Senate Majority Leader Chuck Schumer is urging fellow legislators to give input on the provisions of a measure to federally legalize cannabis. In a letter addressed to fellow legislators, Schumer, Sen. Cory Booker and Senate Finance Committee Chairman Ron Wyden explained that the continued prohibition of cannabis at the federal level hindered the states’ ability to make their own decisions about marijuana. The letter noted that as more states moved to legalize marijuana for both medical and adult use, the federal government had a crucial role to play. They added that hundreds of millions of people in America lived in states that had legalized marijuana in some form, despite it being illegal at the federal level.

The Senate Majority Leader has faced criticism from advocates about how long it’s taken for the bill to reach this stage. However, during a recent press conference, Schumer announced that he planned to formally introduce the bill in April. The bill, called the Cannabis Administration and Opportunity Act, aims to ensure that the federal government matches the advancements made in various states across the United States.

The measure will allow individuals to petition for resentencing, expunge prior convictions, federally deschedule marijuana, eliminate collateral consequences for individuals who have been criminalized because of cannabis and maintain the authority of states to set their own cannabis policies. The measure will also impose a federal tax on cannabis products. Most of the revenue will be allocated to grant programs that support individuals from communities that were most affected by prohibition and who would like to take part in the flourishing industry.

In addition to this, the bill will transfer regulatory authority over marijuana to the U.S. Food and Drug Administration, the Alcohol and Tobacco Tax and Trade Bureau and the Bureau of Alcohol, Tobacco, Firearms and Explosives rather than the U.S. Drug Enforcement Administration.

Late last year, the Senate Majority Leader highlighted that he was focused on keeping major players in other industries out of the cannabis industry in order to create opportunities for smaller operators when marijuana was federally legalized, noting that his measure would help to do just that. He also emphasized that his reform measure would take the necessary steps to ensure that big tobacco and alcohol companies didn’t overtake the industry.

When discussing the letter to his colleagues on the Senate floor last week, Schumer also emphasized the need to create opportunities for small businesses and entrepreneurs to legally pursue new opportunities, adding that the comprehensive federal marijuana bill would help actualize this goal.

420 with CNW — New Congressional Bill Plans to Raise THC Limit for Hemp

Earlier this week, Rep. Chellie Pingree filed a measure which will make some crucial reforms to the hemp industry, including increasing the legal threshold for THC in hemp products to 1% from 0.3% on a dry weight basis. The measure, dubbed the Hemp Advancement Act, would also address an issue associated with levels of THC for in-process hemp.

Many businesses had raised concerns about the THC limit stipulated under the existing federal statute previously, as the process of extracting hemp could temporarily increase the content of THC in a plant in a way that made them liable for enforcement action.

Under this Congressional bill, in-process hemp wouldn’t be subject to any THC thresholds as long as the final product didn’t exceed 1%. This new 1% limit would include delta-9 THC, which is the commonly known psychoactive component in hemp, as well as variants like delta-10 and delta-8, which aren’t as popular but are still available in markets where marijuana hasn’t been legalized.

The measure would also eliminate a requirement stipulated under the 2018 Farm Bill that the plants can only be tested at labs registered by the DEA. In a phone interview, Pingree stated that there weren’t enough testing facilities for hemp across the country, noting that there wasn’t even one lab in Maine while there were only 2 covering New England.

She explained that laboratories which weren’t certified by the DEA were also capable of testing the crop, adding that removing this requirement would eliminate one obstacle farmers faced, as that hemp was an agricultural crop that only needed to be evaluated for appropriate reasons.

The measure would also eliminate a provision in the 2018 Farm Bill which prevents individuals who’ve been charged with drug-related felony convictions in the past decade from participating in the hemp industry. Advocates have in the past argued that this provision perpetuated racial disparities by excluding individuals from communities which had been disproportionately affected by marijuana prohibition. The congresswoman explained that the ban treated hemp like a controlled substance which wasn’t the case, as hemp was an agricultural crop.

She added that prohibiting individuals using this rule was damaging to people who’d like to take part in the industry, as well as the industry as a whole, given the labor shortage in this market.

The measure is being backed by more than ten major cannabis and hemp groups, including the Hemp Industries Association, Americans for Safe Access and the U.S. Hemp Roundtable.

We’ve seen the CBD market grow significantly these last few months in different parts of the globe, with projections showing that by 2028, the market could be valued at $13 billion. CBD has various benefits, which include relieving anxiety and providing pain relief along with anti-acne and anti-seizure properties. Some studies have also found that CBD may help prevent growth of cancer cells. However, more research is needed to support these claims.

CBG is, in some way, the basis of its counterparts as it transforms into other cannabinoids, including THC and CBD, during the cannabis plant’s growth. This may explain why it is found in relatively low concentrations and small quantities.

In addition to this, CBG is nonpsychotropic, like CBD, which means that it does not induce a high. This is unlike THC, which causes individuals to get high when they ingest or consume cannabis.

420 with CNW — Mississippi Governor Signs Medical Cannabis Bill into Law

Last week, Mississippi became the 37th U.S. state to legalize the use of medical marijuana. Gov. Tate Reeves signed the bill into law stating that it would provide medical marijuana to individuals who “could do significantly better” with prescribed doses. According to the National Conference of State Legislatures (“NCSL”), the state joins 36 states and territories including Puerto Rico, the District of Columbia, the Virgin Islands and Guam, where the use of medical marijuana is legal.

The Republican governor mentioned through a statement that a recreational program would not only lead to an increase in users but also reduce performance and bring about societal ills.

This new legislation will see patients diagnosed with AIDS, cancer, autism, Parkinson’s disease, Crohn’s disease and more become eligible to buy medical marijuana with a card. The card will be obtained from the state’s Department of Health after an in-person examination from a qualified health-care worker.

The law will allow patients to receive at most six units per week and 24 units in 30 days. The law describes one unit as either 100mg of THC in an infused product, 3.5g of medical cannabis or 1g of medical cannabis concentrate. Employers, landlords and schools cannot discriminate against card holders under the law. Moreover, it restricts dispensaries from being situated within 1,000 feet of any churches, schools or child-care facilities without a waiver.

The law specifies that plants must be cultivated indoors under restrictive conditions. Taxes have been set on cannabis production and sales while also denying the state the ability to provide any incentive for economic development to cannabis businesses. The legislation will allow counties and cities to opt out in allowing any facilities from growing or selling medical marijuana.

An earlier drafted bill had set the purchase limit to 28 grams each month. However, it was struck down in November 2020 by Mississippi’s Supreme Court. Reeves has described the legislation as being imperfect. However, he sees that its restrictiveness will reduce the number of marijuana blunts in the streets by “hundreds of millions.”

One of the groups that pushed for marijuana’s legalization is the Mississippi Medical Marijuana Association. The association’s executive director, Ken Newburger, said that the laws would improve the quality of life of individuals who would gain the benefits of medical cannabis.

The bill has been tracked down by NORML, which has said that it was long overdue. Jax James, the organization’s state policies manager, says that the law had received overwhelming support from voters over the years. He says that for the last 14 months the people’s wish has been denied.

The USDA announced last week that it would be teaming up with Cornell University to hold a webinar series that promoted hemp education. According to a press release, the series will feature experts in hemp production, research and academia as well as the private industry.

The first episode, which was held last week, focused on outdoor growing of hemp. The next episode will look into the indoor cultivation of hemp. Other topics to be discussed over the next couple of months include the economics of hemp production, the endocannabinoid system, genetics, food sciences, hemp extraction and hemp processing.

Zachary Stansell, the acting hemp curator in the Department of Agriculture, stated that the department’s Agricultural Research Service (“ARS”) dealt with agricultural challenges which affected all Americans. Stansell explained that hemp was emerging as an economically significant and multiuse crop, which was why the series was designed to increase the inclusivity, equity and diversity of the ARS’ mission while offering hemp-specific training, education and networking opportunities to communities that had historically been underserved.

For every event, experts will discuss the topic in question for about 40 minutes, after which participants will be allowed to ask questions. This partnership announcement comes after the USDA revealed that it was taking necessary action to improve insurance policies for businesses dealing with hemp in an attempt to make them more flexible.

Since hemp was legalized under the 2018 farm bill, the department has sought input from stakeholders as the industry grows in addition to taking some steps to align insurance policies of hemp with those of other lawful plants. For instance, the USDA made it possible for hemp cultivators to quality for Multi-Peril Crop Insurance in 2020, in addition to a couple of other coverage programs for which the plant is now eligible.

The USDA also launched a large-scale survey for hemp farmers as part of its overall outreach to gain insight into the current hemp market. The response forms for this survey, which began in August, can be filled out online or via mail.

In the survey, the department asks questions about the primary and secondary uses of hemp, acreage needed for operations, outdoor hemp production plans and prices producers usually bring in. The department’s main areas of interest include extracts such as CBD, smokable hemp, the plant’s seeds and fiber and grain for human consumption.

The survey is being completed in partnership with the University of Kentucky and the National Association of State Departments of Agriculture. Hopefully, the USDA will use the information collected to pass regulations that give sector actors such as Red White & Bloom Brands Inc. 420 with CNW — Most Americans Would Elect Someone Who Uses Marijuana, Survey Reveals

Many Americans have revealed in a new poll that they have no problem electing an individual who uses marijuana. According to the survey conducted by YouGov, 58% of the interviewees indicated that they would elect someone who takes marijuana in their free time. However, 21% wouldn’t cast that vote.

The data used in the survey was collected from 4,096 individuals based in the United States. This survey comes at about the same time that Senate candidate Gary Chambers (D) released a campaign ad in which he was smoking cannabis. During the now-viral video, Chambers discusses the racial discrimination that comes with the prohibition.

Results from the poll also revealed that the majority of Democrats would be fine with voting in a casual user, with 68% of this group saying that they would be willing to vote in such a person while 15% wouldn’t. Meanwhile 47% of Republicans said they would vote for a candidate who uses marijuana as long as the candidate aligns with their other views.

In a survey conducted by Gallup in 2020, findings revealed that there was an increasing acceptance of candidates who use cannabis. The interviewers found that the consumption of cannabis was more morally acceptable than gay relations, animal testing, a woman’s right to choose whether to abort or not, and the removal of the death penalty.

With increasing legislation of marijuana rolling across the country, there has been rising support from people running for different offices. Incidents of candidates as well as sitting politicians publicly consuming marijuana and sharing its benefits have increased.

Chambers’ campaign video might have hit the mainstream, but this is not the first time a political candidate has done this. In 2020 while running for office in Illinois, Anthony Clark shared his experience using marijuana and even smoked a joint during an ad for his campaign. He hosted a weed party and called for legal reforms. In 2019, House Representative James Comer displayed the CBD oil products that he used in front of a committee hearing. A similar occurrence was seen when State Governor Jay Inslee mentioned that he legally grows marijuana while referring to the Washington State’s laws on cultivation.

It does not come as a surprise, therefore, that public perception on marijuana supports its legality. A recent survey funded by Smart Approaches to Marijuana revealed that as many as 68% of Americans would want cannabis to be legal and regulated for recreational and medical purposes.

As much as the majority supports ending prohibition, it is notable that President Joseph Biden has not made any reforms since beginning his presidency. In a separate YouGov survey, the majority of Americans believe that he will not fulfill his campaign promise of cannabis decriminalization.

420 with CNW — One Year On, Advocates Say Biden Hasn’t Acted on Marijuana Promises

President Joseph Biden won office on a mostly progressive platform; he wanted to completely electrify the country’s transport sector and pass modest cannabis reform. Although most drug reform activists would much rather prefer more comprehensive reform, Biden was able to beat former President Donald Trump and take office. Since then, Biden has invested a significant amount of time working on an infrastructure bill that would, among other things, build a public network of charging stations.

However, a year after the Democrats clinched the Senate, House and White House, cannabis reform advocates say Biden still hasn’t acted on any of his modest cannabis promises. In fact, his administration’s actions on cannabis policy have been, by and large, restrictive and even hostile. Cannabis is still criminalized under federal law; thousands of individuals are still imprisoned for nonviolent cannabis offenses and the Controlled Substances Act still classifies cannabis as a Schedule I controlled substance with no medical use.

This is despite the fact that more than 30 states have legalized cannabis for medical use and around 3.6 million patients across the country are actively benefiting from medical cannabis products made by leading companies such as Red White & Bloom Brands Inc. (CSE: RWB) (OTCQX: RWBYF).

One positive thing the Biden administration has done for cannabis policy has been to let states implement their own cannabis policies without federal intervention. However, the federal government’s hands-off policy when it comes to the state-legal marijuana industry has also led to a lack of clarity that causes problems for both consumers and industry stakeholders. Furthermore, the U.S. Department of Housing and Urban Development (HUD) continues to deny people who use state-legal cannabis access to federally assisted housing.

Given the fact that Biden made marijuana policy a part of his presidential campaign platform, many advocates are disappointed that he still hasn’t made any moves. The fact that the White House punished staff who admitted to past marijuana use and included a budget proposal to ban Washington, DC, from legalizing marijuana sales doesn’t help. Morgan Fox, NORML’s new political director says, it is “extremely disappointing that Biden has failed to live up to his campaign promises and has even made moves designed to set the burgeoning industry back.”

The administration’s inaction on even modest cannabis reforms for the past 12 months is “inexcusable,” says Fox, and it is a betrayal of the voters who put Biden in the Oval Office. This disregard for cannabis reform will undoubtedly have a negative impact on the Democratic Party come the 2024 elections, he predicts.
