420 with CNW – Marijuana Legalization Initiative Cleared for Signature Gathering in South Dakota

Marijuana legalization was given the go-ahead for signature collection in South Dakota together with a constitutional amendment meant to legalize hemp and medical marijuana. The motion was introduced in the senate by a former federal prosecutor and was backed by the MPP (Marijuana Policy  Project) and a national cannabis activist group.

The motion to legalize marijuana was filed in June by former U.S Attorney Brenda Johnson. The initiative received the green light for signature collection last week after the attorney general gave the official explanatory statement.

In an interview, Brenda Johnson said that the people of South Dakota are excited and ready to approve a medical marijuana initiative and legalization at the ballot in the coming year.

The initiative which was introduced by the former federal prosecutor would constitute measures to be observed and followed by the residents of South Dakota. The initiative would allow possession and distribution of up to one ounce of marijuana by adults who are 21 years and older. It would permit the residents to cultivate a maximum of three marijuana plants. The issues related with licensing of manufacturers, lab testing facilities and retailers would be tasked to the Department of Revenue in South Dakota.

Sale proceeds of marijuana would be taxed at 15 percent. The tax proceeds would be used to fund the implementation of the weed legalization program, with the extra amounts being used for public education and other state of South Dakota priorities.

Apart from legalizing cannabis, the motion would instruct the legislature to legalize hemp and medical marijuana.

In support of the South Dakota campaign, the Marijuana Policy Project Director, Matthew Schweich told Marijuana Moment that in the U.S., conservative states included, voters are in favour of reforming the marijuana policy. So as an organization, they have to carry out the will of the people when the officials they elected fail to support them.

For marijuana legalization, they must collect 16,961 signatures, and for the proposed constitutional amended to qualify for the ballot box in 2020, they must collect 33,921 signatures from voters. The Marijuana Policy Project involvement will boost the likelihood of the campaign to obtain the required signatures.

The initiative will not pass without resistance since the state’s Republican party are urging the citizens not to sign the petition for the 2020 ballot box while Governor Kristi is rejecting the bill for hemp legalization.

Brenda Johnson, the MPP and others who are for the campaign, “South Dakotans for Better Marijuana Laws” vow to work every day till the day of elections in 2020 to garner support from everyone in the state of South Dakota.

420 with CNW – Florida AG Opposes One Recreational Marijuana Ballot Initiative

There are three initiatives aimed at putting a recreational ballot measure on the 2020 ballot in Florida, but one of those initiatives has been singled out by the Attorney General as being too long and should therefore be rejected by the Supreme Court of Florida.

The ballot initiative that AG Ashley Moody has turned her guns on is sponsored by a group called Sensible Florida. That initiative seeks to legalize recreational cannabis for adults who are at least 21 years old.

Michael Minardi, the chairperson of Sensible Florida, says that the bulk of this constitutional amendment seeks to establish a framework through which the recreational marijuana industry would be regulated.

According to Minardi, the initiative is for Floridians, Florida businesses and for giving power over the cannabis plant back to the people of Florida.

AG Moody doesn’t seem to see things in the same way, and she argues that the 75-word summary of the initiative cannot allow Florida voters to understand fully what the campaigners are proposing.

To drive her point home, Moody took a picture of the amendment as it was dangling from the ceiling to the floor, and she put a caption to the effect that the amendment was longer than the first article of the state constitution. This picture was posted on Twitter by the AG.

To put this amendment in context, the other two initiatives are shorter than the one by Sensible Florida. In fact, one amendment is just a paragraph long while the second one covers two pages. This makes the Sensible Florida amendment tower above these two since it is ten pages long.

That notwithstanding, Minardi says that the strength of their amendment lies in its length. He says that the document clearly spells out all the details of what voters will be called upon to approve, and this removes the possibility that the state lawmakers will implement anything else other than what the voters will have supported.

This argument by Minardi seems to hold water, as the drama surrounding Brexit in the UK shows the folly of approving a general plan without the necessary accompanying details. Successive prime ministers have struggled to build consensus on how the UK should leave the EU, and the millions across the nation are beginning to question whether what the politicians are feuding over is really what they voted for.

Sensible Florida has vowed to take the AG on once the Supreme Court starts considering the language of their proposed amendment. It would be interesting to hear what cannabis companies like Plus Products Inc. (CSE: PLUS) (OTCQB: PLPRF) and SinglePoint Inc. (OTCQB: SING) have to say about this unexpected point of contention between the attorney general and Sensible Florida’s proposed amendment.

420 with CNW – Federal Money to Facilitate Research into Removing Pesticides from Cannabis

A quarter of a million dollars is being handed by a U.S. federal agency to a biotech company so that research into how dangerous pesticides can be removed from several crops, including marijuana, can be done.

Brooklyn Bioscience is the lucky startup that won the two-year grant worth $250,000 from the National Science Foundation. The money will help to further the company’s efforts to engineer an enzyme with the capability of breaking down organophosphates (OPs). OPs are pesticides that have been found to be extremely hazardous to the environment and humans.

Marijuana farmers will be especially interested in this enzyme because research has shown that when organophosphates are taken into the body after a process of combustion (through smoking marijuana, for example), the pesticides are more dangerous than if they were ingested orally.

The enzyme will also come as a godsend to marijuana farmers in various jurisdictions, such as Colorado and California, where the cap for the acceptable level of OPs is much lower than what is permitted in other jurisdictions.

Organophosphates are used to increase crop production because they keep deadly pests at bay. However, these compounds aren’t water-soluble, so it is nearly impossible to wash them away using water.

If the research into producing an enzyme called phosphotriesterase succeeds, farmers will have a low-cost way of breaking down OPs into harmless forms which can be removed using water.

The pesticide industry is estimated to be worth $17 billion in the U.S. alone and at least 10 percent of that market is for organophosphates. This underscores how important it is to develop biological ways of efficiently controlling the levels of those organophosphates in different crops so that human health and the environment are protected.

The enzyme may end up being used in many different crops, but the press release issued by Brooklyn Bioscience emphasizes that the ongoing work will result in pesticide-free marijuana, wine grapes and many other high-value crops.

Toward the end of last month, the Environmental Protection Agency announced that it was welcoming public comment about ten pesticides that are being considered for approval for use during the cultivation of industrial hemp.

A similar process isn’t on the cards for marijuana since the crop remains federally illegal. This prohibitionist stance has been blamed for putting consumers and the environment at risk since the states which have legalized marijuana either for recreational or medicinal use have been left to develop their own consumer protection regulations without federal guidance.
