the medical cannabis implementation plan.

The amendment will also include a change to the finance management plan of the program. Previously, Utah had wanted all transactions to be cash-based, but a planned change will see provisions made for electronic payments to be accepted.

In a strange twist of irony, the medical marijuana plan which was approved by voters in 2018 mentioned a private system of distributing medical cannabis. However, this was changed when, without consulting voters, lawmakers agreed with the Mormon Church to use a state-run distribution system. The lawmakers have now had to turn full-circle and go back to the plan that voters approved last year.

Different pro-medical marijuana advocacy groups, such as Together for Responsible Use and Cannabis Education, have welcomed the latest change. Analysts also believe that industry actors like Hemptown USA and HTC Extraction Systems (TSX.V: HTC) are also pleased that this change has been made.
