420 with CNW – Advocates Intensify Fight for Workers’ Right to Use Marijuana

Should someone using marijuana in a state where it is legal fear that they will lose their job or have their job application rejected? Pro-marijuana advocates are starting to show that the answer is an emphatic “no” and they are demanding for action in this regard.

It is ironical that California, which paved the way for recreational marijuana across the country, doesn’t have protections for workers who use legal marijuana within its state borders. Courts have ruled that the laws legalizing marijuana don’t shield workers from being fired for using marijuana and the attempt of lawmakers to correct this situation was vetoed by Gov. Schwarzenegger during his term in office.

However, things aren’t all bleak across the country. For starters, 15 states, including Arizona, Illinois, New Jersey, Pennsylvania and Rhode Island have all passed laws banning discriminating against job applicants or employees on the basis of their use of marijuana.

Nevada was the first to take this significant step after the state passed the law in June and Gov. Sisolak signed the bill. This law will take effect in 2020.

In April, the New York City Council approved a measure that bans pre-employment marijuana testing. This action shows that local authorities are ready to take the lead on this important matter if state legislatures take long to act on issues that the people find important.

In the past, the courts of law have largely upheld the right of employers to fire an employee for using marijuana or refuse to hire one who tests positive for the drug. However, this tide seems to be changing as well because many courts have ruled in favor of protecting the workers’ right to use marijuana in states where such use is legal.

For example, the right of employees to use medical marijuana in Massachusetts was upheld by a state court last year. Similar rulings were made in Connecticut and Rhode Island.

This year, federal courts also moved to protect this right when a federal court in Arizona ruled that a Walmart employee was wrongfully terminated on the basis of her use of medical marijuana.

The winds or change also seem to be reaching Capitol Hill as a bill was introduced in Congress seeking to protect federal workers from having their employment status determined solely on the basis that such employees use marijuana in states where it is legal.

420 with CNW – Thai State Hospitals Start Distributing Marijuana Oils

Thai state hospitals have stocked up on cannabis oils and are ready to start dispensing them to patients, according to a press release by Anutin Chanvirakul, the Public Health Minister who also doubles as the Deputy Prime Minister of Thailand.

Chanvirakul revealed that Thai state hospitals received a total of 4,500 bottles of marijuana extracts starting on August 7 as a result of the law which was passed in December to make medical cannabis legal in the Asian country.

Under this new law, the government will be responsible for regulating the production, processing and sale of medical marijuana products. Companies will have to apply and be granted licenses before they engage in any activity connected to this new medical marijuana industry.

The Government Pharmaceutical Organization (GPO), an agency run by the Thai government, will work with other state agencies to avail a total of 200,000 bottles of marijuana oil on a monthly basis starting in the month of September. To meet this requirement, the GPO intends to start growing marijuana in greenhouses next year so that supply shortages don’t jeopardize the implementation of the medical marijuana program.

The marijuana oils being stockpiled in state-run hospitals will be given out free of charge to the qualifying patients who are enrolled in the state’s universal health care scheme (the Gold Card) or any of the other health insurance schemes available in the country.

Thai doctors will first diagnose each patient and then recommend the particular cannabis oil formulation that is best suited to help that patient. Based on this prescription, the hospital pharmacy will dispense the oil to be used by the patient.

The addition of medical marijuana to Thai law is widely seen as a boost to the agricultural sector of the country since its favorable conditions can position Thailand as a leader in marijuana production in the region and internationally.

Prohibition Partners, a marijuana research company, estimates that the marijuana industry in Thailand could be worth at least $661 million by 2024.

However, this potential can only be turned into reality when marijuana cultivation and processing is ramped up quickly enough to meet the expected high demand among patients in the country with a 300-year history of using marijuana as a medicine before the drug was outlawed in the 1930s.

The country hopes to develop its own cannabis strains that will compete favorably on the world marijuana market. Laos, Malaysia and the Philippines are currently considering to legalize marijuana for medicinal purposes.

420 with CNW – Study Reviews How Cannabis Inhibits and Kills Cancer Cells

A recent scientific review conducted by researchers at Amity University in India has concluded that the legal status of marijuana should be reconsidered given that there is a lot of research suggesting that compounds from marijuana can inhibit the growth of tumors and also aid the management of different forms of cancer.

The researchers focused on the scientific literature available on the subjects of how different cannabinoids act on various cancers, stimulate appetite, relieve pain and combat nausea.

They discovered that while marijuana compounds can help in treating the symptoms caused by chemotherapy, marijuana shows promise in slowing down the growth of tumors and it can actually kill cancer cells in some cases.

The vast majority of the scientific studies which were included in this review were in vitro (in a test tube) studies while other studies had mice as their test subjects.

There was also a clinical trial which showed that the patients who had an aggressive form of brain cancer exhibited a higher (83 percent) one-year survival rate when given certain cannabinoids as compared to the patients who were treated using a placebo (53 percent one-year survival rate).

Another study included in the review also showed that blood cancer cells which were exposed to two synthetic cannabinoids showed a high rate of mediated apoptosis (programmed cell death). This means that the cannabinoids caused the cancer cells to “commit suicide.”

The researchers point out that not much research has been done on the effect of cannabinoids on breast, oral, liver and lung cancers but those researchers were able to find some studies which revealed that mice with certain types of lung cancer exhibited reduced tumor growth beneath the skin and the cancers didn’t spread as fast from their lungs once those mice were treated with THC.

Even if THC has been given a lot of attention by researchers studying how marijuana can help in the treatment of different cancers, the Amity University team found evidence that other cannabis compounds could also be therapeutic.

For example, they found a study which showed that a certain line of breast cancer significantly reduced its invasiveness and proliferation when those breast cancer cells were exposed to a synthetic form of CBD.

The researchers conclude that on the strength of the existing research pointing to the potential of different marijuana compounds as therapeutic, it is important for the legal status of marijuana (currently regarded as a controlled substance by international conventions) to be revised.

420 with CNW – Medical Marijuana Could Be on Louisiana Dispensary Shelves as Early as Next Week

Early this week, officials from the Louisiana Department of Agriculture and Forestry (LDAF) announced that medical marijuana products could soon be available in licensed dispensaries as soon as next week. This news brings a sigh of relief to patients who have waited through endless delays since 2015 when voters approved a measure to legalize medical cannabis.

Mike Strain, the LDAF Commissioner, revealed that his department had received the first batch of medical marijuana products that were ready for distribution to the licensed medical cannabis dispensaries within the state. Those samples would be tested to ascertain their potency, homogeneity and presence of contaminants.

If those samples pass the lab tests, then the department would give the manufacturers the green light to distribute their products to the places where patients with recommendations can access them.

GB Sciences, a company that was subcontracted by Louisiana State University, has provided the samples to be tested by the state. Strain revealed that the testing process would take approximately seven days and the products would be available if no issues are found during the tests. If any problem is found, the availability of the products would be delayed until those issues were resolved.

Some of the products that were randomly selected from the stores of GB Sciences for the purpose of testing by the regulator include inhalers and cannabis oil drops. The products were made in different formulations of THC and CBD. For example, some products are high in CBD while others are high in THC and low in CBD.

These products will be available to patients with debilitating conditions as long as those patients have been certified by the state to use medical marijuana as a form of treatment.

Louisiana passed strict rules under which the medical cannabis program would be implemented. For example, only two cultivation and manufacturing licenses were issued. Louisiana State University and Southern University were the recipients of those licenses. However, these two institutions could subcontract partners to help them execute their activities, and that is why GB Sciences had a chance to process the products which are undergoing testing.

Southern University partnered with Advanced Biometrics and they are soon planting their maiden medical cannabis crop. They expect the products from this crop to be ready for the market in about five months since it takes that long to grow and process a cannabis crop.

420 with CNW – Thousands Submit Comments Urging FDA to Allow CBD in Supplements and Foods

The U.S. Food and Drug Administration (FDA) started receiving comments on CBD regulation from the public and other stakeholders in April and the comments period came to an end early last week.

The agency had initially planned to close the comments period on July 2 but the overwhelming public interest in the matter led the FDA to extent that deadline to July 16. By the close of the comments period, more than 4,400 submissions had been filed by individuals and organization.

The comments received covered everything imaginable about the therapeutic effects of CBD, how the compound should be tested, packaged and marketed, as well as matters of consumer protection and law enforcement.

There were hundreds of comments from individuals who claimed that CBD had helped them to deal with the symptoms of different health challenges, such as pain and anxiety. Other people claimed that they were able to wean themselves off of other drugs that had serious side effects by using CBD.

Several health associations and medical professionals submitted comments to the effect that the agency should regulate CBD as a health supplement as long as strict labeling and quality standards are set for manufacturers.

The Dravet Syndrome Foundation submitted a comment urging the FDA to formulate regulations that standardize the labeling of CBD supplements on matters of concentration, stability and the ingredients in the products since Dravet syndrome sufferers have been turning to these products after failing to get relief from the existing remedies.

A group of 37 state attorneys general also wrote to the FDA asking the agency to formulate rules that would protect consumers by requiring manufacturers to provide accurate information about the risks and potential benefits of CBD products. This would enable consumers to make an informed decision about the CBD products they use.

The Center for Science in the Public Interest (CSPI) submitted their comment requesting the FDA to design a program through which the state laws on CBD and other related products could be gradually aligned with the federal regulations on these products. By bringing uniformity to the CBD rules across different jurisdictions, the FDA will have taken a significant step towards safeguarding consumers from adulterated, mislabeled and contaminated CBD products, CSPI added.

The National Association of State Departments of Agriculture (NASDA) called on the FDA to work closely with them in order to find ways to regulate the industry without stifling its growth.

The FDA will use these comments, along with any other input it receives from other fora, such as a planned hemp conference next month, while formulating the draft rules for the hemp industry which are slated to be released in August.

420 with CNW – Group Announces Intention to Initiate Ballot Measure to Legalize Recreational Marijuana in Arkansas

A marijuana education and advocacy group in Arkansas has announced that it plans to file two petitions with the state government so that recreational marijuana can be legalized through a ballot measure. The second petition covers the expungement of marijuana-related convictions.

Drug Policy Education Group (DPEG), the nonprofit planning the petitions, says that they had initially wanted to have both issues (legalization and expungement) in the same initiative. However, their legal advisors recommended that they submit separate petitions since it would be hard for the Attorney General to approve a petition which has a constitutional amendment within another proposed amendment.

Melissa Fults, the Executive Director of DPEG, revealed that they had been planning the petitions for more than a year but they decided to move quickly since the lawmakers seem to be moving towards making it harder for voters to effect changes to the state constitution.

Fults revealed that there was consensus among pro-medical marijuana advocates that the Medical Marijuana Commission (MMC) and the State General Assembly had deliberately delayed the launch of the medical cannabis program after voters approved a constitutional amendment in 2016. Sales started 2.5 years after the constitutional amendment, and sales totaling $2 million had so far been registered.

Fults and other advocates have been trying to see more reforms made to the existing cannabis laws. For example, they tried to expand the list of medical marijuana qualifying conditions to three times its current size but the bill failed to make it beyond committee level during the legislative session that has just ended.

The first petition, named Arkansas Adult Use Cannabis Amendment (AAUCA) seeks to give the state’s finance department, through its Alcohol and Beverage Control Division, permission to draft regulations for the recreational marijuana program (cultivation, manufacturing, testing and sales). Under the proposal, adults who are at least 21 years old will be allowed to purchase recreational marijuana in addition to having a maximum of six seedlings and six mature plants for their own use.

The second ballot petition, named the Arkansas Marijuana Expungement Amendment (AMEA), seeks to allow people who were convicted for possessing up to 16 ounces of cannabis to petition a court (which will be set up for this purpose) to be released from prison, have the conviction expunged or request for the restoration of their rights.

Under Arkansas law, any proposed petition for the passing of a new law requires signatures of at least 8 percent of the voters who participated in the most recent elections. A petition for a constitutional amendment requires 10 percent voter support to be approved for inclusion on the ballot.

The nonprofit and its supporters therefore have their work cut out if their petition is to see the light of day. Pundits think that the entire cannabis industry, including participants like VPR Brands LP (OTC: VPRB) and VIVO Cannabis, Inc. As Canadians countdown to the start of cannabis edibles sales in December, some sobering information is filtering in to the effect that life insurance premiums could go up depending on one’s cannabis edibles consumption habits.

When recreational marijuana was legalized in October 2018, most insurance companies stopped regarding marijuana users as smokers. People who are categorized as smokers can pay up to four times more in life insurance premiums when compared to those who are categorized as non-smokers. This is because smokers are seen as being higher-risk clients for insurance companies.

However, it has emerged that one’s marijuana consumption habits can still get that person in the smokers’ category when taking out a life insurance policy.

Different insurance companies have their own cannabis consumption threshold beyond which the individual is classified as a smoker. Many put the weekly consumption cap at 2-4 times, but some have a higher consumption threshold.

So, what’s the deal with cannabis edibles and life insurance premiums?

It is anticipated that marijuana edibles will appeal to a broader section of the Canadian community, including those who are queasy about smoking cannabis flower. Additionally, it will be easier for someone to consume an edible product, such as a brownie, containing cannabis since these products will become readily available.

For example, many will not find any problem consuming at least one cannabis edible each day, and it is rational to expect lots of Canadians to consume more than one pot edible a day. This puts their weekly average consumption at more than the threshold set by insurers, and the smoker classification can get activated for such people.

Since marijuana has only been recently legalized, insurance policies are still in their infancy and the fine print hasn’t yet been adjusted to cater for the actual quantity of marijuana consumed. For example, a small brownie containing a small amount of marijuana is currently rated the same as a jumbo one having much more marijuana than what is contained in the smaller brownie.

This seems unfair to marijuana users, but it is what it is until the policies are modified to accommodate those nuances.

Some people may be wondering how life insurance companies will get data on their clients or prospective clients’ cannabis consumption habits. While these insurers will not access your cannabis products purchase records, they will ask you to provide some information about your marijuana consumption habits as you take out a policy.

If you downplay how much marijuana you consume in order to avoid being classified as a smoker, you face a high risk of any insurance claim you or your loved ones make being denied if the insurer later discovers, from your medical records for example, that you consume way more marijuana than what you declared. A discussion with your attorney is advisable before you sign any life insurance paperwork.

These developments in Canada paint a picture of what could happen in the U.S. if the federal government ever amends its marijuana policies to become more permissive towards the substance. 420 with CNW – Canadian Companies Forced to Delay Launching “Cannabis 2.0” Products

The effects of the longstanding cannabis shortages in Canada are being felt far beyond the empty shelves in retail outlets. When recreational marijuana was legalized on October 17, 2018, a promise was made that marijuana edibles, vapes, CBD and beverages (so-called cannabis 2.0 products) would be available for purchase exactly one year later. Now the regulator has delayed the start of retail sales of those products citing a procedural requirement for the producers.

Health Canada, the regulator of the marijuana industry in Canada, held a briefing on Friday, June 14 in which the regulator informed the public that there would be a delay in rolling out the “cannabis 2.0” products for another two months.

Health Canada mentioned that while its rules would start being operational on October 17, it wouldn’t be possible for any edibles or other “2.0 products” to be sold until at least two months later. This is because the manufacturers of those products will start filing notices with the regulator of the products being brought to market and those manufacturers must then wait for a minimum of 60 days before starting to ship the products to the retail outlets.

It is believed that the 60-day window will allow the regulator to scrutinize those products and approve those which meet all the requirements in the law. In effect, retail sales will begin on Dec. 17 or thereafter.

The revenue generated from cannabis edibles and other second-generation marijuana products will not be reflected in the earnings of the fourth quarter (Q4) of this year. Instead, those figures will only become meaningful at the end of Q1 of 2020.

Canadian companies like Aurora Cannabis and Canopy Growth had been looking forward to launching the sale of these products because those products have performed excellently in the U.S. states which permit their sale.

These Canadian companies are therefore going to have no choice but to revise their revenue projections for Q4 of 2019 to reflect this delay to bring edibles, beverages and other “second-wave” marijuana products to the market.

On the other hand, marijuana companies shouldn’t be too concerned by the delay unless the cannabis 2.0 products were going to carry a bigger profit margin than the smokable flower which is chronically sold out at retail outlets.

Analysts are eager to know what marijuana industry players like VIVO Cannabis Inc. (TSX.V: VIVO) (OTCQX: VVCIF) and TransCanna Holdings Inc. (CSE: TCAN) (FRA: TH8) have to say about this latest announcement by Health Canada.
