420 with CNW — Study Finds Cannabis Decriminalization Decreases Racial Disparities, Arrests

A new study has found that cannabis decriminalization causes a reduction in arrests for possession as well as decreases racial disparities in other arrests. The University of California-San Diego researchers who conducted the study obtained data from the FBI Uniform Crime Report for their research.

The researchers assessed data from 37 states, which was collected between 2000 and 2019, to determine the impact of policies to decriminalize the herb. In their paper, the researchers stated that minorities often bore the burden of the unequal enforcement of laws on drugs, explaining that in the United States, Blacks were more likely to be arrested for marijuana possession in comparison to White people, despite having a similar rate of marijuana use.

The researchers’ analysis showed that decriminalization helped decrease this discriminatory enforcement of the law. The researchers noted in their report that after the implementation of marijuana decriminalization in 11 states, rates of arrest for marijuana possession dropped by more than 40% among youths and more than 70% among adults.

However, the researchers found no evidence suggesting a change in racial disparity among young people, despite the decline in the rate of arrest among both Black and White populations after a state decriminalized cannabis. In their report, they also noted that decriminalization was especially beneficial to Blacks, who had suffered most due to the consequences of the criminal penalties imposed by drug laws.

They also recommended that public health researchers and legislators reconsider marijuana decriminalization as an option of marijuana liberalization, especially in states concerned about the unplanned consequences and implementation costs of recreational and medical marijuana legalization. The findings were published in the “Social Science & Medicine” journal.

Separate research published by the American Medical Association showed findings that were similar to the study, after researchers looked into the impact of decriminalization and legalization of marijuana on racial disparities in arrests. That study was carried out by researchers from Saint Louis University and Eastern Virginia Medical School.

The researchers focused on trends related to race, comparing arrest data from 2008 to 2019. This group discovered that states which legalized marijuana saw 560 less arrests per 100,000 Black individuals and almost 200 fewer arrests for Caucasian individuals on average during that period. Decriminalization was also linked to less arrests for both Caucasian and Black individuals.

In addition to this, the study found a difference in how the policies impacted the youth, with cannabis arrest data on adolescents showing that young individuals had a lower risk of being arrested under decriminalization, in comparison with under legalization.

The past couple of years have been good for the cannabis industry. The industry managed to weather the coronavirus pandemic much better than other sectors, keeping most cannabis employees working and selling even more cannabis products than before the pandemic. However, the best developments have been on the legal side. Federal lawmakers are working on passing cannabis legislation at the federal level, and several states passed some form of cannabis legalization. Now that 2021 has finally run its course, let’s look at some of the most prominent marijuana reform accomplishments of the year.

Connecticut, which still has a completely green recreational market, has focused a great deal on social equity. The state’s newly enacted cannabis legalization bill led to the formation of the Social Equity Council, which is charged with molding Connecticut’s new recreational industry with social equity and diversity in mind.

Governor Ned Lamont highlighted the council’s efforts, stating that its primary duty would be to ensure equitable access to the lucrative cannabis market and mitigate some of the damage caused by the failed drug war. At the 15-person group’s first meeting, it rubber-stamped a list of geographical areas that were disproportionately affected by the decades-long war on drugs.

New Mexico also passed a cannabis law in 2021. Governor Michelle Lujan Grisham lauded the move, stating that it would greatly benefit the state’s economy. Legalizing cannabis in New Mexico will create thousands of new jobs — 11,000 to be exact, says Grisham. State officials began accepting license applications from businesses that would like to become licensed cannabis producers in August although sales still haven’t begun. In the meantime, adults aged 21 and older can possess up to two ounces of marijuana and grow up to six adult plants for personal use.

Commercial cannabis sales in New Mexico are expected to start this year while over in New Jersey, voters approved an amendment that would legalize cannabis consumption for adults 21 and older. New Jersey Governor Phil Murphy included the move in the state’s list of accomplishments for 2021. Commercial sales still haven’t kicked off as the state is still in the process of implementing the legalization. Home cultivation still isn’t allowed, but the governor has said that he is open to allowing people to cultivate cannabis at home for personal use while the state implements legalization.

Thanks to a near-infinite demand, the nascent cannabis industry is poised to see explosive growth over the next couple of years. Worth at least $20 billion in 2020, the sector is expected to grow at a compound annual growth rate of 32.04% to achieve a valuation of $197.74 billion by 2028.

As the sector grows in value, companies such as American Cannabis Partners, which position themselves well, are likely to take a bigger cut of the pie while others may end up being swallowed in the mergers and acquisitions which will accompany the maturation of the industry.

420 with CNW — Canadian Cannabis Executives Share Their Industry Policy Reform Wishlists for 2022

Last year was a mixed bag of a year for Canadian marijuana investors. Speculation about the future of the sector fluctuated wildly as talks about federal legalization heated up in the United States and recreational cannabis prices reached historic lows. Additionally, players in the Canadian cannabis space are waiting with bated breath for the three-year review of the country’s cannabis legislation by federal lawmakers. The review began in December 2021, and the health minister will present the department’s findings and recommendations in 2023.

In the interim, industry leaders have a few policy changes in mind that they would like to see in 2022. George Smitherman, president and CEO of the Cannabis Council of Canada, would like stronger edible products allowed on the market. Currently, cannabis law limits potency to 10 mg of THC per packaged product. In comparison, California allows for 100 mg of THC per package. Smitherman also feels it would be beneficial if customers could buy more cannabis-infused beverages in a single package because as the 28-gram possession limit for THC prevents them from purchasing more than five beverages.

Another change would allow producers to sell their dried cannabis flower in packaging that isn’t childproof to reduce the amount of single-use plastics they use. Since cannabis flower presents a significantly reduced ingestion risk to children compared to candy, using nonchildproof packaging would also be safe.

However, the biggest challenge the industry faces right now is falling recreational cannabis prices, says Smitherman. Although prices are designed to draw customers from the illicit market, they have had a major impact on producers’ bottom lines.

Lawmakers can ease the pressure off producers by adjusting excise tax rates. Mandesh Dosanjh, president and CEO of Pure Sunfarms, would like a reform of the industry’s excise tax rules. Rather than a fixed or flat rate, he says, the government ought to change the tax to a more manageable percentage. As of December 10, cannabis sales are taxed at $4.97 per gram.

Dosanjh also criticized the country’s inconsistent lab testing standards, which often end up with different results for the same product. This has allowed some producers to test their products in different labs and then use the result with the highest cannabinoid value, which often translates to higher prices.

Niel Marotta, president and CEO of Indiva, would like to see an increase in potency limits for edibles. He also hopes that Quebec’s government will remove its ban on edibles and vape products. Low prices are also a point of contention, he says, although his company is more insulated because it deals with edibles rather than cannabis flower. Marotta hopes to be able to break into the restaurant industry one day with a variety of cannabis-infused edibles, including salt and sugar.

420 with CNW — Study Explores Why Individuals Use Marijuana During Pregnancy or While Lactating

A new study has found that people who use marijuana during lactation or pregnancy use it to manage pre-existing conditions such as insomnia and mental health conditions, as well as pregnancy-related symptoms, including nausea and vomiting.

Dr. Meredith Vanstone, one of the authors of the study, stated that their findings didn’t resonate as much with evidence on motives for marijuana use that have been identified in nonpregnant populations, which proposed that reasons for the herb’s use during lactation and pregnancy were unique.

Vanstone explained that the reasons for the herb’s use that had been provided by the study’s participants closely resembled those cited in research on the use of medical marijuana, noting that most participants used the herb to manage more than one symptom. These reasons included to manage nausea or boost appetite, for sleep, and to control muscle spasms and pain as well as manage depression and anxiety.

For their study, the researchers recruited 52 individuals from Canada, one of whom identified as nonbinary. Each individual who was recruited had used marijuana prior to their pregnancy. At the time of their interviews, 22 of them were breastfeeding while the remaining were pregnant. Every individual was asked to give reasons why they used cannabis, with researchers finding that these reasons changed when some became pregnant. For instance, some stopped using cannabis due to health reasons, guilt and social stigma while others stopped out of fear of harming the fetus.

Those who continued to use cannabis after finding out that they were pregnant discussed their motive as associated with managing symptoms of conditions that existed prior to the pregnancy, as well as pregnancy symptoms. The researchers found that after giving birth, the reasons some participants gave for using marijuana changed again to closely resemble the motives they gave for using the herb before they became pregnant.

The study’s findings have implications for clinical practice, which include counselling of lactating and pregnant individuals on the possible harms of using marijuana and alternative approaches. In the conclusion, Vanstone noted that it was important for doctors to understand that individuals who use marijuana during pregnancy often did so because they recognized the benefits of marijuana for controlling various symptoms. Vanstone highlighted that there existed an opportunity to help pregnant individuals find alternatives that were safe for both the mother and the child, while looking into the benefits that these individuals derived from marijuana.

The study’s findings were reported in the “Canadian Medical Association Journal.”

420 with CNW — Federal Agency Announces Funding for Research into Drug-Harm-Reduction Approaches

The National Institutes of Health is promoting research into the effectiveness of various harm-reduction strategies, which include safe consumption facilities and drug decriminalization, as part of its effort to fight the opioid epidemic. The federal health agency released requests for applications last week for an effort that will generate funding for studies on how safe consumption sites and other harm-reduction strategies can be used to address the overdose crises.

The agency seeks to launch a Harm Reduction Network that will grow the understanding of the implementation, impact and effectiveness of new and existing harm-reduction strategies in order to address substance use disorder and the opioid epidemic more broadly.

A counterpart request for application requests the establishment of a coordination center in the network, which will offer coordination and logistical support, clinical practice and research resources, data sharing and data harmonization supports.

The agency is accepting applications for projects that entail the expansion of the delivery models and settings through which harm-reduction policies are established; the development and testing of new harm-reduction practices; the assessment of the impact of new harm-reduction strategies that have been implemented at the local and state levels; and implementation of new and existing harm-reduction policies effectively.

In its notice, the agency states that harm-reduction strategies are aimed at minimizing or preventing adverse outcomes associated with substance use, including the transmission of infectious diseases as well as nonfatal and fatal overdoses. The ageny highlights examples of existing harm-reduction services, which include HIV and Hepatitis C virus testing, sterile syringes, safer smoking equipment, fentanyl test strips and naloxone.

This is in addition to noting that the Office of National Drug Control Policy is focused on the prioritization of harm-reduction policy, as a way to prevent overdoses.

Component agencies of the NIH, including the National Institute on Drug Abuse, state that emerging harm-reduction strategies include the authorization of safe consumption facilities, prosecutor and police-driven diversion and deflection efforts, and the decriminalization of certain drugs.

Nora Volkow, director of NIDA, has repeatedly voiced concerns about the harms caused by drug criminalization. Last year, Volkow revealed that she was open to exploring how support systems could help individuals obtain treatment, hinder them from getting infected with HIV, and prevent overdoses and death.

In November 2021, the city of New York established the first safe consumption facility in the country. Advocates wonder how the government will react to this, as it recently blocked Safehouse, a not-for-profit in Philadelphia, from establishing a harm-reduction facility.

Another year has drawn to a close. For many, 2021 was a mixed bag of a year — we were still grappling with the effects of the coronavirus pandemic, but the global supply chain and economy was starting to show signs of recovery. The year brought a variety of wins to America’s cannabis industry, even though some events may not have seemed like wins at the time. For instance, the controversial suspension of American sprinter Sha’Carri Richardson due to a positive THC test sparked an intense review of cannabis policy. Here is an overview of what happened to cannabis in 2021.

Several states legalized cannabis last year. New York State passed a bill that would allow adults 21 and older to purchase and possess cannabis as well as decriminalize the possession of up to three ounces of cannabis or 24 grams of concentrates. This bill would also expunge certain cannabis offenses from people’s records and provide a variety of protections for people who work in the marijuana industry or consume cannabis. In Virginia, lawmakers passed a bill to legalize cannabis possession and home cultivation. Cannabis-related arrests, charges, and convictions would be sealed away from public view.

New Mexico also joined the cannabis train, passing a law that would allow adults 21 and older to possess up to 16 grams of concentrates, two ounces of cannabis and 800 milligrams of infused edibles; they would also be allowed to grow up to six mature plants at home. Connecticut passed a cannabis law in June 2021, allowing for the possession of up to 1.5 ounces of cannabis and minimizing punishments levied on those between 18—20 who are found possessing cannabis. Retail cannabis sales for adults 21 and over will begin in 2023.

Alabama also joined the increasing number of states with cannabis laws, passing a medical marijuana bill that would allow patients with any of 20 qualifying conditions to use medical marijuana. Louisiana passed a marijuana decriminalization bill that would bring down the penalty for possessing up to 14 grams of cannabis to a $100 fine. According to Governor John Bel Edwards, there’s a chance this modest reform could result in broad legalization.

Lawmakers also made significant moves at the federal level. For starters, Senate Majority Leader Chuck Schumer and some congressional colleagues introduced a bill dubbed the Cannabis Administration and Opportunity Act that would federally decriminalize cannabis. The bill would also expunge past convictions and allow states to craft their own cannabis policies. A key House committee passed a federal legalization bill that would promote social equity, but cannabis banking legislation failed to reach the finish line.

One of the most surprising events of 2021 was a GOP lawmaker unveiling an alternative federal legalization plan that would essentially treat cannabis like alcohol. Last year also saw safe consumption sites gain traction, with sites in New York preventing dozens of overdoses deaths.

California, currently the largest cannabis market in the U.S., has also enacted its own reforms to further streamline the marketplace in which entities such as Simply Sonoma Inc. operate.
