420 with CNW – 4 Things to Expect in the California Marijuana Market in 2020

California is the largest marijuana market in the U.S., so it is worthwhile to look forward and see what is in the works for this state’s cannabis industry in the new year. Here are some of the major things that could pan out in 2020.

  1. Courts Hear Marijuana Delivery Lawsuits

When Prop 64 was approved by California voters, local authorities were given the liberty to decide whether to accept or reject marijuana businesses within their jurisdictions.

That promise was put to the test and a row over how much control municipalities and cities have over the marijuana industry came to a head when state regulators insisted that marijuana businesses could deliver weed anywhere within the state while the local authorities say such deliveries should only happen in places that permitted marijuana businesses to set up shop.

In a twist of irony, the Fresno County Superior Court is set to start hearing a case pitting 24 cities against the California Bureau of Cannabis Control on April 20 (the unofficial marijuana holiday). The outcome of this case could either give weed companies some needed respite or hamper their activities even further.

  1. Legislative Changes

On January 1, Senate Bill 34 took effect and licensed businesses can now donate medical marijuana products to patients that are needy and cannot afford them.

More importantly for marijuana businesses, Assembly Bill 37 seeks to allow companies to deduct their operational costs before their tax liability is computed. This is a major piece of legislation because it effectively sweeps aside federal laws that have denied marijuana businesses the same tax benefits that other businesses enjoy.

A legislative change that is likely to rub weed businesses and consumers the wrong way is Assembly Bill 1810. This bill seeks to ban passengers in taxis, limos and other commercial vehicles from consuming marijuana. This means that the idea of weed party buses has gone up in smoke.

Marijuana businesses insist that California needs to make many more legal reforms if the industry is to survive or even thrive given the challenges that it has faced in the first three years of legal recreational cannabis sales.

  1. Expunging Criminal Records

Prop 64 set out a process through which people with marijuana convictions could apply to have their records expunged or charges amended. However, records show that only a tiny fraction of potential beneficiaries has applied for expungement, partly due to the costs and complications of the process.

Assembly Bill 1793 passed in 2018 gave a July 2020 deadline in which local prosecutors have to track down and process the expungement or retroactive downgrading of cannabis convictions. As this deadline looms, thousands are likely to be eligible for housing, employment and other benefits they were denied as a result of their convictions.

  1. Cleaning Up Weedmaps

Weedmaps was started to provide marijuana consumers with information about the places where they could buy weed legally in California. However, state regulators warned the directory about having listings of unlicensed marijuana sellers and Gov. Newsom enacted a law that imposed fines of up to $30,000 for each day that an unlicensed marijuana seller remains operational.

Weedmaps is likely to make good on its promise to remove illicit sellers from its directory and the outcome of this action could reveal how much damage delisting those unlicensed businesses does to the cannabis black market.

Homeowners have been locking up their guns and money for safekeeping for centuries. However, they no longer have to keep their stash of weed in the same way as a result of technological advancements which have seen a new and safer method introduced for keeping recreational marijuana safe.

Several centuries back, people used to store cannabis in makeup bags, pencils cases, or under their mattresses. The potency and cost of contemporary marijuana are rendering weed vulnerable to theft either by innocent children, corrupt house managers, and uncanny roommates.

Philip Wilkins said that people no longer believe in stashing their weed in Ziploc bags, closet, or under the floorboards.

Wilkins and his two partners ( Ben Gliksman and Sep Seyai) founded a Toronto-based company known as KEEP. This year the company developed its first electronic storage and security device. The electronic device is called KEEP, and it is fitted with a biometric lock that connects through an app on the owners android smartphone.

The device owner can apply their phone security features such as fingerprint, voice, or facial recognition to unlock the storage device.

KEEP has features meant to maintain the quality of the weed, such as hermetic seal, humidity, and temperature thermometers to keep the marijuana fresh and odorless. The inside of the device is also fitted with LED lighting and trays to make sure that the owners do not have to feel around in the dark looking for edibles, vape pens, or pot. You can store a maximum of 28 grams of dried flower or 4.4 pounds of marijuana. The owners can use a scale to track their usage.

KEEP will be unveiled on the market in March 2020, both in the U.S. and Canada. It will be sold at dispensaries selling legal marijuana and via the KEEP.com website. It will also be sold through licensed producers such as Canada growers. The retail price for KEEP in the U.S. will be about $226 while in Canada it would be $300.

In an interview explaining the motivation behind the company, Wilkins said that he and his partners wanted to leverage the discoveries taking place in consumer electronics and apply it to marijuana because it signifies the growth of the marijuana market.

In November, KEEP was selected as an honoree by the CES Innovation Awards.

KEEP is not the only weed storage solution; others include a black walnut wood box from Marley Natural Shop, which goes for $192, Humidor Combo Box ($99), or LOCK-R Box ($250) from Ryot.

KEEP’S modern design blends into any home. The device has a back-lit LED display that shows the time and outside temperature.

The cofounders of Amazon’s The Marijuana Show, Wendy  Robbins and Karen Paull, wrote an email saying that they liked the device as it keeps your marijuana climate-controlled.

Robbins said that she would buy KEEP since it would keep her stash safe from kids and housekeepers. She also noted that it is a clean and decent way of storing marijuana.

420 with CNW – New Florida Bill to Protect Medical Marijuana Patients from Being Fired

The number of registered medical marijuana patients in Florida is estimated to be about 300,000. The patients are issued with medical marijuana cards that give them access to MMJ for them to legally to treat some medical conditions. However, these licensed users of medical marijuana in Florida are facing negative consequences at work and in school.

Some of the people who have suffered a setback in their education or career because of medical marijuana include Kaitlin McKeon who enrolled for a nursing program at Nova Southeastern University. The school requires applicants to do a drugs test, and hers came back positive for marijuana. She uses medical marijuana to treat chronic stomach pain. After the failed drugs test, the school dismissed her application which further derailed her career and education.

Another victim is Alan J. McDuffie who worked for the city of Miami. He applied for a permanent position with his department and was required to do a drug test which turned positive for marijuana. The city fired him even after he told them that he is registered for medical marijuana. McDuffie uses marijuana to manage back spasms. Both McKeon and McDuffie have filed suits against their respective institutions. They claim that the institutions discriminated against them for using medical cannabis.

Florida’s statute of medical marijuana gives employers the freedom to implement drug-free policies and the law does not stipulate that employers retain workers using medical marijuana. However, the new legislation that could change all that in Florida is in the House. The bill which was proposed by Boca Raton Rep. Tina Polsky would provide some protection for people using marijuana in schools and workplaces.

Adam Kemper, a Boca Raton employment attorney whose specialization is medical marijuana compliance, said that the timing of the bill is perfect because the number of people using medical marijuana in Florida is increasing.

The bill would prohibit employers from discriminating, firing, downgrading, or taking any other adverse action against an employee who is a registered user of medical pot. However, the bill would not offer protection for people whose jobs are safety-sensitive such firefighters, people operating heavy pieces of machinery, drivers, those handling dangerous materials, carrying weapons, and persons providing care to children or patients.

The new bill stipulates that a person whose drug test is positive must provide a written notice explaining why the tests are positive. They can also submit a doctor’s certification and MMJ cards as proof of legal use. The bill also permits people fired or penalized for using marijuana to file a lawsuit against their employer for compensation and reinstatement.

Kemper also said that if pot usage is hampering with an employee’s job performance, the bill allows employers to take action such as discharge the person from their duties.

The legislation does not address employees’ rights when an employer asks about the medical condition that requires them to use pot. However, federally, if an employee is seeking accommodation under the Americans With Disabilities Act, they must disclose their medical history and the specific medical condition to the company.

Under any other condition, the employers would be crossing the line if they asked employees personal questions.
