420 with CNW – Mexican Supreme Court Extends Marijuana Legalization Deadline

The Mexican Supreme Court has extended the deadline for marijuana legalization, which it made last year when lawmakers were given up to  October 31 to change the policy on prohibition of personal use or cultivation of marijuana by terming it unconstitutional.

The previous ruling had stipulated that the policy be changed by  October 31, but it has now been extended to April 30, 2020.

The Mexican Supreme Court granted the extension on Tuesday but publicized it on Friday. Last week, the committee submitted a comprehensive marijuana legalization bill to the Senate. Due to the additional time granted by the Supreme Court, the Senate is going to break down the legalization bill and begin debates on it this week.

The lawmakers requested the extension on Tuesday last week after seeing that it would be impossible to conclude the debate and vote before October 31. Their motion of deadline extension was approved by the court, which noted the complexity of the process. They also observed that the circumstances for the request were unique and exceptional.

Some of the concerns to be discussed by the lawmakers include the monopolization of the marijuana industry by multinational marijuana corporations once they join the legal market. Marijuana advocates have also complained about the strict policies regarding the number of marijuana plants to be cultivated at home.

The legislation which was approved last week by the committees stipulated that 20% of the licenses be awarded to economically disadvantaged persons. The bill also stated that people who are 18 years and above could possess, purchase, and consume marijuana. It also allowed people to cultivate up to four marijuana plants.

Since the Supreme Court ruling, the legislators have been submitting various bills that were used to make the legislative reforms. The policies were also developed from the input gathered from the solicited public information on reform proposals.

The Senate might add several policies to the legislation since they have six months to act on the legislative reform. The Senate Health committee also filed a new bill this week. The bill might be added to the proposed changes because the advocates feel that it is an improvement to the last proposal, which was to be voted on. For instance, the new legislation allows people to grow a maximum of 6 plants and possess a maximum of 30 grams of marijuana; however, the new bill prohibits edibles and THC-infused beverages.

The Mexican Senate has not reached a consensus about marijuana legalization in the country and how it should look. But, the leaders still insist that they are close to finalizing the comprehensive marijuana legalization plan. The Senate leader of the MORENA Party, Senator Monreal, said that the Senate would vote on the bill in the first weeks of November. However, after the Supreme Court extended the deadline by several months, it is not yet clear if he will also extend further.

After approval by the Senate, the legislation will be forwarded to the Chamber of Deputies and, finally, the president’s desk.

420 with CNW – Michigan Jittery About Availability of Recreational Marijuana

After adult-use recreational marijuana was legalized in Michigan last year, people went to the stores licensed to sell only to realize that they needed medical certification from the state to be able to purchase pot.

One year later and Michigan residents still cannot walk into a store and buy weed.

However, this may soon be possible in the first quarter of 2020. That is if the  Marijuana Regulatory Agency accepts applications from businesses possessing medical marijuana licenses this fall. Since medical marijuana businesses have passed the rigorous licensing process, it will be quicker and easier to issue recreational selling licenses to them.

It may be a long wait before the sale of any adult-use marijuana begins because owners of the medical marijuana dispensaries are complaining about lacking enough quality products to stock their shelves, which begs the question of where the sellers will get enough recreational marijuana supplies whose market is almost ten times that of medical marijuana.

Currently, all the licensed marijuana growers are growing medical cannabis, and this includes the caregivers who are allowed to grow weed for their patients. Before, the caregivers used to sell their excess stock to dispensaries, but the MRA prohibited the act in June. Medical cannabis cannot be sold as a recreational weed.

According to Robin Schneider, the executive director of the Michigan Cannabis Industry Association, the MRA rules allow for surplus medical marijuana to be used for recreational purposes if the department approves it. However, this is not possible if there is a shortage of medical marijuana, as it would entail denying the patients medication.

Currently, there is no surplus, and it is not possible to grow recreational marijuana as licenses are yet to be approved. No one has an accurate answer regarding when residents of Michigan will be able to walk into a store and buy legal cannabis.

According to the CEO of GROW Cannabis Marketing in Royal Oak, Mort Meisner, medical marijuana shortages are still a big challenge, and the MRA, together with the growers, should take action to increase availability.

Since licenses for recreational marijuana are yet to be issued, the market will still be in shortage, and the adult-use consumers will continue procuring their weed from the black market. Meisner says the shortage and lack of licensing are due to poor leadership since the agency was created last spring by Governor Gretchen Whitmer.

420 with CNW – Group Campaigns for Congressional Action on Pesticide-Free Marijuana

Last Tuesday, Beyond Pesticides, a nonprofit organization said that a lack of federal regulations on pesticides used on marijuana plants is putting marijuana consumers at risk.

Beyond Pesticides are advising their supporters to send letters to lawmakers urging them to hold hearings and investigations on the illicit use of unapproved pesticides in the legal markets to prevent toxic pesticide contamination. They are urging the state to advise the farmers to adopt an organic system of planting the cannabis crop.

The Environmental Protection Agency (EPA) has to approve and register each crop before farmers can apply the pesticide. And since cannabis is not a legal agricultural crop, EPA will not be able to register any pesticides for the crop as it will require first to carry out studies showing their environmental and human impact. Moreover, there are no established tolerances for pesticide use in marijuana plants; therefore, EPA cannot approve labeling of the product’s safety requirements.

However, in August, EPA announced that they are reviewing ten pesticides that can be used on hemp crops.

Some states that have implemented their own regulations regarding pesticide application in cannabis crops have reported several cases of contamination. These states include California, Colorado, and Oregon. This situation requires congressional interference, argues Beyond Pesticides, because the use of federally registered pesticides is prohibited in other states.

The letter says that states do not have the permission to allow the use of pesticides in marijuana production or processing because of the absence of federal testing on the possible effect of pesticides on marijuana users, producers, and the environment as a whole. However, it can provide guidelines for sustainable production practices meant to protect the health of the consumers and the environment.

The nonprofit organization argues that the only option for marijuana farmers is to embrace input exempt from federal registration and adopt organic soil management practices. However, the downside to embracing the organic soil management approach is the continued registration of pesticides for marijuana in some states, which violates federal law.

The group further argues that it would be prudent, precautionary, and a positive trajectory for the farmers to follow the dictates of the national organic soils management practices when growing marijuana.

Beyond Pesticides says that it is essential to limit consumer exposure to pesticide. This is because pesticides introduce toxic chemicals to medical marijuana products. And, the ability of the body to detoxify these pesticide chemicals can be hindered by using medical marijuana because cannabinoids essentially inhibit enzymes that assist in detoxifying chemicals.

Beyond Pesticides made two recommendations to be addressed by Congress. The first issue is for Congress to hold hearings documenting states that are using federally registered pesticides, thus violating federal law. The second issue is for Congress to request the Office of the Inspector General and Government Accountability Office to conduct an investigation that clarifies the responsibility of the EPA and state enforcers in ensuring pesticide product labeling compliance.

420 with CNW – Study Finds Youth Cannabis Use Reduced After Marijuana Legalization in Washington

A new study by Washington State found that the number of youths using marijuana has reduced following the state legalization of recreational marijuana.

According to the study, the number of students in grades six, eight, 10, and 12 in King County purchasing marijuana for personal use reduced or remained constant the whole of 2016. The consumption rate of the female students in grade 10 remained constant while that of the male students decreased. However, there was a spike up to four times the number of alcohol users among the users and non-users of cannabis.

The Centers for Disease Control and Prevention Morbidity and Mortality published the findings in their weekly report this Friday supporting past studies with similar results on the decline of marijuana use among the youths after legalization of recreational cannabis in Washington and other states in the U.S.

To assess the health risk behaviors of the youth, the department of health in Washington conducts a Washington State Health Survey among public school students in grades six, eight, 10, and 12 after every two years. While conducting their study, the researchers from Seattle and King County analyzed the data from 2004-2016 on substance abuse before making their conclusions.

The researchers established that there was a decline in the number of sixth-graders using marijuana in the past 30 days, while there was no change in the number of eighth-graders who used weed in those 30 days. The rate of the sophomores and seniors consuming cannabis increased in the year 2004-2012; however, the percentage decreased after marijuana was legalized for personal use in 2012. The findings from the survey contradict the opponents who thought that legalizing marijuana would pave the way for access to cannabis by teenagers.

From the analyzed data, they found that grade 10 students who admitted to using marijuana in the past month also used other substances such as alcohol, vape pens, and cigarettes. 67% used alcohol, 43% vape pens, and 24% cigarettes.

The reason why the rate of marijuana consumption among teens decreased is because of the reduction in the illicit supply of weed by introducing legal competitors in the markets. The youth may have also lost interest in the drug once it became legal. The government should also monitor other factors that prompt the use of marijuana, such as association with family and friends.

The decline or constant state of marijuana consumption was also evident in the state of Colorado and Oregon, who legalized recreational marijuana in 2013 and 2014, respectively.

Analysts agree that marijuana industry players like Neutra Corp. (OTCQB: NTRR) and Organigram Holdings Inc. (TSX: OGI) (NASDAQ: OGI) feel vindicated that research has shown that legalization of marijuana was never a ploy to get kids using marijuana.
