420 with CNW — Ailing MTA Employee Mulls $5 Million Suit Against New York for Denying Him Medical Cannabis

Although more than 30 states have legalized some form of cannabis, the drug still remains illegal at the federal level. So while people in states with legal cannabis markets can consume cannabis legally, they are still liable to federal repercussions in certain situations. This is especially true for individuals who are employed by federal organizations, which base their policies on federal regulations and consequently penalize employees who use cannabis.

An ailing Metropolitan Transportation Authority (“MTA”) worker found this out the hard way after the NYC Transit Authority suspended him and forced him to attend drug rehab classes for using medical cannabis. NYC Transit worker Myles Watson is now looking to file a $5 million notice of claim against the agency, arguing that he was a victim of discrimination due to severe back and neck injuries he had sustained while on the job. Watson’s legal claims came soon after New York Governor Andrew Cuomo finally signed legislation to legalize recreational cannabis in the state.

The 43-year-old’s troubles began back in 2017 when he was involved in a car accident while in an NYC transit vehicle. The ordeal left him with three herniated disks and two bulging disks and forced him to have neck fusion surgery. However, he couldn’t rely on prescription painkillers to reduce the pain he was in because he suffered from diverticulosis and celiac disease. He began using cannabis to help manage his pain and stomach issues.

Since it is a federal agency, NYC Transit carries out random drug tests. During one such test, Watson tested positive for marijuana and was instructed to attend drug counseling sessions. Another car crash in December 2019 injured him further, tearing cartilage in his knee and causing even more pain. He began smoking CBD flower for pain relief, tested positive for marijuana during another random drug test, and was suspended without pay last November. Due to this, Watson has had his vehicle repossessed, his daughters have no health insurance and their home is under threat of foreclosure.

The agency also instructed Watson to attend several drug counseling sessions per week with individuals who are addicted to much more dangerous drugs. He argues that he isn’t addicted to cannabis, he is just using it medicinally to address his health issues. His lawyer, John Scola, says that although federal agencies such as the MTA have to abide by federal law, they cannot ignore anti-disability discrimination laws in their quest to enforce “archaic” cannabis policies.

Still on the subject of medical marijuana, many programs are underway to conduct clinical trials on several cannabis-based medications, including trials being done by XPhyto Therapeutics Corp. 420 with CNW — Texas Legislative Committee Unanimously Approves Medical Cannabis Expansion Bill

Last week, a Texas House committee voted in favor of a bill to expand the state’s medical cannabis program. One of a number of cannabis reform bills discussed by the legislature last week, the legislation was sponsored by House Public Health committee chair Stephanie Klick. The bill is designed to significantly expand Texas’ already-limited medical marijuana Compassionate Use Program (“TCUP”), adding a couple more conditions to the list of diseases that qualify patients for a medical marijuana prescription.

Patients suffering from chronic pain and any type of cancer, as well as veterans with post-traumatic stress disorder, will now be able to take medical marijuana to treat their conditions. Bill HB 1535 will also include debilitating conditions that have been determined by the Department of State Health Services and included on the list of qualifying conditions. On top of that, the legislation will increase the medical marijuana cap for THC (delta-9 tetrahydrocannabinol) from 0.5% to 5%.

Finally, House Bill 1535 would create institutional review boards and authorize those boards to promote studies on medical cannabis and how the state’s medical cannabis program has affected its patients. The 11-0 vote in favor of the legislation came after a landmark committee hearing that included testimonies from physicians, veterans and Texans who were forced to manage or treat their medical conditions with opioids.

Klick, who authored as well as sponsored it, is also responsible for separate legislation that expanded the state’s medical cannabis program to include seizure disorders, multiple sclerosis (“MS”) and terminal cancer in 2019. Klick says the new bill will expand the medical cannabis program again and task Texas Health and Human Services with creating a medical cannabis research program. The legislation has been met with plenty of support from medical cannabis patients, industry stakeholders and drug reform advocates.

According to Texas Original Compassionate Cultivation CEO Morris Denton, the bill is a step in the right direction. However, he concedes that it still isn’t as comprehensive as he would have liked it to be, and his opinion is shared by many. The hope was that the committee would amend the legislation to remove the cap for THC, allow all patients who can benefit from it to use medical cannabis, allow independent laboratories to test marijuana products, and grant physicians and patients in the medical cannabis space legal protections.

Despite this, Texans for Responsible Marijuana Policy isn’t worried. Its representatives as well as Senators will have the chance to make amendments to House Bill 1535 on the floor.

As the debate on the expansion of the medical cannabis bill rages on, there are cannabis products that are legal across the country. 420 with CNW — Schumer Says Senate Will Loosen Marijuana Policies Regardless of Biden’s Attitude

Although more than 30 states have legalized cannabis in various forms over the past decade, federal law still classifies cannabis as a controlled substance. With the House, Senate and White House in the Democratic Party’s hands, however, federal cannabis legislation has never had a greater chance of becoming law as it does right now. Unfortunately, President Joe Biden is staunchly against allowing adult-use cannabis, although he does support modest cannabis reform, including medical cannabis and expunging records of prior cannabis related offenses.

But according to Senate Majority Leader Chuck Schumer, Biden’s views on the matter won’t hold him back, and consequently, the Senate will move forward with federal marijuana legislation whether or not the president is on board. For a while now, Schumer has been an outspoken advocate of cannabis reform, first introducing a bill to legalize cannabis back in April 2018. Schumer, whose home state New York recently legalized recreational marijuana, has said he supports federal legalization and that he will soon introduce a federal cannabis reform bill with Senators Ron Wyden and Cory Booker.

Even though the White House isn’t behind broad cannabis legalization, Schumer says the Senate will still take aggressive action to loosen the currently restrictive federal laws on cannabis. Although most cannabis reform opponents said legalizing cannabis would lead to all kinds of social ills, including increased drug use and higher crime rates, Schumer says the fears are unfounded. Most states that legalized cannabis in the past decade have seen more positives than negatives from their legal cannabis markets, including increased job opportunities, social justice, and millions of dollars in tax revenue.

State-legal cannabis markets also proved that the American people wanted to legalize cannabis, says Schumer, adding that if a relatively conservative state such as South Dakota votes in favor of legalizing cannabis, then the tides are definitely changing in favor of legalization. With Democrats now in control of the Senate, he can now put a cannabis reform bill on the floor, something that was basically impossible while Senator Mitch McConnell was in charge.

The only holdout is Biden, who has said that although he supports medical cannabis and record expungement, he isn’t behind legalizing adult-use cannabis. According to Schumer, Biden has said he would like to see more information, and the Senate Majority Leader would be happy to make his arguments and try to evolve his stance on cannabis. If the president doesn’t budge, the Senate will still move forward with cannabis reform without his support.

420 with CNW — Poll Finds 67% of Voters in Louisiana Support Marijuana Legalization

According to the recently published results of a poll, at least two-thirds of voters in Louisiana support the full legalization of cannabis, both for recreational and medical use. These voters include the majority of the Republicans in the state, according to the poll.

This recent survey, conducted by JMC Enterprises, indicates that support for marijuana legalization in the state has risen significantly from the time a similar poll was done. For example, only 54% of the voters expressed support for legalization last year compared to the 67% who now say they would prefer to see cannabis legalized.

In this recent poll, only 16% of the people sampled admitted that they wouldn’t want to see marijuana legalized in Louisiana for recreational use, but they would support legalization for medicinal use. Just 8% expressed opposition to both medical and recreational use legalization.

As has been the case previously, Democrats lead the surge of supporters of cannabis legalization. The JMC poll, not surprisingly, shows that 67% of all Democrats support recreational marijuana legalization compared to 58% of Republicans who support the policy change. Youth are particularly bullish on the subject with 93% of all younger voters saying they would like to see marijuana legalized not only for medical but for recreational use as well.

During the same poll, voters were asked to express their thoughts about changing cannabis policy so that people are fined for marijuana possession or use instead of serving time in jail. Nearly half of the respondents said they preferred full legalization rather than decriminalization. Only 27% said removing criminal penalties would be preferred in lieu of full legalization.

At the moment, the marijuana laws in the state only allow patients enrolled in the medical marijuana program access a limited range of cannabis products. An estimated 75% of those who took part in the JMC poll want this to change so that patients have access to a wider variety of products, including the entire marijuana plant.

Last year, Gov. John B. Edwards appended his signature to a bill geared at expanding the state’s medical cannabis program so that licensed physicians could prescribe medical marijuana for any patient suffering from a debilitating condition. Previously, physicians could only recommend medical marijuana as a treatment for a narrowly defined list of conditions and diseases.

JMC Enterprises polled a total of 1,160 voters in the state March 22–23. The findings represent the latest views of registered voters in the state. It remains to be seen how these results will influence policy in the coming years.

The state of Illinois’ marijuana market is booming with data showing that last year the state sold more than $1 billion worth of legal marijuana both from recreational and medical marijuana purchases. Projections indicate that those sales figures will only keep growing as the market grows and consumption of marijuana products increases.

Currently, officials in the state are rolling back on the rules and restrictions that were imposed at the height of the COVID-19 pandemic to help control the virus spread. With vaccines being rolled out, more and more bar and restaurant operators are launching new projects.

One of these projects is the launch of the first on-site consumption bar of cannabis in the state. Located in Sesser, which is nearly 300 miles south of Chicago, owners are making their final preparations to open the Luna Lounge either late next month or in early May.

The venue is a bring-your-own-style bar where consumers are encouraged to buy marijuana from off-site dispensaries. The venue is billed as a safe space where consumers will not have to worry about being thrown out of a bar for rolling up a joint. The venue will also have smoking paraphernalia that can be rented.

Luna Lounge owners reveal that the bar will pave the way for Sesser to become more of a tourist destination, in addition to being the first bar of its kind in the state of Illinois. However, because of the indoor restrictions imposed on smoking in the state, the bar will not be serving alcohol. Customers who wish to buy food can purchase it from food trucks that will be parked outside the venue.

In 2020, the state of Alaska became the first state in the United States to permit on-site cannabis consumption while a site in Springfield became the pioneer to receive an onsite-license in the state of Illinois. Local law enforcement in Sesser then followed suit by approving the plan to launch Luna Lounge in March of the same year.

The first cannabis dispensary in downtown Chicago also began its operations last year. However, there doesn’t seem to be a push demanding for on-site consumption to be allowed in the city. This is despite the fact that on-site consumption of cannabis has the potential to unbridle creative possibilities in the city’s restaurant industry. For instance, underground marijuana dinners have a better chance of becoming popular if regulations were loosened.

While it is important for onsite marijuana consumption lounges to open, not all products made from cannabis are subject to restrictions regarding where they can be consumed. 420 with CNW — Wyoming House Committee Passes Republican-Sponsored Cannabis Legalization Bill

Last week, a Wyoming House committee passed a legislation to legalize cannabis and discussed another proposal that would require that state agencies research and issue recommendations on allowing medical marijuana.The adult-use legalization bill’s lead sponsor is the chair of the Judiciary Committee. The legislation would allow individuals aged 21 and above to buy and possess up to 3 cannabis ounces and grow up to 12 mature cannabis plants for personal use.

The proposal, which was co-sponsored by other top Republican legislators and the House speaker, got a 6-3 vote after receiving testimonies from the public and state agencies, which included former U.S. senator and Rhode Island Governor Lincoln Chafee, who now lives in Wyoming. Chafee revealed that he supported the bill, stating that the legislation would create a profitable revenue stream.

Chairman Jared Olsen observed that this marked an important moment for the state of Wyoming and mentioned recent surveys that showed public support for the change in policy, both nationally as well as in the state, noting that in several of the states, voters had passed legalization measures through the ballot. Olsen said that if the legislature failed to act, he expected Wyoming voters to help end marijuana prohibition.

The chairman also said that if a legalization measure led by voters was approved, the legislative process wouldn’t design the regulation of cannabis, stating that instead, the public via ballot measure would decide what it would look like as well as what it would entail.

Wyoming’s neighbors, South Dakota and Montana, are two of the jurisdictions that passed cannabis legalization ballot initiatives during the 2020 November elections.

Olsen encouraged the committee to approve his legislation, which would impose a 30% tax on cannabis sales. Two-thirds of tax revenue generated from cannabis sales would be directed to public schools while the remainder would be allotted to individual jurisdictions that permit cannabis retail locations in their areas.

Some of the legislators who voted to pass the legislation in the committee revealed that they weren’t sure how they would vote on the floor or that they’d oppose it, with some noting that they were pro-advancing the bill so that the full body would be afforded the chance to discuss this important issue.

If approved, the law would come into effect on July 1 this year. However, the legislation doesn’t contain any measures that reveal when sales would commence or how soon licenses would be issued to prospective retailers.

420 with CNW — How CBD Oil Differs from CBD E-Juice

Legalized after decades of prohibition by the 2018 Farm Bill, CBD quickly became one of the most popular products on the market. The hemp extract has potent medicinal properties, making it effective against a wide range of medical conditions. Since CBD does not intoxicate users, plenty of people have been using it to help address a variety of issues, with CBD oil and CBD e-juice (vape juices) being among the most popular means of consumption.

CBD oil was the original method of consumption when CBD became legal, but industry growth coupled with advances in technology led to the popularity of CBD e-liquid. So what is CBD oil and vape juice, and how do the two differ?

CBD oil is the cannabidiol extract that is derived from the hemp plant. Although users can consume CBD in its oil form, usually sublingually or orally, it can also be formulated into tinctures, edibles, and capsules. CBD oil products can be taken orally but cannot be smoked or vaped. CBD oil is usually extracted with food-grade oils such as olive or coconut oil that the body can easily digest and absorb. However, these additives make CBD oil too viscous to be smoked or vaped.

CBD e-juice and vape liquids, on the other hand, are designed for vaping. Unlike CBD oil, which is viscous and does not vaporize easily due to the food-grade oils used during extraction, CBD vape juice comprises CBD oil extract coupled with a thinning agent. Common thinning agents include medium-chain triglyceride (“MCT”) oil, vegetable glycerin (“VG”) and propylene glycol (“PG”), and these agents reduce the CBD oil’s viscosity, allowing the vape juice to heat and vaporize easily. Users have to use specialized vape pens that heat the CBD e-juice until it vaporizes and can be inhaled.

Any form of CBD oil that is taken orally will take a while to kick in as the oil first has to be digested before the body metabolizes the CBD, usually in 30 to 60 minutes. The caveat is that the effects will last anywhere up to 12 hours. CBD e-juices take much less time to kick in because they are inhaled, and consumers can start feeling the effects in as little as 30 seconds. However, the effects only last a maximum of five hours, much less than CBD oil.

Both methods have their pros and cons, but at the end of the day, they both deliver cannabidiol to the system. CBD oil may take longer to kick in, but its effects last much longer. And while CBD vape juice doesn’t stay in the system for as long, it offers quick relief. Individuals thinking about consuming CBD should consult their health-care professional.

Congress passed the Farm Bill in 2018, effectively legalizing the cultivation and sale of industrial hemp and its extracts after decades of prohibition. With farmers across the country taking part in pilot programs, a market for CBD quickly developed. The hemp extract is said to have a wide variety of health benefits, and preliminary reports coupled with anecdotal evidence have been encouraging.

Shatter and wax are without a doubt the most potent and quickest-acting means of consuming CBD. Shatter is an amber, translucent solid that is brittle to the touch while CBD wax looks just like wax and has a consistency similar to coconut oil. Both of them, collectively referred to as wax, are highly concentrated, with up to 80% CBD content, and they have strong long-lasting effects. Here are five things users should know about CBD wax.

There are four different types of wax, depending on the extraction process used to pull the CBD from the plant matter and the texture of the resultant extract. Shatter looks like brittle amber glass; budder is more creamy in texture, much like butter; crumble has a crumbly, grainy texture similar to feta cheese; and live resin is a malleable, dark-yellow concentrate.

Different production methods result in different types of wax. There are numerous extraction methods lab techs use to pull CBD from the plant matter. The butane hash oil (“BHO”) method, which uses butane as the primary solvent during the extraction process, is the most popular. Carbon dioxide extraction uses pressurized carbon dioxide and produces a much cleaner, solvent-free product compared to BHO. Producers also use air pressure and the freeze-dried method to extract the cannabinoids.

CBD wax and shatter are quite safe. To stay on the safe side, consumers should make sure they purchase products from recognizable brands that offer a certificate of analysis to prove they are pure and contaminant free. Additionally, consumers may want to avoid products made using BHO as the extraction method tends to leave traces of butane solvent in the wax.

CBD wax is fast-acting. If users are surprised by how quickly the effects kicked in when they smoke CBD flower, they would be amazed by how instantaneous the effects of CBD wax are. Most users report near-immediate effects, and thanks to their high potency, the effects are quite strong and tend to last long.

CBD wax is not intoxicating. Although marijuana and industrial hemp belong to the same family, there is one major difference: legal industrial hemp contains barely any THC, the cannabinoid responsible for cannabis’ euphoric effects. Consequently, all hemp derivatives, including CBD wax, does not intoxicate users.

As long as consumers buy a high-quality product from a reputable brand, they shouldn’t have to worry about THC contamination or failing a drug test. However, users should note that waxes and shatters are usually used by highly experienced consumers, so make anyone using CBD should conduct plenty of research and, more importantly, consult a doctor before they consume CBD.
