420 with CNW – Senate Approves Bill Banning Feds from Interfering in Medical Marijuana State Programs

On Thursday, the Senate passed the spending legislation which has a provision that ensures that medical marijuana states are protected from federal interference. However, the question on everyone’s mind is if the bill will be signed into law once it gets to the president’s office.

The spending legislation is also referred to as minibus appropriation as it covers funding for Agriculture, commerce, Environment, Food, and Drug Administration, Housing, Interior, Justice, Military Construction, Rural Development, Science, Veteran Affairs, Transportation and Urban Development for the 2020 financial year.

The vote on the bill was overwhelming, with 84 in favor vs. 9 votes against. The legislation also had language related to new hemp and CBD.

The legislation prohibits the Department of Justice from using its resources to persecute persons whose actions comply with state marijuana regulations.

In June, the House approved the Justice Department Appropriation bill which would extend protection to all Cannabis programs including  recreational use and sale in the legalized states in the U.S. Marijuana advocates are hopeful that the Senators will approve the legislation; however, in an interview with some media outlets, some Senators said that it is unlikely for the added policies to be adopted because of the bicameral agreement made by the Congressional leaders which stipulated that no new policy riders are to be added during the appropriation process unless agreed on a bipartisan basis.

If the bicameral conference committee negotiators agree to use the House language in the final legislation, the Senate will send the amended bill to the president’s desk for 2020. If, by 21st November, the spending bill is not signed into law, the government will cease operations. Therefore, to avoid such an incident, the larger chambers may opt to approve the bill previously passed by the Senate.

The political director of NORML, Justin Strekal, said he hopes the House will insist on the inclusion of the provision restricting the feds from interfering with marijuana programs in the legalized states in the minibus spending legislation.

Last week, a separate amendment was added to the minibus appropriation bill by Senator Bob Menedez, calling on the Attorney General to review the criminal justice effects of marijuana legalization. However, the Senate did not consider nor discuss the measure.

Apart from the marijuana protection language, the Senate Appropriations Committee also advanced other policies through the spending process. They approved legislation with additional policies that barred Washington from using the local resources, such as tax revenue, to develop a legal marijuana market. It also approved a provision granting funds to the Department of Agriculture to sanction rules for legal hemp program.

In the House version of the appropriations bill, lawmakers also approved a provision for issuing protection to the banks doing business with the marijuana industry, as well as the removal of the measure barring D.C. from implementing a marijuana market.

The majority of the Senate is Republican, and they are sticking with the bicameral agreement; this may lead to the formation of standalone cannabis legislation, such as the SAFE Banking Act, which would allow banks to work with weed businesses without interference from the Department of Justice.

Analysts are of the view that the entire cannabis industry, including Marijuana Company of America Inc. (OTCQB: MCOA) and VPR Brands LP (OTCQB: VPRB), is waiting with bated breath to see how the final vote on the bill goes.

420 with CNW – Finnish Government to Consider Petition to Decriminalize Marijuana

Possession and cultivation of marijuana for personal use is being considered for decriminalization by Finland’s government after marijuana advocates collected the 50,000-plus petition signatures required to prompt the parliament to review the measure.

The proposal stipulates that people found in possession of 25 grams of marijuana or farming a maximum of four plants would not face criminal charges.

The yields of a single marijuana plant are equivalent to the 25 grams permitted under the proposal; therefore, people are urged to dry one plant at a time.

According to Yle, the collection of signatures was started last month by a group called Kasvua Kannabiksesta. Most of the signatures were gathered last month by the Kasvua Kannabikseat group. And, they credited their success to their social media campaigns.

The activist Janne Karvinen said that it is natural for people to do things at the last minute. Recently the group has been promoting the measure through social media. She believes that there are more than 50,000 people in Finland supporting their proposal.

According to the measure, people who consume marijuana in a public space would be charged under new penalties.

A translated explanation of the petition states that the current policy goal is harm reduction, but it has not succeeded. The anti-drug policy is the motive behind the prohibition of marijuana possession and consumption. The ban only targets the minority, and it is harmful to people, and a big waste of law enforcement resources.

The advocates said that imposing criminal charges on marijuana consumers is harmful because no matter how minor the charges are, the misdemeanor offense stays on the person’s records. The advocates also cited the decriminalization model in Portugal, which helped in reducing the number of drug overdoses and people infected with HIV.

The group said that instead of legalizing marijuana, Finland’s government should decriminalize it, as this ensures that it is still adhering to the United Nations rules that stipulate that member countries should not allow marijuana to be legally regulated and sold. However, this has not hindered member countries such as Canada and Uruguay from legalizing cannabis.

According to the proposal, decriminalization is the process of abolishing the criminal aspects of an act that is illegal and punishable by law. The abolished criminal sections may be transformed into a minor offense punishable by a fine.

The Finnish lawmakers will formally debate and consider the decriminalization proposal, but it is still too early to predict whether they will approve or reject the petition.

Analysts think that industry players like Plus Products Inc. 420 with CNW – New Mexico Marijuana Working Group Releases Proposals

On Wednesday, a working group that was appointed by New Mexico governor released its recommendations for a legal cannabis market.

The group was formed in June this year by Governor Michelle Lujan Grisham (D), who was interested in the development of a legalization plan by the panel of experts before the January 2020 legislative session which lasts for 30 days only. New Mexico State could be next in legalizing marijuana in the United States.

The report from the group provides recommendations such as marijuana packaging requirements, promotion of social equity, and allocation of tax revenue derived from marijuana sales.

In a press release, the working group chair, Pat Davis who is the City Councilor in Albuquerque, said that to explore every aspect of marijuana legalization, both the bad and the good, the group held more than 30 hours of public gatherings across the state where they collected more than 200 pages of public comments to help in writing their report.

The recommendations in the report included the release of marijuana possession convicts, tax exemptions for medical marijuana, setting product requirements, and introducing a subsidy program that would lower the cost of medical cannabis for low-income patients.

The working group also suggested that the state bans home cultivation of weed or for growers to acquire a license. Just as stipulated in the current law, the group also suggests that patients with medical marijuana cards to be allowed to cultivate a maximum of six cannabis plants for their use.

In an email, Lujan Grisham’s press secretary, Nora Meyers Sackett, wrote that the governor is happy because the working group included her priorities such as protection measures for the medical program, public and workplace safety concerns and clear labeling or the packaging in their marijuana legalization proposal.

She further added that the governor would review the working group’s recommendations and then incorporate them into the legislation and strive to earn the support of the legislators and stakeholders before the legislative session.

Some of the recommendations from the working group include the prohibition of marijuana advertisements that feature children, clearly labeled containers with correct doses, and maintenance of reliable testing methods. Penalties will also be imposed on individuals selling weed to minors or consuming it in a car. Training of the police to identify drug-impaired drivers using tax revenue funds is also catered for in the proposals. The proposals suggest that a tax rate of 17% be imposed on marijuana sales. Local authorities would be allowed to use the revenue collected from marijuana as they see fit.

The working group also suggests that funds should be set aside to help communities and small businesses with capital to start their weed companies. The revenue generated should also be used to support housing, on-the-job training, and education programs in the state.

Davis said that if the recommendations are well implemented, they will be able to create 11,000 jobs. 420 with CNW – Marijuana Legalization Bill Introduced in Pennsylvania

Just a few days after Gov. Tom Wolf (D) announced that he was now in support of legalizing recreational marijuana, a bill has been filed in the state Assembly seeking to create a state-run system through which recreational marijuana can be brought to the state.

Under the legislation introduced by Rep. David Delloso (D), adults 21 or older can possess, consume, purchase and even cultivate marijuana through a stores system run by the state through the Liquor Control Commission.

The text of this proposed law states that the legalization of marijuana is being sought in order to enhance the best use of law enforcement resources, promote personal freedom and avail more revenue in the state purse.

The proposal also includes suggested tax rates for recreational marijuana products. The 19 percent tax collected on sales would be put in the general fund of the state, and a separate regulatory program would be established to oversee industrial hemp.

One notable provision of this draft law seeks to create an avenue through which Pennsylvania would import recreational marijuana products from other states or even countries. However, the existing federal law regards marijuana as a controlled substance that cannot be moved across state lines, which is why companies that operate in different marijuana markets in the U.S. build entirely new systems instead of moving products from one state where they operate to another.

The import provision also creates a condition that other states or countries must meet if they are to engage in recreational marijuana trade with Pennsylvania; those jurisdictions must accept marijuana exports from Pennsylvania.

Oregon was the first to pass such a law providing for interstate commerce in marijuana, but their law had a provision that this mechanism could only be triggered once the federal government changed its laws on marijuana.

In June, Rep. Earl Blumenauer and Sen. Ron Wyden, both Democrats from Oregon, filed similar bills in Congress and the U.S. Senate respectively that would make it possible for states where marijuana is legal to trade in the substance with each other. However, these bills have never been scheduled for hearing.

If this bill is passed, the Liquor Control Commission would be given up to July 1 next year to have regulations ready for the implementation of the recreational marijuana program.

It isn’t yet clear how much support this proposal to run the marijuana program using a state cultivation and distribution model would work since it could put state employees directly in conflict with the federal government that would regard them as “drug traffickers.”

Experts are of the view that industry actors like VIVO Cannabis Inc. (TSX.V: VIVO) (OTCQX: VVCIF) and VPR Brands LP (OTCQB: VPRB) will be watching to see whether Pennsylvania becomes the first state to run a recreational marijuana system.

The designated doctor, for an additional fee, will provide you with an official diagnosis. People suffering from menstrual cramps and soreness from old injury also qualify for the Arizona medical cannabis card.

  1. Submit Your Application

The Arizonian Department of Health Services (DHS) provides guidelines on the process of submitting applications. You can visit the site https://azdhs.gov/licensing/medical-marijuana/index.php. In earlier days, people used to submit their applications, but in recent times the doctors upload your photo and documentation to the DHS system. As the applicant, you will have to sign a form promising not to sell or misuse your medication. The application will cost you $150, but if you qualify for food assistance, you will only pay $75. If you are issued with the new MMJ card, you will have access to medical marijuana for two years.

  1. Get Your Medical Marijuana

After you have received your medical marijuana card, you can start enjoying the benefits of weed by purchasing from a certified pharmacy near you. You are allowed to buy up to 2.5 ounces of medical cannabis every two weeks. If you live 25 miles or farther from the nearest dispensary, you are allowed to grow a few medical marijuana plants.
