420 with CNW – Congressional Committee to Debate Two Marijuana Legalization Bills This Week

On Friday, a memo briefing to the effect that when the legislative session starts this week, a Congressional committee would be debating two legislations seeking to legalize marijuana at the federal level as well as other marijuana research legislations.

On Wednesday, the House Energy and Commerce subcommittee will hold a hearing on several reform proposals, with testimonies from the Drug Enforcement Administration (DEA), Food and Drug Administration (FDA), and National Institute on Drug Abuse (NIDA) witnesses.

This comes two months after the House Judiciary Committee approved the Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act, which was sponsored by Chairman Jerrold Nadler (D-NY). The MORE Act is one of the bills being taken up by the Energy and Commerce Subcommittee on Health on January 15.

The obtained memo starts by detailing the content of the marijuana policy in the U.S., such as the restrictions imposed by the Controlled Substances Act (CSA) on marijuana research, legalization of industrial hemp, petitions submitted in the past seeking for marijuana rescheduling, and public health issues.

Some of the witnesses for the scheduled hearing include Matthew Strait, who is the DEA Senior Policy Advisor, FDA Deputy Director for Regulatory Programs Douglas Throckmorton, and the Director of NIDA Nora Volkov.

Discussed below are some of the bills which will be debated next week.

Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act

The MORE Act aims to remove marijuana from the list of controlled substances Act. It is also seeking for expungement of the records of past marijuana convictions, as well as imposing a five percent tax on marijuana sales. Revenues from the sales would be reinvested in communities most affected by the war against drugs.

The MORE Act would also create a way for resentencing people jailed for marijuana felonies. It would also ensure that immigrants are not denied citizenship because of marijuana. The bill has provisions to ensure that weed users are not blocked from receiving public benefits and security clearance by federal agencies.

Marijuana Freedom and Opportunity Act

The legislation was sponsored by Rep. Hakeem Jeffries (D-NY). The bill’s provisions are to deschedule marijuana at the federal level, create a fund that supports minorities and marijuana businesses owned by women as well as providing grants to marijuana ex-convicts.

Medical Marijuana Research Act of 2019

It was sponsored by Rep. Matt Gaetz (R-FL). The bill seeks approval of more manufacturers of research-grade cannabis, protects institutions researching weed, and gives permission to the Department of Veteran Affairs in the U.S. to present patients with the option of treating their conditions using marijuana.

Medical Marijuana Research Act of 2019

A bipartisan group of House members led by Rep. Earl Blumenauer (D-OR) introduced the legislation. It has provisions simplifying the process of registration for researchers interested in studying marijuana. It also permits private manufacturers to supply researchers with research-grade marijuana.

Legitimate Use of Medicinal Marijuana Act

It was introduced by Rep. Morgan Griffith (R-VA). It aims at moving marijuana from Schedule I to Schedule II. It also aims at clarifying that transportation, use, possession, production, and distribution of medical marijuana cannot be prohibited by the federal government.

Veterans Medical Marijuana Safe Harbor Act

It was sponsored by Rep. Barbara Lee (D-CA). Its aim is to allow military veterans to use, possess, or transport medical pot under federal law. Veteran Affairs doctors would also be permitted to recommend medical marijuana to their patients.

420 with CNW – Illinois Residents Buy Recreational Marijuana Worth $3.2 Million on the First Day of Legal Sales

On Thursday, it was announced that the first day of legal adult-use marijuana sales in Illinois attracted more than 77,000 transactions, which generated approximately $3.2 million in sales. One of the transactions was made by the second-most powerful official in the state, Lieutenant Governor, Juliana Straton, who bought edible gummies. Stratton said that she was there to celebrate the big day in Illinois.

According to Toi Hutchinson, the sale of legal recreational marijuana took effect on New Year’s Day, and the state-licensed dispensaries made 77,128 transactions. Hutchinson is the senior advisor to Governor J.B. Pritzker on marijuana control.

The retail outlets reported long lines of customers during the first day of legal sales, and they expect the lines to persist through the weekend.

Speaking to a reporter on Thursday in Chicago, Hutchinson said that the long lines show that there is a massive opportunity for the cannabis industry to grow.

When compared to other states such as the bordering Michigan, which generated $3.1 million in its first two weeks of legal adult-use sales after the launch on December 1,  it shows that Illinois has a potential for growth since it exceeded that amount within just the first day of sales.

Colorado was the first state in the U.S. to legalize adult-use cannabis. The state launched the sale of marijuana on January 1, 2014 and generated over $1million in sales.

Hutchinson further said that Thursday was the deadline for those who wished to apply for business licenses under the social equity provisions. The day also marked phase two of the Illinois legalization law.

Phase two of the legalization law is meant to help minority applicants who were severely affected by the fight against drugs. The social equity provisions require qualified applicants to pay lower licensing fees. It also provides them with business loans and any other technical assistance.

The legalization laws also stipulate that some of the marijuana revenues would be used for neighborhood development grants. It also had a provision for expungement of low-level marijuana convictions.

On Tuesday last week, Pritzker granted more than 11,000 pardons to people with low-level marijuana convictions.

On the day of legal sales launch, Wednesday, people began streaming in at the dispensaries as early as 6 a.m. Medical marijuana is already legal in Illinois, and now, Illinois is the 11th state to legalize the consumption and sale of adult-use cannabis.

In Illinois, people who are 21 years and above can possess up to 1.06 ounces of marijuana buds and up to 0.17 ounces of marijuana concentrate.

The executive director of the Cannabis Business Association of Illinois, which is based in Springfield, Pamela Althoff, said that most of her Wednesday morning was spent in Chicago and Northwestern suburbs, where customers had to wait for about three hours to be served as the day progressed. She also noted that people were courteous and civil, and the police were present at most dispensaries to control traffic.

Althoff advised consumers not to use marijuana in public and also noted that, like any other new product, marijuana products might be a little costly. Althoff further that they hope that the prices will go down as the market matures.

About 36 licensed dispensaries are selling recreational marijuana, and by May 2020, the state officials said that they would have issued 75 more permits. State officials further estimate that by the end of 2020, Illinois could generate $250million from marijuana sales.

Top federal drug and health agencies are under pressure from a group of senators to provide an update about the long overdue increase in the number of authorized marijuana manufacturers for study purposes.

Led by Senator Elizabeth Warren (D-MA), the lawmakers wrote a letter emphasizing the importance of expanding the supply of research-grade marijuana as more states move to legalize marijuana either for recreational or medical consumption. The letter was addressed to the Drug Enforcement Administration (DEA), Office of National Drug Control Policy, and the Department of Health and Human Services.

Although the DEA announced that it would approve additional marijuana growers for research-grade weed more than three years ago, it is yet to deliver on its promise since it keeps delaying the process. In August the agency said that it is in the process of approving the applications; however, due to the large number of applications, it will have to establish alternative rules before issuing new permits.

The DEA made that announcement before the deadline issued by the court previously, which required the agency to take action. The lawsuit against the DEA was filed by a researcher whose application for marijuana production for research purposes had been suspended. The court dismissed the suit in October since the agency provided an update.

However, the senators were not placated by the agency’s response, and they are seeking guidance on the process to be taken to ensure that the qualified researchers are granted licenses on time.

The letter which was sent on Wednesday last week said that the number of studies covering the therapeutic effects of cannabis is limited even though millions of U.S. citizens are legally permitted to consume medical or recreational marijuana. The letter further noted that the number of Americans seeking doctors’ advice on marijuana treatment for ailments, such as chronic pain, PTSD, or terminal illnesses is ever-growing; therefore, federal agencies should make an effort to increase the amount of credible information on marijuana health benefits and health risks.

Being classified under Schedule 1 of the Controlled Substances Act creates a barrier for researchers to conduct studies on marijuana.

The lawmakers also argued in the letter that inhibiting research opportunities and discouraging researchers who are independent and qualified from conducting studies on the benefits of marijuana is a hindrance to states looking to implement their marijuana laws.  Marijuana studies are vital to developing an understanding of marijuana, and the findings would be a gem to the doctors, patients, and lawmakers across the U.S.

The letter also poses five questions to the agencies, and they expected the response by January 10.

  1. The status and timeline of application approval by the DEA
  2. Information about the existing supply of research-grade marijuana and if the facility is cultivating more varieties.
  3. Information on whether the government would reschedule marijuana
  4. The application process guidelines.
  5. Their support for research on the therapeutic effects of marijuana

The senators also wrote that there is a need for evidence-based public policy, which is vital to securing the health of the citizens since millions of Americans can now access medical and recreational marijuana. They added that the federal government should provide the necessary leadership and tools required in developing research in cannabis.

Other senators who signed the letter include Ron Wyden (D-OR), Kristen Gillibrand (D-NY), Cory Booker (D-NJ), Ed Markey (D-MA), and Jacky Rosen (D-NV).

420 with CNW – Huge Demand Forces Michigan Recreational Weed Retailers to Impose Purchase Limits

In Michigan, recreational marijuana business is booming. On Wednesday, a recorded message from Arbors Wellness in Ann Arbor said that currently, the shop has a high number of customers, which is keeping them extra busy and they are therefore unable to answer calls. The overwhelming demand has even led to purchase limits being imposed by the retailers.

The sale of recreational marijuana in Michigan was launched on December 1 and since then, demand has been so high that businesses were forced to turn away customers at some point. On the first day of recreational sales, four shops generated an average of $221,000.

On Wednesday, Arbor Wellness owner, James Daly, said that they had a line of customers all day and that they are working through the lines professionally with a wait time of approximately 40 minutes.

Greenstone Provisions in Ann Arbor employees said that by 1 pm on Wednesday, the wait time to get served was about 2-hours. While on Tuesday, customers had to wait for 3 to 4-hours before getting served at Exclusive Brand’s dispensary in Ann Arbor.

Michigan Supply and Provisions in Morenci, located along the border with Ohio, is having a steady flow of customers; however, on Wednesday afternoon, no customers were waiting in line to be served.

On Sunday and Monday, Greenstone Provisions had to turn away hundreds of potential customers because it had run out of stock of marijuana buds. Since then, the retail outlets made a point of restocking daily.

Marijuana shops have been forced to institute a purchase cap on the amount of marijuana each individual is supposed to buy because of the massive demand. Greenstone Provisions, Michigan Supply, and Provisions in Morenci have instituted a sale limit of 7 grams of marijuana flower per person.

Arbor Wellness’ sale limit is 1/8 of an ounce of flower. They also have a purchase limit of two edibles, seven pre-rolled joints, and 15 vaping cartridges.

The only dispensary that did not institute purchasing caps is Exclusive Brands. On Wednesday, Omar Hishmesh, Exclusive Brands co-owner, said that they are not putting any sale limit since they are not going to run out of stock. He further noted that they are fully stocked and are actively re-stocking products; thus, no shortages.

According to Michigan laws, the sale limit for the flower is 2.5 ounces, which includes a maximum of 15 grams of concentrate.

In-store inventory is moving like a hotcake, which makes real-time resupplying difficult; however, business owners still insist product shortages will not happen any time soon.

Currently, there are three licensed recreational marijuana processing plants and one licensed transportation business in Michigan.

Greenstone Provisions and Michigan Supply and Provisions inventory is at the mercy of their competition since the three licensed processing facilities are owned by their competitors. The three facilities are owned by Exclusive Brands, Arbor Wellness, and Green Peak. Green Peak is the largest processing facility in Michigan, and it is planning on establishing retail locations across the state.
