The legislature in New York State is close to finalizing an agreement on a draft law aimed at legalizing marijuana in the state, according to Andrea Stewart-Cousins, Majority Leader of the state senate. Stewart-Cousins revealed that a consensus, followed by a floor vote, was imminent once the lawmakers agree on the way safety and traffic stops will be handled when marijuana is legalized for recreational adult-use.

The current disagreement has to do with how people driving under the influence should be treated. Some say impaired driving should be regarded as a normal traffic infraction while others insist it should be categorized as a misdemeanor.

Speaking from a law enforcement point of view, Monroe Country DA Sandra Doorley, who is also president of the association bringing together all the district attorneys in the state, revealed that when a driver impaired by marijuana is regarded as having committed a traffic infraction, members of the public are likely to regard impaired driving as a minor infraction similar to getting a ticket for exceeding the speed limit. Doorley adds that such an attitude would be wrong, given that driving under the influence of marijuana has the potential to put visitors and state residents at risk.

In a sign that the lawmakers are certain that an agreement will be reached, the state Senate as well as the state Assembly both removed cannabis from the provisions of the budget proposals they are considering.

Previous attempts to legalize recreational marijuana have ended in failure after lawmakers failed to agree on a number of sticking points, including how the revenue generated from taxes on marijuana would be spent as well as issues to do with the expungement of past cannabis convictions and the leeway local authorities would have regarding whether to allow recreational marijuana businesses within their jurisdictions. Gov. Cuomo has wanted the state to have a significant say in how taxes from marijuana sales are spent while many lawmakers wanted the law to stipulate that a large chunk of marijuana taxes go to minority communities which bore the worst of the failed drug war.

Cuomo released a proposal in February adjusting his plans so that they are more aligned with the wishes of the lawmakers. This included making changes to his plan in order to allow licensed marijuana businesses to deliver recreational marijuana.

Pressure has been piling on the governor and legislators to pass a cannabis law after New Jersey legalized recreational cannabis through a ballot measure. It now seems that the time has come for Empire State residents to be granted access to legal recreational marijuana.

420 with CNW — USDA Secretary Approves Final Hemp Rules Despite Industry Concerns

The new head of the U.S. Department of Agriculture recently gave final approval to a federal rule that established the regulations for the hemp industry, despite concerns from advocates about some provisions. Widely considered to be a supporter of the hemp industry, Agriculture Secretary Tom Vilsack approved the rule after a department review, which started during the presidential transition had been concluded. The rule will come into effect on March 22, 2021.

The head of the USDA Domestic Hemp Production Program Bill Richmond stated in an email to stake holders that the final rule had been under additional review by the department as part of the new administration’s transition. Richmond added that the rule would now advance as stipulated in the Federal Register, as it had received approval from Secretary Vilsack.

The Agricultural Marketing Service in the department also released a message stating that the USDA and other agencies had taken the opportunity to review pending and new regulatory actions as part of the new administration’s transition. The statement noted that the routine procedure was done to make sure that new programs as well as those that had already been established were resourced and structured appropriately and that the programs were implemented to best serve their stakeholders.

The USDA had released the rule earlier in January, which came nearly two years after hemp was federally legalized under the Farm Bill 2018. Stakeholders in the industry say that these regulations being approved represent a positive step forward that offer businesses needed guidance. However, they have also indicated some policies that they hope to amend as the crop’s market grows.

With Vilsack’s final seal of approval, the rules will not be subject to further revision ahead of their enactment date. However, stakeholders and advocates have indicated that they will continue to call for changes as the market matures.

The U.S. Hemp Roundtable’s general counsel Jonathan Miller stated that the organization was pleased to see the final regulations’ improvements over the provisional final rule, referring to amendments that the department had made after issuing its initial interim regulations. Miller noted that the regulations were much improved, adding that it was clear that the USDA had listened to hemp farmers as well as the industry and paid attention.

However, Miller also observed that there were a few issues that were still pending. Those issues include the Drug Enforcement Administration’s continued involvement in registering laboratories to test hemp. He mentioned that the group was hopeful that these issues could be resolved through legislation in Congress or discussions with the USDA.

420 with CNW — Biden’s AG Nominee Reaffirms His Willingness to Respect States’ Cannabis Laws

The U.S. attorney general nominated by President Joe Biden stated in a written statement that the Department of Justice wouldn’t be using its resources to prosecute individuals who were in compliance with state cannabis laws.

Judge Merrick Garland explained that the government should focus on extensive criminal enterprises that do not comply with the state’s marijuana legalization laws rather than pursuing individuals who were complying with the local marijuana policies.

When asked about by Ranking Member Chuck Grassley how he would handle the federal-state cannabis policy conflict, Garlande remarked that it would not be best to utilize the department’s limited resources to pursue prosecutions of individuals who were abiding by the laws in states that have legalized cannabis and are effectively regulating it. Instead, he continued, the focus should be placed on ensuring that minors were prohibited from accessing marijuana and that no attempts were made by criminal enterprises to try and evade state laws.

Garland’s views on the matter correspond to policies known as the Cole memorandum, which was introduced under the Obama administration. The memorandum was, however, repealed by Jeff Sessions, former President Trump’s first attorney general, under the Trump administration.

When asked about whether he supported efforts to legalize or decriminalize marijuana, the attorney general nominee chose to give an answer that centered on the harms of the draconian policies in effect. Garland said in his statement that criminalizing the use of cannabis had contributed to the racial disparities in the criminal justice system and led to the mass incarceration of many individuals in the country. He added that this had made it even harder for millions of Americans to get employed, because of their criminal records for nonviolent offenses.

Marijuana policy reform advocates were pleased that the attorney general nominee gave his views about respecting state cannabis laws in writing.

NORML’s political director Justin Strekal stated in an interview that the responses Garland gave showed that he did not intend to impede the progress that had been made in the consumer access of marijuana or marijuana regulation. NORML is a not-for-profit organization that advocates for the reform of cannabis laws.

Garland was also asked about the role the Justice Department would play in the decriminalization, legalization and the recreational use of cannabis. He responded by stating that, first that, historically speaking, the Department of Justice had not assigned resources to be used to prosecute persons for simple possession of cannabis; he then reiterated his point on the department’s priorities.

420 with CNW — Lawmakers Urge President Biden to Issue Mass Cannabis Pardons

President Joe Biden expressed his support for cannabis reform during his presidential campaign, and now members of Congress are holding him to his word. More than 30 members of Congress have signed a letter urging the president to grant mass clemency to people with federal, nonviolent cannabis convictions. After signing the letter, the 37 members of Congress then headed to Twitter to drum up support for the letter and push the President into action.

Led by Congressional cannabis co-chairs Reps Earl Blumenauer, an outspoken advocate for cannabis reform, and Barbara Lee, the members of Congress want Biden to follow the lead set by former Presidents Gerald Ford and Jimmy Carter. Back in the 1970s, Ford and Carter used their executive authority to offer clemency to more than 10,000 Americans who went abroad to avoid being drafted for the Vietnam War.

The Congressmen noted that cannabis drug reform has been sweeping across states, with more than 30 states now allowing some form of cannabis. They also mentioned the historic vote made last year by the House of Representatives to decriminalize marijuana at the federal level. But until Congress sends the president a comprehensive bill that will federally decriminalize cannabis to sign, they say, he can use his presidential powers to help advance criminal justice reform and help thousands of Americans who are currently incarcerated for nonviolent cannabis-related crimes.

The move by the representatives from Congress has been met with support from cannabis reform advocates. Justin Strekal, political director of the National Organization for the Reform of Marijuana Laws (“NORML”) has praised them for being brave enough to pressure their party’s president to do something about cannabis prohibition in the country. So how would President Biden pardon Americans with nonviolent marijuana-related convictions?

Back in 1977, President Carter issued a proclamation that outlined the criteria for Americans who had violated the Military Selective Service Act and were eligible for clemency. Individuals who had dodged the draft for the Vietnam War then submitted documents showing that they indeed qualified for clemency and were pardoned. This is what the Congress reps would like the President to do, instead of the individual clemency we’ve seen from past presidents.

420 with CNW — NFL Studies How Players Can Use CBD, Marijuana as Alternatives to Opioids

The NFL Players Association and the National Football League are learning more about the potential cannabis and its components, such as CBD, possess as alternative treatments for pain. This is in addition to finding out how the use of marijuana affects athletic performance.

Last week, a notice was made public by the joint organizations’ committee. It states that the league’s objective is to find investigators who possess the ability to conduct studies whose goal will be to add to the Pain Management Committee’s knowledge about athletic performance and pain management in players of the NFL.

Apart from focusing on the effects of marijuana or its derivatives on athletic performance, the NFL-NFLPA committee noted that last year it held two forums on cannabinoids to learn more about the science behind cannabinoids and how they’re manufactured in North America. However, the forums’ findings were inconclusive as the Pain Management Committee (“PMC”) discovered that, while CBD has potential to provide pain relief, science at the moment lacks evidence to support these claims.

In a paper for the players, the committee noted that while cannabinoids were a promising component, most hype surrounding it was based upon various results from animal studies. As part of a bargaining agreement, the league also changed its policy on drug testing. The new policy does not allow for suspension of NFL players from games over positive tests for any drug, including cannabis.

This decision demonstrates a considerable shift in the league’s approach to drug use by its players, with the agreement highlighting the need to concentrate on treatment and evaluation rather than punishing players.

Currently, players who self-refer themselves, show any behaviors that demonstrate drug misuse or test positive for drugs will be required to join an intervention program where they will be evaluated and receive a treatment plan. After that point, testing positive would be met with a half-week loss of salary for beginner violations, loss of a week’s salary for second violations, and an additional week’s salary loss for third violations. Any violations after that would result in a three-week salary loss.

The NBA is showing similar tendencies. Earlier in December, the league’s top official stated that an interim policy by the NBA to stop randomly testing players for cannabis amid the COVID-19 pandemic may be made permanent. Commissioner Adam Silver explained that instead of conducting blanket tests, the league would reach out to any player who demonstrated signs of problematic dependency rather than players who used cannabis casually.

420 with CNW — Senate Leaders Have First Meeting to Discuss Cannabis Legalization Plan

The past few years have seen several states legalize recreational or medical cannabis. By 2020, more than 30 states allowed cannabis in various forms, and there was hope that eventually the wave of cannabis reform would reach the federal level. Toward the end of the year, the U.S. House of Representatives passed a cannabis decriminalization bill that would definitely have stalled in the then Republican-controlled Senate. However, the Democrats clinched both the House and Senate majority, renewing the hope that one day, cannabis would be legal at the federal level.

In late January, Senate Majority leader Chuck Schumer hosted a meeting with marijuana stakeholders, beginning the long journey toward finally legalizing cannabis at the federal level. The Democrat was joined by Senate Finance Committee Chair Ron Wyden and Senator Cory Booker, as well as representatives from advocacy groups and the fledgling cannabis industry. The guests included staffers from Drug Policy Alliance (“DPA”) and Students for Sensible Drug Policy as well as other organizations with ties to the Marijuana Justice Coalition, according to sources who attended the hour-long meeting.

In a joint statement released before the meeting took place, the trio of senators, who are at the forefront of cannabis reform, said they would release draft legislation in the coming weeks to help paint a picture of what federal legalization would look like. They stated that the war on drugs and marijuana policing, in particular, had failed, and they called for a change in federal policy that would focus on repairing the harms of the decades’ long war on drugs.

Topics that were discussed during the meeting include the regulatory structure for cannabis, tax policy and social equity. Attendees say one issue the senators were especially committed to was a Senate bill that at minimum would deschedule cannabis and replace current anti-cannabis legislation with a justice and equity-focused policy. Although the senators didn’t go into much detail about what the cannabis bill would eventually look like, they signaled that they would incorporate the feedback they received during the meeting and from other sources.

Amber Littlejohn, executive director at the Minority Cannabis Association (“MCBA”), says the meeting between the senators, advocates and industry stakeholders was historic, especially since Schumer, Booker and Wyden want to make equity and justice the foundation of the legislation. Queen Adesuyi, policy manager of national affairs for the Drug Policy Alliance, also praised the senators’ efforts, saying that seeing “such a dynamic trifecta of leadership” working on delivering justice to communities that were most affected by the war on drugs is exciting.

Booker is expected to be the legislation’s lead sponsor once proposed legislation is filed, after which the bill would likely be referred to Wyden’s committee.

420 with CNW — Weather Vagaries Trigger Medical Marijuana Shortages in Jamaica

Jamaica, a country that has long been associated with cannabis, reggae and Rastafarianism is running low on marijuana. Despite being named after sturdy plants that can generally withstand most kinds of terrains and weather extremes, “weed” actually requires a specific blend of moisture and heat to thrive. Unfortunately, Jamaica has experienced heavy rains that pummeled the crop followed by an extended drought that dried everything out, causing massive losses and a significant reduction in supply.

According to farmers who grow cannabis, the heavy rains followed by drought caused tens of thousands of dollars in losses. Daneyel Bozra, a marijuana grower in the southwest part of Jamaica, says the weather destroyed everything. He grows cannabis in Accompong, a historical village founded by escaped 18th-century slaves called maroons. The coronavirus pandemic and resultant health measures, including a 6 p.m. curfew, made the situation even worse.

Kenrick Wallace, a 29-year-old farmer who also grows cannabis in Accompong, says the curfew disrupted the farmers’ routine of tending to their fields at night. With the lack of roads forcing the group of farmers he works with to walk to reach their fields as well as to get water from wells and springs, they simply didn’t have enough time to care for their plants. Wallace cultivated only 300 pounds of marijuana compared to the average 700 to 800 pounds his group normally produces; he estimates they may have lost more than $18,000.

An upsurge in demand is also to blame for the gaps in the cannabis supply chain. With the country loosening its previously rigid cannabis policies and the pandemic causing more people to turn to cannabis, the supply chain has had a hard time catering to the ballooning demand. Tristan Thompson, chief opportunity explorer for Tacaya, a consulting and brokerage firm for the country’s surprisingly young legal cannabis industry, calls it a “cultural embarrassment.”

Last year was the worst year, he says, adding that growers have never seen this amount of loss. Tourists have started coming into the country, many of them looking for its famed cannabis, and many have posted on travel websites how Jamaica is running low on marijuana. CEO of Jamaica’s Ganja Grower’s and Producers Association Paul Burke says that with the government loosening restrictions, more people can appreciate its therapeutic value without the stigma that has been attached to usage in the past.
