Evidence has shown that marijuana was used 5,000 years ago for various diseases in Romania. The plant is referenced in the 1500 BC Chinese Pharmacopoeia. In addition to this, marijuana was also used extensively throughout India as bhang and was also found on mummies in Egypt.

History has shown that in the 1900s in South Asia, marijuana was recommended by physicians as a remedy for people who were asthmatic and was also utilized in treating bronchitis. While this may be surprising seeing as smoke is generally not good for people with respiratory problems, research has shown that marijuana smoke may not behave in the same way as other smoke, such as tobacco smoke, does. Marijuana smoke has been shown to cause bronchodilation, which actually dilates the airways.

Despite the controversy surrounding its use, cannabis has proven itself to be an effective alternative to some pharmaceuticals. Chockfull of potent medicinal properties, cannabis is believed to treat numerous conditions such as chronic pain, anxiety, stress and insomnia. One group of individuals that could greatly benefit from medical marijuana but hasn’t always been given access would be veterans, as they are more likely to suffer from conditions such as anxiety, chronic pain and PTSD.

Despite its history, cannabis saw a couple of wins during the November 2020 elections. Fifteen states had already legalized adult cannabis use as of election night, and voters in Arizona, New Jersey and Montana approved measures to legalize adult use. Voters in South Dakota voted to legalize both recreational and medical marijuana while Mississippians approved medical marijuana.

According to Eric Goepel, founder and CEO of Veterans Cannabis Coalition, and Justin Strekal, political director of the National Organization for the Reform of Marijuana Laws (“NORML”), these wins will aid veterans in four ways.

Increased access to marijuana. Since the drug is illegal at the federal level, states had to opt into medical marijuana programs for their citizens, including veterans, to gain access to the drug. Veterans living in states that didn’t allow cannabis would either have to use pharmaceutical alternatives, putting them at risk of side effects and addiction, or practice cannabis tourism. But with voters in more states legalizing cannabis, veterans will have more access and, according to Goepel, they won’t have to deal with potential “gatekeeping” by local public health officials or doctors.

Reduced prices. As cannabis’ medicinal properties came to light, its demand skyrocketed. However, plenty of states classified it as a controlled substance, and the ones that had a legal cannabis market tended to have high barriers to entry, leading to a bottleneck in supply. As we know, high demand coupled with low supply usually leads to higher prices, and veterans sometimes had to pay hundreds of dollars a year in fees. With more cannabis cultivators, manufacturers and retailers in the market, Goepel says, veterans may be able to purchase cannabis at much cheaper prices.

Change in federal law. At the moment only 15 states in the entire United States have not legalized cannabis, and as more states jump on the bandwagon, there is less incentive for the federal government to continue classifying cannabis as a controlled drug. Leaders in the Department of Veteran Affairs have used this classification as reason against prescribing cannabis to veterans, and this will likely change in the face of federal legalization.

Reduced stigma. After decades of prohibition, marijuana has garnered a tainted reputation. But as more states legalize it and create programs to allow recreational and medical use, veterans will be able to access cannabis without any fear of social stigma.

Earlier this week, senate appropriators released various reports and spending bills for fiscal year 2021 that have incorporated various provisions related to hemp and marijuana. Hemp contains no more than 0.3% THC, as defined under federal law.

However, the USDA proposed a 0.5% negligence threshold, which means that farmers who have exceeded that limit would have to destroy their plants. The senate panel is calling for the agency to reconsider the policy, taking into account stakeholder feedback.

A few other marijuana-related provisions that had appeared in previous reports and appropriation bills were also incorporated in the bills. Those included measures that banned Washington, DC, from using the district’s taxes to execute a regulated cannabis market while also protecting medical marijuana programs in the state from government intervention. Legislators also continue to identify barriers to cannabis research brought about by federal prohibition.

In addition to this, a new section has been added that asks the National Institute on Drug Abuse (“NIDA”) to add more marijuana-related questions to its annual government survey of young people. Legislators would like to incorporate queries about the consumption of flavored cannabis edibles and vapes that appeal to young people.

The senators also demanded $5 million in funding for FDA research into marijuana and marijuana derivatives, protecting state hemp programs and enlarging cannabis studies in the U.S. Department of Health and Human Services.

On the other hand, the House advanced appropriation bills of its own during the summer that include wider marijuana reform policies, showing an overlap between the House and the Senate. In the House version, proposed legislation includes provisions aimed at the following:

  • Grant the state of Washington the ability to legalize recreational marijuana sales
  • Oversee the nation’s CBD and hemp industries
  • Enlarge research on marijuana
  • Ease access to basic banking services for marijuana businesses
  • Protect recreational cannabis legalization laws from government interference

To keep most agencies and programs funded, the government has been relying on continuing resolutions, seeing as the fiscal year for next year actually began Oct. 1, 2020.

The report for the measure to fund the Department of Health and Human Services has several passages that direct officials to widen the scope of cannabis research. The measure also includes a note that marijuana’s classification as a Schedule 1 drug only hinders research.

Over in the District of Columbia, the bill funding the state currently maintains a rider banning the city from using its own funds to legalize and regulate recreational marijuana sales. This is despite the House-passed version of the fiscal year 2021 legislation proposing that the policy be revoked.

A week ago, New Jersey legalized the sale of marijuana. The state has allowed the sale of medical marijuana since 2010 when the Compassionate Use Medical Marijuana Act was approved. Currently, upwards of 80,000 individuals in the state use marijuana to help alleviate or treat symptoms of various conditions, which range from epilepsy, cancer, nausea and pain to glaucoma and ALS.

The state’s medical cannabis program is designed to help some individuals improve their quality of life and others to ease their last moments of life. However, there are those who are concerned that the legalization of recreational marijuana for adults may influence the medical cannabis program. In various states, the launch of a recreational marijuana market has severely damaged the availability of medical marijuana.

The rise of the markets may influence some patients to ditch the doctor’s office visit for self-medication using the recreational products. Additionally, the marijuana strains that medicinal patients use, especially those with low THC levels, often become unavailable. The increase in recreational markets therefore indirectly leads to growth in overall THC levels in the marijuana sold in a state because many growers opt to sell only products with high THC levels.

Research also shows that specialized edibles normally purchased by medical patients also increase in price after the legalization of marijuana. An analysis was carried out by the Associated Press in four states where medical cannabis was available. The study revealed that in those four states — Alaska, Colorado, Nevada and Oregon — there was a decrease in the number of medical marijuana patients after the legalization of marijuana. In the state of Oregon, the number of medical marijuana shops dropped to two from 400.

There are many individuals who rely on medical marijuana, so if the medical marijuana dispensaries in New Jersey were to close down, the result would be tragic. The prejudices that prevent marijuana from being approved as medication do not help prevent this. These prejudices persist despite the many studies and trials that prove cannabis to be a medicinal plant with various benefits and a bonus recreational use as well.

The research is said to be insufficient though, as researchers look deeper into understanding marijuana and its strains as well as the conditions that it can help manage. To help do this, the Cannabis Education and Research Institute (“CERI”) was formed to advance research on cannabis. Apart from understanding the plant’s botanical properties, the institute is also calling for the end of federal restrictions that may impede research in this area. The removal of a prohibitive designation, such as the classification of marijuana as a schedule 1 drug, would only open the door to more research. This would be helpful in saving medical marijuana for individuals who need it.
