CannabisNewsBreaks – VPR Brands LP (VPRB) Announces Settlement of Second Patent Infringement Case

VPR Brands (OTC: VPRB) is a market leader and pioneer in electronic cigarettes and vaporizers for nicotine, cannabis and cannabidiol (“CBD”). The company owns intellectual property, which is one of the original patents filed for electronic cigarette technology. Dating to 2009, the patent includes independent claims covering electronic cigarette products containing an electric airflow sensor, including a sensor comprised of a diaphragm microphone. The technology, covered under electronic cigarette utility patent US 8,205,622, includes an airflow sensor that turns the battery on and off and covers most auto-draw, button less e-cigarettes, cig-a-likes, pod devices and vaporizers. According to the update, the patent case filed in United States District Court Central District of California Los Angeles Division, VPR BRANDS LP V. PHD MARKETING INC, was settled with both defendants for a total sum of $85,000 to be paid to VPR Brands LP. “I want to once again thank our legal team at SRIPLAW for their hard work and diligence in settling this matter,” said Kevin Frija, CEO of VPR Brands. “As I have said before, it is a win-win for all parties when a dispute can be settled ahead of trial.”

CBDNewsBreaks – VPR Brands LP (VPRB) Enforces IP Patent Rights, Files Lawsuits

VPR Brands (OTC: VPRB), a market leader and pioneer in electronic cigarettes and vaporizers for nicotine, cannabis and cannabidiol (“CBD”), has recently filed three lawsuits to protect it intellectual property (“IP”) rights. The company’s IP includes one of the original patents, dating back to 2009, filed for electronic cigarette technology. The patent covers claims associated with an electric airflow sensor that turns the battery on and off, as well as auto-draw, buttonless e-cigarettes, cigalikes, pod devices and vaporizers using an airflow sensor. The most recent lawsuits bring the total number of lawsuits the company has filed to nine; in the announcement, VPR Brands noted that it expects to file more as almost every company in the vape space offers at least one product using its patented auto-draw technology. The company and its legal counsel is in the process of identifying and notifying more than 50 companies about suspected infringement. “The surge of the vaping category for nicotine, cannabis and CBD in the last few years has reached billions of dollars in sales. That has created opportunities for our patented Auto-Draw technology, which we believe is now preferred by many, if not most consumers,” said VPR Brands CEO Kevin Frija in the press release. “Infringement can be avoided by simply adding a button to the battery. However, the preferred option by consumers to simulate smoking is our buttonless auto draw technology and we believe this is an opportune time to consider licensing, enforcement or potentially a sale of our intellectual property to one of the larger players in the space. Our Patent could be a huge windfall for the company.”

420 with CNW – Alabama Legislative Panel Recommends the Legalization of Medical Marijuana

When a state Senate bill to legalize medical marijuana in Alabama was met with stiff resistance in the state Assembly, a compromise was reached to create a panel to study the matter further and recommend a way forward for the state. That legislative panel voted last week to proceed with legalization in a move that has been lauded by marijuana advocates.

The Medical Cannabis Study Commission is made up of 18 members and 12 of them voted in favor of medical marijuana legalization. Three abstained and the other three members voted against legalization.

The report of the panel indicates that the members of the Commission presented and debated various issues connected to the use of medical marijuana. While some medical research on the therapeutic use of marijuana was inclusive, the members found strong evidence that the substance was helpful to people suffering from a number of health challenges.

In their draft legalization bill, the panel recommends that the state forms an 11-member Alabama Medical Cannabis Commission to license cannabis businesses and track the industry “from seed to sale.”

The panel also recommends that the state supports research into the medical benefits of cannabis and also puts resources towards finding ways to make the legal medical marijuana industry as inclusive as possible.

Sen. Tim Melson (R), a long-time marijuana advocate who was the chair of the study commission, revealed that the Friday vote shows that the draft bill formulated is a well-thought out document that addresses the crucial issues connected to a regulated medical marijuana industry.

Melson is an anesthesiologist and medical researcher who spearheaded the Senate bill that was passed in May last year. He admitted that at one time, he was strongly opposed to the legalization of marijuana for any purpose. However, when he took a rational look at the available research, he changed his mind and became a strong advocate of medical marijuana.

For that reason, he appealed to other legislators to set their biases aside and evaluate the existing literature before forming an opinion on marijuana.

While advocates are happy with the findings of the commission, they are concerned that the draft bill is too restrictive in its current form. For example, it bans smokable forms of marijuana and gives employers the liberty to fire or refuse to hire an employee based on that employee’s use of medical marijuana.

The list of qualifying conditions is also shorter than what is typical in other states where medical marijuana is legal.

Alabama’s legislature will resume business on April 4 and the bill will come up for discussion. Experts believe that marijuana companies like VPR Brands LP (OTCQB: VPRB) and Plus Products Inc. (CSE: PLUS) (OTCQX: PLPRF) will be hoping that the lawmakers modify the bill and customize it to the needs of the people of Alabama.

420 with CNW – Innovators Create App-Controlled Device for Storing Weed

Homeowners have been locking up their guns and money for safekeeping for centuries. However, they no longer have to keep their stash of weed in the same way as a result of technological advancements which have seen a new and safer method introduced for keeping recreational marijuana safe.

Several centuries back, people used to store cannabis in makeup bags, pencils cases, or under their mattresses. The potency and cost of contemporary marijuana are rendering weed vulnerable to theft either by innocent children, corrupt house managers, and uncanny roommates.

Philip Wilkins said that people no longer believe in stashing their weed in Ziploc bags, closet, or under the floorboards.

Wilkins and his two partners ( Ben Gliksman and Sep Seyai) founded a Toronto-based company known as KEEP. This year the company developed its first electronic storage and security device. The electronic device is called KEEP, and it is fitted with a biometric lock that connects through an app on the owners android smartphone.

The device owner can apply their phone security features such as fingerprint, voice, or facial recognition to unlock the storage device.

KEEP has features meant to maintain the quality of the weed, such as hermetic seal, humidity, and temperature thermometers to keep the marijuana fresh and odorless. The inside of the device is also fitted with LED lighting and trays to make sure that the owners do not have to feel around in the dark looking for edibles, vape pens, or pot. You can store a maximum of 28 grams of dried flower or 4.4 pounds of marijuana. The owners can use a scale to track their usage.

KEEP will be unveiled on the market in March 2020, both in the U.S. and Canada. It will be sold at dispensaries selling legal marijuana and via the KEEP.com website. It will also be sold through licensed producers such as Canada growers. The retail price for KEEP in the U.S. will be about $226 while in Canada it would be $300.

In an interview explaining the motivation behind the company, Wilkins said that he and his partners wanted to leverage the discoveries taking place in consumer electronics and apply it to marijuana because it signifies the growth of the marijuana market.

In November, KEEP was selected as an honoree by the CES Innovation Awards.

KEEP is not the only weed storage solution; others include a black walnut wood box from Marley Natural Shop, which goes for $192, Humidor Combo Box ($99), or LOCK-R Box ($250) from Ryot.

KEEP’S modern design blends into any home. The device has a back-lit LED display that shows the time and outside temperature.

The cofounders of Amazon’s The Marijuana Show, Wendy  Robbins and Karen Paull, wrote an email saying that they liked the device as it keeps your marijuana climate-controlled.

Robbins said that she would buy KEEP since it would keep her stash safe from kids and housekeepers. She also noted that it is a clean and decent way of storing marijuana.

KEEP has also attracted a large number of investors, although Wilkins will not reveal them until the month ends. Marijuana industry players like VPR Brands LP (OTCQB: VPRB) and Sugarmade Inc. (OTCQB: SGMD) could be very pleased that the marijuana industry is giving opportunities to the tech industry to innovate and provide complementary products to consumers.

420 with CNW – How Marijuana Can Improve Your Holidays

The holiday season is around the corner, and it is a time of festivities and gathering of families, friends, and relatives. To some, the season is a source of stress, anxiety, and insomnia. Are you nervous when attending a family gathering? Take a small dose of marijuana to take the edge off. Be careful not to indulge in excess since you do not want a noticeable high.

The consumption of marijuana during the following activities can help relieve some of the adverse effects of the festive holidays.

Family Get-Togethers

Sometimes it can be a challenge to be around relatives when all they want is to discuss controversial issues or do things that make you uncomfortable for an extended period. To make these visits tolerable, you can consume a microdose of marijuana while being careful not to induce an apparent high. If you want to be discreet while using marijuana, you can opt for consuming edibles as they are packed with a small amount of weed, which you can eat all evening discreetly. Since marijuana edibles do not have the smell of cannabis, you will not have “judgy” comments thrown your way.

Traveling

The month of December involves a lot of movements from one point to another since families want to re-unite either during Thanksgiving, Christmas, or New Year’s. The traveling means some people are going to be traversing long distances, mostly through the air, and most often, this leads to jet lag. For those who are traveling, they can take a light dose of cannabis beforehand as it will help them sleep throughout their flight.

Feasting

During the month of December, which is full of parties and celebratory activities, people indulge themselves in a variety of rich and delicious foods and beverages. If you find that your appetite is lacking, you can take marijuana as it is known to improve appetite. It also makes food taste better. Purchase the strains that are known to induce the desire for food. Take a small dose before meals, and you will find that the food is yummy.

Unwinding

If you want to break away from all the partying and the additional strain such holiday activities can cause, take a relaxing strain of marijuana through smoking, vaping, or a bong.

Marijuana does not address all conditions; therefore, if you are overwhelmed by all the activities in the holidays to the point of considering self-harm, seek the help of a friend or a qualified professional.

Industry watchers are convinced that marijuana companies like VPR Brands LP (OTCQB: VPRB) and VIVO Cannabis Inc. (TSX.V: VIVO) (OTCQX: VVCIF) can recommend the best product for the different situations in which you may find yourself during the holidays.

CBDNewsBreaks – VPR Brands LP (VPRB) Provides Update on Monetization, Enforcement of Electronic Cigarette Utility Patent

VPR Brands (OTCQB: VPRB), a market leader specializing in vaporizers and accessories for essential oils, cannabis concentrates and extracts (“CBD”), as well as electronic cigarettes containing nicotine, on Monday provided an update regarding the monetization and enforcement of its U.S. utility patent for electronic cigarettes. The company’s patented technology is one of the earliest filed electronic cigarette patents and includes two broad, independent claims encompassing products with an electric airflow sensor, including a sensor comprised of a diaphragm microphone. VPR Brands has begun identifying more than 50 infringing companies, based on sales volume, and has started notifying the companies of their infringement. Per the update, VPRB recently hired intellectual property (“IP”) law firm SRIPLAW to advise the company on monetization strategy and manage and execute the process. The company’s monetization strategy includes licensing and or manufacturing contracts with infringing brand owners. “Having personally been in the vape industry for the past 10 years and witnessing the evolution of e-Cig and vapor technology, it is befitting that our company owns this US utility patent for what has grown to be a multibillion-dollar market. The inner construction of an e-cigarette is quite simple and fairly standard and it is very obvious as to what our auto draw technology patent covers, and potential infringement is rather clear when you see it,” VPR Brands CEO Kevin Frija stated in the news release. “Our patent could be a huge windfall for the company either by enticing infringing companies to order product through VPR Brands or as an alternative pay royalty on infringing product. Infringement can be avoided by simply adding a button to the battery but there is a reason the preferred option by consumers and most manufactures to date to simulate real smoking is our buttonless auto draw technology which best mimics real smoking.”

420 with CNW – New Florida Bill to Protect Medical Marijuana Patients from Being Fired

The number of registered medical marijuana patients in Florida is estimated to be about 300,000. The patients are issued with medical marijuana cards that give them access to MMJ for them to legally to treat some medical conditions. However, these licensed users of medical marijuana in Florida are facing negative consequences at work and in school.

Some of the people who have suffered a setback in their education or career because of medical marijuana include Kaitlin McKeon who enrolled for a nursing program at Nova Southeastern University. The school requires applicants to do a drugs test, and hers came back positive for marijuana. She uses medical marijuana to treat chronic stomach pain. After the failed drugs test, the school dismissed her application which further derailed her career and education.

Another victim is Alan J. McDuffie who worked for the city of Miami. He applied for a permanent position with his department and was required to do a drug test which turned positive for marijuana. The city fired him even after he told them that he is registered for medical marijuana. McDuffie uses marijuana to manage back spasms. Both McKeon and McDuffie have filed suits against their respective institutions. They claim that the institutions discriminated against them for using medical cannabis.

Florida’s statute of medical marijuana gives employers the freedom to implement drug-free policies and the law does not stipulate that employers retain workers using medical marijuana. However, the new legislation that could change all that in Florida is in the House. The bill which was proposed by Boca Raton Rep. Tina Polsky would provide some protection for people using marijuana in schools and workplaces.

Adam Kemper, a Boca Raton employment attorney whose specialization is medical marijuana compliance, said that the timing of the bill is perfect because the number of people using medical marijuana in Florida is increasing.

The bill would prohibit employers from discriminating, firing, downgrading, or taking any other adverse action against an employee who is a registered user of medical pot. However, the bill would not offer protection for people whose jobs are safety-sensitive such firefighters, people operating heavy pieces of machinery, drivers, those handling dangerous materials, carrying weapons, and persons providing care to children or patients.

The new bill stipulates that a person whose drug test is positive must provide a written notice explaining why the tests are positive. They can also submit a doctor’s certification and MMJ cards as proof of legal use. The bill also permits people fired or penalized for using marijuana to file a lawsuit against their employer for compensation and reinstatement.

Kemper also said that if pot usage is hampering with an employee’s job performance, the bill allows employers to take action such as discharge the person from their duties.

The legislation does not address employees’ rights when an employer asks about the medical condition that requires them to use pot. However, federally, if an employee is seeking accommodation under the Americans With Disabilities Act, they must disclose their medical history and the specific medical condition to the company.

Under any other condition, the employers would be crossing the line if they asked employees personal questions.

According to industry watchers, marijuana industry players like VPR Brands LP (OTCQB: VPRB) and Sugarmade Inc. (OTCQB: SGMD) welcome this proposed law because employees or students will no longer be made to choose between treatment and their jobs or studies.

420 with CNW – Florida House Panel Turns to Oregon for Lessons on Recreational Marijuana

There is a strong possibility of putting recreational marijuana legalization on the 2020 ballot in Florida and this has prompted the House panel to turn to Oregon to learn about the economic, environmental, and other changes that have occurred since the state legalized recreational marijuana in 2015.

The executive director of the Oregon-Idaho High-Intensity Drug Trafficking Area, Chris Gibson, told the House panel (House Health & Human Services Committee) that there has been an increase in tax revenue. The state has also experienced a rise in illicit use of drugs and that currently, Oregon is dealing with marijuana overproduction.

Gibson also told the panel that currently, the state has enough marijuana to meet the demand of consumers within Oregon for the next six-and-a-half years.

Gibson further said that due to the excessive supply of weed to the recreational market, it is believed to be servicing the black market sales in other states such as Florida. He also noted that some legal businesses are exporting marijuana out of state, which is considered illegal.

Although he refused to comment on whether marijuana is being used as a scapegoat for illicit drugs, he said that in the last five years, Oregon has reported an increase in drug use across the state.

Adult use and possession of marijuana were legalized in Oregon in 2015 through the ballot. The measure garnered 56% of the votes. According to the data from the Department of Revenue in Oregon, the state has collected marijuana tax revenue amounting to more than $275 million since 2016. And, the majority of it is from recreational sales, said Gibson.

Medical marijuana in Florida was approved in 2016 through the ballot. Supporters of recreational marijuana legalization are trying to include two measures in the 2020 elections so that adult-use recreational marijuana can also be available in the Sunshine State.

One of the campaigns to legalize pot is spearheaded by the “Make it Legal Florida” initiative and they are supported by medical marijuana operators in the state. This particular measure would permit people aged 21 years and above to possess up to 2.5 ounces of cannabis.

After the HHS committee meeting of Tuesday, the House panel Chairman, Ray Rodrigues, told reporters that the members of his committee should have all the information about the two proposals. Rodrigues further noted that if either of the proposals gets in the ballot, the constituents will need information and their position on the bills. Therefore, the HHS committee should be fully informed.

Rodrigues was intrigued by Gibson’s presentation on the environmental impacts of growing marijuana on Tuesday. According to Gibson, to produce a kilogram of weed, the plant uses as much energy as that of two refrigerators and release as much CO2 in the air as a passenger car in one year.

It is widely hoped that this information-gathering process will not be used by the House Panel to de-campaign legalization. Analysts believe such an act would be regarded as unfair by cannabis industry companies like Plus Products Inc. (CSE: PLUS) (OTCQB: PLPRF) and VPR Brands LP (OTCQB: VPRB) who have always looked for ways to be more efficient in all steps of the production, manufacture and sale of pot.
