A group of senators from the Democratic Party is urging a significant committee to ensure small cannabis entities have equitable access to federal Small Business Administration (SBA) lending programs and development resources available to other industries.

In an April letter to the leaders of the Appropriations subcommittee, the senators urged that the FY 2025 FSGG spending measure include provisions to stop the SBA from rejecting loan applications from small cannabis entities operating legally in states that have approved marijuana use and sales.

Senator Jacky Rosen led the letter, asking the subcommittee leaders to add clauses to the spending bill that would prevent the SBA from excluding state-legal marijuana businesses from its entrepreneurial development initiatives. Other senators who signed the letter alongside Rosen include Cory Booker, Jeff Merkley, Ron Wyden, Tammy Duckworth, Martin Heinrich, John Hickenlooper, Ed Markey, Michael Bennett and Alex Padilla.

The senators highlighted the change in public attitude toward cannabis reform, pointing out that markets which bring in billions of dollars in tax revenue had resulted from the legalization of cannabis in the majority of states. The senators also noted that most banks are hesitant to work with legal marijuana entities because of federal law conflicts, compelling these businesses to operate mainly with cash. This situation poses public safety risks. The lawmakers argued that SBA loan initiatives could bridge the gap left by private-sector reluctance, providing vital capital for entrepreneurs, including women, minorities and veterans.

Leading cannabis companies are urging a federal court to permit the public to attend a hearing virtually in a lawsuit where the companies are requesting protection for in-state marijuana activities from federal interference. The U.S. Department of Justice has stated it holds “no stance” on this request.

The hearing will take place before the United States District Court for the Western Division of the District of Massachusetts. The plaintiffs’ attorneys highlighted in a motion that the disagreement raises issues of public interest. They reported receiving a lot of requests from the media to watch the hearing online, as most can’t be present in person.

Further, they argue that permitting remote access to the hearing will not prejudice any parties involved. They suggest that access by phone or video conference would be adequate. They also mentioned that they consulted with the defendant’s counsel, who confirmed that the defendant has no stance on the motion.

The lawsuit, titled Canna Provisions vs. Garland, is spearheaded by Verano Holdings Corp., a multistate cannabis operator, alongside Massachusetts-based marijuana companies Wiseacre Farm and Canna Provisions as well as Gyasi Sellers, the CEO of Treevit.

Leading the lawsuit is David Boies, who has previously represented clients such as former vice president Al Gore, the DOJ and plaintiffs in the lawsuit that resulted in the repeal of California’s same-sex marriage statute.

In their lawsuit, the companies argue that the federal prohibition of cannabis lacks justification, especially given the widespread legalization of cannabis in states and the federal government’s generally noninterventionist stance on the matter.

Last month, the plaintiffs requested oral arguments, a request granted by Judge Mark G. Mastroianni, an appointee of President Barak Obama. In response, the DOJ maintained its neutral position.

Central to the case is whether in-state marijuana activity impacts interstate commerce. The federal government contends that marijuana legalization draws tourists from other states, thereby affecting interstate commerce. In a recent filing, the DOJ contended that it makes sense to conclude that Massachusetts’s legal cannabis market stimulates marijuana tourism, a distinct type of cannabis-related interstate commerce.

The DOJ’s brief referenced a Supreme Court decision from decades ago, affirming Congress’s jurisdiction to regulate establishments attracting out-of-state tourists, even if the transactions occur entirely within the state. Conversely, the plaintiffs argue that the Commerce Clause of the Constitution should not allow the DOJ to interfere in activities legal within state borders, as the state itself regulates these.

The recent motion follows an announcement by President Joseph Biden that his administration is formally reclassifying cannabis. A proposal to place marijuana in Schedule III is set to be published in the Federal Register soon.

The planned regulation change was approved by Attorney General Merrick Garland, one of the main defendants in this case. However, rescheduling marijuana would not equate to federal legalization, and it appears unlikely that this rulemaking will impact the DOJ’s stance in the ongoing court case.

Recent research on the effects of regular marijuana usage disproves popular perceptions about the drug by showing no connection between habitual users’ decreased motivation or paranoia. The study found no indication of a marijuana-induced hangover the following day.

One of the unexpected results was that long-term users did not exhibit a decline in desire or effort-exertion willingness, either due to internal or external factors. In fact, consumers who used the product more frequently claimed to be more motivated and to have experienced more negative emotions and impulsivity.

The study highlights both expected and unexpected results, challenging misconceptions surrounding cannabis’ effects. The researchers attribute much of the misunderstanding to cannabis’ historical criminalization, which has skewed perceptions of the drug and its users. According to the authors, even though cannabis is widely used, especially when compared to tobacco, alcohol and caffeine, little is known about how it affects regular users in daily life.

Reddit served as a source for the study’s participants, who had to be at least 21 years of age and from Canada or the United States. Participants were required to use cannabis at least three times weekly for recreational purposes. Throughout the weeklong study period, participants completed a 30-minute baseline assessment and a brief assessment five times daily between 10 a.m. and 11 p.m.

The study found negligible influence on motivation, defying popular belief. Interestingly, the study indicated that people like to become high. In addition to feeling less stressed and afraid, chronic users reported feeling a variety of good emotions while high, including amazement, inspiration and thankfulness.

Interestingly, and against widespread perceptions, chronic users’ levels of paranoia did not rise when they got high. However, it was associated with decreased momentary conscientiousness, indicating reduced self-control and organization.

Although cannabis intoxication had short-lived effects on chronic users’ emotional states, there was little evidence of a hangover the next day. Additionally, frequent users reported greater negative emotions but also higher motivation compared to less frequent users.

While the study could not conclusively determine causality, it suggested a complex relationship between cannabis use and emotional states. The authors acknowledge limitations in participant selection, noting that the sample may not represent less frequent or novice users. Despite these limitations, the study provides valuable insights into the everyday experiences of habitual cannabis users, challenging misconceptions and paving the way for future research.

Other recent studies have similarly challenged misconceptions about cannabis, including its neurocognitive effects, which were found to be minimal among medical cannabis patients with chronic health conditions. Additionally, marijuana use was associated with a lower likelihood of cognitive decline and improved cognitive functioning in some studies.

Contrary to claims that marijuana causes mental illness, research has shown modest improvements in cognitive functioning and reduced medication usage among teens and young adults at risk of psychosis who use marijuana regularly. Studies have also debunked claims of marijuana causing IQ loss, attributing observed declines in IQ to shared familial factors rather than marijuana use itself.

Overall, while the long-term effects of cannabis use remain uncertain, recent research suggests that many fears surrounding marijuana may be exaggerated, and further investigation is warranted to better understand its impacts.

A recent publication in the “Medical Cannabis and Cannabinoids Journal,” authored by LECOM in collaboration with AYR Wellness (AYR), delves into the effects of medically approved cannabis on patients’ mental, social and physical well-being. The study showed that patients experienced notable enhancements across these domains, including increased energy levels, within the initial 30 days of treatment with medical cannabis.

This study is the partnership’s first publication; four further studies examining the medical benefits of cannabis are in the works.

The 90-day cohort study involved 103 adults (18 years of age and older) and was designed to evaluate the effects of medically prescribed cannabis on their psychological, social and physical well-being. Every 30 days, participants were required to complete electronic surveys tracking their overall quality of life and cannabis usage.

Furthermore, participants were required to document any negative effects they attributed to cannabis use, such as rapid heart rate, anxiety, dizziness, hallucinations or cognitive impairments. Additionally, participants had to disclose whether they consumed tobacco or alcohol products regularly during at least one-half of the study duration, including within the initial 30 days.

Analysis of the survey data revealed a substantial improvement in participants’ overall well-being and a significant decrease in pain levels between the 30- and 60-day intervals. Notably, individuals who used medical cannabis once daily exhibited the most significant enhancement in general health compared to those who consumed it more frequently, although this finding requires further validation due to the limited sample size of once-daily consumers (n=8).

Participants also reported reductions in emotional constraints, pain and fatigue. Those who consumed alcohol within the initial 30 days reported using medical cannabis less frequently and felt less emotional and energetic compared to nondrinkers. However, the frequency and quantity of alcohol consumption did not appear to influence these outcomes.

Individuals treating opioid addiction and PTSD with medical cannabis tended to use higher THC concentrations, whereas those managing anxiety and chronic pain opted for lower concentrations. Dry mouth, cough and increased appetite were the most commonly reported adverse effects, with no significant differences observed across frequency or modes of administration.

The authors noted that these findings contribute to destigmatizing medical cannabis use, highlighting its positive impact on patients’ lives over 90 days. They call for further research to comprehensively elucidate its medical efficacy and long-term effects.
