420 with CNW – Congress Passes Coronavirus Bill With Marijuana Banking Provisions

Although government-issued coronavirus-related measures were designed to curb the spread of the virus, they had an unintended consequence, economic downturn. With all but the most essential businesses ordered to close during lock-downs, the economy was in a free fall. More than 20 million Americans have lost their jobs since the start of March, and the government ended up deploying a massive $2 trillion coronavirus relief bill to help people and small businesses weather the storm.

However, due to ongoing federal prohibition, businesses in the state-legal marijuana industry were denied access to these relief funds. Federal prohibition has made banking institutions avoid cannabis businesses, dooming them to cash only transactions which in current times are a big no. Advocates, stakeholders and lawmakers decried the cannabis industry’s exclusion from these funds, stating that it pays taxes just like any other business and many small businesses in the sector are facing financial hardship due to the coronavirus pandemic.

On May 15, the U.S. House of Representatives passed a $3 trillion coronavirus stimulus bill which includes a provision that would allow banks to serve state-legal marijuana businesses without fear of federal retaliation. Dubbed “The Health and Economic Recovery Omnibus Solutions [HEROES] Act,” the bill includes the SAFE Banking Act which granted banks permission to transact with cannabis businesses without fear of federal reprisal. It was approved by the House last fall but has since been stuck in a Senate Committee.

“The inclusion of cannabis banking in the HEROES Act is a positive statement from the House and strongly supplements the decision that the majority of states have made by designating cannabis businesses as essential.” says Washington DC lobbyist David Mangone who lobbies for the National Cannabis Roundtable. Cannabis was one of the few industries that were designated as essential by state governments. However, since marijuana businesses do not have access to cashless payment systems, they have to transact on a cash only basis, greatly increasing the workers’ and customers risk of infection.

“The pathway forward in the Senate is both uncertain and challenging, but SAFE banking is one of the few provisions that not only has strong bipartisan support but also generates revenue rather than adds to the deficit,” Mangone says.

The bill now heads to the Senate which has never passed cannabis banking legislation and has already shown some push back. “I would be surprised if it passed the Senate, just given Senate Majority Leader Mitch McConnell’s comments on the SAFE Act previously, and given his statements about his reaction to it in the last 24 hours,” says Jonathan Havens, co-chair of the Cannabis Law Practice.

“It’s not enough that the House is going to do this. The Senate really needs to act in concert, and it doesn’t sound like they are going to do that if you take your cues from McConnell.”

420 with CNW – Pre-Employment Cannabis Testing Ban Takes Effect in New York City

Last year, the New York City Council approved a ban on pre-employment drug testing for marijuana. As of May 10, the ban took effect, and it stipulates that companies in the city can’t conduct pre-employment tests for THC metabolites unless the position is safety sensitive.

The original bill included language that exempted some jobs from the prohibition on testing, such as people charged with supervising or caring for children and positions “tied to a federal or state contract or grant.” It also contains a provision that allowed the New York City Commission on Human Rights to expand the list of exempted jobs.

The commission later proposed regulations last month, leaving them open for public comment until April 27. Under the proposal, workers who use heavy machinery, spend a significant amount of time on a construction site, gas utility lines, or use a motor vehicle on a daily basis would not be exempt from pre-employment testing.

Although the exemptions haven’t been finalized yet, the commission announced that “claims arising between March 10, 2020, and the date when the rules are finalized, the Commission will not be filing enforcement actions related to the above-listed positions.” This means that if an employee files a complaint about pre-employment drug testing for the aforementioned positions, the Commission will not take action.

The move has been widely praised by advocates as a proper step in protecting cannabis consumers from unfair discrimination. However, some advocates have taken issue with the list of exemptions, and argue that they are too broad.

Marijuana Policy Project (MPP), for instance, has said that the “MPP understands the City Council decided to exclude safety-sensitive positions. However, MPP believes the proposed rule goes beyond what is required by the Bill.”

“We are particularly concerned by the inclusion of a limitation for anyone who drives daily, which could impact a large number of working-class New York City residents. Science has proven that cannabis can stay in one’s system up to a month later. This means a positive test for marijuana does not prove one is impaired at work,” said DeVaughn Ward, senior legislative counsel at MPP in written testimony to the Commission.

However, according to some, employers should ultimately be able to decide whether they want a drug free work environment or not.

“Restricting an employer’s right to test for THC is the first step to prohibiting employers from all substance testing that puts accident injury and fatal liability directly upon them,” said the National Drug and Alcohol Screening Association (NDASA).

“Without exempting all employers or offering the ability to opt-in or out of Local Law 91 then a burden will be put on the shoulders of the employers to provide safe work environments by forcing them to accept applicants that are using a known impairing substance.”

Experts say the cannabis industry, including companies like SinglePoint Inc. (OTCQB: SING), would like to see more jurisdictions ban pre-employment THC tests because those tests force consumers to choose between their jobs and using a substance that they need (especially medical marijuana users).

420 with CNW – Cannabis Groups Urge Congress to Consider Banking Access in Next COVID-19 Bill

More than three months after the coronavirus was first identified in Wuhan, China, thousands have lost their lives and the world economy has taken a historic hit. In the U.S., over 20 million individuals have lost their jobs as all but the most essential businesses shut down their brick and mortar locations. The hospitality and restaurant industries have been especially hit.

Although most states with legal marijuana deemed the industry essential, a lot of marijuana businesses have had a hard time operating during the lockdown. Medical experts say the virus can survive on money for quite a while, but due to prohibition, these businesses have been forced to operate on a largely cash basis. This not only puts the employees in danger of infection but also the millions of immunocompromised people who rely on marijuana as medicine.

On Friday, a coalition of marijuana advocacy groups sent a letter to House leadership asking them to remedy this situation. They want the House to incorporate language allowing the cannabis industry to access banking services in upcoming coronavirus relief legislation.

Financial institutions have always shied away from transacting with the cannabis sector for fear of reprisal from the federal government. This locks cannabis businesses out of contactless payment options like credit cards, which are highly encouraged at this time.

“As recent reports show that viruses can live for up to 17 days, the public safety concerns of this cash-only system compound. The lack of access to financial institutions places industry workers, government employees, and the public at large at risk as banknotes circulate from consumers and patients to businesses to government,” states the letter.

“Unlike other essential industries with access to remote payment processing and the use of credit cards to make a transaction entirely contactless, an industry limited to cash transactions must do business in close proximity to the public, including immunocompromised and otherwise medically vulnerable patients.”

The letter was signed by the National Cannabis Industry Association, Americans for Safe Access, Global Alliance for Cannabis Commerce, Marijuana Policy Project, Minority Cannabis Business Association, NORML, National Cannabis Roundtable, National Association of Cannabis Businesses, Policy Center for Public Health and Safety, and the Safe and Responsible Banking Alliance.

It also touches on the fact that marijuana businesses were denied access to the disaster relief funds dispatched by the federal government.

“Cannabis businesses and their employees already face a significant public safety risk without access to the banking system, and the COVID-19 crisis has only exacerbated this risk with these essential businesses having to move their cash-only transactions outside the store,” says Rep Ed Perlmutter.

“I will continue pushing for the inclusion of the SAFE Banking Act or other forms of relief for this industry in the next package.”

Analysts believe that the entire marijuana industry, including SinglePoint Inc. (OTCQB: SING), will be hoping that the decision makers in Washington soften their stance on marijuana and make concessions aimed at helping the industry through this crisis.

420 with CNW – THC-A: A Superior Neuroprotectant and Anti-Inflammatory Cannabinoid?

The past few years have been instrumental for cannabis. It has seen a slew of positive legislative changes and more states are willing to look at it objectively, especially in regard to its potential medical benefits. Although the science to back this up is scarce, we now know without a doubt that cannabis produces chemicals called cannabinoids, and they are responsible for its therapeutic abilities.

The two most common ones are THC and CBD. THC is the main active component in marijuana and it is responsible for cannabis’s infamous ‘high.’ CBD, on the other hand, carries most of marijuana’s medical potential and has a wide variety of medical applications. However, cannabinoids aren’t limited to just these two.

Cannabis produces over 100 of them and aside from THC and CBD, there are numerous others including THC-a, CBD-a, CBC, and CBG. Cannabinoids like THC-a, or tetrahydrocannabolic acid, especially, hold their own against CBD in some aspects.

CBD is a powerful anti-inflammatory, but THC-a may be even more potent. It is the inactive form of THC, and it gets converted into the psychoactive chemical when it is heated or burnt. The process also occurs naturally as the plant dries.

Like CBD, there isn’t enough science to definitively say that THC-a is 100% effective against certain conditions. However, there is plenty of anecdotal evidence, and preliminary research has been encouraging.

It is a potent anti-oxidant, and it could hypothetically be used as a neuroprotectant in neurodegenerative conditions like Alzheimer’s, Parkinson’s, Multiple Sclerosis, ALS, and similar conditions. Although there haven’t been any human trials yet, the science behind the theory is sound.

THC-a is also a powerful anti-inflammatory, and it has been found to be 10-20 times more potent than CBD. And while cannabidiol can kill affected cells in high doses, THC-a does not.

One risk with cannabidiol is potentially harmful drug interactions. CBD is broken down in the liver by an enzyme that breaks down many common medications and it can interact with these drugs in potentially dangerous ways. THC-a, on the other hand, is broken down by a relatively lonely enzyme and has limited chances of interacting with any other drugs in your system.

THC-a is also more abundant than CBD. Cannabidiol may be insanely popular, but it makes a small percentage of the total cannabinoids produced by cannabis. Since THC-a is the inactive form of THC, there are larger reserves of it. As long it is extracted before it converts into THC, using a cold extraction method like chilled ethanol, you’ll have a lot more THC-a than CBD.

Although THC-a still isn’t as accessible as cannabidiol yet, this may change with time as more research is done. At the moment, experts recommended a 10-40mg dose over the day, for a couple of weeks for the best results.

420 with CNW – Former Federal Prosecutor Says Legalizing Cannabis Will Hurt Cartels

Cannabis is arguably the most abused drug in the world. Half of all drug seizures in the world is marijuana, and the black market makes vast amounts of money from marijuana trafficking. According to a former federal prosecutor who’s now running for Congress, legalizing marijuana may hurt the cartels that feed these black markets.

Adam Schleifer saw the dark side of humanity while working as a federal prosecutor investigating the illicit drug trade. He realized that America made a large part of the illicit drug market, and he came away with one conclusion. Federal legalization.

He is now a congressional candidate, and he argues that federal marijuana legalization is a superior alternative to blanket criminalization. Aside from dealing a great blow to the cartels, legal marijuana will generate tax revenue, create jobs and protect public health, he says.

“Before COVID-19 turned our world upside down, legalization of marijuana was expected to be a centerpiece of New York’s 2020 budget legalization. Now, legalization and the $300 million in estimated annual tax revenue that it will eventually bring will have to wait,” he said.

“This raises an important question. Why are we not talking more about federal legalization of marijuana, which could generate some $132 billion in tax revenue and create 1 million new jobs? Federally legalized, regulated, quality-controlled marijuana would also deprive pernicious international drug cartels of major revenue sources and help us support the integrity of our borders,” he says.

He adds that if undertaken with appropriate health and safety oversight by the U.S. Food and Drug Administration (FDA), “federal legalization would help address our vaping crisis.”

The former assistant U.S. attorney served in Los Angeles from 2016 to 2019, and he is running to fill the seat vacated by retiring Appropriations Committee Chairwoman Rep. Nita Lowey.

He says that at its base marijuana is a product with some medical applications and less physically addictive and dangerous than alcohol.

“We should let American farmers and not international drug cartels meet the demand for marijuana under the framework of federal safety and purity regulation by the FDA. And federal legalization would generate important tax dollars while reducing the financial inefficiencies and fraud that are endemic to our existing state by state patchwork system.”

He says that although the cartels may have a head start in terms of agricultural experience and marijuana transportation and infrastructure, he hopes the criminal element and the violence and predation associated with it will eventually degrade and dissipate.

Experts say the views expressed by the former federal prosecutor are in line with what the marijuana industry, including companies like Round Meadow Holdings Corp. and SinglePoint Inc. (OTCQB: SING), have always said about safeguarding consumers from the risks of black market cannabis products by implementing legalization at the federal level.
