420 with CNW — Why New Jersey Legislators Are Unwilling to Allow Patients to Grow Medical Cannabis

New Jersey legislators are currently in the process of finalizing the details of the state’s marijuana decriminalization and legalization policies. While the S3550 bill has lessened the penalties for individuals found carrying less than six ounces of marijuana, it still forbids any person from having the intent to distribute or the distribution and possession of a controlled and dangerous substance. The bill does not touch on marijuana home-cultivation, which remains criminalized.

This is despite poll data from a Rutgers University 2018 poll, showing that 60% of voters in the state disagreed with a prohibition that forbade residents from cultivating their own marijuana at home.

There are still many gaps in the bill, despite the work that’s been poured into the legislative sessions. Ryan Magee, a marijuana attorney at Riker Danzig Scherer Hyland & Perretti, ascribes this to how much support and time is available to sufficiently address the topic. Magee goes further to state that if at-home growing is ignored this time around, reform may happen in the future.

More than a decade ago, legislators had discussed home cultivation of marijuana while drafting the state’s medical cannabis program. While it wasn’t included in the Compassionate Use for Medical Marijuana Act’s final draft, which was signed by Gov. Jon Corzine, there once had been a home cultivation provision that allowed registered patients to cultivate up to six plants at home without incurring any penalty.

However, opponents had compared New Jersey’s proposed initiative with California’s proposition 215, which allowed medical patients to cultivate marijuana at home. At the time, California was the first state to implement a state-regulated medical cannabis program, a move that garnered widespread criticism.

To avoid this, the sponsors of the bill shifted their decision-making power to the state’s health department. This decision led to the department limiting the amount of usable cannabis a patient could have to an ounce per month. Soon after this, the assembly health committee removed the provision allowing home cultivation from the bill completely.

This came soon after state Sen. Nicholas Scutari supported the pardon of John Jay Wilson,  who was a multiple sclerosis patient, to grow his own marijuana.

In addition to Washington, DC, 17 states in the U.S. currently permit at-home marijuana cultivation for individuals aged 21 and above. However, some states have imposed more limitations on which residents can cultivate at home.

For instance, in Arizona and Nevada, residents who are of age are allowed to cultivate marijuana recreationally only if they live no less than 25 miles away from a dispensary. In Missouri, the law dictates that only medical cannabis patients are allowed to cultivate at home, and these cannabis patients must pay a $100 fee.

States such as Massachusetts and Alaska have more progressive measures. Massachusetts allows growing of up to 12 plants if there are two residents of age in the household while Alaska allows any individual who is 21 years and older to grow up to six marijuana plants.

420 with CNW — Study Shows Medical Marijuana Beneficial to Parkinson’s Patients

The health and medical field is seeing an increased interest in the use of medical marijuana to reduce symptoms of various ailments such as Parkinson’s disease, now that the herb has been legalized in many regions across the globe.

Results from a survey of Parkinson’s disease patients from Germany show that more than 8% of patients with the disease admitted to using marijuana products and more than half of those users, who made up roughly 54%, revealed that the products had been clinically beneficial.

Marijuana products that contain THC, which is the primary psychoactive compound in marijuana, are allowed to be prescribed in Germany when marijuana can help alleviate disabling symptoms and when prior therapies have not been tolerated by the patient or have been unsuccessful.

On the other hand, products containing pure cannabidiol (“CBD”), which is extracted from the hemp plant directly, are available on the internet as well as in pharmacies, and can be acquired without a prescription.

The researchers’ objective was to evaluate patients’s perceptions of medical marijuana while also assessing the experiences of patients who had already used marijuana products. They carried out a cross-sectional countrywide questionnaire-based survey among German Parkinson’s association members.

The association, Deutsche Parkinson Vereinigung, is the largest group of Parkinson’s disease patients, made up of about 21,000 members from German-speaking nations. The questionnaires were distributed in April 2019, both in the investigator’s clinic and with the group’s membership journal.

The researchers analyzed more than 1,300 questionnaires, with their results showing that the interest in medical marijuana in the Parkinson’s disease community was high. However, knowledge on different types of marijuana products was scanty. From the study population, only 9% of the respondents could differentiate between CBD and THC, 28% were informed on the different routes of administration, i.e., oral administration vs. inhaling, and 51% knew of medical marijuana’s legality.

The researchers found that tolerability was good, with 40% of the marijuana product users reporting that they helped alleviate muscle cramps and pain. Additionally, more than 20% of the users revealed a decrease in restless legs, anxiety, depression, tremors, freezing and a decline of stiffness.

Besides this, patients also reported that as compared to oral products which contained CBD, inhaled marijuana products that contained THC were more effective in remedying stiffness. However, those products were not well tolerated.

Dr. Carsten Buhmann, who was involved in the study, explained that the study’s findings confirmed that patients with Parkinson’s disease had a growing interest in treatment with medical marijuana but had limited knowledge on how to take it and how to differentiate between CBD and THC.

Buhmann then remarked that physicians should consider these angles when giving advice to their patients on treatment with medical marijuana. The findings, he said, may assist physicians in deciding on the type of cannabinoid a patient may benefit from, whether a patient could benefit from the treatment, the symptoms it may address as well as the suitable course of administration.

Earlier in November, voters in New Jersey voted overwhelmingly in favor of recreational cannabis. As such, New Jersey has joined the growing number of states that allow adult-use marijuana, with the amendment taking effect on Jan. 1, 2021. Soon after the 67.25% vote in favor of recreational cannabis, state legislators in Trenton started drafting the laws and regulations for the industry, and Gov. Phil Murphy made two appointments to the state’s newly formed Cannabis Regulatory Commission, which will oversee the medical and recreational cannabis industry.

Aide Dianna Houenou has been appointed to chair the five-member Cannabis Regulatory Commission. Gov. Murphy described her as “the right person at the right time,” stating that she is the kind of person who will ensure the Garden State’s nascent cannabis industry will be “equitable, fair, and inclusive of all communities.” She currently serves as senior policy advisor and associate counsel to the Governor and advises on policy issues regarding military and veterans, community affairs, as well as criminal justice and immigrants’ rights matters.

Born and raised in California to immigrants from Benin and France, Houenou moved to New Jersey four years ago to work with the ACLU as policy counsel, advocating for marijuana legalization as well as leading New Jersey United for Marijuana Reform. She was involved in the establishment of the state’s Office of New Americans and helped to advance criminal justice initiatives such as advancing civilian oversight of law enforcement officers.

Jeff Brown, the current assistant commissioner of the New Jersey Department of Health, will work as the Cannabis Regulatory Commission’s executive director. He oversees the Division of Medicinal Marijuana, and under his leadership, the division has increased patient enrollment numbers from 17,000 to 95,000 and more than doubled the number of physicians and dispensaries participating in the state medical cannabis program.

Before joining the state Department of Health, Brown was involved with the passage and implementation of the Affordable Care Act, specifically the expansion of Medicaid and the creation of health insurance exchanges. Murphy is excited about the new appointments, and responding to a recommendation by Senate President Steve Sweeney, he is set to appoint Krista Nash as the third member of the commission.

420 with CNW — Research Finds That EU Youth Have Abandoned Tobacco, Alcohol in Favor of Weed

Teens in Europe are drinking less alcohol, smoking less tobacco and increasingly turning to cannabis, a new continent-wide study has found. Teens aged 15 and 16 year olds are drinking and smoking less than they were in the nineties and early 2000s, but the increasing rates of cannabis consumption have raised fears that youth may be engaging in different but equally damaging addictive behaviors. The study was carried out by the European School Survey Project on Alcohol and Other Drugs (“ESPAD”).

In what was its seventh such study since 1995, ESPAD interviewed 99,647 15- and 16-year-olds from 35 countries on their attitudes towards drug use; the interviews were conducted via questionnaires. Comprised of a network of autonomous research teams across 40 European countries, EPSAD is the largest international research project on substance abuse among adolescents in the world. The study was coordinated by the EPSAD Italian team at the National Research Council of Italy (“CNR-IFC”), with the results published in collaboration with the European Monitoring Center for Drugs and Drug Addiction (“EMCDDA”).

After collecting data on teen drug use over the course of 2019, the researchers found that more than three-quarters (75%) of the respondents had consumed alcohol in the past, with 47% doing so within the past month. This is down from 90% and 68% in 2003, and it can be partly attributed to recent legislation banning the sale of alcohol to minors. Only 10% of the respondents said that they smoked tobacco on a daily basis, down from the 20% who smoked daily 25 years ago.

The researchers also found that only one in five teens smoke every so often compared with the one in three who did so in 1995. Additionally, 40% of the respondents admitted to having tried e-cigarettes while only 14% smoked e-cigarettes daily. Of those who had never smoked before, 14% stated that they had tried e-cigarettes within the past month. However, while alcohol and tobacco use has been on a steady decline, the researchers found that cannabis use among European teens has been on the rise.

Approximately 16% of the respondents admitted to having tried cannabis in the past compared with 11% in 1995. Another 15% of Italian teens admitted to monthly use, with 24% of French teens saying they had used illicit drugs in general on at least one occasion. The study found that 2.8% of French teens were most likely to have tried cocaine. It also noted that 6.6% of the respondents had used sedatives and tranquilizers, stating that the “non-medical use of prescription drugs among adolescents remains a concern.”

420 with CNW — Senate Committees in Mexico Pass Marijuana Legalization Bills

During a joint hearing last week, several committees of the Mexican Senate provisionally approved a modified bill to legalize cannabis; a formal vote is scheduled for the coming week. The bill, which had been circulated in provisional form and was revised before the meetings, aims at establishing a controlled marijuana sector in Mexico.

Additionally, adults aged 18 years and above would be allowed to grow up to four plants of cannabis for personal consumption as well as buy and possess a maximum of 28 grams of cannabis. The panels voted to waive an earlier version of the bill, which had been advanced by lawmakers on the Senate’s United Commissions of Justice, Health and Legislative Studies, during the last week’s session.

Eduardo Ramirez, Senate president, stated that there’s general agreement to actualize the reform before the date mandated by the court. Therefore, a Senate vote should be expected soon. This is despite advocates hoping for more revisions to be made that ensure social equity and consumers’ rights in the newly created marijuana market. The existing deadline to pass this law remains Dec. 15, 2020.

On a separate note, a marijuana advocacy group voiced concerns about some provisions it  considers to be extremely restrictive. An example is the limitations on the cultivation of marijuana outdoors. The legislation, however, attempts to reduce how much influence huge cannabis corporations wield. For instance, the legislation stipulates that within the initial five years after the legal market is launched, a minimum of 40% of marijuana licenses have to be awarded to applicants from historically marginalized, low-income and/or indigenous communities. The issuance of licenses as well as the regulation of the cannabis market would be performed by the Mexican Institute of Cannabis.

In addition to this, consuming cannabis publically will be permitted, with the exception of large gatherings at which individuals under the age of 18 years can be exposed and places where the use of tobacco is prohibited.

Furthermore, the proposed legislation states that people shouldn’t consume marijuana in homes in which underage individuals reside or are present. The possession of marijuana exceeding 28 grams yet less than 200g would not be punishable by jail time and would instead be considered a violation punishable by a fine.

If the Senate signs off on the cannabis legalization bill, the legislation would then be advanced to the Chamber of Deputies.

While legislators work to complete the marijuana reform legislation, there’s been a wave of lighthearted pushes to center attention on this matter by activists and members. This has mostly taken the form of gifting and planting marijuana.

For example, earlier in September, Interior Ministry Secretary Olga Sánchez Cordero, was offered a marijuana plant as a gift by Emilio Álvarez Icaza, a Senator, during a Senate floor discussion. She said she’d make it one of the plants in her own personal garden.

420 with CNW — Texas Legislators Pre-File Bills to Legalize Marijuana

Slightly more than a week after five states voted to legalize marijuana in some way, legislators in Texas have started pre-filing bills aimed at enacting marijuana reforms in the conservative U.S. state.

In only two days, a total of 13 marijuana-related bills targeting the 2021 legislative session of Texas were pre-filed. One of those bills seeks to legalize the recreational use of cannabis by adults; another wants to decriminalize the possession of small amounts of marijuana and protect people who genuinely think they are in possession of hemp but are found with marijuana. Still a third is designed to put the issue of marijuana legalization before voters in the state.

While most of those bills seek to make massive reforms to marijuana policy in Texas, the most far-reaching is a legalization bill that has been sponsored by a newly elected state senator. Democrat Roland Gutierrez is currently a member of the state assembly and is waiting to join the senate in January. His bill, Senate Bill 140, intends to allow Texans who are at least 21 years of age to purchase, possess and consume marijuana within the state. The bill also has provisions establishing a regulated marijuana market in Texas.

The senator-elect has largely premised his bill on the potential financial benefits that the state is likely to enjoy once a regulated marijuana industry is established. For example, the lawmaker states that the marijuana industry has the potential to inject about $3.6 billion into the Texas economy in addition to bringing a minimum of 30,000 new jobs to the state.

His figures aren’t wishful thinking as estimates done by Vicente Sederberg LLC, a law firm, indicate that a legal marijuana industry can earn Texas at least $1.1 billion in taxes as well as millions extra from license and other fees.

These financial benefits come at just the right time as state officials say Texas will have a deficit of $4.6 billion as the legislature resumes business in January 2021.

Gutierrez jumps on this fact, noting that marijuana legalization provides a solution to raising the needed funds without burdening ordinary Texans with additional taxes. Ironically, the money the incoming state senator talks about receiving from a legal marijuana industry will come from excise and sales taxes levied on those products. However, this method of getting the needed resources may be more acceptable to Texans as they could see it as the price they have to pay to access cannabis legally within the state.

420 with CNW — Federal Marijuana Legalization Bill to Get Floor Vote in December

Steny Hoyer, a U.S. representative from Maryland and the House Majority Leader, wrote a letter to his colleagues providing details about the upcoming legislative session, slated to run November to December. That letter indicated that the long-awaited floor vote on federal marijuana legalization will happen, though he didn’t mention exactly when that’s likely to be during the brief session.

In his letter, Hoyer explains that the House will vote on the MORE Act. This bill seeks not only to decriminalize marijuana but also to create a pathway for the expungement of nonviolent, marijuana-related convictions that have made it nearly impossible for scores of Americans to secure employment, access credit or even find appropriate housing. These bottlenecks have prevented the affected people from contributing positively to the economies of the states where they reside.

It should be remembered that this same bill had been scheduled for a floor vote back in September. However, a number of Congressmen and women who faced tight races to retain their seats felt uneasy about voting on marijuana legalization while the House had failed to pass a COVID-19 stimulus package. The vote was therefore called off, and the Majority Leader promised to bring up the bill after the dust of the recently ended elections has settled.

Last week’s elections saw massive wins for marijuana as five states passed marijuana measures either for medical or recreational cannabis. That approval means that now more than one-third of the country has some form of legalized marijuana, including jurisdictions such as South Dakota and Montana, which are seen as very conservative.

Public sentiment is also massively in favor of federal cannabis legalization as evidenced by a recent Gallup poll, which found that nearly seven in ten Americans support the legalization of marijuana.

It is therefore not surprising that the House wants to vote on the pending marijuana bills since this is in line with what the public wants. Reacting to Hoyer’s letter about the planned floor vote, Rep. Barbara Lee, who co-chairs the marijuana caucus in the House, said that the success registered in the legalization ballot measures voted upon last week showed that it was necessary for Congress to get up to speed with the needs of the public.

Chuck Schumer, the Senate Minority Leader, also expressed his agreement through a tweet regarding the planned floor vote. It now remains to be seen whether the bill will have sufficient support to pass.

420 with CNW — Will Europe Increase Its THC Limit to 0.3%?

In late October, the European Parliament voted to raise the THC limit for industrial hemp from 0.2% to 0.3%. Back in 1984, the standard for a European THC limit in industrial hemp was set at 0.5%. That limit was reduced to 0.3% in the 1970s and reduced even further to 0.2% in 1999. The original goal of the 0.2% limit was to prevent high-THC marijuana from being grown in low-THC industrial hemp fields.

However, in the 20 years since the limit was set, hemp farmers in Europe have been pushing for it to be raised, arguing that the limit reduces the number of strains they can use. Amendment 8 & 93, which raises the limit state, “As regards the areas used for the production of hemp, in order to preserve public health and to ensure the coherence with other bodies of legislation, the use of hemp seeds varieties with tetrahydrocannabinol content below 0.3% should be part of the definition of eligible hectare.”

These amendments were passed alongside Amendment 234, which adds hemp to the sectors covered by EU marketing standards so that eventually products could be graded according to appearance, consistency, characteristics and restrictions. Parliament’s vote to increase the limit to 0.3%, bringing it in line with the THC limits used in the Americas, has been met with applause from hemp activists.

“The increase of THC level would allow new varieties to enter the market and to be bred, resulting in a better adaptation of the crops to the climatic conditions of the different EU territories,” the European Industrial Hemp Association said in a statement.

Now that the European Parliament has approved the amendment increasing the THC limit to 0.3%, a few more steps are required before that legislation can take effect. Although advocates and players in the hemp industry have met the news with praise, some wonder whether the amendment will actually become effective. Parliament’s vote only establishes its opinion on the Common Agricultural Policy Reform proposal. For the amendment to actually go into effect, it has to be approved by two more bodies: The Council of the European Union and the European Commission.

These three bodies are set to begin negotiations on the agricultural policies in mid-November, only a couple of weeks away. At this point, any outcome is possible.
