420 with CNW — CBD Firm’s Appeal Could Allow Cannabis, Psychedelics Companies to Get Trademarks Before Legalization

The 2018 farm bill legalized industrial hemp, which is a nonpsychoactive version of cannabis, and its derivatives for cultivation and sale. The law stipulated that, as long as individuals had official approval from their states or tribes, they could cultivate hemp and sell it for use in everything from textiles and clothing to concentrates. Thanks to the federal status of hemp and cannabis, businesses in the space cannot trademark their products — but this may soon change.

A CBD company that recently fell afoul of this regulation is now appealing, and if the company wins, the ruling could have implications across industries dependent on soon-to-be legal products such as cannabis and psychedelics. Joy Tea, a company that markets hemp-derived tea, had tried to secure a trademark with the U.S. Patent and Trademark Office (“USPTO”) only to be denied. According to USPTO, the lawfulness of goods isn’t determined by what the law at the federal level may be months or years from now but at the time of the application.

So, even if a company anticipates that CBD beverages or any other product will be legalized in the future, the application will not be registrable. Even though Congress had already legalized CBD via the farm bill in 2018, the USPTO denied Joy Tea’s application because the U.S. Food and Drug Administration (“FDA”) still doesn’t allow marketing cannabinoids in dietary supplements or food items.

Joy Tea’s attorney Larry Sandell argues that it was improper for the federal agency to deny Joy Tea a trademark registration. Sandell, who is an intellectual property attorney at Mei & Mark LLP, says trademarks are meant to protect a company’s ideas as the company prepares itself for the market. For instance, companies in the pharmaceutical space can obtain trademark registration for a formulation to protect it from theft while they are still working on the product.

Countering that argument, the USPTO said that while this is true, the comparison is misleading as pharmaceuticals are not unlawful, per se. Since Joy Tea’s CBD-based beverages do not have FDA approval, the USPTO says that the beverages are not only unapproved but unlawful. Thus, Joy Tea is seeking an appeal against the ruling, and if it is successful, the effects will reverberate far and wide.

If Joy Tea succeeds, companies will be able to trademark products that currently aren’t legal at the federal level, making these spaces a lot more desirable for startups and established businesses. If the company loses its case, businesses in cannabis, psychedelics and other such industries will be stuck in a “terrible spot,” Sandell says.

The outcome of this appeal may have far-reaching consequences in the cannabis sector, and it remains to be seen how a successful appeal may spur innovation at firms such as RYAH Group Inc. (CSE: RYAH), which already has a sizeable portfolio of innovative products.

420 with CNW — Public Defenders Accuse Bronx DA of Dragging Feet on Dropping Pending Cannabis Cases

In April, New York passed one of the most progressive recreational cannabis laws in the country, joining a small but growing number of states that now allow adult-use cannabis. On top of allowing adults aged 21 and over to grow, purchase and possess cannabis, the bill also provided provisions for dismissing prior cannabis-related charges and expunging such offenses from people’s records. However, more than one month after New York state legalized recreational cannabis, a number of New York residents still have pending cases and even arrest warrants for offenses that are now considered legal under state law.

Each of the five administrative units, or boroughs, in New York City has got its own district attorney’s office, and public defenders in the Bronx have accused the Bronx DA of dragging his feet rather than making haste to dismiss pending cannabis-related cases. On April 20, 2021, the public defenders sent Bronx DA Darcel Clark’s office a letter urging him to conduct the affairs of his office in line with the Marijuana Regulation and Taxation Act (“MRTA”). The defenders estimate that there are currently hundreds of pending cases involving serious charges such as criminal possession or sale of cannabis that are currently legal or considered lesser violations.

Despite the passage of the recreational cannabis law, those cases are still hovering over people’s heads, says Eli Northrup, a lawyer from Bronx Defenders. For instance, 41 people from the Bronx have been arraigned before court on marijuana charges, and their court dates are coming up. There are also cases involving individuals who, after being arrested, were given desk appearance tickets to present themselves in court as well as warrants issued for people who failed to show up before court or did not pay their fine.

Northrup says this group probably includes individuals with warrants that are decades old, making it the largest category of individuals impacted by the Bronx DA’s inaction. Ruben Fernandez, another attorney allied with the Bronx Defenders, says plenty of judges have been throwing out cannabis-related charges as accused persons appear in their courts. Ideally, individuals who were charged with offenses that are now considered legal would have their records automatically expunged of the offense.

However, some issues such as clearing warrants may take some time, exposing people with such warrants to the risk of arrest if an officer stops them before the process is complete. In fact, some people may not even be aware that there are warrants out for their arrest, Fernandez says. Court dates are an extra hustle, causing people to lose work hours and forcing them to find child care, which can be quite costly.

According to a spokesperson from the Bronx DA’s office, the DA is currently evaluating cases to determine if they fit the criteria for dismissal.

It is unfortunate that some prosecutors seem to be in no hurry to drop charges that can no longer be sustained under the current marijuana laws in New York state; moreover, this is coming at a time when several companies in different jurisdictions, such as RYAH Group Inc. 420 with CNW — Researchers Debunk Lazy Stoner Mentality Surrounding Marijuana Use

A common notion that surrounds marijuana is that cannabis users are indolent individuals who are basically couch potatoes, vegging out while eating snacks in bed.

While the origins of this stereotype aren’t clear, we can at least agree that marijuana helps individuals sleep, which isn’t a bad thing now, is it? Especially if you consider that one-third of all people in America have sleep problems.

Now a recent study has found that it’s not only inaccurate to refer to stoners as lazy, but it’s also not true. As a matter of fact, the study found that frequent and light users of marijuana recorded more physical activity in comparison with non-users, which suggests that cannabis may actually boost physical activity.

The study, which featured more than 2,000 participants who were all adults, was reported in the Harm Reduction Journal.

Combined with prior research done by scientists from the University of Colorado, which discovered that marijuana assisted in exercise routines, these findings add to the already existing evidence that shows that most of the preconceived notions about marijuana users and the effect of the drug on individual’s lives are baseless.

This also means that in lieu of burdening hospitals, as prohibitionists and opponents of marijuana legalization propose, marijuana legalization may have a net positive influence on public health.

Scientists from the Herbert Wertheim School of Public Health and Longevity Science in San Diego as well as the University of California examined the responses submitted for the National Health and Nutrition Examination Survey conducted in the years 2005–2006. The participants of the survey not only had to fill out questionnaires but also have their activity levels measured by accelerometers, which are used to measure the intensity and length of physical activity.

The researchers noted that the study was the first to measure physical activity using accelerometers. In addition, the participants were also classified as either non-, frequent, moderate or light marijuana users. This was dependent on how much marijuana use they reported.

Researchers discovered that the general activity rates of marijuana users did not differ from that of individuals who didn’t use marijuana. They also wrote that in comparison with non-users, frequent marijuana users engaged in more physical activity.

It should be noted that there were some limitations observed by the researchers, among them the fact that marijuana users were younger and had lower BMIs in comparison with non-users. Additionally, half of the marijuana users reported that they smoked cigarettes.

The researchers also found that those who didn’t smoke tobacco were more active.
