  1. Legal means no limit

Adult-use marijuana in Illinois is permissible, but only people aged 21 or above are allowed to use and possess marijuana. People can possess a maximum of 30 grams of marijuana bud and can only buy it from a licensed dispensary within the state.

Registered medical marijuana patients in Illinois can grow a maximum of five plants at their home, and it should be hidden from the public.

  1. You can smoke weed anywhere

Some of the marijuana consumption restrictions include not using while driving, or on school grounds. Public consumption of marijuana is also prohibited, and this includes parks, sidewalks, and even in restaurants or bars where cigar and cigarette smoking is illegal. However, Illinois will issue permits to the establishments that want to set up smoking lounges. Besides, dispensaries interested in setting up smoking zones in their shops would also be permitted.

The local police is responsible for arresting marijuana offenders. Although they said that their focus would not be on the low-level offender, Naperville police warned marijuana users in a Facebook video that anyone found violating the new law would be liable to civil litigation.

People should also note that Illinois law does not operate beyond the borders of the state, thus if you are caught with weed at an airport, be sure that the federal authorities could take action against you.

  1. Illinois is tracking weed users

420 with CNW – 4 Things to Expect in the California Marijuana Market in 2020

California is the largest marijuana market in the U.S., so it is worthwhile to look forward and see what is in the works for this state’s cannabis industry in the new year. Here are some of the major things that could pan out in 2020.

  1. Courts Hear Marijuana Delivery Lawsuits

When Prop 64 was approved by California voters, local authorities were given the liberty to decide whether to accept or reject marijuana businesses within their jurisdictions.

That promise was put to the test and a row over how much control municipalities and cities have over the marijuana industry came to a head when state regulators insisted that marijuana businesses could deliver weed anywhere within the state while the local authorities say such deliveries should only happen in places that permitted marijuana businesses to set up shop.

In a twist of irony, the Fresno County Superior Court is set to start hearing a case pitting 24 cities against the California Bureau of Cannabis Control on April 20 (the unofficial marijuana holiday). The outcome of this case could either give weed companies some needed respite or hamper their activities even further.

  1. Legislative Changes

On January 1, Senate Bill 34 took effect and licensed businesses can now donate medical marijuana products to patients that are needy and cannot afford them.

More importantly for marijuana businesses, Assembly Bill 37 seeks to allow companies to deduct their operational costs before their tax liability is computed. This is a major piece of legislation because it effectively sweeps aside federal laws that have denied marijuana businesses the same tax benefits that other businesses enjoy.

A legislative change that is likely to rub weed businesses and consumers the wrong way is Assembly Bill 1810. This bill seeks to ban passengers in taxis, limos and other commercial vehicles from consuming marijuana. This means that the idea of weed party buses has gone up in smoke.

Marijuana businesses insist that California needs to make many more legal reforms if the industry is to survive or even thrive given the challenges that it has faced in the first three years of legal recreational cannabis sales.

  1. Expunging Criminal Records

Prop 64 set out a process through which people with marijuana convictions could apply to have their records expunged or charges amended. However, records show that only a tiny fraction of potential beneficiaries has applied for expungement, partly due to the costs and complications of the process.

Assembly Bill 1793 passed in 2018 gave a July 2020 deadline in which local prosecutors have to track down and process the expungement or retroactive downgrading of cannabis convictions. As this deadline looms, thousands are likely to be eligible for housing, employment and other benefits they were denied as a result of their convictions.

  1. Cleaning Up Weedmaps

Weedmaps was started to provide marijuana consumers with information about the places where they could buy weed legally in California. However, state regulators warned the directory about having listings of unlicensed marijuana sellers and Gov. Newsom enacted a law that imposed fines of up to $30,000 for each day that an unlicensed marijuana seller remains operational.

Weedmaps is likely to make good on its promise to remove illicit sellers from its directory and the outcome of this action could reveal how much damage delisting those unlicensed businesses does to the cannabis black market.

420 with CNW – Marijuana Production Legalized in Zambia

The Zambian government has approved a proposal seeking to legalize marijuana production in the African country. The marijuana cultivated in Zambia would be strictly used for medicinal purposes and exportation.

Annual license fees for companies looking to operate marijuana businesses in Zambia will be $250,000. Only those whose bids are successful will be awarded commercial permits to grow and export cannabis.

According to the Health Minister Chitalu Chilufya, the government would issue medical marijuana licenses once companies have presented evidence and assurance of their cultivation process to the point where patients can use the end product without inducing the psychoactive effect of adult-use marijuana. This is due to the large number of unsolicited proposals for cultivation licenses for medical marijuana received by the government.

Before legalization, a multi-sectoral team was selected to research the process of marijuana production from the farm to the lab, to the manufacturing plant, and finally to the end consumer who utilizes the products for medicinal purposes. Chilufya further said that the DEC and the Zambia police would be working together to punish people using marijuana illegally.

The Ministry of Health in Zambia would also be tasked with the responsibility of issuing licenses while the Zambia National Service would be strictly supervising the growth of marijuana crops.

The legislation legalizing marijuana production was passed on Wednesday during a cabinet meeting at State House. Several top officials at the Cabinet Office confirmed the passing of the bill, although they could not be identified since they were not allowed to speak to the media.

The unidentified officials further said that the Cabinet Memo seeking for marijuana legalization for medical purposes submitted by the Minister of Health, Dr. Chilufya, was approved by the Cabinet. Interestingly, the Ministry of Home Affairs, Ministry of Agriculture, and the Ministry of Commerce were all working together in an attempt to take over the process of issuing permits from the Health Ministry during the cabinet meeting. The Ministry of Health has been pushing for medical marijuana legalization for some time.

The reason why many Departments were interested in being assigned the responsibility of issuing the licenses is that the whole process was sponsored by wealthy organizations and companies that were initially promised permits, and after the final vote, the Health Ministry won.

Research conducted by The African Cannabis Report revealed that by the year 2023, the legal marijuana industry in Africa could be worth more than $7.1 billion annually. This is the first thorough report on the legal marijuana sector in Africa.

Despite the potential of African marijuana industries, apart from Lesotho, marijuana is prohibited in all the other African countries.

420 with CNW – Bipartisan Lawmakers Urge DEA to Allow Researchers to Study Cannabis from Dispensaries

On Friday, a bipartisan coalition of legislators from the House and Senate sent a letter to the Department of Justice requesting policy amendments, which would allow researchers to use marijuana bought from state-legal dispensaries for their studies on its benefits and risks.

The legislators were led by Rep. Harley Rouda (D-CA) and Sen. Brian Schatz (D-HI). In the letter, they cited federal health agencies’ feedback where they said that research on marijuana is inhibited by the existing restrictions on cannabis. The primary challenge is that there exists only one federally-authorized facility producing research-grade marijuana.

Although the DEA said that they are in the process of authorizing more manufacturers, three years have passed since they announced approving more research-grade marijuana growers. The same agency further noted that it is in the process of developing alternative rules for licensing submitted applications.

However, the National Institute of Health and the Food and Drug Administration released a status quo report that did not address the barriers inhibiting researchers from using marijuana obtained from dispensaries for their research. The letter recommends for the agencies to allow researchers to use marijuana acquired from the state-legal dispensaries.

The legislators wrote in their letter that many states have marijuana laws and regulations in place for licensing industrial manufacturing activities and products for medical marijuana but not for research purposes, which would lead to FDA licensure.

The letter also repeatedly pointed out the lack of chemical diversity of the marijuana supplied by the federal government. One study found that marijuana obtained from a national research facility is more similar to hemp than to cannabis found in the market.

The bipartisan coalition made two recommendations; the first one is the amendment of internal policy which would allow researchers with Schedule 1 licenses to obtain marijuana-derived products from state-legal dispensaries for study. The second one is to issue guidance clarifying that DEA licenses are not a must for hemp researchers and that they can obtain hemp since it was legalized under the 2018 Farm Bill across the U.S.

The DEA is required to issue a response to the letter by December 20.

Twenty-one members of Congress signed the letter, including Senators such as Kamala Harris (D-CA), Cory Gardner (R-CO), Earl Blumenauer (D-OR), Joe Kennedy (D-MA), and Matt Gaetz (R-FL).

In a press release, Rouda said that the U.S. research laws are ancient. He also noted that 47 states have some form of marijuana legalization, and the federal agencies must ensure that there is a way to study the benefits and risks of marijuana products.

420 with CNW – Marijuana Companies Look to Europe for Greener Pastures

Marijuana companies in North America are experiencing lots of trouble, and companies that are looking to reap profits from cannabis are suffering from significant losses. In the meantime, European companies such as World High Life PLC are basking in the new opportunities brought by the emerging marijuana industry.

The marijuana sector needs a fresh look because its markets remain unattractive despite the changes in equity valuation and investor attitudes.

Canopy Growth holds the blue-chip marijuana market leader position. Before Constellation Brands Inc. acquired its first stake in 2017, Canopy Growth had already secured a significant amount of funds.  A few days before marijuana was legalized in Canada; Canopy Growth shares increased by $55.45 (C$73.75). However, the stock price has dropped by 73% since then, and within the past six months, the company recorded the highest losses ever.

Canopy Growth shares were valued at $18 billion (C$24 billion) by the stock market at the end of April 2019. At the moment, the value at the stock market has dropped to less than $5.2 billion (C$7billion). Compared to the first quarter, the company’s sales were down 15% in the second quarter.

Apart from Canopy, other companies suffering from the downturn in marijuana market are Aphria Inc. whose shares have fallen 59% since April, and Aurora Cannabis Inc. whose shares have fallen 76% since the end of the first quarter of 2019. In the marijuana sector, companies are struggling with declining liquid assets, expensive operations, and shareholder attenuation.

On Tuesday, some pot stocks recorded a rise. Companies like the Horizons Marijuana Life Sciences (ETF), which holds dozens of marijuana stocks recorded a 4.9% increase in stock trading. This suggests that investors are beginning to see the opportunities in marijuana stocks. Canopy stock also recorded a rise of $1.53, which is equivalent to 8.2%.

The marijuana market in North America is struggling with a fall in stock prices and surplus marijuana; however, the investors are investing more and more in the European emerging marijuana industry since they do not want to miss out on the new opportunity.

In a few years, the new frontier market in Europe may become the most significant market around the globe. It is estimated that by 2029, the medical marijuana market in Europe and the UK will be worth approximately $64.2 billion (£58 billion).

420 with CNW – Key Congressional Committee Passes Marijuana Legalization Bill

On Wednesday, a key Congressional committee passed legislation that would decriminalize and tax marijuana as well as expunging federal marijuana convictions. However, to become law, it has to be approved by the full House and the Republican-controlled Senate. The House Judiciary Committee passed the bill by a vote of 24 to 10.

The bill is known as the Marijuana Opportunity Reinvestment and Expungement (MORE) Act of 2019 and was introduced by Rep. Jerrold Nadler (D-NY) and co-sponsored by more than 50 legislators.  The legislation has the following provisions:

  • Remove weed from Schedule 1 of the Controlled Substance Act, which includes drugs such as heroin, fentanyl, and ecstasy.
  • Allow states to create their own marijuana policies, decriminalize low-level marijuana felonies, and seal the record for past federal convictions.
  • Create a Cannabis Justice Office that would impose a 5% tax on legal marijuana sales to fund job training, legal aid, and help people who are negatively affected by marijuana prohibition.

In a statement, Nadler said that the MORE Act has been long overdue. He further said that rather than handling marijuana as an issue of personal choice and public health, the government has been taking it as a criminal justice problem. Nadler asserted that it is unwise and unjust to federally arrest, prosecute and incarcerate people for using recreational or medical marijuana.

The Pew Research Center conducted a survey in November 2019 which revealed that more than two-thirds of American adults support the legalization of medical and adult-use marijuana. However, only 8% said that marijuana should remain illegal in all forms.

According to the National Conference of State Legislatures, currently, in the U.S., medical and recreational marijuana is legal in eleven states, including the District of Columbia, while medical marijuana is legal in 33 states.

Although the public is in favor of the bill, the majority of the Republicans are still on the fence about pursuing marijuana legalization.

On Wednesday, Colorado Republican and Committee member, Ken Buck said he is doubtful the Republicans will back this bill. He is almost sure that the Senate will not even consider it. Buck’s suggestion for the House is to deal with other measures that would get bipartisan support.

All 2020 presidential candidates, except the former Vice President Joe Biden, are in favor of marijuana legalization. Biden openly opposed marijuana legalization during the primary debates on Wednesday saying that more scientific research is needed to prove that it is not a “gateway drug.” Although the Centers for Disease Control agree with the need for further studies, the organization also noted that people who use weed do not proceed to use other hard drugs.

One can only imagine that marijuana companies like LiveWire Ergogenics Inc. (OTC: LVVV) and No Borders Inc. (OTC: NBDR) will only celebrate once the MORE Act is approved by Senate and signed into law by the President.
