420 with CNW – Cannabis Legalization Opponents Admit Federal Policy is Blocking Research

Apart from marijuana legalization advocates, Friends of the National Institute on Drug Abuse (FNIDA) have also recognized that the federal authorities’ restrictions on marijuana are inhibiting cannabis research. FNIDA also raised the issue of federal limitations to Congress.

FNIDA submitted a proposal to a Senate committee on federal restrictions indicating that the status of marijuana and other drugs on the controlled substances list is inhibiting researchers from conducting studies on the drugs.

The group (FNIDA) also requested a federal agency, NIDA, to release a report containing all the research hurdles associated with the controlled substance status of cannabis.

In a new document published by the Senate, FNIDA describes itself as a coalition of more than 150 scientific and research communities, patient groups, and other organizations whose commitment is to prevent and treat drug use disorders.

The group aims to have the Department of Labor, Health and Human Services, as well as the Department of Education and related agencies adopting their language in the financial report for the year 2019. The recommendations made by FNIDA were published earlier this month by the Government Publishing Office, although it is not certain when they submitted their statement.

FNIDA is concerned that the federal restrictions are hindering research on drugs classified as Schedule 1, such as cannabis or its compounds. Currently, we need every information regarding the drugs, and instead of heaping on the restrictions, the agency should be lowering them and other hurdles inhibiting scientists from conducting research. The Appropriations Committee directed NIDA to write a report on the barriers to research on drugs and components that are classified as controlled substances.

Some members of FNIDA, such as Kevin Sabet, publicly challenged the letter submitted to the Senate. Sabet argued that rescheduling of the drug is not a must to supporting research efforts. Kevin Sabet is the president of Smart Approaches to Marijuana; he also serves on the group’s Board of Scientific Advisors.

In 2015, Sabet’s group said that drug rescheduling would not solve the challenge for the need for more research on the drug; instead, it would encourage the illicit operators to continue manufacturing poor quality products.

Sabet wrote in the Huffington Post that reclassifying marijuana would only serve as a victory to marijuana advocates as it would be distracting and meaningless.

In a law review article submitted in 2013, Sabet argued that for legitimate marijuana research to proceed, it is not a must for marijuana to be rescheduled because the Schedule 1 status of weed does not prevent it from being tested and studied for medical purposes. However, Sabet did not acknowledge the fact that the research programs can be delayed by restrictions laid out on Schedule 1 substances.

Bertha Madras commended the DEA (Drug Enforcement Administration) for rejecting the petition for rescheduling pot. She further said that it would be unethical to move marijuana to Schedule II of controlled substances.

In April, NIDA Director Nora Volkow said that it becomes difficult to research once drugs are classified as Schedule I, which is usually done to protect the public.

This news is likely to be welcomed by the marijuana industry, including Organigram Holdings Inc. (TSX: OGI) (NASDAQ: OGI) and Marijuana Company of America Inc. (OTCQB: MCOA), since the growing consensus that marijuana’s current scheduling is a barrier to research will pile pressure on the federal authorities to revise this classification eventually.

420 with CNW – Minnesota Marijuana Legalization Advocates Take Lessons from Colorado

This week, former Colorado public officials Stanley Garnett and Doug Friednash, who were opposed to marijuana legalization, shared their opinions with Minnesota legislators about the things to consider if cannabis is to be legalized.

The two are currently members of a Denver law firm with a department dealing with marijuana and industrial hemp. They said that they are sure they made the right decision by opposing legalization. At the time of their speech, they were invited to Minnesota by Ryan Winkler, who is the Minnesota House Majority Leader. Winkler is heading the cannabis legalization initiative in Minnesota.

The two said that the reason they accepted the invitation was to express their fears on the legalization of adult-use weed and regulations if Minnesota moves forward with the initiative. Friednash, who is the former chief of staff to Colorado’s Governor John Hickenlooper, said that other states that opt to follow Colorado could learn from their experience.

Friednash went on to say that the process of legalization was scary because no other state had done it and were afraid of the implications since they were being watched internationally.

Garnett, who served as the district attorney in Boulder County for three terms, said that he was in favor of adult-use marijuana prohibition before the voter approval in 2014.

Garnett has had a change of heart because he is now in favor of recreational marijuana legalization, as it ensures public safety. He noted that Colorado’s experience with marijuana has revealed that with proper rules in place, legalization is better than criminalization.

Garnett further said that he was initially doubtful of the success of the 2012 referendum in Colorado which required legislators to allow for the legal cultivation, possession, use, and sale of cannabis to adults.

Garnett also said that marijuana prohibitionists claimed that the legalization of adult-use pot would lead to the collapse of the western civilization because of increased crime rates, deaths, as well as deterioration of public safety. But, none of these have happened since legalization.

In Minnesota, they have a medical cannabis program that permits patients with a limited set of illnesses to use marijuana. The drugs can be accessed only in the form of a pill, oil, or vapor.

Winkler, together with other broader marijuana advocates, are drafting a bill for the next legislative session and the majority of the Democrats are in favor but the Republicans are against the legalization of marijuana for non-medicinal use. He says that they aim at creating a legal and regulated market while still enforcing action against illegal activities such as underage use and the black market.

Friednash further said that before licensing, the state has to consider agricultural, revenue, and public safety impacts in addition or marijuana’s effects on the education system and human rights.

420 with CNW – Bill Filed in Illinois to Give Marijuana Industry Greater Access to Banking Services

Last week, an Illinois lawmaker filed a bill that would increase access to banking services for marijuana businesses. The number of financial institutions accepting to transact with marijuana-related businesses is increasing; however, the majority are still wary of doing business with cannabis businesses while cannabis remains federally illegal.

Now new legislation that would create a licensing process for banks and credit unions has been introduced by Democratic Representative Kambium Buckner. The bill would allow financial institutions to accept and issue special purpose checks for cannabis businesses.

The new legislation coincides perfectly with the comprehensive marijuana legalization bill, signed by the Illinois governor, which is set to take effect on January 1, 2020.

Although the legislation would have no effect on federal marijuana policy, it would help mitigate the risks that are faced by marijuana businesses operating on a cash-only basis by allowing licensed financial institutions to accept alternative methods of payments.

The new legislation assigns the responsibility of issuing the licenses to the Cannabis Banking and Credit Union Advisory Board.

The provisions of the bill include providing a safe and fast way to pay state and local fees and taxes, facilitating the payment of rent associated with marijuana business account holders as well as issuance of special purpose checks. The board would also have to invest in the state’s economy legally and reduce the burden of collecting and managing large sums of money from the local government.

Individuals or entities that have received limited marijuana charters or credit unions are expected to follow the Federal Bank Secrecy Act. They are also required to comply with the reporting guidelines for the Financial Crimes Enforcement Network.

The special purpose checks issued by the financial institutions can only be issued for the specific tasks as stipulated in the legislation. For example, paying off local and state taxes, rent, and issuing of bonds or warranties would only be allowed through these checks.

Marijuana limited charter banks and credit unions can form a network by entering into a contract. But, this would not prevent them from providing financial services to other businesses other than cannabis businesses.

The introduction of the new legislation finds Congress deep in the bipartisan legislation debates, which are meant to protect banks from being penalized by the federal regulators for transacting with marijuana businesses across the legal states. The SAFE Banking Act, which was approved by the House in September, is expected to secure Senate Banking Committee approval before the end of 2019.

In an interview with an online industry publication last week, the panel chairman, Senator Mike Crapo said that he is in support of holding a committee vote in the near future. But, he is suspicious of the House impeachment proceedings that could delay the marijuana banking vote.

Experts are of the view that cannabis businesses like ChineseInvestors.com (OTCQB: CIIX) and Organigram Holdings Inc. (TSX: OGI) (NASDAQ: OGI) may be hoping that this Illinois bill is enacted so that cannabis businesses can access some banking services.
