420 with CNW – New Zealand Government Presents 2020 Marijuana Legalization Bill

On Tuesday, the residents of New Zealand got a peek at the contents of a draft proposal on marijuana legalization that will be subject to a voter’s decision during the 2020 ballot.

According to a summary statement, the government of New Zealand is publishing the draft bill to ensure that the residents are well informed on the direction of legalization and the decisions being made.

The draft legislation gives a framework of the essential elements of establishing a regulated recreational marijuana market. Before the 2020 elections, the government will have updated the bill while taking into account public feedback.

If the bill is voted for by more than 50% of all voters, the soon to be elected government will have the responsibility of enacting new laws for regulating recreational marijuana.

The proposed legislation has the following policies:

  • People above the age of 20 would be able to purchase marijuana products.
  • People would be required to consume weed in private places and licensed facilities.
  • Mandate investments in public health education campaigns.
  • It would impose restrictions on campaigns.
  • It would also create a marijuana business licensing program.
  • People are also allowed to purchase up to 14 grams of marijuana per day and grow a maximum of two plants for personal use.

The government of New Zealand would be tasked with the establishment of the Cannabis Regulatory Authority to regulate the marijuana industry, approve business permits, and promote public health. The Cannabis Regulatory Authority would also be responsible for imposing the excise tax so that the government can recover costs incurred during the implementation of the marijuana program.

In a press release, Justice Minister Andrew Little said that the purpose of making the referendum questions, Marijuana Legalization draft and the Control Bill was to promote public awareness and discussions.

He further said that he aims to have the draft bill published in early 2020, to give them time to debate any needed changes. He also said that experience from abroad shows them the importance of presenting the public with factual and explanatory information to make an informed decision when voting.

The primary objectives of the legislation are to promote policies that reduce the severity of harm associated with marijuana and reduce the rate of marijuana use through education and treatment programs.  The bill’s secondary objective is to eliminate the black market, reduce the arrest record, and safeguard quality control for marijuana products.

The details on the legalization proposal were first published in May. The bill was approved for a voter’s decision after the Green Party struck a deal to install Labor Party head Jacinda Ardern as the prime minister.

The referendum question will be structured like this:

  • Do you support the proposed Cannabis Legalization and Control Bill?
  • YES, I support the proposed Cannabis Legalization and Control Bill.
  • No, I do not support the proposed Cannabis Legalization and Control Bill.

This week, a survey was released showing that 49% of New Zealand residents are opposed to marijuana legalization, and 43% support marijuana reform. It is uncertain if the voters will give the bill the nod.

Green Party MP, Chloe Swarbrick, said that the primary focus of the bill is to limit access, and eradicate the illicit market. Swarbrick further noted that in New Zealand, people of all ages could purchase weed since the drug dealers do not check IDs, nor do they care about the safety of the products they are selling.

420 with CNW – Another Marijuana Legalization Bill Introduced in Mexico Legislature

On Tuesday, a key Mexican lawmaker introduced a new marijuana legalization bill in parliament. The legislation would allow people to cultivate marijuana in their homes.

The coordinator of the ruling MORENA party’s bench in the Deputies Chamber, Mario Delgado Carrillo, while filing the legislation, argued that regulating marijuana would help in promoting health among the Mexicans. Furthermore,  having the government in charge of the program would help in reducing industry monopolization by the big marijuana companies.

In the bill, he outlined the history of the marijuana ban in Mexico while citing that there is not enough evidence to support the ban. The prohibition of cannabis is repressive, and it violates the fundamental rights of the Mexicans. He also added that legal access to marijuana could be used to treat patients with certain conditions.

The bill also states that prohibition has led to widespread violence in Mexico through the formation and multiplication of criminal gangs. Furthermore, marijuana legalization would create jobs and stimulate growth in the Mexican economy.

As stated in the bill, the government would form a department called Cannsalud, which would be responsible for regulating the legal cannabis market. The department would be a branch of the federal government with technical, operational, and management roles to help in the realization of the sole purpose of the bill, marijuana legalization.

Last year, Mexican lawmakers went on a benchmarking trip to Canada to learn more about their marijuana legalization model. In Canada, marijuana is sold through government stores. It seems the Mexican lawmakers have adopted the Canadian system of the government-run approach to marijuana regulation.

The Mexican legislation would permit adults to cultivate a maximum of six marijuana plants for recreational use.

According to Delgado, the state would constantly supervise and control the growth and use of marijuana to make sure that it stays within the margin of legality, and the marijuana market is not left to the control of the citizens.

Under the bill, a public company would be formed as an intermediary to help identify and mitigate risks possible in the market; such as international companies maximizing their profits by utilizing weed above the legal potency limit, which would prove harmful to human health.

The Mexican Senate has been organizing events to promote talks about marijuana legalization for the past several weeks. A former White House drug czar was featured in one event where he urged the Mexican lawmakers to implement strong regulation for the cannabis market.

Earlier this month, Senator Julio Mencaca of the MORENA party introduced new marijuana legislation that does not call for the government to control sales.

420 with CNW – LA Launches Crackdown on Marijuana Black Market

Recently, the city of Los Angeles launched a major crackdown on illegal marijuana activities that include cultivation, extraction, manufacturing and delivery. The city has a penalty of six months’ incarceration and a fine of $1,000 for those convicted of engaging in any unlicensed commercial cannabis activity.

LA City Attorney Mike Feuer is quoted as saying that that his office was taking the enforcement action because it wasn’t good for some entities to go through the entire process of getting licensed while others come and distort the industry without playing by the same rules.

Currently, the city has about 165 licensed businesses that are engaged in retailing and delivering legal marijuana. However, many more continue to flout the rules and operate in the shadows, a problem that has persisted over the years.

Some industry players and activists have started to become frustrated by this unending cat and mouse game with black market operators and they are suggesting that the penalties for commercial marijuana activity in California aren’t stiff enough and an amendment should be made to the law so that serious or repeat offenders are charged under federal law which carries stiffer penalties.

For example, under federal marijuana laws, anyone found engaging in commercial marijuana activity that involves 100 kilos of cannabis is liable to imprisonment for up to 40 years and a fine that can be as high as $25 million.

These activists and industry players point to “Project Exile” started in Virginia in 1997 to stamp out gun-related crime within the state as an example. In that project, felons found with guns weren’t charged in state courts where the sentences were lighter.

Instead, they went before federal courts and received stiffer penalties which came with denying the suspects bail until their cases were heard and concluded. Felons couldn’t be released until they had served their entire sentence and they were jailed at least 1,000 miles away from the county where they lived. Library, commissary and mail privileges were also off the table for such convicts.

“Project Exile” was effective in reducing gun-related homicides and other gun-related crimes in Virginia, and a modification of this tactic is being suggested as a way to deal a decisive blow to the marijuana black market in California.

It isn’t certain whether the prosecutors in California would agree and come up with the necessary measures to implement this strategy, but experts think industry participants like Cannabis Strategic Ventures Inc. (TSX.V: RIV) (OTC: CNPOF) would welcome any measure that gets rid of the illegal cannabis industry players so that consumers only access licensed products that have undergone rigorous testing.

420 with CNW – New Industry-Backed Cannabis Legalization Measure Announced in Florida

A multi-state medical marijuana dispensary chain is behind the latest measure which has been filed to legalize recreational marijuana in Florida. This measure was filed on Aug. 6.

The 2020 ballot measure was a filed by Make It Legal Florida, a political committee registered at the beginning of this month. The chair of this committee is the government affairs director of MedMen, a medical marijuana dispensary with operations in Florida and several other states.

Under this proposal, it would be legal to possess, use and transport up to a maximum of 2.5 ounces of recreational marijuana as long as one is at least 21 years old. The measure also recommends that medical marijuana dispensaries in the state can sell marijuana for adult recreational use.

Make It Legal Florida didn’t include the home cultivation of marijuana in its measure, and there was no mention of whether retail shops could be licensed for the sole purpose of selling recreational marijuana.

If this measure gets voter approval during the 2020 election, recreational marijuana will have to be packaged in child-proof materials and will be clearly labeled. No adverts targeting people who are less than 21 will be permitted.

The subject of home cultivation is a touchy one for the industry because there were angry outbursts in response to reports that an association of medical cannabis companies, including MedMen, wrote to Governor Cuomo of New York earlier this year urging the state to reject home cultivation clauses in any legalization law.

A spokesperson for Make It Legal Florida revealed that the measure was being reviewed by the relevant department of the state and the group would announce the next steps once the language of the measure is approved.

At the moment, it isn’t clear to what extent MedMen is running or funding this initiative which will require 766,200 voter signatures if it is to appear on the ballot. Once on the ballot, a minimum of 60 percent of the voters who turn out has to approve the ballot measure before a constitutional amendment can be effected.

Make it Legal Florida has the support of personal injury lawyer John Morgan who was heavily involved in the campaign to legalize medical marijuana in the state. MedMen is also reportedly involved in another measure to put recreational marijuana on the Arizona ballot in 2020.

420 with CNW – Using Medical Marijuana in Florida Could Affect Gun Ownership

As more patients get certified to use medical marijuana in Florida, it has come to light that their use of this particular drug could prevent them from purchasing a gun if they declared that they use state-legal marijuana. This reality also applies to medical and recreational marijuana users in states where such use is legal.

When someone goes to buy a gun, he or she is required to fill ATF Form 4473. This form captures all the relevant records pertaining to the firearm you wish to purchase, including details about the buyer.

Section 11e of that form clearly stipulates that the use of marijuana remains a federal crime even if states have legalized the drug. In short, even if medical cannabis is legal in Florida, that legality is of no consequence during the purchase of firearms.

For now, many people may not yet be aware of the implication of using medical marijuana and its effects on gun ownership, but lawyers warn that people will start taking notice or being upset if their applications to buy guns are rejected or when they face criminal charges related to owning a gun when one is a user of marijuana.

However, Craig Kailimai, the Assistant Special Agent in Charge of the ATF office in Tampa, Florida says that it is unlikely that the federal government could prosecute gun owners who use medical marijuana in Florida unless the law enforcement agencies can prove that the individual poses a real threat of violence.

Kailimai is quick to add that while charges may not be instituted, it remains a crime to buy a gun if you are a user of marijuana. But, the ATF and the federal government will only pick interest in a marijuana user who conforms to state marijuana laws if such a user becomes violent or reveals violent tendencies.

Unless federal marijuana laws change, people who wish to act in accordance with the strict spirit and letter of the law could be faced with a difficult choice between taking the medical marijuana that they need to deal with their health condition, or to buy and own a firearm.

Analysts believe that marijuana industry players like Cannabis Strategic Ventures, Inc. (OTCQB: NUGS) and Canopy Rivers Inc. (TSX.V: RIV) (OTC: CNPOF) could be citing such contradictions between federal and state laws as they campaign for marijuana law reforms at the federal level. No one should have to choose between using medical marijuana and giving up his or her right to own a firearm in the U.S.
