420 with CNW – California Marijuana Industry Workers Move to Unionize

California has made it easy for weed workers to join labor unions after Governor Gavin Newsom on Friday signed into law a bill that requires all cannabis stores that have 20 employees or more to enter into labor peace agreements.

California is the second state (after New York) to issue a requirement for licensed weed shops to enter into a peace deal with the labor union whereby they promise not to stop their employees from joining a union. This agreement will discourage workers from organizing labor strikes against the company.

In recent years, there has been an increased number of states decriminalizing marijuana, and this has prompted labor unions to push for these agreements. The labor union goal is to make sure that the 6 billion dollar industry does not take advantage of their workers who, instead of being paid proper wages, are paid below the minimum wage.

According to the United Food and Commercial Workers International Union (UFCW), the push for the agreements is a way for workers to form a labor union and boost their membership. When the cannabis workers are unionized, they can negotiate for better pay, annual pay rises, and health insurance coverage. UFCW is responsible for organizing marijuana workers in the U.S since 2011.

After voters approved the ballot measure for the legalization of recreational marijuana sales in 2016, California issued a requirement for all weed shops to sign the labor peace deal. However, the downside to this requirement was that the law did not include how the agreement would be enforced, nor the deadline for signing the contract by the marijuana businesses.

According to the new law signed on Friday, businesses are given a maximum of 60 days to sign the labor peace deal; if not, the employee can file a complaint with the state’s labor regulators.

A California Assembly member, Reggie Jones-Sawyer said that the signed law would help employees with clear information on when the employer is not complying with the law and when they should file a complaint.

The labor strategy being used by the emerging marijuana industry was once used to organize shipyard workers and casino employees.

Each labor deal varies from company to company, but the similarities are; the managers agree not to stop workers from joining unions, provide contact information of labor organizers to employees and give unions access to the workplace to meet with the employees. Meanwhile, the unions agree not to incite employees to go on a strike and not to say negative things about the employers to the workers.

When a marijuana company advertises the unionizing of its employees, it means that the business is a legal entity. On Saturday, there was a grand opening of a dispensary in Hotbox Farms in Ontario and thousands of people were in attendance to witness the event as well as see Snoop Dogg’s live performance.

The dispensary, which is owned by Steven Meland, is the third one to open in Ontario, Oregon. In an interview with CBS 2, Meland who also owns hotbox farms on Huntington says that he has been planning to open the dispensary for a long time. He further states that Hotbox is a community-based business which caters for the needs of the community and that is why they voted for the dispensary to be located there.

The concert is a way of giving back to the community and introduce the dispensary, he added.

The entrance-free event required an immediate police response because of the celebrities attending and an influx of tourists to the city.

The Ontario police found out about the event when they met with Meland on Friday. They also found out that he had only applied for the permit for use of fireworks, food catering and beer garden. Meland was yet to file a permit for Special Events or noise variance. This left the police with less time to prepare to ensure the safety of the crowd and enough parking space.

The Ontario police Sergeant Dave Walters was concerned about the parking space, the means of getting in and out of the venue by the crowd, and how the medical specialists were to access the area in case of a medical emergency. He further states that if proper permits were filed and in good time, they would have had enough time to prepare for the event.

Walters said that if something happens, it will be impossible for the police to control a crowd of 5,000 people on a two-acre lot. In response to the sergeant of police, Meland says the event must happen, and it did.

The event coincided with the ban on flavored vaping products which was announced by Kate Brown, the Oregon governor.

Meland was happy that the governor did not issue a flat out ban on vapes because most the vape pens with issues are found on the illicit and unregulated market.

He is confident that his business will not be affected by the ban because his company only deals with vape pen brands that select strains. He knows the people from whom he is sourcing CBD products, and those given the permit to trade his products. That is why he is confident that their products will remain on the shelves when the definition of the products being banned is released.

In a press conference on Wednesday, Tom Wolf, Pennsylvania Governor accompanied by Lt. Gov. John Fetterman, announced his support for the legalization of adult-use recreational marijuana. In his announcement, he included the final report from Lt. Governor John Fetterman’s statewide tour on recreational marijuana legalization. He also proposed the next steps to be taken after reviewing the input submitted by the citizens from the 67 counties who attended their listening sessions or reverted via their online platform.

In his announcement, Governor Wolf said that Lt.Governor Fetterman fulfilled his promise of touring all the 67 counties in Pennsylvania to get the opinion of the citizens regarding the legalization of adult-use recreational marijuana. Moreover, the majority of the feedback received was in favor of recreational marijuana legalization.

Lt. Governor John Fetterman invited the public, media companies and local officials to the tour stops in each county, where the attendees indicated their interest in the bill by a show of hands.

The report comprises of two parts. The first part looks at the volume of messages sent to the online platform hosted on the governor’s website, the comments made on the platform and comment cards collected at the tour stops, as well as any additional message received by the Lt. Gov Fetterman in other formats.

420 with CNW – A Historic Vote Approves the Marijuana Banking Bill in the House

On Wednesday, the House of Representatives made history by passing a standalone cannabis reform bill. The bill aims to protect financial institutions and ancillary firms that provide services to legitimate marijuana companies in the United States. The legislation would guarantee stability and security to the multibillion-dollar marijuana industry as well as ensuring public safety.

A vote of 321 passed The Secure and Fair Enforcement (SAFE) Banking Act. All Democrats but one voted for the bill while  91 Republicans voted for the bill and 102 opposed it. For the bill to pass, it required a two-thirds majority of the House to vote for it.

In the United States, recreational marijuana is legal in eleven states, including the Columbian District. Moreso, most of the states in the U.S have legalized the use of medical marijuana. However, at the federal level, marijuana is still considered illegal, making financial institutions and credit unions dread conducting business with marijuana businesses out of fear of being prosecuted or facing the consequences of not abiding by the regulations.  The SAFE Banking Act will protect these institutions from the effects of conducting business with marijuana companies and enterprises.

In March, the bill moved out of the House Finance Committee. Before the vote on Wednesday, the bill had tallied 200 sponsors of which 26 were Republicans. Several national banking groups are supporting the bill by pushing Congress to take action. These groups include American Bankers Association, Independent Community Bankers of America, and the Credit Union National Association. The National Association for State Treasurers, plus state attorneys general and governors from 20 different states all urged Congress to approve the bill.

Although some human rights groups are against the bill claiming that it would be a hindrance to other reforms and federal legalization; the cannabis trade groups, some human right groups, and people advocating for marijuana legalization are in favor of the bill.

Neal Levine, the CEO of the Cannabis Trade Federation (CTF), said that the federation applauds the House for passing the SAFE Banking Act and that they hope that the Senate will follow suit. He also said that the bill benefits the cannabis businesses and the communities that have chosen to embrace cannabis legalization. The Bill allows weed businesses to access banking services; thus, eliminating their reliance on cash. This will, in turn, improve safety within the community, transparency within the industry and adherence to cannabis-related regulations.

It is still not clear if the bill will be approved in the Republican-controlled Senate, but experts are in agreement that industry participants, such as Wildflower Brands Inc. (CSE: SUN) (OTCQB: WLDFF) and Willow Biosciences Inc. (CSE: WLLW), are keeping their fingers crossed hoping that the upper chamber also passes the bill.
